<p>MoS of Prime Minister’s Office and Ministry of Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh today released a book and it’s e-Version on 8 Years of Administrative and Pension reforms (2014-2022).</p>



<p>Speaking on the occasion, the Minister said, eight years of administrative and pension reforms under Prime Minister Narendra Modi are aimed at social transformation.</p>



<p>Delivering the inaugural address at a webinar on Administrative Reforms and Pension Reforms (2014-2022) in New Delhi, Dr Jitendra Singh said, the large scale use of technology and integration approach are the twin pillars of both the revolutionary Governance and Pension Reforms carried out in the last eight years.</p>



<p>Dwelling on Pension Reforms, Dr Jitendra Singh said, ever since Narendra Modi came to power in 2014, the Department of Pension &amp; Pensioners’ Welfare had introduced a number of revolutionary reforms including relaxation in the provision of Family Pension for divorced daughters and Divyangs, the introduction of Face Recognition Technology through the mobile app for ease in submitting Life Certificate by elderly pensioners, Electronic Pension Pay Order, assistance from Postal Department to facilitate pension process etc.</p>



<p>He said, moreover steps like an extension of Family Pension to the differently-abled child of a deceased Government employee/Pensioner or giving a major hike in the Family Pension emoluments for Divyang children of a deceased government servant/pensioner are not only pension reforms but these are social reforms having wide implications.</p>



<p>On Administrative Reforms, Dr Jitendra Singh listed several out of the box ideas like abolishing the century-old colonial practice of attestation of documents by a gazetted officer and replacing it with self-attestation, doing away with interviews for Group-B (Non-Gazetted) and Group – C posts in the Central Government since 2016, three-month Central stint for fresh IAS officers as Assistant Secretary, change in the nature of PM Excellence Award and the abolition of around 1450 rules, which have become obsolete.</p>



<p>Referring to Mission Karmayogi’s main mantra of moving from “Rule to Role”, Dr Jitendra Singh said, the Civil Servants must train themselves for a new and challenging assignment as most of the flagship schemes of the Government are now hugely Science and Technology based.</p>



<p>The Minister also released an e-Book on 8 Years’ Achievements of Department of Pension &amp; Pensioners’ Welfare and that of DARPG on the occasion.</p>

<p>(a) whether there are any restrictions under relevant conduct rules on investments by Central Government employees in stock market/financial market instruments;<br />
(b) if so, the details thereof and the reasons therefor;<br />
(c) whether Government is considering any proposal for giving greater freedom to Central Government employees to invest in such instruments; and<br />
(d) if so, the details thereof?</p>
<p><strong> </strong></p>
<p><strong>ANSWER</strong></p>
<p>MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)</p>
<p>&nbsp;</p>
<p>(a) &amp; (b): Yes Sir. Rule 16 of the Central Civil Services (Conduct) Rules, 1964, is relevant for investment by Central Government employees in stock/ financial market instruments. The provisions of Rule 16 are reproduced as under:</p>
<p>&nbsp;</p>
<p>&#8220;(1) No Government servant shall speculate in any stock, share or other investment: Provided that nothing in this sub-rule shall apply to occasional investments made through stock brokers or other persons duly authorised and licensed or who have obtained a certificate of registration under the relevant law. Explanation &#8211; Frequent purchase or sale or both, of shares, securities or other investments shall be deemed to be speculation within the meaning of this sub-rule.&#8221;</p>
<p>&nbsp;</p>
<p>(2) (i) No Government servant shall make, or permit any member of his family or any person acting on his behalf to make, any investment which is likely to embarrass or influence him in the discharge of his official duties. For this purpose, any purchase of shares out of the quotas reserved for Directors of Companies or their friends and associates shall be deemed to be an investment which is likely to embarrass the Government servant.</p>
<p>&nbsp;</p>
<p>(ii) No Government servant who is involved in the decision making process of fixation of price of an Initial Public Offering or Follow-up Public Offering of shares of a Central Public Sector Enterprise shall apply, either himself or through any member of his family or through any other person acting on his behalf, for allotment of shares in the Initial Public Offerings or Follow-up Public Offerings of such Central Public Sector Enterprise.</p>
<p>&nbsp;</p>
<p>(3) If any question arises whether any transaction is of the nature referred to in sub-rule (1) or sub-rule(2), the decision of the Government thereon shall be final.</p>
<p>&nbsp;</p>
<p>(4) (i) No Government servant shall, save in the ordinary course of business with a bank or a public limited company, either himself or through any member of his family or any other person acting on his behalf,</p>
<p>&nbsp;</p>
<p>(a) lend or borrow or deposit money, as a principal or an agent, to, or from or with, any person or firm or private limited company within the local limits of his authority or with whom he is likely to have official dealings or otherwise place himself under any pecuniary obligation to such person or firm or private limited company; or</p>
<p>&nbsp;</p>
<p>(b) lend money to any person at interest or in a manner whereby return in money or in kind is charged or paid:</p>
<p>Provided that a Government servant may give to, or accept from, a relative or a personal friend a purely temporary loan of a small amount free of interest, or operate credit account with a bona fide tradesman or make an advance of pay to his private employee:</p>
<p>&nbsp;</p>
<p>Provided further that nothing in this sub-rule shall apply in respect of any transaction entered into by a Government servant with the previous sanction of the Government.</p>
<p>&nbsp;</p>
<p>(ii) When a Government servant is appointed or transferred to a post of such nature as would involve him in the breach of any of the provisions of sub-rule (2) or sub-rule (4), he shall forthwith report the circumstances to the prescribed authority and shall thereafter act in accordance with such order as may be made by such authority.</p>
<p>&nbsp;</p>
<p>2. Further, vide O.M. No. 11013/6/91-Ests.(A) dated 8.04.1992 (copy enclosed), it was clarified that shares, securities, debentures etc. are treated as movable property for the purpose of Rule 18 (3) of the Central Civil Services (Conduct) Rules, 1964, which provides for intimation/ permission of an individual transaction, if the value of such transaction exceeds two months of basic pay of the Government servant.</p>
<p>&nbsp;</p>
<p>(c) &amp; (d): At present, there is no proposal under consideration of the Government for giving greater freedom to Central Government employees to invest in stock market/ financial market instruments.</p>

<p>Pension – The Tamil Nadu Pension Rules, 1978 – Amendment to rule 36 – Orders – Issued.</p>
<p><b>Read:</b></p>
<p>From the Commissioner of Archives and Historical Research D.O.Letter No.5557/A2/11, Dated 03.02.2015</p>
<p><b>ORDER:</b></p>
<p>In the letter read above, the Commissioner of Archives and Historical Research has stated that the existing provision of Rule 36 of Tamil Nadu Pension Rules, 1978 is misused frequently to perpetuate Government jobs within the families of existing Government servants and requested to make reference to Medical Board mandatory for all cases of retirement by Medical invalidation.</p>
<p>2.Based on the above, the Government after careful examination have decided to amend the Tamil Nadu Pension Rules, 1978. Accordingly, the following Notification will be published in the Tamil Nadu Government Gazette:-</p>
<div style="text-align: center;"><b>NOTIFICATION</b></div>
<p>In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Pension Rules, 1978.</p>
<p><b>AMENDMENTS</b></p>
<p>In the said Rules, in rule 36, in sub-rule (1), under the heading “Explanation” in clause (a), –</p>
<p>(1) for item (i), the following item shall be substituted, namely:-</p>
<p>“(i) A Medical Board in the case of all Medical invalidation cases, whether they are self drawing Officers or non-self drawing Officers.”;</p>
<p>(2) in item (ii),-</p>
<p>(a) sub-item (a) shall be omitted;</p>
<p>(b) in sub-item (c), for the expression “Medical Officer” occurring in two places, the expression “Medical Board” shall be substituted.</p>

<p>Central Government Employees will be engaged as Inspecting Officers and of the Flying Squad for conducting/ supervising of examinations of Staff Selection Commission at various Centres Places. The retired officials will also be paid honorarium. DoPPW has issued a Notice to all Retired Central Staffs and requested them to register in SANKALP</p>
<p>Department of Pension &amp; Pensioners Welfare i.e DoPPW has been requested by Staff Selection Commission (HQ), New Delhi for a list of central government pensioners for engaging them as Inspecting Officers and of the Flying Squad for conducting/supervising of examinations of Staff Selection Commission at various Centres/places. The retired officials will also be paid honorarium.</p>
<p>2. DoPPW has launched the intiative &#8220;SANKALP&#8221; for retired central government civil pensioners/retiring employees for voluntary activities for useful intervention in society so that their skill, expertise and knowledge can be used.</p>
<p>3. Al the employees retiring from the BHAVISHYA system hereby requested to register themselves on &#8220;SANKALP&#8221;. For this. they can visit our website i.e www.persmin.gov.in/pension.asp and www.pensionersportal.gov.in</p>

										<content:encoded><![CDATA[<p><strong>Retired Central Employees Win War in Supreme Court &#8211; Alas! Stalled by the Government : Pension News</strong></p>
<p>Three decades after their battle began, and despite a victory in the Supreme Court in September, several thousand retired central government employees are yet to get their pension restored.</p>
<p>Unwilling to let the octogenarians celebrate with pension benefits, the Centre filed a review petition in the top court last month and decided to implement the restoration subject to its outcome. The Union ministry of personnel, public grievances and pensions issued an office memorandum on December 21to give former central government employees who had litigated for years, including K Ganesan, a spearheading litigant who died during the process, this bittersweet news.</p>
<p>The issue centres around a pension rule that permitted central government employees to shift en masse from the 1960s to the 1980s to public sector undertakings (PSUs) that needed experienced workers at the time. To aid and promote the move, the Centre allowed the employees to avail of 100% lump sum pension in advance for 15 years.</p>
<p>The rules had till then permitted a partial one third commutation. Acomplicated formula is at work for pension calculations.Essentially, such employees who had claimed a lump sum upfront in a particular year, went on to fight for restoration of pension (effectively arrears) as per service years, after accounting for the lump sum payment made earlier. The issue was a fight against effective downgrade of pension slabs.</p>
<p>Several legal battles ensued, beginning in 1983. In 1987, the SC first allowed one-third restoration for Central government employees after a 15-year period, and a decade later extended the benefit to those who had shifted to PSUs.</p>
<p>K Ganesan, who was with the finance ministry and in 1986 moved to BHEL, a PSU, after availing of lump sum pension in advance, launched a fight in the Madras high court.In 2007, the court upheld the plea.</p>
<p>It significantly held that the Centre cannot wipe away the rights of an employee for restoration. It said an employee remains a pensioner under the Pensions Act, 1871. Navi Mumbai resident Satish Kate, part of another association and who worked with the Indian Bureau of Mines and retired in 2006 from Indian Oil Corporation, is among those awaiting restoration.</p>
<p>&#8220;Many of the 7,000-odd pensioners are aged over 80. They may not live to enjoy pension in their lifetime if the legal battle continues,&#8221; he said. &#8221; The SC order applies to all of us who were absorbed by PSUs.The PM heads the ministry of personnel, public grievances and pension.”</p>

										<content:encoded><![CDATA[<p><b>Madras High Court issues notice to Centre on One Rank One Pension</b></p>
<p>Madurai: The Madras High Court today issued notice to the Centre on a petition seeking a direction to issue a notification to implement the One Rank One Pension (OROP) scheme within a stipulated period.</p>
<p>Acting on the petition by ex-serviceman S Chinnadurai, Justice S Vaidyanathan ordered notice to the Cabinet, Finance and Defence secretaries and sought their reply within two weeks.</p>
<p>The petitioner contended that 90 per cent of the ex- servicemen are living below the poverty line.</p>
<p>Previous governments had already announced OROP and allocated Rs 500 crore for it. On May 1, Prime Minister Narendra Modi had also assured that OROP would be implemented by the government but no timeframe had been given, he alleged.</p>
<p>The Indian ex-servicemen movement had also sent a memorandum and he had also submitted a representation.</p>
<p>Chinnadurai said it was mandatory on the part of the government to implement OROP before the fiscal 2014-15 after announcing the scheme.</p>
<p>The delay in implementing the scheme would demoralise serving soldiers and ex-serviceman and adversely affect the integrity of the country, he said.</p>
<p>He said that army men, who sacrificed the better part of their youth for the country, were not even getting proper jobs after they retired between 30 and 40 years of age.<br />

The department of pension &amp;amp; pensioners’ welfare is in the process of providing a platform for the retiring central government employees to showcase their  commendable work done during their service. It is envisaged that this would provide satisfaction to the retiring employee and also act as a motivator for serving employees. The retiring employee may submit a write-up, not more than 5000 words along with appropriate attachments and would be published in departmental website.</p>

<p data-iceapw="53">19.2.2015  on”Anubhav”   and  to  say  that  an online  system  has  been  developed   by the National  Informatics   Centre(NIC).   Instructions  for  use of this  application   by the  retiring employees,   Head  of  Offices/   Head  of  Departments   in  the  Ministries/   Departments   are enclosed  herewith.  These  instructions   may  be read  in conjunction   with the  OM referred to above.</p>
<p data-iceapw="25">2. You may log on to the application  by clicking on link “Anubhav” on persmin.gov.in/pension.asp.  The login Id  and password  is given in attached  document.</p>
<p data-iceapw="50">3.  The form on “Anubhav”,  furnishing  the details  of the outstanding  work by the retiring employee  has also  been  modified  in consonance  with the software  application.     A copy of the revised “Anubhav”  form  is also enclosed.     This form  is to be submitted  along with form 5 of CCS (Pension)  Rules.</p>
<p align="left" data-iceapw="36">4.  The   instructions    may   be  circulated   appropriately    among   all  employees   of  the Ministry and   attached/    subordinate    offices   and   given   wide   publicity   to  encourage participation  in “Anubhav”  as this project  is being monitored  at the highest  levels.</p>
