<p>Hon’ble Sir,</p>



<p>Through this memorandum, your kind attention is invited to the discontentment, resentment, displeasure and woe of employees left to their ill fate on depriving of guaranteed minimum pension under NPS or any other pension scheme equal to half of their last Pay and delinking of the same from Inflation.</p>



<p>It has always been expected from a Govt to play a role of ideal employer for its employees and protector for the citizens of India who are contributing continuously for the progress of the country and assure social security to its employees as well as citizens.</p>



<p>Every employee whether he belongs to Govt Industry of any Private Industry dedicates his skill, power and energy to his employer till superannuation or until he lost his capacity to do so and gets remuneration to fulfil his requirements. After superannuation or being incapacitated by whatsoever reasons he becomes unable to serve to get remuneration but his requirement does not end.</p>



<p>Then the onus is on the employer to mitigate the hardships faced by the employee. This social security cannot be measured by solely market related factors. Under Central Govt Sectors, this responsibility was borne by the Govt. as it compiled the CCS (Pension) Rules-1972. Later, Govt. introduced Employees’ Pension Scheme- 1995 for change over from contributory provident fund to pension scheme.</p>



<p>Now market related factors have compelled the Govt. to deviate to bear its responsibility of social security as an employer. Govt. succumbed to this pressure and introduced New Pension Scheme (Defined Contributory Pension Scheme) applicable to Central Govt Servants who join on or after 01.01.2004.</p>



<p>As per this New Pension Scheme 10% of Basic Pay+ DA is being recovered from the employees as a compulsory deduction and government is also contributing 14% of Basic Pay + DA of the employees. A government servant can exit at or after the age of 60 years and it would be mandatory for him to invest 40 per cent of pension wealth to purchase an annuity which will provide for pension for life time of the employee and his dependent parents/ spouse.</p>



<p>But the abovementioned method lacks of the following benefits required to the employees for their livelihood-</p>



<ol class="wp-block-list"><li>This new system has no minimum guaranteed Pension.</li><li>There is no safeguard from price hike in absence of dearness allowance on pension.</li><li>No benefit of additional pension on attaining age of 80 years, 85 years, 90 years, 95 years, 100 years.</li><li>No safeguard, in case of missing employees.</li><li>Compulsory retirement pension.</li><li>Compensation Pension</li></ol>



<p>From above it is established that the new entrants will not be eligible for Superannuation Pension, Compensation Pension, Compulsory Retirement pension, Compassionate Allowance etc. Any scheme not containing the above benefits is not accepted to the employees.</p>



<p>Introduction of New Pension Scheme/ National Pension Scheme (NPS) for Central Government Employees w.e.f 01.01.2004 has adversely affected the concept of social security provided by the Government and it has put the future as well as retirement security (social security) of the employees at stake in lack of guarantee of minimum pension under the scheme. In place of adopting progressive and dynamic approach for the assets of the society viz retired employees, Govt adopted a retrograde policy with no guaranteed pension, no safeguard from erosion caused by inflation etc. Likewise, other pension schemes also have the many anomalies.</p>



<p>Sir, on the occasion of the election of five states, many political parties has assured the employees in their manifesto that if they come into power, they will implement the old pension scheme. These announcements have also aroused the feeling among the central government employees that the central government should also bring its employees under the old pension scheme.</p>



<p>This agitation programme from 3rd May to 6th May has been conducted by the employees to draw your attention towards the deprived employees for assurance of safe old age.</p>



<p>Therefore, you are requested to look into the following demand and do the needful for earliest redressal of them-</p>



<p class="has-text-align-center"><strong><mark style="background-color:rgba(0, 0, 0, 0)" class="has-inline-color has-vivid-red-color">Scraping of NPS and restoring of CCS (Pension) rules, 1972.</mark></strong></p>



<p class="has-text-align-center"><strong>or</strong></p>

<p>Subject: <strong>Grant of Dearness Relief to Central Freedom Fighter Pensioners w.e.f. 01.07.2019 &#8211; regarding.</strong></p>



<p>Sir,</p>



<p>I am directed to refer to this Ministry&#8217;s letter No.45/08/ 2017-FF(P) dated 26.03.2019 (copy enclosed) regarding 10% Dearness Relief to be paid to the <a href="https://centralgovernmentnews.com/tag/freedom-fighter-pensioners/" target="_blank" rel="noreferrer noopener" aria-label="freedom fighter pensioners (opens in a new tab)">freedom fighter pensioners</a> w .e.f. 01.01.2019 and to say that recently Dearness Relief in respect of Central Government pensioners has been enhanced by 5% by the Government of India, Ministry of Personnel, Public Grievances &amp; Pensions, Department of Pension &amp; Pensioners’ Welfare, New Delhi’s O.M. No.42/04/ 2019-P&amp;PW(D) dated 21.10.2019. Hence the Dearness Relief admissible to the Central Freedom Fighter/ spouse/ daughter pensioners shall be enhanced from the existing rate of 10% to 15% w .e.f. 01.07.2019. All the banks are requested to calculate the arrears w.e.f. 01.07.2019. </p>

<p>The payment of arrears of Dearness Relief shall not be made before the date of disbursement of pension/ family pension of October, 2019. The revised amount of pension for various categories of pensioners after increase of 5% DR i.e. total 15% Dearness Relief will be as follows</p>

<p>The Prime Minister of India, Shri Narendra Modi launched at Ranchi today, the National Pension Scheme for Traders and Self Employed Persons, a pension scheme for the Vyaparis (shopkeepers /retail traders and self-employed persons) with annual turnover not exceeding Rs 1.5 crore. The Governor of Jharkhand Smt. Draupadi Murmu, Chief Minister of Jharkhand Shri Raghubar Das, Minister of Tribal Affairs Shri Arjun Munda, Minister of State  for Labour &amp; Employment (I/C) Shri Santosh Kumar Gangwar and other dignitaries were also present on the occasion.  With this nation-wide launch, the facility for enrollment under the scheme has been made available to the prospective beneficiaries through 3.50 lakh Common Service Center (CSCs) across the country. In addition people can also self-enroll by visiting the portal <a rel="noreferrer noopener" aria-label="maandhan.in/vyapari (opens in a new tab)" href="https://www.maandhan.in/vyapari" target="_blank">maandhan.in/vyapari</a>. The eligible Vyaparis can visit their nearest CSCs and get enrolled under the scheme. At the time of enrollment, the beneficiary is required to have an Aadhaar card and a saving bank/ Jan-dhan Account passbook only. He/ She should be within 18 to 40 years of age group. GSTIN is required only for those with turnover above Rs. 40 lakhs. The enrolment under the scheme is free of cost for the beneficiaries. The enrolment is based upon self-certification.</p>



<p>Government has approved National Pension Scheme for Traders and Self Employed Persons in acknowledgement of notable contribution of Vyaparis (shopkeepers/ retail traders and self-employed persons). It is a voluntary and contributory pension scheme for entry age of 18 to 40 years with a provision for minimum assured pension of Rs 3,000/- monthly on attaining the age of 60 years. The beneficiary should not be income tax payer and also not a member of EPFO/ ESIC/ NPS (Govt.)/ PM-SYM. The Central Government shall give 50 % share of the monthly contribution and remaining 50% contribution shall be made by the beneficiary. The monthly contribution is kept low to make it affordable. For example, a beneficiary is required to contribute as little as Rs.100/- per month at a median entry age of 29 years. </p>



<p>This pension scheme is one of the top priorities of Prime Minister Narendra Modi’s Government in its second term. According to the Ministry’s 100-day plan, this scheme will target enrolling 25 lakh subscribers in 2019-20 and 2 crore subscribers by 2023-2024. An estimated 3 crore Vyaparis in the country are expected to be benefitted under the pension scheme.</p>

<p>The Atal Pension Yojana (APY) is the guaranteed Pension Scheme of Government of India administered by PFRDA.</p>
<p>The Subscriber base under APY has crossed 1.24 crore mark. The Govt of India guarantees the pension benefits. The Scheme is very easy to understand and it is very transparent. More than 27 lacs new subscribers have joined the Scheme during the current financial year, i.e. 2018-19. States like Uttar Pradesh, Bihar, Andhra Pradesh, Maharashtra and Karnataka are the top contributors in APY enrollment. The Scheme allows any Indian Citizen between the age group of 18-40 years to join through the bank or post office branches where one has the savings bank account. The table below shows State wise enrollment, gender wise distribution and coverage along with the latest population in those States.</p>
<p>The State wise potential, that is eligible population that can be covered under APY, and gender wise distribution of population as on 27th Oct 2018 is given below:</p>

<p>Subject : <strong>Procedure for extending the benefits of Old GPF / Pension Scheme to those casual workers covered under the Scheme of 1993 and regularized on or after 01.01.2004.</strong></p>
<p>It has been observed that the pension cases of casual labour who were regularized on or after 01.01.2004 and eligible for old GPF/Pension Scheme vide DOPT OM No.49014/2/2014-Estt(C) dated 28.07.2016 have not been processed by the concerned Ministries/Departments. In order to avoid the hardship to the pensioners all the Ministries/Departments/PAOs have been requested to finalise the pension cases of the pensioners after following the procedure below:</p>
<p>1) Deptt. may issue the order that the old GPF Scheme/ Pension Scheme is applicable to the concerned official.</p>
<p>2) CPAO may be requested through concerned Pay &amp; Accounts Office to stop Provisional Pension after cancellation of PPO, if issued.</p>
<p>3) NSDL may be requested by the concerned PAO to deposit the NPS subscription, Govt. Contribution plus interest thereon into the Govt. Account through ERM of NSDL.</p>
<p>4) On receipt of the amount it may be classified by the concerned PAO as below:</p>

<p>Will the Minister of DEFENCE be pleased to state:-</p>
<p>(a) whether the Government proposes to restore the old pension scheme of the Armed Forces that was in vogue till 1971 which clearly defined pension as 70 per cent of last pay drawn and if so, the details thereof;</p>
<p>(b) the time by which the Government plans to set up a committee to review the present pension scheme which pegs pension at 50 per cent of last pay drawn;</p>
<p>(c) if so, the details thereof; and</p>
<p>(d) the other steps taken by the Government in this regard?</p>

In this scheme, standard retiring pension, service pension were related to Rank and the prescribed length of service but it was neither linked to the emoluments nor to the service beyond the prescribed period of standard service.</p>

<p>Will the Minister of DEFENCE be pleased to state:-</p>
<p>(a) whether the Government proposes to start a pension scheme for the Short Service Commission (SSC) officers in the defence sector;</p>
<p>(b) if so, the details thereof;</p>
<p>(c) whether the Government proposes to sanction pension for the defence personnels serving less than fifteen years and if so, the details thereof;</p>
<p>(d) whether the Government has received any representation from the Military Service Pensioners Association in this regard and if so, the details thereof and the action taken by the Government in this regard; and</p>
<p>(e) whether the Government proposes to launch any other welfare schemes for the military personnels who had served for less than fifteen years and if so, the details thereof?</p>

<p>(a) &amp; (b): At present, the Short Service Commissioned officers granted commission from other rank are entitled to pension on completion of 12 years of qualifying service. However, Short Service Commissioned officer who is granted commission from direct civil life is entitled to Terminal Gratuity only. There is no new proposal under consideration.</p>
<p>(c) Presently there is no such proposal.</p>

<strong>Dated 2nd September 2016</strong></p>
<p>The initial report received at the Confederation Central Head Quarters indicate the participation of about ten lakhs Central Government employees in today’s nationwide general strike action of the Indian Working Class. Earlier, endorsing the call of the Central Trade Unions, the Confederation of Central Government employees and workers had called upon the Central Government employees to take part in the one-day strike to compel the Government to withdraw the anti-people and anti-labour neo-liberal policies pursued by the Central Government.</p>
<p>Offices of the Postal, Income Tax, Ground Water Board, Survey of India, Geological Survey of India, Printing and Stationery department, Botanical Survey of India, Indian Bureau of Mines, RMS offices, census department, Indian Space Research organization, Central Government Health Scheme, Atomic Energy, Medical Stores depots, Film Institute of India, AGMARK, Indian Council for Medical Research, Film division and various other autonomous scientific and research institutions etc. remained closed and the work completely paralysed.</p>
<p>The strike also affected the functioning of various offices of Indian Audit &amp; Accounts department, Civil Accounts, Central Excise and Customs, CPWD etc. Total civilian employees of various Defence organisations and Defence Accounts Departments participated in the strike. The Strike was total in Kerala, West Bengal, Tamilnadu, Andhra, Telangana, Jharkhand, Chattisgarh, Odisha, Assam, North Eastern states, Karnataka, Maharashtra, Punjab, Madhya Pradesh and 70 to 80% in other states.</p>
<p>The Central Government employees were particularly unhappy over the totally negative attitude of the NDA Government towards their demands while implementing 7th Central Pay Commission recommendations. Ban on creation of new posts, non-filling up of about six lakhs vacant posts, introduction of New Contributory Pension Scheme, non-regularisation of Gramin Dak Sevaks and casual, contract workers, ceiling on compassionate appointments, rejection of the demand for increase in the minimum wage and fitment formula, reduction in the percentage of House Rent Allowance, abolition of 52 allowances etc. are some of the retrograde measures taken by the Central Government.</p>
<p>The Confederation National Secretariat Congratulates the Central Government employees, who undertook intensive campaign to make the strike a grand success. The Confederation salutes all its members for their whole hearted participation in the strike and making it an unprecedented success.</p>

<p>The existing pension scheme for Central freedom fighter pensioners and their eligible dependents has been restructured as per the table below:</p>

<p>The revised scale shall take effect from 15.08.2016.</p>
<p>The existing Dearness Relief system based on All India Consumer Price Index for Industrial workers, which was hitherto applied to freedom fighter pensioners on annual basis, is being discontinued and replaced by the Dearness Allowance system applicable to Central Government employees twice a year.</p>
<p>All freedom fighters and spouses and dependent parents/eligible daughter pensioners of deceased freedom fighters drawing pension under the Swatantrata Sainik Samman Pension Scheme, 1980 would be benefitted by the decision. So far, total 1,71,605 freedom fighters and their eligible dependents have been sanctioned pension under the scheme. At present 37,981 freedom fighters and their eligible dependent pensioners are covered under the scheme. Of these, 11,690 are freedom fighters themselves, 24,792 are spouses(widows/widowers) and 1,499 are daughter pensioners.</p>
<p>In 1969, Government of India introduced the ‘Ex-Andaman Political Prisoners Pension Scheme’ to honour the freedom fighters who had been incarcerated in the Cellular Jail at Port Blair. In 1972, to commemorate the 25th Anniversary of our Independence, a regular scheme for grant of freedom fighters’ pension was introduced. Thereafter, with effect from 01.08.1980, a liberalized scheme, namely the ‘Swatantrata Sainik Samman Pension Scheme’ is being implemented. Besides the freedom fighters, spouses (widows/widowers), unmarried and unemployed daughters (upto maximum three at any point of time) and parents of deceased freedom fighters are eligible for pension under the scheme.</p>

<p><em><strong>Schemes for Retired Employees</strong></em></p>
<p>The pension of Central Civil Government servants appointed on or before 31.12.2003 is governed by the Central Civil Services (Pension) Rules 1972 or the corresponding Pension Rules of other Services/Departments such as All India Services and Railways.</p>
<p>The Central Civil Government Servants appointed on or after 01.01.2004 are governed by the Defined Contribution-based Pension Scheme under the National Pension System.</p>
<p>The personnel belonging to the Defence Services continue to be eligible for pension under Defined Benefit Pension Rules applicable to defence personnel.</p>
<p>There is no proposal to introduce any new pension scheme for retired Central Government employees.</p>
<p>This was stated by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr. Jitendra Singh in a written reply to a question by Smt. Rekha Verma in the Lok Sabha today.</p>
