Sub:- Payment of Pension/Family Pension in respect of NPS subscribers as per Department  of Pension and Pensioners’ Welfare Notification dated 30th March 2021 – reg.

Attention is invited to Department of Pension and Pensioner’s Welfare (DoP&PW) Gazette Notification dated 30th March, 2021 wherein the Central Civil Services (Implementation of National Pension System) Rules, 2021 came into force. The payment of pension/family pension to the pensioners/ family pensioners covered under the National Pension system has been regularized through this notification. Therefore, the payment of pension in these cases will be made through the concerned CPPCs of Authorized Banks as OPS. The following categories have been created to process these pension cases:-

W- Ordinary Family Pension
X- Invalid Pension
Y- Extraordinary Pension
Z- Extraordinary Family Pension

Moreover, in addition to creation of these categories CPAO has upgraded its system and incorporated a field of PRAN for NPS cases. The procedure for processing of these cases in CPAO is at final stage for roll out.

All the CPPCs of Authorized Banks are hereby directed to comply with the following instructions-

• 1. Include the above mentioned categories of NPS in their system/software.
• 2. Include a field of ‘PRAN’ in their system/software.
• 3. Comply with the Gazette Notification dated 30th March 2021

Further, all the CPPCs of Authorized Banks are requested to intimate this office at the earliest, once these changes are implemented.

Subject:- Expeditious settlement of family pension cases by banks.

Sir,
I am directed to say that instances have been brought to the notice of this Department where, on the death of a pensioner, the spouse/ family members of the deceased pensioner are asked by the Pension Disbursing Banks to submit details and documents, which are otherwise not required for commencement of the family pension. This amounts to harassment of the spouse and family members and often leads to avoidable delay in commencement of family pension by the Banks.

2. The spouse/ family member, whose name is included in the PPO issued to the deceased pensioner, is required to submit only the following details/ documents for commencement of family pension to him/her:

I. In cases where the deceased pensioner and spouse were holding a joint account:

• A simple letter/application for commencement of family pension
• Death certificate in respect of the deceased pensioner
• Copy of PPO issued to the pensioner
• Proof of age/date of birth of the applicant

The spouse/ family member is not required to submit the details in Form 14 to the Bank for commencement of the family pension.

II In cases where the spouse did not have the joint account with the deceased pensioner

• Application in Form 14 bearing the signatures of two witnesses
• Death certificate in respect of the deceased pensioner
• Copy of PPO issued to the pensioner
• Proof of age/date of birth of the applicant

Form 14 is not required to be attested by a Gazetted officer, etc. The paying bank will identify the spouse/family member based on the information given in the PPO and its own “Know Your Customer” procedures.

III In cases where, on the death of the pensioner and spouse, the family pension has to pass over to another family member;

• If the other family member has been co-authorized for family pension in the PPO, the same procedure as in sub-para II above shall be followed.
• If the name of the other family member is not included in the PPO, he/she may be advised to approach the office which the Government servant/pensioner last served, for the issue of a fresh PPO.

3. You are requested to issue suitable instructions to the CPPC(s) and the pension paying branches of your Bank to obtain only the minimum essential details/documents, as mentioned above, from the claimants of family pension, and to ensure that they are not subjected to any harassment by seeking unnecessary details and documents. The details of family members, other than the Applicant, are not relevant for commencement of family pension by the bank, and the same should not, therefore, be sought from the Applicant under any circumstances.
4. A half-yearly statement on the progress of sanction of family pension may be submitted to this Department latest by 15th of October and 15th of April, in the enclosed format.
5. This may be treated as MOST URGENT.

Subject: Pension Adalat to be held on 23.08.2019. -reg.

The undersigned is directed to refer to Department of Pension & Pensioners’ Welfare DO No.I / 12/2019-P&PW(G) dated 28.06.2019, OM No. 1/12/2019-P&PW(E) dated 05.07.2019 and this Ministry’s OM of even no. dated 23.07.2019 on the above mentioned subject and to say that this Ministry had widely circulated the holding of Pension Adalat on 23.08.2019 for quick redressal of the grievances of pensioners within the framework of extant policy guidelines.

2. As regards the pensioners of the Core Secretariat of this Ministry is concerned, no case has been acknowledged for discussion in Pension Adalat on 23.08.2019 till date. All other cases have been transferred to their respective Ministries/ Divisions/ Organisations for appropriate action.

3. At present, this Ministry has received no request representation of the pensioners for redressal. As such, it is not feasible for this Ministry to hold Pension Adalat on 23.08.2019.

Subject:- Submission of Life Certificate.

It has been the experience of this Department that the Senior Pensioners i.e. the pensioners 80 years and above are facing a lot of difficulties standing in queues while giving the Life Certificates in November. It has been under the consideration of the Government to provide some relief to such pensioners.

2. It has therefore, been decided by the Government, that Senior Pensioners aged 80 years and above be allowed to give their Life Certificate w.e.f 1st October every year instead of November which would be valid till 30th November of the subsequent year.

3. The remaining pensioners below the age of 80 years may continue to give their Life Certificate in November as per existing provisions of CPAO Scheme booklet.

This has the approval of competent authority.

Sub: Engagement of a consultant in the Department of Pension & Pensioners Welfare

The Department of Pension & Pensioners’ Welfare intends to engage a consultant to assist the Department for undertaking comprehensive review/revision of CCS (Pension) Rules and orders issued by the Government on the subject of pensionary benefits and other important issues requiring immediate attention. The revision and review of the rules etc. is being undertaken by the Department in compliance with recommendation of the Hon’ble Supreme Court in the matter of UoI Vs. R. Sethumadhavan and Other. In addition, the Department may also assign the consultant any other work related to this Department.

Accordingly, applications are invited from retired Central Government
Employees having been retired from the post of Deputy Secretary/ Director or equivalent i.e., to say from any-post carrying the following Pay Band / Pay Matrix:

i. Rs.15600 – 39100 + 7600 Grade Pay;. or
ii. Rs.37400 – 67000 + 8700 Grade Pay; or
iii. Pay Matrix 12 or 13 under 7th CPC

MANDATORY SERVICE EXPERIENCE

The applicant should have a minimum of 3 years experience in dealing with
pension cases and pension related court cases of Central Government Employees.

Age

Age should not be more than 65 years on the date of advertisement.

REMUNERATION

On selection, the consultant will be paid consolidated remuneration equivalent to his last pay drawn minus pension. He will also be paid Dearness Allowance on the ‘remuneration amount’ at the rates applicable for Central Government Employees on the date of engagement. No other allowance such as HRA / Transport Allowance etc. will be payable to the consultant.

The consultant may be required to undertake outstation visits also for which he will be paid Travelling Allowance/ hotel/ guest-house reimbursement as per rules applicable to equivalent scales.

DURATION OF ENGAGEMENT
The duration of engagement will be one year from the date of initial engagement which period may be curtailed or extended at the sole discretion of the Department and the same will be binding on the consultant.

The appointment of consultants would be on full-time basis and he will not be permitted to take up any other assignrnent during the period of Consultancy with the DoP&PW.

The appointment of consultant is of a temporary (non – official) nature and the appointment can be cancelled at any time by the Department without assigning any reason.

600 retiring Central Government employees to participate in Pre-Retirement Counselling Workshop

The Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh will inaugurate the All India Pension Adalat here tomorrow.

The Pension Adalat, being organised by the Department of Pension & Pensioners Welfare (DoP&PW), will be one of the largest exercises for Pensioners’ Welfare ever undertaken by the Government as part of Good Governance dedicated to Central Government Pensioners. It is a unique effort wherein on a single day all the Central Government Ministries would be conducting their respective Pension Adalats in which on-the-spot resolution would be provided across the table to the grievance holder.

All the stakeholders of the pensioner’s case viz. the Department, Pay and Account Officer, the concerned Bank, along with the pensioner or his representative, will settle the grievance within the framework of extant rules. This is a great reformative measure to get the grievances resolved in the quickest possible way by avoiding unnecessary recourse by the pensioners to Courts.

It is expected that this measure will resolve issues of thousands of pensioners in one day, in a single sitting across the country. In addition to the Central Ministries, the Offices of Accountant General would be separately addressing the Pensioner grievances of All-India Service officers, in all the states across the country.

Besides the Pension Adalat, a Pre-Retirement Counselling (PRC) is also scheduled for the Central Government employees who are about to retire in the next six months. 600 retiring Central Government employees will participate in this PRC out of which a significant number will also be from the Central Armed Police Forces. The objective of the PRC Workshop is to create awareness about post-retirement entitlements as well as to educate them on advance planning for retirement including medical facilities and participation in voluntary activities after retirement.

On the occasion, Dr. Jitendra Singh will also give away the Anubhav Awards-2018 to recognise the contribution of the Central Government employees to the Anubhav Portal which is designed to create an institutional memory for successive generations of Central Government employees. It may be recalled that the Anubhav scheme had been instituted at the call of the Prime Minister Shri Narendra Modi in the year 2015. This is meant to encourage retiring and retired employees to submit an account of their experiences while working in the government and thereby create an institutional memory to help in future governance as well as to motivate and inspire different generations of government officials in their respective assignments. The scheme has resulted in registering more than 5,000 Anubhavs from Government employees till date from 91 Departments.

Subject:Implementation of Government’s decision on the recommendation of the VIIth Pay Commission on CCS (Extraordinary Pension) Rules, 1939 – Enhancement of Constant Attendant Allowance.

The undersigned is directed to say that at present Constant Attendant Allowance (CAA) is Granted to pensioners who retired on disability pension under the CCS(Extraordinary Pension) Rules 1939, with 100% disability (where the individual is completely dependent on somebody else for day-to-day function). The Constant Attendant Allowance is paid in addition to the disability pension. The present rate of Constant Attendant Allowance admissible is Rs.4500/- per month.

2.Consequent upon the decision taken by the Government on the recommendations of the 7th Central Pay Commission on Allowances, Government has accepted the recommendation of 7th Central Pay Commission to increase the Constant Attendant Allowance by a factor 1.5, ie. to Rs.6750/- per month. Accordingly, sanction of the President is hereby conveyed for enhancement of the amount of Constant Attendant Allowance from the existing Rs.4500/- to Rs.6750/- per month.

3. These orders will take effect from 01.07.2017.

4. In so far as persons belonging to Indian Audit and Accounts Department, these orders issue after consultation with the Comptroller & Auditor General of India.

5. These orders are issued with the concurrence of the Ministry of Finance (Department of Expenditure) vide, their OM No.11-1/2016-IC dated 11.07.2017.

Sub: Simplification of pension procedure (i) Handing over of PPO to the retiring employee by the Head of Office before retirement and

(ii) Submission of undertaking by retiring Government servant along with pension papers – reg.

The undersigned is directed to invite attention to this department’s Office Memorandum of even number, dated 7th May, 2014 (copy available at departmental website), vide which provision had been made that the undertaking to be submitted by the retiring Government servant/pensioner to the pension disbursing bank to refund or make good any amount to which he is not entitled may be obtained by the Head of Office from the retiring Government servant along with Form 5 and other documents before his retirement. This undertaking is forwarded to the pension disbursing bank along with the Pension Payment Order (PPO) by the Accounts Officer/CPAO following the usual procedure. The bank shall credit the pension to the account of the pensioner as soon as this Undertaking is received along with the pension documents.

2. The pensioner is no longer required to visit the bank to activate the first payment of pension. Therefore, after ascertaining that the Bank’s copy has been despatched by the Central Pension Accounting Office, the pensioner’s copy of the PPO is to be handed over to him at the time of retirement along with other retirement dues. This should be feasible in all cases where the Government servant had submitted pension papers within the time-limits prescribed in the Central Civil Services (Pension) Rules, 1972.

3. An employee posted at a location away from the office of the Head of Office or who for any other reasons feels that it would be more convenient to him to obtain his copy of PPO from the bank, may inform the Head of Office of his option in writing while submitting his pension papers.

4. However, in the recent past, many instances have come to the notice of this Department wherein the pensioner’s copy of the PPO had not been handed over to him/her and instead had been sent to the Bank and the same was lost in transit sometimes thereby causing hardship to the pensioner.

5. In view of the foregoing, all Ministries/Departments are once again requested to strictly follow the above procedure henceforth viz., handing over the copy of pensioner PPO to him/her at the time of retirement along with other retirement dues except if the pensioner specifically requests for delivering his/her copy of PPO through bank. Department of Posts and Department of Telecommunications are requested to make suitable amendments to the instructions to the Accounts Officers and pension disbursing Post Offices/Banks to adhere to the above procedure.
