<p>The provisional payroll data of EPFO(Employees’ Provident Funds Organization) released on 20th August 2021, highlights a growing trend with 12.83 lakh net payroll additions during the month of June 2021. With respect to payroll data, the impact of the second wave of COVID-19 pandemic waned during June 2021, leading to tremendous growth in net payroll additions as compared to April and May 2021. Month-on-month analysis reveals an increase of 5.09 lakh additions in net subscribers during June 2021 as compared to the previous month of May 2021.</p>



<p>Of the total 12.83 lakh, net subscribers added during the month, around 8.11 lakh new members have come under the social security coverage of Employees’ Provident Funds Scheme for the first time. During the month, around 4.73 lakh net subscribers exited but rejoined EPFO by changing jobs within the establishments covered by EPFO. This shows that the majority of subscribers opted to continue their membership with EPFO, using transferring of funds from the previous job to the current PF account rather than applying for the final withdrawal of their PF accumulations.</p>



<p>Regarding age-wise comparison of payroll data, the age-group of 18-25 years has registered highest number of net enrolments with around 6.15 lakh additions, which is 47.89% of total net additions during the month of June, 2021. This is followed by age group of 29-35 with around 2.55 lakh net payroll addition. Age-wise payroll data indicates that many first time job seekers are joining organised sector workforce in large numbers.</p>



<p>Gender-wise analysis indicates that net female addition during the month stood at 2.56 lakh, which is around 0.79 lakh more than those added during May 2021.</p>



<p>State-wise comparison of payroll shows that states of Maharashtra, Haryana, Gujarat, Tamil Nadu and Karnataka are still at the forefront of payroll addition with addition of approximately 7.78 lakh subscribers during the month. This is around 60.61% of total net payroll addition across all age groups.</p>



<p>Industry-wise payroll data indicates that ‘expert services’ category (consisting of manpower agencies, private security agencies and small contractors etc.) constitutes 41.84% of total subscribers addition during the month. In addition, month-on-month growing trend in net subscription has been noticed for industries like trading-commercial establishments, engineering products, building &amp; construction, textiles, garment making, hospitals and financing establishments.</p>



<p>The payroll data is provisional since the data generation is a continuous exercise as updation of employee record is a continuous process. The previous data hence gets updated every month. From May-2018, EPFO has been releasing payroll data covering the period September 2017 onwards.</p>



<p>EPFO provides provident fund, pension benefits to the members on their retirement and family pension &amp; insurance benefits to their families in case of untimely death of the member. EPFO is country’s principal organization responsible for providing social security benefits to the organized/semi-organized sector workforce covered under the statute of EPF &amp; MP Act, 1952.</p>

<p>The undersigned is directed to refer to DoT letter No. 36-9/2002-Pen(T) dated 24.03.2003 (copy enclosed) vide which clarification was issued regarding the above mentioned subject.</p>



<p>2. The matter has been examined afresh and the DoT letter dated 24.03.2003 has been superseded by <strong><a href="https://centralgovernmentnews.com/tag/DoT/" target="_blank" rel="noreferrer noopener">DoT</a></strong> letter No. 36-9/2002-Pen(T)Pt. dated 05.06.2020 (copy enclosed).</p>

<p>Sir,</p>



<p>This refers BSNL letters No. 1-15/2019- PAT (BSNL) (Part) dated 30.01.2020, No. 22-92/2017/ General/Vol.I dated 5.7.2018 mentioned therein, and earlier references from <strong><a href="https://centralgovernmentnews.com/category/bsnl/" target="_blank" rel="noreferrer noopener">BSNL</a></strong> on the subject. :</p>



<p>2. The matter has been examined in light of the advice rendered by Department of Pension &amp; a Pensioners Welfare vide ID Note No. 4-9/2018-Vig.I (pt) dated 28.09.2018 (copy enclosed).</p>



<p>3.. Department of Pension &amp; Pensioners’ Welfare vide the above referred ID Note on the question whether judicial proceedings initiated against a Government servant by the state police on the basis of a complaint by a private party for any action-other than in any official capacity would come under the ambit of Rule 69 of CCS (Pension) Rules 1972 &#8211; conveyed the following:</p>



<ul class="wp-block-list"><li> If a Government servant is convicted during the period of service, action is taken under Rule 19 of the CCS (CCA) Rules and a penalty under Rule 11 of the CCS (CCA) Rules is imposed. Such action under said Rules is taken irrespective of whether the conviction is on account of charges connected with his official capacity or otherwise. Once a Government servant retires, action cannot be taken against him under CCS (CCA) Rules. After retirement, if the Government servant is found guilty of misconduct during service action can be taken under Rule 9(i) of the <strong><a href="https://centralgovernmentnews.com/category/ccs/" target="_blank" rel="noreferrer noopener">CCS</a></strong> (Pension) rules and his pension/ gratuity can be withhold/ withdrawn.</li><li>DoP&amp;PW is of the view that all misconduct under CCS (Conduct) Rules for which the Government servant could be punished under the CCS (CCA) Rules, during the period of service would be covered by the provisions of Rule 9 and Rule 69 of the CCS (Pension) Rules, 1972. Therefore, after retirement, in cases where the judicial proceedings for any act during service (whether in official capacity or otherwise) which could be termed as misconduct under the provisions of CCS (Conduct) Rules are continued after retirement, such judicial proceedings shall come under the purview of Rule 9 and Rule 69 of CCS (Pension) Rules, 1972.</li></ul>



<p>4. The applicability of the above advice on other cases of similar nature has been examined. In view of the explicit advice rendered by Department of Pension &amp; Pensioners’ Welfare reproduced above, the previous DoT letter No. 36-9/2002- Pen(T) dated 24.03.2003 in this regard is hereby superseded by the above advice rendered by Department of Pension &amp; Pensioners’ Welfare.</p>



<p>5. As regards the applicability of the above to VRS optees under BSNL VRS-2019, it is to intimate that there is no ruling for any differential treatment to these retirees.</p>



<p>6. This issues with the approval of Secretary (T).</p>

<div>In Lok Sabha Minister of Communications and Information Technology Shri.Milind Deora said in written reply to the question about the pension benefits for MTNL and BSNL employees on 5.9.2012 that the pensionary benefits to the absorbed employees of BSNL are covered under Rule 37-A of Central Civil Services (Pension) Rules, 1972, and the same are being paid by the Government. The pensionary benefits to absorbed employees of MTNL are being paid by MTNL. MTNL employees Associations/Unions are demanding payment of pensionary benefits by the Government.</div>

<div>LOK SABHA ANNEXURE UNSTARRED QUESTION NO. 3970 DATED 05-09-2012</div>
<div>MTNL was established on 1.4.1986 and employees were initially transferred to MTNL on deemed deputation and absorbed in MTNL as per their options. The date of absorption for  Group C and D employees was 1.11.1998 whose  pensionary benefits are governed by DOP&amp;PW’s Office Memorandum dated 5.7.1989, whereas the date of absorption for Group A and B employees was 1.10.2000 whose  pensionary benefits  are governed by  Rule 37-A of CCS (Pension) Rules, 1972.</div>

<div>Rule 37-A was notified at the time of formation of BSNL.  The pensionary benefits of Government employees who got absorption in BSNL w.e.f. 01.10.2000 are governed by Rule 37 A of CCS (Pension) Rules, 1972. As per the provisions Sub-Rule 21 of Rule 37-A,  the absorbed employees of BSNL are paid pensionary benefits by the Government.</div>

<div>After the notification of Rule 37-A on 30.9.2000, MTNL employees/Associations have been demanding for similar treatment regarding payment of pension/pensionary benefits as given to BSNL employees.</div>
<div></div>
<div>The matter regarding applicability of Rule 37A to MTNL was considered by Committee of Secretaries    in its meeting held on 14.12.2004 in which it was observed that the issue is well settled and should not be reviewed at this stage on the grounds that there are disparities in pay scales between MTNL and BSNL staff and in majority of the pay slabs, BSNL was given one scale below than MTNL.  Hence, the existing system of payment of pension would continue.</div>

<div>The MTNL Associations/employees are continuously demanding for payment of pensionary benefits to MTNL employees at par with BSNL employees. They are also not supporting for  creation of Pension Fund/Trust as required under the Rules.</div>
<div></div>
<div>The matter was again discussed in a high level meeting during 2007 and accordingly a Cabinet Note was submitted on 23.2.2009. However, due to differences of opinion among the concerned nodal Departments on the issue, it was desired that the difference of opinion may first be resolved in Committee of Secretaries before placing the issue in the Cabinet. Department of Legal Affairs has asked for fresh opinion of nodal Departments. The opinion of Department of Pension and Pensioners Welfare as well as Department of Public Enterprises have since been received. Opinion on Department of Expenditure is still awaited. Further, as per the discussions held in the Parliamentary Committee of Petitions on 11.7.2012, CMD, MTNL is also exploring the possibilities of MTNL employees’ representatives accepting the BSNL pay scales.  In parallel, the groundwork for creation of Pension Fund/Trust for payment of pension to MTNL employees as per Rules/orders has also been initiated by this Department/MTNL.  Being a matter of policy, it is not possible to fix any time-frame.  Meanwhile, the pensionary benefits to absorbed employees of MTNL are being paid by the MTNL.</div>
