<h3 class="wp-block-heading">Subject: Timely payment of retirement benefits to the retiring employees</h3>



<p>The undersigned is directed to say that timelines have been prescribed under the CCS (Pension) Rules, 1972 for each activity involved in the processing of a pension case and for payment of pension and gratuity to a retiring Government servant. As per this timeline, the process of verification of service and other preparatory work should be<br />undertaken one year before a Government servant is due to retire on superannuation, the Government servant should submit the forms six months before retirement, the Head of Office should send the pension case to the PAO four months before retirement and the PAO should issue PPO and send it to CPAO one month before retirement. The CPAO is required to issue the Special Seal Authority within 21 days, thereafter.</p>



<p>2. Instructions have been issued vide this Department’s OM No 1/27/2011- P &amp;PW (E) dated 01.08.2017 for handing over the copy of pensioner PPO to him/her at the time of retirement along with other retirement dues. The Rules also provide for sanction of provisional pension in cases where a Government servant is likely to retire before finalization of his pension and gratuity.</p>



<p>3. “BHAVISHYA’, the online Pension Sanction &amp; Payment Tracking System, facilitates online tracking of pension sanction and payment process by the individual as well as the administrative authorities and keeps the retiring employees informed of the progress of pension sanction process through SMS/E-Mail. The system is, therefore, very useful for ensuring timely payment of pensionary benefits to the retiring Government servant.</p>



<p>4. In spite of the timelines prescribed in the rules/ instructions and simplification/ streamlining of the procedures through <a href="https://centralgovernmentnews.com/bhavishya-pension-sanction-payment-tracking-system/" target="_blank" rel="noreferrer noopener">BHAVISHYA</a>, issue of the PPO and payment of retirement benefits continue to be delayed in a large number of cases. A significant percentage of the grievances registered on the CPENGRAMS relate to non-payment of retirement dues for several months after retirement. Delay in settlement of retirement dues also leads to avoidable litigation. In a number of cases, the courts have directed payment of interest for the delayed period to the affected pensioners, besides making adverse comments on the functioning of the administration.</p>



<p>5. In order to ensure timely payment of retirement dues in all cases, it has been decided that the progress of the pension cases should be regularly monitored by the Heads of the organizations and the Heads of Departments. An effective monitoring mechanism is required to be established in every office/ Department to review the progress of processing of the pension cases. The information available from the BHAVISHYA software may be utilized for this purpose.</p>



<p>6. Farewell programs are often organized in the offices on the occasion of retirement of employees. This is one of the most appropriate occasions that can be utilized to review the progress of the pension cases and to sensitize the concerned staff about the importance of timely payment of retirement dues. Accordingly, in every farewell function, Heads of organizations/ Departments/ offices may review the progress of pension cases of all the employees of that organization/ Department/ office, who are due for retirement in the next six months. Wherever the processing of any pension case is found to be behind schedule, proactive action must be taken to ensure that all retirement dues are paid on time to the retiring Government servant.</p>



<p>7. A half-yearly statement may be submitted by each Department/ organization/ office to the Secretary of the administrative Ministry/ Department indicating the particulars of the Government servants in whose case issue of PPO was delayed by more than two months after retirement on superannuation. The statement may also contain the reasons for the delay in issuing the PPO and remedial action taken to avoid such delays in future.</p>

<h3 class="has-text-align-center wp-block-heading"><strong><span style="text-decoration: underline;">FOREWORD</span></strong></h3>



<p>Department of Pension and Pensioners Welfare has been leveraging technology year after year, to make the system seamless and more and more convenient for the elderly Pensioners, while taking other steps for bringing about changes in pension policy towards providing a life of dignity for them and their dependents. Some of the major initiatives/support measures taken in this regard include providing Doorstep Service for submission of Digital Life Certificate through Postal Department besides the facility to submit life certificate online through Jeevan Pramaan Portal. This is considered to be a step towards making the Pensioners “Atamnirbhar” as the DLC can now be given from the comfort of one’s home also.</p>



<p>Over the past few years, this Department has also taken a number of decisions to liberalize and simplify the rules and procedures to make the life of our honored pensioners and their dependents simpler and dignified. Rules have been relaxed for divorced daughters to receive Family Pension and now a daughter is entitled to receive the Family Pension even if the divorce has not finally taken place but the divorce petition had been filed by her during the lifetime of her deceased parent employee/ pensioner. Earlier Rule provided for payment of Family Pension to a divorced daughter only if the divorce had taken place during the lifetime of deceased parent pensioner or his spouse. The new Rule not only brings ease to the life of pension receiving individuals but also ensures respectable and equitable rights for the divorced daughters in society. Rule 64 of CCS (Pension) Rules, 1972, was relaxed in order to ensure immediate provisional sanction of pensionary benefits amid the unprecedented situation of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a>, wherever an employee is likely to retire before finalization of his dues or is unable to submit the pension claim form. . The Government has very recently made amendment of income criteria for grant of family pension to children/siblings suffering from a mental or physical disability.</p>



<p>While the DOPPW has been striving to bring about, from time to time, necessary changes, it is all the more important to keep the pensioners aware of various developments in the pension administration system. Keeping this in view the Department has now decided to bring about Booklet titled “Know Your Retirement Benefits”, which I am sure, will be helpful in creating awareness amongst pensioners. It will also serve as a guide for officers and dealing staff dealing with pension-related matters in Ministries/ Department/ Organisation.</p>



<p>I am happy and proud to release this Booklet of Department of Pension and Pensioners Welfare which will be a help in determining the retirement benefits entitlements of Pensioners and their dependents.</p>

<p>To ensure timely payment of <a href="https://centralgovernmentnews.com/category/pension/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">pension</a> to the retirees; it has been decided to streamline the process of pension payment to avoid any delays, especially during the <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">COVID-19</a></strong> pandemic period.</p>



<p>2. All the Civil Ministries/ Department of the Central Government may ensure that the pension cases in their office are processed through ‘Bhavishya’ Software integrated with Pension Module of PFMS.</p>

<p>Subject: <strong>Coverage under Central Civil Services (Pension) Rules, 1972, in place of National Pension System in terms of DoPPW OM dated 17.02.2020 &#8211; clarifications- regarding.</strong></p>



<p>The undersigned is directed to say that instructions have been issued vide this Department’s O.M. of even number dated 17th February, 2020, that in all cases where the results for recruitment were declared before 01.01.2004, against vacancies occurring on or before 31.12.2003, the candidates declared successful for recruitment shall be eligible for coverage under the Central Civil Services (Pension) Rules, 1972. Accordingly, such Government servants who were declared successful for recruitment in the results declared on or before 31.12.2003, against vacancies occurring before 01.01.2004 and are covered under the National Pension System on joining service on or after 01.01.2004, may be given a one-time option to be covered under the <a href="https://centralgovernmentnews.com/category/ccs/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">CCS</a> (Pension) Rules, 1972.</p>



<p>2. References have been received in this Department seeking clarifications in regard to the implementation of the aforesaid instructions in certain circumstances. The issues raised by the various Departments have been examined in this Department and the position is clarified as under:</p>

Can the option exercised by such a Government servant be considered in accordance with the O.M. dated 17.2.2020 and, if so, which Department / office will take a decision on such option.</td><td>Such a Government servant is also eligible to exercise option under O.M. dated 17.02.2020. A decision on the option shall be taken by the appointing authority of the post in the Department/Office for which such option is exercised by Government servant. In case the Government servant has submitted his option in his latest Department/office, that Department /Office shall forward the option to the concerned Department/office, for taking an appropriate decision. The decision taken by the concerned Department/Office shall be communicated to his latest Department. In such cases, the instructions relating to mobility as contained in this Department’s O.Ms. No. 28/30/2004-P&amp;PW(B) dated 26.07.2005 and 28.10.2009 shall also be applicable and further action for counting of past service for pension/ gratuity shall be taken in accordance with the CCS(Pension) Rules, 1972 by the latest Department/Office.</td></tr><tr><td>2</td><td>Can an option exercised by a member of the family of the deceased Government servant be considered.</td><td>If a Government servant, who was otherwise eligible to exercise option in terms of the O.M. dated 17.02.2020, has already died, the option exercised by the member of the family, who is eligible to receive NPS benefits on death of the Government servant in accordance with PFRDA (Exits and Withdrawals under NPS) Regulations, may be accepted and processed in accordance with the instructions contained in this Department’s OM dated 17.02.2020.   If, before his death, the Government servant had joined another Central Government Department/ office with proper permission after tendering technical resignation, the option exercised by the such nominee shall be processed in accordance with the clarification No. (1) above.</td></tr><tr><td>3</td><td>In cases covered by clarification No. (2), how will the amount of the corpus in the NPS account, which was transferred to the Government consequent on death of the Government servant in accordance with the O.M. No. 38/41/06/P&amp;PW(A) dated 05.05.2009, be adjusted.</td><td>The amount of the corpus in the NPS account, which was transferred to the Government consequent on death of the Government servant, shall be adjusted in the manner indicated in para 9 of this Department’s O.M. dated 17.02.2020, with the modification that the employee’s contribution in the NPS account along with up-to-date interest, calculated on the rates applicable to GPF from time to time, shall be paid to the person in whose favour a nomination to receive NPS amount was submitted by the Government servant under the Regulations notified by PFRDA.</td></tr><tr><td>4.</td><td>Will the instructions contained in the OM dated 17.02.2020 be applicable in the case of Government servants who joined on or after 01.01.2004 on appointment on compassionate grounds. If so, how will the eligibility of such Government servants to exercise option under OM dated 17.02.2020 be determined.</td><td>A Government servant, who joined on or after 01.01.2004 on appointment on <a href="https://centralgovernmentnews.com/tag/compassionate-grounds/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">compassionate grounds</a>, shall be eligible to exercise option in terms of the OM dated 17.02.2020, if the competent authority had taken the decision on the recommendation of the Screening/ Selection Committee to appoint the Government servant on compassionate grounds before 01.01.2004.</td></tr></tbody></table></figure>

										<content:encoded><![CDATA[<p><strong>Implementation of Bhavishya in the Ministries/Department: Minutes of the meeting held on 17.03.2016</strong></p>
<p><em>Minutes of the meeting held on 17.03.2016 at 10.00 AM under the Chairpersonship of Secretary (P&amp;PID on the status of Implementation of Bhavishya in the Ministries/Department including their attached &amp; subordinate offices</em></p>
<p>A meeting to review implementation of <strong>Bhavishya</strong> was conducted on 17.03.2016 under the Chairmanship of Secretary (Pension) at 10.00 AM at CD Deshmukh Auditorium, India International Center, New Delhi.</p>
<p>2. List of Participating Ministry/Department is at Annexure-I</p>
<p>3. JS (Pension) welcomed the participants in the meeting and briefed about the status of implementation of Bhavishya . Till date 1814 DDOs are registered with Bhavishya Portal and 4975 DDOs from attached/subordinate offices/Para Military forces are yet to be registered.</p>
<p>4. Secretary (P&amp;PW) stated that 52 Ministries/Department have not taken follow-up action on the decision taken in the last Review Meeting held on 05.02.2016 and this is not acceptable. After taking stock of status of implementation in different ministries/department the following decisions have been taken in the meeting:</p>
<blockquote><p>i) Nodal Officer of each Ministry/Department should ensure that all the Salary/Pension DDOs of their Departments including Attached/Subordinate offices/Para Military forces must register on to Bhavishya before 31st March, 2016.</p>
<p>ii) Nodal Officer of each Ministry/Department should upload the complete/updated information about their attached offices, subordinate offices, and DDOs, etc in the prescribed tables under &#8216;Organizational status -Utility&#8217; on Bhavishya Portal.</p>
<p>iii) NIC-DOP&amp;PW will include a column &#8216;Remarks&#8217; for Nodal Officer under &#8216;Organizational status -Utility&#8217;</p>
<p>iv) DDOs already registered on Bhavishya should upload the information of all the retirees on Bhavishya portal by way of uploading XML file of their salary package on Bhavishya. In this regard &#8216;User Manuals&#8217; may be referred which are uploaded on the Bhavishya portal</p>
<p>v) DoP&amp;PW will call a meeting of NIC and those Ministries/Department who are unable to get the NIC-Email ID for their DDOs, HOOs and PAOs, which is mandatory for registration in Bhavishya.</p>
<p>vi) Nodal Officers of Ministries/Department is requested to approach NICSI for the training on Bhavishya of their DDOs/HOO/Staff at a single point. Attached and Subordinate offices will also route their training requirement through the Nodal Officers of Ministries/Department. A meeting with NICSI and their empanelled agency will be called alongwith those ministries who are facing problem for conduction of training programme for their officers.</p>
<p>vii) DoPPW will contact each registered DDOs and HOOs through Call Center set up by this Department to know the status of implementation of Bhavishya. All DDOs and HOOs may be instructed by the Nodal Officer to cooperate with representative of Call Center and provide necessary inputs.</p>
<p>viii) Secretary (P&amp;PW) has taken a serious note, of not attending the Review meeting by some of the Ministry/Department and directed to write a d.o. letter to the Secretary ofthe concerned Ministry/Department.</p>
<p>ix) Secretary (Pension) also directed to incorporate regional offices of D/o Official Language in Bhavishya Portal.</p>
<p>x) There was mismatch in some cases of data uploaded on the Bhavishya Portal under &#8216;Organizational Status-Utility&#8217; and the data as stated by the Nodal Officer/representative of some ministries in the meeting. Secretary (Pension) directed to reconcile the data discrepancy.</p></blockquote>
<p>5. The next Review Meeting on Bhavishya under the Chairpersonship of Secretary (P&amp;PW) with the Nodal officers of all Ministries/Department will be will called shortly.</p>

<p>MINUTES OF THE ADVISORY COMMITTEE MEETING FOR WEB-BASED PENSIONERS’ PORTAL HELD ON 29th AUGUST, 2014 UNDER THE CHAIRMANSHIP OF SECRETARY (PENSION, AR&amp;PG)</p>
<p><strong>A list of participants is annexed.</strong></p>
<p>2. A meeting of the Advisory Committee for Web-Based Pensioners’ Portal under NeGP was held on 29th August, 2014 under the chairmanship of Secretary (P, AR&amp;PG) in Lok Nayak Bhawan, New Delhi with a view to seek suggestions etc. for further improvements of the Pensioner Portal.</p>
<p>3. Secretary (P, AR&amp;PG) welcomed the participants and requested J S (Pension) to give a brief background of constitution and role of the Advisory Committee. JS (Pension) while giving the background mentioned that the Pensioner Portal has been progressing well based on the inputs provided from time to time by user Departments forming part of the Advisory Committee. The participants were also informed that since the last meeting of the Advisory Committee was held in June, 2013, the Department of Pension &amp; Pensioners Welfare (DoP&amp;PW) have added to the Portal two new components namely Bhavishya (an On-line Pension Sanction and Tracking System) &amp; Sankalp (an initiative to channelize the skill and expertise of pensioners in to meaningful social activities post retirement). While giving a brief description of background and concept of these two new applications, a brief glimpse of these two web based applications was also shown online to the participants. Both initiatives were well appreciated by the member of Advisory Committee. The participants were also informed that the website of Pensioners Portal which includes latest circulars/instructions/activities of the Department is regularly being updated.<br />
4. At this point of time and in the context of Bhavi a software, the issue regarding timely processing of pension papers of prospective pensioners also came up. Secretary (PARPG) desired that the Departments/Offices dealing with pension papers should play a pro-active role in discussing with the pensioners any existing discrepancies/shortcomings in the service records and how best these could be rectified! overcome to avoid delay in processing the pension papers. He desired that all required actions should be completed well before the date of the retirement for timely disbursement of retirement dues.</p>
<p>5. The representative of Bharat Pensioner Samaj felt that software similar to Bhavishya should also be introduced for Railway Pensioners. To this, ED, Railway Board informed that Railways is already in the process of setting up separate Portal for Railway Pensioners named Arpan. He also informed that Railways, on pension matters, have been following the circulars/guidelines etc issued by DoPPW. Secretary (Pension) mentioned that circular issued by DoPPW should get percolated to all lower formations/implementing agencies as soon as possible to avoid any erroneous interpretations of Rules etc. and BHAVISHYA utilised in all Ministries/Departments for ensuring timely sanction of pension.</p>
<p>6. Thereafter, the agenda points were taken up. I S (Pension) explained the Action Taken Report (ATR) on the decisions taken in the last Advisory Committee meeting. The representative of Bharat Pensioner Samaj had sought some clarifications on point No. 4 of the ATR regarding FAQ format, linkage with the Website of Pensioner Portal and extending cooperation with Pensioner Association, which was explained by the representative of M/o Railways. With regard to extending cooperation to the identified Pensioner Associations by We Railway, it was decided that the DoP&amp;PW will reiterate their earlier instructions on the same. The representatives of Bharat Pensioner Samaj and Indian Ex-Service League also stated that the computers with Scarmer &amp; Printers which were supplied to them in 2008-2009 under Pensioner Portal Scheme are now obsolete (being old version) and it should be replaced by new one with latest compatible version. On this, it was felt that National Informatics Centre (NIC) team may visit these Associations in Delhi and give a feedback on the issue.</p>
<p>7. Giving a lead for discussions for further improvement of Pensioner Portal, Secretary (Pension) wanted to know from the representative of D/O Electronics &amp; Information Technology (Deity) whether the evaluation of Pensioner Portal has reached its maturity and whether the mechanism of the Advisory Committee imbibed to play Advisory Role for improvement of Pensioner Portal still exists. The representative of Deity informed that new technologies such as Mobile Service Delivery, Cloud Computing ( Meghraj), AppStore etc. have recently emerged in the field of Information Technologies. The Deity has taken an initiative to study 5 big NeGPs for revamping those NeGPs by incorporating these technologies. DoP&amp;PW can also think of new architecture for revamping of Pensioner Portal. This matter can be further discussed with Deity and on the basis of discussions Deity may come up with a new Project. Use of mobile applications would be desirable. J S (Pension) also pointed out to the representative of Deity for completing the lrnpact Assessment of Pensioners Portal by an independent agency for which DoP&amp;PW has been writing to Deity for the last one year or so.</p>
<p>8. The DDG, NIC was of the View that since the Portal is meant for Pensioners who may not be so computer savvy and other stakeholders, the users of the Pensioner Portal should be visited to have more realistic view of improving the Pensioner Portal. The representative of D/O Ex- Serviceman Welfare mentioned that the present format of CPENGRAMS do not contain provisions for sending reminders by nodal officers to its subordinate formations. This facility should be created and there should be a provision of ‘Alert’ for ‘Directions’ subsequently issued by nodal Ministry to its subordinate formations. He also desired that there should be such facility for search of cases of Defence Personal on the basis of Army ID number which is carried by Defence Personnel throughout their service period and thereafier.</p>
<p>9. The representative of National Ex-Service League felt the need for simplification of use of Grievance Redressal facility for rural areas as most of the Ex-Servicemen reside in these areas. He was, however, informed that since internet facilities are speedily percolating to rural areas also through Common Service Centres (CSC), there should not be any difficulty even for pensioners from rural areas to make use of facilities under Pensioner Portal. However, the use of CSCs by pensioners in village areas could be worked out as this would lead to more optimum utilisation of resources.</p>
