<p>Reference: This office Circular No.456 dated 18.03.2011, Circular No.503 dated 17.01.2013, Circular No. 542 dated 27.05.2015, Circular No. 547, 548 dated 11.09.2015 and Circular No.560 dated.08.06.2016</p>
<p style="text-align: center;"><strong>(Available on this office website www.pcdapension.nic.in)</strong></p>
<p>Consequent upon issue of GOI, MOD letter No.16(01)/2014/D(Pen/Pol) dated 18.05.2016, the Circular No. 560 dated 08.06.2016 was issued by this office for revision of Casualty Pensionary Awards in respect of Pre-2006 Armed Forced Officers and JCOs/ORs w.e.f. 01.01.2006. As per above Govt. letter, ‘the minimum guaranteed rates of Disability Element/ Liberalised Disability Element/ War Injury Element which were already revised w.e.f. 24.09.2012 vide GOI, MOD letter No 16(01)/2014-D(Pen/Pol) dated 10.04.2015 circulated vide this office Circular No. 542 dated 27.05.2015 has now been made applicable w.e.f. 01.01.2006 instead of 24.09.2012.</p>
<p>2. As per Para-5 of ibid Govt. letter, the aggregate of Service Element (revised in terms of Para 2.1 of GoI, MoD letter No 16(6)2008(1)/D(Pension/Policy) dated 04.05.2009 circulated vide Circular No. 410 dated 13.05.2009 and War Injury Element as amended from time to time, shall not exceed the minimum of the fitment table for the rank in the revised pay structure issued for implementation of recommendations of 6th CPC introduced from 01.01.2006 corresponding to the pre-revised Pay Scale held by the Armed Forces Personnel at the time of retirement/ discharge/ Invalidment. This ceiling of aggregate of War Injury Pension (Service Element plus War Injury Element) with reference to minimum of fitment table in the revised pay structure applicable from 01.01.2006 as mentioned above shall stand removed with effect from 01.07.2009 vide GoI, MoD letter No.10(01)/D(Pen/Pol)2009/Vol.II dated 19.01.2010.</p>
<p>3. Therefore, the arrears in respect of War Injury Pension shall be calculated in two phase viz. w.e.f <strong>01.01.2006 to 30.06.2009</strong> with ceiling/ cap as mentioned in Para-2 above and w.e.f<strong>. 01.07.2009 to 23.09.2012</strong> without cap. It is also mentioned that the Service Element has also been revised vide GoI, MoD letter No.1(04)/2015(II)-D(Pen/Pol) and 1(04)/2015(I)-D(Pen/Pol) dated 03.09.2015 circulated vide this office Circular No. 547 and 548 dated 11.09.2015 respectively to ascertain current entitlement of the service element.</p>
<p>4. Accordingly, to facilitate the PDA’s for the revision of War Injury Pension, corrigendum PPO was considered to be necessary. Annexure attached with Circular No.560 dated 08.06.2016 in all such affected cases was called for with certain information. <strong>Now, considering the hardship to the Ex- Servicemen located in remote areas, it has been decided that the requirement of Annexure to the Circular No. 560 for revision of War Injury Pension will be dispensed with and revision will be done by the PDAs on the basis of minimum of fitment table attached herewith. No corrigendum PPO will be issued by this office in this regard.</strong></p>
<p><strong>5. For revision of War injury Pension, minimum fitment table has been enclosed as annexure ‘A’ to ‘F’ and PDAs are authorized for revision of pension within the cap (i.e. aggregate of Service Element and War Injury Element to revised amount till 30.06.2009. Thereafter, the revision shall be done as per table annexed to GoI, MoD letter No. 16(01)/2014/D(Pen/ Pol) dated 18.05.2016, circulated vide Circular No. 560 dated 08.06.2016 for calculating the arrears up to 23.09.2012 i.e. without cap.</strong></p>
<p>6. It is also mentioned that vide this office circular No. 560 dated 08.06.2016 cited under reference, rates/ tables for modified parity of Special/ Liberalized Family Pension and Disability/ War Injury Element for various ranks was already prepared and circulated. In the said circular, there is no table for Hony. Naik, Hony. Havildar and Havildar granted Hony. rank of Nb Subedar. In view of above, it is hereby clarified that since Hony. Rank of Naik, Havildar and Havildar holding Hony rank of Nb Sub are drawing pay in the pay scale of Sepoy, Naik and Havildar respectively, therefore, they are entitled for modified parity with reference to substantive rank held at the time of retirement/ discharge/ invalidment except Naik (TS) who draws the pay of Naik. Therefore, Naik (TS) should be entitled for modified parity with respect to Naik rank.</p>
<p>7. All the Public Sector Banks disbursing defence pension would render a monthly progress report to the office of the PCDA(P) Allahabad as per the Proforma attached as <strong>APPENDIX- ‘Y’</strong> (both for ICOs and JCOs/ ORs). All PDAs are therefore, requested to ensure rendition of the said monthly report both in hard and soft copy <strong>(Excel Format)</strong> by name to <strong>Shri S. Basumatary, Sr. Accounts Officer (P) (Audit Co-ordination)</strong> on e-mail ID: <strong>cda-albd@nic.in</strong> by 15th of the following month. It is also enjoined upon that all the columns of<strong> APPENDIX- ‘Y’</strong> must be filled in complete and correct manner. It is also requested that one more copy of the requisite <strong>APPENDIX- ‘Y’</strong> may invariably be sent along with the pension payment scrolls in which arrears of pension will be shown.</p>
<p>8. The DPDOs will render the said monthly progress report in <strong>APPENDIX- ‘Y’ to the office of the PCDA (P) Allahabad</strong> as well as respective CDAs i.e. CDA (PD) Meerut and CDA Chennai as the case may be.</p>
<p>9. A copy of arrear sheet shall invariably be provided to the concerned pensioner by the PDAs for information.</p>
<p>10. All other terms and conditions shall remain unchanged.</p>
<p>11. The provisions of this circular shall take effect from 01.01.2006 and arrears, if any, shall be allowed from 01.01.2006 up to 23.09.2012.</p>

<p>It is clarified vide GOI, MOD letter No 2(3)/2012-D(Pen/Pol) dt-22.10.2013, received through HQRs office, that the circumstances mentioned in 1) GOI letter No 1(11)/2006-(Pen-C) PC dated 8th Sep 2009, 2) GOI letter No 1(11)/2006-D(Pen-C) PC dated-05.03.2010 and 3) GOI letter No 2(1)/2011/D (Pen/Policy) dated 03.02.2011 would be equally applicable to all the three services i.e Army, Air Force, and Navy.</p>

It has been brought to the notice of the Ministry that some cases are pending finalisation for grant of liberalised family pension (LFP) for want of clarification in the Govt letters dated No. 1(11)/06-D(Pen-C) PC dated 08.09.09, No. 1(11)/2006-D(Pen-C) PC dated 5.3.10 &amp; No. 2(1)/2011-D(Pension/Policy) dated 03.02.2011 (copies enclosed). The matter was considered in a meeting held under the chairmanship of the Secretary (ESW) on 24.05.2013. it was decided that the circumstances mentioned in the 3 letters would be equally applicable to all the three Armed Forces, although, some of them were included at the instance of Air HQrs. Army, Air Force and Navy may get the pending cases re-examined for eligibility of LFP in the light of clarifications given in the meeting and instructions contained in the said letters.<br />
This issues with the approval of Secretary (ESW) &amp; concurrence of MoD(Fin) vide 10(4)12010/Fin/Pen, dated 19.8.2013.</p>

<p><strong>Some model Calculations are done here</strong></p>
<p>Being a commissioned officer of Regular Army, the revision is to be done as per Annexure –A (table No 1) annexed to PCDA (P) Circular No 500. Look in relevant column for the rank and relevant row for qualifying service.</p>
<p>The revised pension w.e.f. 24.9.2012 comes out to 27795/- P.M.</p>

Firstly, it needs to be raised to 13590/- from 13500/- P.M. wef 01/07/2009 as per PCDA (P) Circular No 482 dt 19/04/02012. Then look for revised pension for the Rank and QS in Table -20 (Air Force) annexed to Circular NO 501. The revised pension should be 15465/- wef 24/09/12.</p>
<p>Moreover, as the pensioner is more than 80 years old, he is also entitled to additional pension corresponding to revised pension.</p>

<p>FAQ of CSC &#8211; 2012 : The department of Principal Controller of Defence Accounts (Pensions) has issued clarifications as Frequently Asked Questions on implementation of One Rank One Pension to pensioners / family pensioners&#8230;</p>
<p style="text-align: center;">
<strong>FAQs on Implementation of OROP vide Govt. Order dated 17.01.2013</strong></p>
<p style="text-align: left;">
Q: 1 <strong>Are these orders applicable to those pensioners also whose date of commencement of pension is exactly 01.01.2006 ?</strong><br />
A: Yes, these orders are applicable to all the pensioners/family pensioners whose date of commencement of pension is on or before 01.01.2006.</p>
<p>Q: 2 <strong>The date of commencement of family pension in respect of a family pensioner is 01.04.2006 whose late husband had retired from the service on 31.08.1999. Will the family pension of the family be revised under these orders?</strong><br />
A: Yes, the family pension will be revised under these orders because the deceased soldier was a pre-2006 retiree.</p>
<p>Q: 3 <strong>It is being contended by some pensioners/their associations that the arrears on account of this revision should be paid w.e.f. 01.01.2006 as the orders are merely an amendment to GOI, MoD letter dated 11.11.2008. Please clarify?</strong><br />
A: As the provision of these orders are effective from 24the September 2012. Hence no arrears shall be allowed for the past period.</p>
<p>Q:4 <strong>Will the additional pension also be revised accordingly ?</strong><br />
A: The improved pension will be the basic pension from 24.09.2012 and hence additional pension payable will also be revised accordingly by the PDA.</p>
<p>Q:5 <strong>The basic pension of a pre-2006 pensioner (Rank &#8211; Havildar , Group ‘D’) of Army having total qualifying service of 15 years is slated to be increased from 3500/- p.m. to 5301/- P.M. Is such a high increase in Basic Pension is in order?</strong><br />
A: The increase in BP from 3500/- to 5301/- P.M for the pensioner with particulars as mentioned above is in order. It is evident from the existing basic pension of 3500/-PM and the particulars given above that the PDA has not revised pension of the individual correctly w.e.f. 01.07.2009. The correct entitlement of the individual is as under:</p>

Q:6<strong> In most of the cases neither the pensioner has applied to the PDA for revision of their pension nor any Corr PPO or instructions have been received by the PDA from the PSA. Please supply the proforma of application in this regard?</strong></div>
<div></div>
<div>A: It has been clearly mentioned in the orders that the revision of pension by PDAs has to be made with reference to Pension Tables annexed to the orders. No further authorization from the PSA or any application from the affected pensioner is required to carry out the revision.</p>
<p>Q:7 <strong>The tables annexed to circular No 501 &amp; Circular No. 502 start from QS of 15 years onwards. How to revise the pension of a pensioner having less than 15 years if qualifying years?</strong><br />
A: Following elements of pension / type of pension are to be revised by PSA.</p>
<p>Special Pension<br />
Invalid pension<br />
Service element of disability pension in respect of PBOR discharged with less than 15 years qualifying service<br />
Service pension of TA personnel irrespective of their QS service and<br />
Service element of War Injury Pension and Liberalized Disability Pension</p>
<p>Q:8 <strong>Mr. ‘X’ who is a Hony Nb Sub, Gp ‘D’ pensioner having total QS of 24 years is already drawing a basic pension of 7750/- PM. However as per table – 4 (Army) annexued to Cir No 501, his basic pension w.e.f. 24.9.12 should be 7601/- PM. Please advise how to regulate such cases.</strong><br />
A: The existing pension of the pensioner in such cases might have been revised by PCDA (P) by issuing Corr PPO (s) based on some courts orders etc. No action by PDA is required in such cases.</p>
<p>Q:9<strong> Mr ‘X’ is a DSC pensioner in receipt of two pensions, one for regular Army service, and another for DSC service. Are both these pensions to be revised by PDAs?</strong><br />
A: The pension for regular Army service will only be revised under these orders by the PDA. A reference for revision of pension for DSC service will be sent to PCDA (P).</p>
<p>Q:10<strong> The tables annexed to Circular No 501, in respect of DSC pensioner seem to be incomplete e.g. the table in respect of Sep of DSC are only up to QS of 23 years. How to revise pension of a sep of DSC who has total QS of 24 years or above?</strong><br />
A: Sepoy in DSC have maximum engagement period up to 20 years only with the exception that the maximum term of engagement can be up to 23 years in case of pensioner retired on or 30.5.98. Hence QS in such type of cases may be restricted to the maximum permissible and pension revised accordingly. Period-wise complete list of maximum terms of engagement for JCOs/ORs is enclosed in Appendix-X to Cir No 501.</p>
<p>Q:11<strong> There is no table annexed to Cir No 502 to revise Ordinary Family Pension for NOKs of DSC Personnel. Please advise how to revise such cases ?</strong><br />
A: The family pension in respect of DSC personnel who are in receipt of family pension for only DSC service are to be revised at the same rates as given for family pensioners of Regular Army. DSC personnel on “clerical duty” and “other duty” are entitled for family pension of regular Army personnel of group “Y” and “Z” respectively.</p>
<p>Q:12<strong> What are the basic fields/data required to revise pension under these order?</strong><br />
A: The basic fields/data required to revise pension under these orders are as follows:</p>
<p>Type of <a href="http://centralgovernmentnews.com/category/pension/">pension </a>viz Retiring pension/service pension/ Ordinary Family Pension/ Special Family Pension/ War 1. Injury Pension/ Dependant Pension<br />
2. Rank of the pensioner<br />
3. Group of the pensioner (only for JCOs / PBORs)<br />
4. Qualifying service (without weightage)<br />
5. Record Office<br />
6. Date of commencement<br />
7. Date of <a href="http://centralgovernmentnews.com/category/retirement-age/">Retirement</a></p>
<p>Q :13 <strong>How to look for the above information in the PPO or related record ?</strong><br />
A: In case of Post -86 retires all the information is generally available in the original PPO of the Pensioner. In cases where the required information is not available in the PPO or other record of the PDA, the missing information may be called for from the PSA concerned.</p>
<p>Q:14 <strong>In case of Pre-86 retires Qualifying service is generally not available in the PPO of the pensioner. Pl. advise the way out to regulate such cases.</strong><br />
A: The qualifying service in such type of cases can be looked for in the original Descriptive Roll of the pensioner or in the Corrigendum PPO(s). Original discharge book/certificate issued to the pensioner by the Record office is also an authentic source of such information.</p>
<p>Q: 15<strong> Is capturing of information about Record office financially importance or can be done away with?</strong><br />
A: Following are the 4 major categories of JCOs/PBORs based on Record office.</p>
<p>Naval Record Office<br />
Air Force Record Office<br />
DSC Cannanore Record Office<br />
All other Record offices except those mentioned above.</p>
<p>Different tables are available to cater to these categories and hence the importance of information about Record Office can’t be done away with.</p>

<p>As per existing practice Audit Report for counting of former service in respect of Defence Civilian Employees covered under old pension scheme is being rendered by the Office of the PCDA (P) Allahabad. However, consequent upon introduction of New pension scheme w.e.f. 01-01-2004, this office has stopped rendering audit report for counting of former service in r/o employees covered under New pension scheme. Now, it has been decided that this office will continue to Render Audit report to those employees who are covered under New Pension scheme till finalization of NPS Rules.</p>
<p>2.Therefore it is advised to forward affected cases as well as returned cases to render Audit Report.</p>

<p>Reference: This office Important Circulars No. 57 bearing no. GI/C/0198/VOL-I/Tech dated 17-09-2008, 62 bearing no. GI/C/0198/VOI-II/Tech dated 12-11-2008 and Circular no. 96 bearing no. GI/C/0198/VOL-IV/Tech dated 04-12-2012.</p>
<p>Attention of all pension disbursing authorities is invited to above cited circulars wherein instructions had been issued for implementation of GOI, Ministry of P,PG and pensions, Deptt of P&amp;PW OM No. 38/37/08-P&amp;PW(A,) dated 01 September 2008 and that Ministry OM.No. 1/3/2011-P&amp;PW (E) dated 25-05-2012. Now, GOI, Ministry of P,PG and pension, Dept of P&amp;PW have further issued orders under their OM No. 38/37/08 P&amp;PW (A) dated 28-01-2013, a copy of which is enclosed for immediate implementation.</p>
<p>2. According to current orders, pension of pre-2006 pensioners as revised w.e.f. 01- 01-2006 in terms of para 4.1 or para 4.2 of the OM dated 01-09-2008 as amended from time to time would be further stepped up to 50% of the sum of minimum of pay in pay band and the grade pay corresponding to the pre- revised pay scale from which the pensioner had retired, as arrived at with reference to the fitment tables annexed to the Min of Fin, Deptt of Expenditure OM No. 1/1/2008 &#8211; IC dated 30-08-2008. In case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above referred OM dated 30-08-2008 of Ministry of Finance, Department of Expenditure.</p>
<p>3. The normal family pension of pre-2006 pensioners as revised w.e.f. 01-01-2006 in terms of para 4.1 or para 4.2 of the OM dated 01-09-2008 as amended from time to time would be further stepped up to 30% of the sum of minimum of pay in pay band and the grade pay corresponding to the pre- revised pay scale from which the Government servant had retired, as arrived at with reference to the fitment tables annexed to the Min of Fin, Deptt of Expenditure OM No. 1/1/2008 &#8211; IC dated 30-08-2008. In case of HAG and above scales, this will be 50% of the minimum of the pay in the revised pay scale arrived at with reference to the fitment tables annexed to the above referred OM dated 30-08-2008 of Ministry of Finance, Department of Expenditure.</p>
<p>4. A revised concordance table ( Annexure ) of the pre &#8211; 1996, pre-2006 and post 2006 pay scales/pay bands indicating the pension/family pension (at ordinary rates) payable under the above provisions is enclosed to facilitate payment of revised pension/family pension.</p>
<p>5. The pension so arrived at in accordance with para 2 above and indicated in col.9 of Annexure will be reduced/prorata where the pensioner had less than the maximum required service ( 33 years ) for full pension and in no case it will be less than Rs. 3500/- p.m.</p>
<p>6. Further, it has also been decided that:-</p>
<p>(i) In case of Govt. servants who died while in service before 01-01-2006 and in respect of whom enhanced family pension is applicable from. 24-09-2012 the enhanced family pension will be stepped up to 50% of the sum of minimum of pay in the pay band and the grade pay corresponding to the pre-revised pay scale in which the Govt. servant had died, as arrived at with reference to the fitment table annexed to the Fin of Finance OM dated 30-08-2008 &amp; in case of HAG and above scales this will be 50% of the minimum of the pay in revised pay scale arrived at with reference to the fitment table annexed to the OM dated 30-08-2008.</p>
<p>(ii) In the case of a pensioner who retired before 01-01-2006 and in respect of whom enhanced family pension is applicable from the date of approval by the Government, i.e. 24-09-2012, the enhanced family pension will be stepped up to the amount of pension as 2 revised in terms of para 2 read with para 5 above. In case the pensioner has died before 24-09-2012, the pension will be revised notionally in terms of para 2 read with para 5 above. The amount of revised enhanced family pension will, however, not be less than the amount of family pension at ordinary rates as revised in terms of Para 3 above.</p>
<p>7. In case the pension consolidated pension/family pension/enhanced family pension calculated as per Para 4.1 of OM No. 38/37/08-P&amp;PW (A) dated 01-09-2008 is higher than the pension/family pension calculated in the manner indicated above, the same ( higher consolidated pension/family pension ) will continue to be treated as basic pension/family pension.</p>
<p>8. These orders will take effect from 24-09-2012. There will be no change in the amount of revised pension/family pension paid during the period 01-01-2006 and 23-09- 2012, and, therefore, no arrears will be payable on account of these orders for that period.</p>
<p>9. All pension disbursing authorities are therefore, requested to revise the pension/family pension in affected cases in terms of Govt. OM dated 28-01-2013. Payment made w.e.f. 24-09-2012 will be adjusted against the arrears now being paid and these cases may be reflected in the monthly account sent to this office as &#8216;change item&#8217;.</p>
<p>10. Where the PDAs are in doubt in regulating the payment of revised pension/family pension under these orders, the cases with full details of pensioner/family pensioners and PPO No: etc may be referred to Audit Section of this office for advice and further action.</p>

<p>A copy of GOl, MOD letter No.1 (2)/2012/D (Pen/Pol), dated 15 May 2012 is enclosed for information and further necessary action.</p>
<p>2. It has been clarified by GOI, MOD that in the case deceased Armed Forces Personnel is not survived by a widow/widower or child, the dependent parents become directly eligible to receive family Pension. In case where a deceased Armed Forces Personnel is survived by a widow / widower or child and position changes subsequently because of death or remarriage of the spouse and / or death or ineligibility of child /children including disabled child, the dependent parents become eligible for Family Pension. However in terms of this Ministry’s letter No.17(4)/2008(2)/D (Pen/Pol) dated 12.11.2008, a childless widow subject to dependency criteria is entitled to the Family Pension even after remarriage. In such an event, the parents of the deceased Armed Force Personnel become entitled to the Family Pension only after the childless widow dies or when her independent income from all sources becomes equal to or higher than prescribed dependency criteria under the rule.</p>
<p>3. In view of the above you are requested to verify your records and initiate Ordinary Family Pension claims of the affected personnel as per the provision of above Government letter to G-4 Section of this office supported with Sheet Roll,OFP claim and income certificate.</p>
