Subject: Regarding deletion of note of conditional sanction printed in PPOs of Pre-01.01.2006 retirees Havildar granted Hony Rank of Naib Subedar in compliance of Honbie High Courts and AFTs orders.

In compliance of various court orders, conditional sanctions were being issued by AG/P5-4 (Pen/Legal), IHQ (Mob), New beihi in respect of Pre-01.01.2006 retiree Havildars granted Hony rank of Naib Subedar for implementing Gol, Mob letter dated 12.06,2009 in their cases. Accordingly, corrigendum PPOs were/are being issued notifying their pension w.e.f. 01.01.2006 @ Rs. 8450/- for Group “X” and ( Rs. 7750/- for Group .Y and “Z as per the provisions of ibid Mob letter by this office. These Corrigendum PPOs have a Note containing that condition as “The sanction will, however, be subject to the final outcome of appeal, if any filed before the Hon’ble Supreme Court of India. In the event, the appeal is decided in favour of liaI, the petitioners shall be liable to refund the entire amount paid to him under the ibid sanction”.

Of late, it has been observed that large number of such cases of pre 01.01.2006 retiree Hcivildar granted Hony rank of Naib Subedar for grant of pension in terms of Gol, Mob letter dated 12.06.2009 were decided by the various Courts/AFTS. Now, AG/PS- 4 (Pen/Legal), IHQ of Mob, New beihi has started converting conditional sanction into absolute sanction by deleting the ibid contents as printed in Note of Corrigendum PPO of these cases. Large number of such type of sanctions for deleting conditional sanction are being received in this office from Record Offices concerned for issuing Corr. PPO for deleting that Note of conditional sanction in respect of pre-01.01.2006 retiree Havildar granted Hony rank of Naib Subedar.
2. As large number of Corr. PPOs are to be issued in such cases without any financial bearing or other changes, as such, it has been decided by the competent authority that the note The sanction will, however, be subject to the final outcome of appeal, if any filed before the Hon’ble Supreme Court of India. In the event, the appeal is decided in favour of UoI, the petitioners shall be liable to refund the entire amount paid to him under the ibid sanction” as printed in the respective PPO of those pre-01.01.2000 retirees Havildars granted Hony rank of Naib Subedar issued in compliance of the Court/AFT orders. may be treated as deleted.
3. It is further reiterated that deletion of ibid note will be applicable only where Service Pension w.e.f. 01.01.2006 @ Rs. 8450/- for Group X and @ Rs. 7750/- for Group and Group Z were notified in compliance of various Courts/AFTS orders in respect of Pre-01.01.2006 retiree Havildar granted Hony rank of Naib Subedar and not in other cases.

Subject: Amendment of GOI, MOD letter No.1(2)/2016-D(Pen/Pol) dated 30.09.2016 and revision of pension of Pre-2006 pensioners (JCOs/ORs and Commissioned Officers) delinking of qualifying service of 33 years for revised pension.

Copy of GoI, MoD letters No.1(2)/2016-D(Pen/Pol) dated 11.10.2017 and 22.12.2017 are forwarded herewith for further necessary action at your end.

2. Minimum guaranteed pension table for all the ranks of Defence Forces Personnel for service pension and family pension have been issued vide GoI, MoD letter No.1(2)/2016-D(Pen/Pol) dated 30.09.2016 (Circular No.568 dated 13.10.206).

3. Consequent upon issue of GoI, MoD letter dated 11.1.0.2017 following amendments are made in GoI, MoD letter No.12(2)/2016-D(Pen/Pol) dated 30.09.2016:

Further, it has also been decided by the competent authority that rates of service pension and family pension in respect of NCs (E) of Army and Air Force will also to be revised in terms of GoI, MoD letter dated 22.12.2017 as the rates of service pension and family pension in respect of NCs (E) of Army and Air Force have not been provided in GoI, MoD letter dated 30.09.2016. Therefore, AnnexureB (Army) and Annexure-C (Air Force) are amended as follows:-

 (i) Following note is inserted below Annexure-B (Army)

Note:- Rates of pension indicated in Annexure-B (Army) is also applicable for the revision of pension in respect of NCs (E) of Army as per rates applicable for Sepoy Group “Z”.

(ii) Following rates of pension may be included in Annexure-C (Air Force) :

Sub:- Counting of former AF Service (Army/Navy/AF) towards Civil Services – Clarification regarding…

On the introduction of New Pension Scheme, counting of Former Service was stopped. GOI, DP&PW vide their 0M No.P&PW 0M N028/30/2004- P&PW (B) dated 26 July, 2005 followed by 0M dated 28.10.2009 allowed counting of Former Service for such employees only who have been mobilized after submitting technical resignation for new appointment in the new Ministry/ Department/ Central Autonomous bodies subject to fulfillment of other prescribed condition.

2. The subject matter was referred for clarification as to whether benefits of counting of former service as per Rule 19 of the CCS (Pension) Rules 1972 is allowed to those reemployed Ex-Servicemen who have been appointed to civil establishment on or after 01.012004 on the issuance of GOI DP&PW vide their 0M No. P&PW 0M No-28/30/2004- P&PW (B) dated 26 July, 2005 followed by 0M dated 28.1Allahabad

3. In this regard competent authority has issued following clarifications:-

i. Vide Rule 2 of the CCS(Pension) Rules 1972 are not applicable to those who have been appointed to civil establishment on or after 01.01.2004 i.e. benefits of Rule 19 of the CCS(Pension) Rules 1972 are also not available to those appointed to civil establishment on or after 01.01.2004.

ii. DP&PVV vide their 0M No 28/30/2004-P&PVV (B) dt. 26.012005 followed by 28.10.2009 had allowed counting of former service for those employees only who have been mobilized after submitting technical resignation for new appointment in the new Ministry / Department/ Central Autonomous Bodies subject to fulfillment of other conditions i.e. unless and until Armed Forces Personnel had joined new service after rendering technical resignation for joining the new post, he/she shall not be covered under Deptt of P&PW 0M No. 28/30/2004 P&PW (B) dt. 28.10.2009.

3. Therefore, it is requested that all similarly placed cases may be regulated accordingly. Cases where benefits of Rule 19 of the CCS(Pension) Rules 1972 have been given to those appointed to a civil establishment on or after may be reviewed de-novo and necessary action may be taken in each case in consultation with Pay Controllers.

4. In view of the foregoing, you also are requested to issue suitable instructions (along with copy of this circular) to all the Head of Offices under your administrative control to ensure that claim on the subject matter henceforth are floated in accordance with clarification given in above Para.

Subject: Special benefits in cases of death & disability in service : Revision of Disability Pension / Family Pension of Pre-2006 disability Pensioners/ Family Pensioners regarding.

Reference: This office Important Circulars No. 142 dt. 11.06.15 and C-150 dt.10.5.16.

Attention is invited to above cited circulars wherein instructions had been issued for implementation of GOI, Ministry of P,PG and pensions, Deptt of P&PW OM No.45/03/2008  P&PW(F) dated 20th November,2014. As per Para III(a), IV(a) and Para V(a) of ibid OM, the Service Element of disability pension of pre-2006 disability pensioners was linked to qualifying service for earning full pension.

2. Now, GOI, Ministry of P,PG and pension, Dept of P&PW have further issued orders under their OM No. 45/03/2008-P&PW(F) dated 8th August, 2016, that in terms of GOI OM No.38/37/2008-P&PW (A) dated 06.04.2016 the revised consolidated pension of pre-2006 pensioners shall not be lower than 50% of the minimum of the pay in the Pay Band and grade pay (wherever applicable) corresponding to the pre-revised pay scale as per the fitment table without pro-rata reduction of pension even if they has qualifying service of less than 33 years at the time of retirement. This provision would be equally applicable for computing service element of revised disability pension being drawn by pre-2006 disability pensioners. Accordingly, the provision linking the service element of disability pension under Para III(a), IV(a) and V(a) of this Department’s OM of even no. dated 20th November 2014 stands deleted. The arrears of revised disability pension would be payable with effect from 1.1.2006.

3. In order to implement the instruction contained in the above said Govt. letters, HOOs are required to review/identify the cased where Disability Pension /Family Pension have been notified in terms of CCS (EOP) Rules and forward the same with details i.e. PPO Nos., Current PDA details, Pay scale under IV & V CPC and address of Payee to this office for revision in terms of OM of even no. dated 20.11.2014, OM No. dt. 29.04.2016 and read with 8.08.2016.

4. It is therefore, requested that suitable instruction along with copy of this circular may be issued to all the Head of Offices under your administrative control for initiating action in this regard.

Circular No. 184

Sub: Issue of Pension Slip to Defence Pensioners/family pensioners.

Attention is drawn to RBI letter No. DGBA.GAD. N o. H-10975/45.05.031/2006-07 dated January 9, 2007 instructing all the agencies banks to issue pension slip to all the Armed Forces Personnel/Defence Civilian Pensioners including family pensioners at the commencement of pension and thereafter whenever there is a change in the quantum of pension. RBI’s above instruction was also forwarded by this office to all banks vide this office circular N o. 128 dt. 13.07.2007.

Besides above, whenever any circular was issued by this office after 6th CPC implementation, Pension Disbursing Agencies were requested to send intimation regarding disbursement of revised pension to this office in the format prescribed with the circular concerned. Pension Disbursing Agencies were simultaneously requested to provide invariably a copy of the said format to the pensioner concerned. A brief details of circulars issued and format prescribed for intimation of revision to be carried out by PDA to this office as well as pensioners is given below.

However, it has been brought to the notice of this office that Pension Disbursing Agencies are not providing the details of revised pension/family pension to the pensioners/family pensioners. Thereby due to lack of knowledge pensioners are not sure about correctness of the amount of the arrears being paid to them and most of them have a sense of suspicion against the revision.

To overcome above suspicion, it is requested that an explanatory sheet as per the enclosed format may be provided to all defence pensioners/family pensioners invariably.

Latest official details of Defence Pensioners – PCDA released

Profile of Defence Pensioners as on April 2015

As on 01.04.2015 the Defence Accounts Department is servicing 24.61 lakhs pensioners, spread across the country.

The category wise details of pensioners is as under:

On an average 45,000 Defence Forces personnel and Defence civilians retire every year and become part of pensioners’ strength. While working out the data‐base of pensioners as on a given date, average wastages out of the pensioners’ data base are worked out to arrive at the number of Defence pensioners on a particular date.

The Defence pensioners are spread over the length and breadth of the country. The major pockets having concentration of Defence pensioners are states of Himachal Pradesh, Haryana, Punjab, Uttar Pradesh, Bihar, Maharashtra, Tamil Nadu and Kerala among others.

The Zone/State wise details of pensioners is enclosed in the accompanying Annexure – ‘A’.

Further, around 4.60 lakhs pensioners drawing pension from 63 Defence Pension Disbursement offices, which are also mapped in the accompanying Annexure – ‘B’.

Pre-2006 retirees get pension relief

Finally, after many twists and turns, it has arrived! In a relief to lakhs of pre-2006 retirees of the armed forces and central government, their pension has been revised with effect from January 1, 2006, rather than from September 24, 2012.

The department of pension and pensioners’ welfare (DoPPW) issued the universal orders regarding this revision on Thursday. Anomalies in the fixation of the pension of the pre-2006 central government retirees had come to light after the implementation of the recommendations of the sixth Pay Commission. The issue was whether pension was to be calculated based on the minimum of pay for each rank/grade within the newly introduced bands or on the minimum of the pay-band itself.

The Central Administrative Tribunal (CAT) and Armed Forces Tribunal (AFT) then corrected it and ruled that the pension would be calculated on the basis of the minimum of pay for each rank/grade within a particular band, which gives the retirees a higher pension.
