<p>Kind attention is invited to the correspondence cited above on NFIR&#8217;s PNM item No. 12/2016 pending with the Railway Board. Though the subject was discussed with the Railway Board (ED/PC-I) in the special meeting held on 04/06/2019 and Official Side conveyed that the matter was under consideration, unfortunately the issue has not yet been settled.</p>

<p>Federation further desires to convey to the Railway Board that pursuant to Railway Board&#8217;s instructions revising the designations of various erstwhile Group &#8216;D&#8217; Staff (RBE No. 201/2018 dated 27/12/2018), the following categories of staff working in the Railway Hospitals have been excluded from the payment of HPCA/PCA.</p>



<p><strong>1) Hamals, GP 1800 and 2) Peon Assistants, GP 1800 now revised as Hospital Attendant.</strong></p>



<p>In this connection, NFIR desires to state that the staff of above categories working in the Railway Hospitals also undertake various jobs and come into contact with the patients, therefore they should also be covered for payment of Hospital Patient Care Allowance / Patient Care Allowance.</p>



<p>NFIR, therefore, request the Railway Board again to review and issue instructions to the Zonal Railways etc., soon covering all the remaining categories of staff working in the Railway Hospitals for the purpose of payment of Hospital Patient Care Allowance / Patient Care Allowance as has been allowed to the staff of categories working in the Central Government Hospitals.</p>

<p>Kind attention of Railway Board is invited to NFIR&#8217;s PNM agenda item No. 1212016 and the correspondence cited under reference.</p>
<p>In this connection, Railway Board vide letter dated 1310912018 conveyed to the Federation that a Committee had been constituted to find out if any other category of staff working in Railway Hospitals Hlealth Units is eligible for HPCA/PCA and the recommendations of the Committee are being processed for further necessary action. Consequently, NFIR vide its letter dated 1910912018 requested the Railway Board to make available a copy of the recommendations of the Committee to facilitate the Federation to go through the same and make appropriate suggestions. A period of more than three months passed, copy of the Committee&#8217;s report has not been made available to the Federation.</p>
<p>NFIR, therefore, once again requests the Railway Board to please provide a copy of the recommendations of the Committee early for Federation&#8217;s perusal for discussing further, with the Board.</p>

<p>Consequent upon the decision taken by the Central Government Employees&#8217; Welfare Co-Ordination Committee, Kolkata, vide letter No.C.G.E.W.C.C./Kol/Holiday/2018-19/669 dated 10/10/2018, Main Office including Railway Section of the Principal Controller of Accounts ( Fys), Kolkata &amp; RTC (ER) and the Accounts Offices under CFA(Fys) BGF will observe 17(seventeen) Compulsory holidays as in Annexure &#8211; A and 2 (two) Restricted Holidays from the list of 34(Thirty Four) Restricted holidays as in Annexure &#8211; B for the calendar year 2019. The date of Holidays for the Muslim Festivals may be changed on sighting of the Moon and decision to be taken by the CGEWCC, Kolkata based on the decision of the State Government in respect of ldu&#8217;l Fitr, ldu&#8217;l Zoha [Id-Uz-Zuha (Bakrid )], Muharram and Id-e-Milad.</p>

<p>Subject : <strong>Modification of pay-slip of Industrial employees under OFB- regarding.</strong></p>
<p>Reference : This office earlier circular no dated 25/09/2017 and further 16/10/2017.</p>
<p>Consequent on implementation of 7th CPC OFB had invited proposal from all SGMs/GMs as well as PCA (Fys) on modifications of pay-slips of IEs in OFB. On receiving feedback from different Gp controllers, the suggestions were forwarded to Wage Package Team, Ishapore for incorporation in the Wage Package. The updated format of wage package has been accepted by OFB and some further modifications for incorporation of Aadhaar No, Bank Account No, Date of Retirement (copy enclosed) has now been sought in the Wage Package by OFB.</p>
<p>It is therefore, requested to kindly look into it and offer your valuable suggestions/proposals in consultation with Br. Accounts Offices under your jurisdiction for onward submission to OFB.</p>

<p>Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:-</p>
<p>(a) whether his Ministry has finalised draft rules regarding minimum standards for clinical laboratories, framed under Clinical Establishments Act, 2010, if so, the details thereof;</p>
<p>(b) whether his Ministry is aware that presently most of the work of clinical and research laboratories of even prestigious department i.e. ICMR and Central Government Hospitals is performed and supervised by professionally qualified and technically competent BSc, MSc, PhD medical laboratory professional in lab sciences who are not MBBS/MD, if so, the details thereof;</p>
<p>(c) whether the cadre review of medical laboratory staff approved earlier has not been implemented in complete manner so far and most of issues like pay fixation, DPC, MACP, revision of recruitment rules, filling of vacant promotional posts are still pending, if so, the details thereof and the reasons therefor;</p>
<p>(d) whether his Ministry has not issued any order till date regarding grant of Patient Care Allowance/Hospital Patient Care Allowance (PCA/HPCA) to health employees as per the accepted recommendations of Seventh Central Pay Commission and if so, the details thereof and the reasons therefor; and</p>
<p>(e) whether his Ministry has also approved the short term certificate courses/ programmes which are neither formal degree nor diploma in allied health sciences and run under the aegis of Ministry of Skill Development and are very contrary to the core curricula designed by his Ministry in terms of course content and duration of courses etc., if so, the reaction of the Government thereto?</p>
<p><span style="text-decoration: underline;"><strong>ANSWER</strong></span></p>
<p>THE MINISTER OF STATE IN THE MINISTRY OF HEALTH AND FAMILY WELFARE (SMT. ANUPRIYA PATEL)</p>
<p>(a): Yes. The draft notification to amend the Clinical Establishments (Central Government) Rules, 2012 regarding minimum standards of medical diagnostic laboratories is available on the website of Clinical Establishment Act &lt;clinicalestablishments.gov.in&gt;.</p>
<p>(b): As per the information received from ICMR most of the work of clinical and research laboratories is performed and supervised by professionally qualified and technically competent technical staff and Scientists having B.Sc, M.Sc, Ph.D and MBBS, MD qualification.</p>
<p>As far as Central Government hospitals in Delhi viz. Safdarjung Hospital and Lady Hardinge Medical College &amp; Associated Hospitals are concerned, all the diagnostic work is performed and supervised by professionally qualified and technically competent MBBD/MD professionals.</p>
<p>(c): The cadre of the Medical Laboratory Staff of Central Government Hospitals in Delhi namely Safdarjung, Dr. RML and Lady Hardinge Medical College &amp; Associated Hospitals has already been restructured and implemented by giving benefits of 7th Central Pay Commission.</p>
<p>(d): The order containing condition for payment of HPCA/PCA after implementation of Seventh Central Pay Commission has not been issued so far. The matter is under consideration in this Ministry in consultation with Ministry of Finance.</p>
<p>(e): This Ministry has developed a course curricula for short term skill training. The National Skill Qualification Framework (NSQF) level of the skill development curricula is kept lower than the level of Diploma and Degree in core allied health courses developed by this Ministry. A skilled worker will only reach the higher levels after acquiring adequate qualification (either Diploma or Degree) through an accredited institute/university. There are no contradictions in the short term courses as compared to the core curricula developed by the Ministry.</p>

<p>Sub:- <b>Revision of the rates of Hospital Patient Care Allowance (HPCA) and Patient Care Allowance (PCA) to Railway employees working in Railway Hospitals and Health Units/Clinics-regarding.</b></p>
<p>Hospital Patient Care Allowance (HPCA)/Patient Care Allowance (PCA) was introduced on the Railways in terms of Board’s letter No.E(P&amp;A)II-98/HW-6, dt. 09.01.2008 (RBE No.1/2008). Subsequently, on implementation of 6th CPC recommendations, the rates of HPCA/PCA have been revised vide Board’s letter No.E(P&amp;A)II-2013/AL-3, dt. 20.02.2013 (RBE No.15/2013) and dt. 14.07.2014 (RBE No.74/2014).</p>
<p>2. Consequent upon the decision taken by the Government of India on the recommendations of the 7th CPC, the President is pleased to decide that Hospital Patient Care Allowance (HPCA)/Patient Care Allowance (PCA) shall be admissible only to existing eligible Group &#8216;C&#8217; and &#8216;D&#8217; (Non-Ministerial) Railway employees as per R1H3 of the newly proposed Risk and Hardship Matrix ( Rs.4100 for level 8 and below and Rs.5300 for level 9 and above).</p>
<p>3. The revised rates of HPCA/PCA shall be admissible with effect from the 1st of July, 2017.</p>
<p>4. The other terms and conditions regarding admissibility of HPCA/PCA as contained in Board’s letter dt. 09.01.2008 (RBE No.1/2008) and subsequent letters in this regard will remain in force.</p>
<p>5. These orders would be subject to any modification after issue of instructions by the Nodal Ministry i.e. Ministry of Health &amp; Family Welfare.</p>
<p>6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p><strong>Subject: Night Duty Allowance (NDA) &#8211; Clarification regarding Fixation of ceiling of pay for entitlement.</strong></p>
<p><strong>Ref. : CGDA UO No. AT/11/2366/NDANol-X dated 22.01.2016 and last reminder dated 13.12.2016</strong></p>
<p>In compliance of Hon. CAT, Jodhpur Bench Order dated 5 Nov 2009, MoD issued letter dated 8th May 2015 to provide that the payment of Night Duty Allowance (NDA) shall be made on the basis of the current pay of the employees who are deployed for performing the duty during the night hours. Accordingly, Principal Controller of Accounts (PCA)(Fys), Kolkata issued letter dated 29.05.2015 to define the new formula for computation of NDA. This formula provides that the amount of NDA shall be computed by taking employee&#8217;s current Band Pay &amp; Grade Pay plus DA divided by 195 (i.e. total working hours in a month). In this manner, the Hon&#8217;ble CAT order, as upheld by Hon&#8217;ble High Court/Supreme Court stands implemented in letter &amp; spirit.</p>
<p>2. Subsequently, PCA (Fys) Kolkata issued letter dated,9 Sep 2015 to prescribe the pay ceiling corresponding to Rs. 2200 per month (specified in terms of DoPT OM dated 4 Oct 1989) to determine entitlement of staff for night duty. However, the corresponding pay so prescribed was not accepted by the OFB Administration.</p>
<p>As per OFB&#8217;s calculations, the current pay corresponding to Rs.2200 is not only different, but there is wide disparity in both the figures. OFB has stated that they cannot accept this unilateral decision of PCA(Fys) because the calculations are incorrect. Besides, this has led to industrial unrest at all Ordnance Factories.</p>
<p>The staff side members have expressed displeasure and have threatened to stop Night duty at all Ordnance Factories. OFB Admn apprehends serious loss of production and have requested MoD to examine the issue and intimate corresponding pay of Rs.2200 so that the employees could be detailed accordingly for performing duty at night hours. Likewise, CGDA has also sought clarification from MoD on the same issue.</p>
<p>3. The matter was examined in MoD in consultation with MoD(Fin) and DoPT. DoPT stated that the calculations made by both PCA (Fys) and OFB are incorrect and prescribed a different formula to compute the current pay corresponding to Rs.2200 per month that existed during 1989. Both PCA(Fys) and OFB have rejected this formula for being cumbersome and unworkable.</p>
<p>This office also supports their views because using this formula entails tedious calculations of pay of each employee ever since their date of joining service, running into decades. In a nutshell, attempts to find out the current pay equivalent to Rs.2200 pm have not been fruitful in spite of consultations with DoPT and MoD(Fin), and the stalemate on the issue continues across all the defence establishments, leading to confusion and possible loss of productivity.</p>
<p>4. On further consideration, it has been observed that the DOPT OM No. 12012/4/86-Estt.(Allowances) dt. 04.10.1989 on the subject of NDA lays down following condition to determine the entitlement for NDA:</p>
<p><strong> (Clause a) &#8211; The ceiling of pay for entitlement of NDA shall be Rs. 2200/- p.m.</strong></p>
<p><strong>(Clause b)- There will however be no ceiling for entitlement of NDA in respect of officials who are, at present, getting this benefit as per existing criteria.</strong></p>
<p><strong>5.Clause (a)</strong></p>
<p>The pay ceiling of Rs. 2200 per month mentioned in the DoPT in their OM dated 4 Oct 1989, was prescribed more than 25 years ago. During the intervening period, two Pay Commissions have come into force which have altered the pay structure of the employees drastically. In spite of an altogether different landscape of the pay structure, the DoPT did not come up with any revised order to amend the provisions of their OM dated 4 Oct 1989 relevant to the current pay structure. In the absence of clear guidelines, the management of Defence Establishments resorted to adhoc measures to keep their organisations running during the night hours in the intervening period. Proposals sent by MoD to DoP&amp;T at various stages in the light of various judicial pronouncements, were rejected, sometimes on the grounds that the DoPT orders are not applicable to industrial employees.</p>
<p>In the current phase, the efforts being made by the defence authorities to adhere to the prescribed pay limit have proved to be frustrating because of the practical difficulties being faced by both Accounting Authorities and the Defence Estts who, due to tedious and lengthy calculations, have not been able to reach a consensus to determine the level of staff who can be deployed for performing the night duty. In the current scenario, where  the pay ceiling of Rs.2200 prn. is obsolete and meaningless, and the DoPT have  avoided prescribing a realistic ceiling that would be relevant to the current pay  structure of the Government employees, it is left upon MoD to find a solution. Even though MoD proposes to take up the matter with DoPT again for prescribing a pay ceiling based on the current pay structure, it is however felt that the decision thereon shall have reflection over the future cases only and is not likely to resolve the current cases.</p>
<p><strong>6. Clause (b)</strong></p>
<p>The provision in the DoPT OM dated 4 Oct 1989 (highlighted above in para 4) permits entitlement of NDA without any ceiling in respect of officials &#8220;who were getting this benefit (at that time) as per existing criteria&#8221;. In view of the fact that the pay ceiling prescribed in clause (a) is of no relevance today, it has become necessary to resolve the imbroglio by resorting to the second provision given in this OM &#8211; named as clause (b). It has been decided that till such time the new pay parameters based on the current pay structure to determine the entitlement for NDA are prescribed by the nodal Ministry, OFB/Field Offices/Defence Establishments are allowed to determine the entitlement of their employees for the purpose of NDA in terms of this clause in the DoPT OM dated 04.10.1989 that provides that<strong> there shall  be no ceiling for entitlement of NDA in respect of such officials who were getting this  benefit at that point of time</strong> as per extant criteria. So as to give a formal and concrete shape to this, the OFB and other Defence Establishments are being advised to issue a one-time office order, specifying in definite terms, the designations/ categories/levels of non-gazetted employees (Industrial and Non Industrial) who were getting this benefit of NDA in accordance with extant instructions i.e. DoPT OM dated 4 Oct 1989, so as to ensure their seamless deployment at night shifts and payment of NDA based on current pay.</p>
<p>7. CGDA is, therefore, requested to issue necessary directions to their lower formations to deal with the cases of payment of NDA accordingly.</p>

Reference: HQrs Office Important Circulars Xo.AX/XVIII/1/18001/GH dated 21.11.200 and AN/XIV/14153/III/HRA/CCA/Vol.-X dated 18.03.2011</p>
<p>Comprehensive guidelines have been issued on the subject vide HQrs Office Important Circular dated 21.11.2000, to regulate the stay of officials at Guest Houses/transit accommodations. Further, HQrs Office Circular dated 18.03.2011 clearly stipulates that those occupying Government accommodation are not eligible for HRA and that the officers staying in the Inspection Quarters/Bungalow etc. in the Headquarters of their posting will not be entitled to draw HRA for the penod during which they stay in the Inspection Quarters/Bungalow etc.</p>
<p>2. Despite this, HQrs office is in receipt of reference from PCDA/CDA asking for clarification on the subject matter.</p>
<p>3. It is therefore, reiterated that those residing in Government accommodation be it Inspection Quarter or Transit Facility or Guest House shall not be granted HRA as stipulated vide GOI, Ministry of Communications, in consultation with Ministry of Finance, vide their letter No.14-4/85-NB dated 26.11.1985. Action may be taken accordingly.</p>

<p>On perusal of the report of EDs Committee constituted to examine the feasibility for payment of Hospital Patient Care Allowance/Patient Care Allowance (PCA) to the Kitchen Staff working in the Railway Hospitals/Health Units, the Federation finds that the following vital points have been ignored by the Committee while finalizing its recommendations:</p>
<p>• Railway Board vide letter No. E(P&amp;A) II-98/HW-6 dated 09/01/2008 issued orders for payment of Hospital Patient Care Allowance (HPCA). Patient Care Allowance (PCA) to the Group ‘C’ &amp; ‘D’ staff working in Railway Hospitals/Health Units/Clinics with effect from 01/01/2008 pursuant to the directives issued by the Ministry of Health &amp; Family Welfare vide OM No. Z. 28015/24/2001-H dated 4th February 2004 duly removing ambiguity in this regard.</p>
<p>• The Principal Bench/CAT, New Delhi vide order dated 21st February 2014, while deciding OA No. 974/2013, has also relied on Railway Board’s circular dated 09/01/2008 and directed to pay HPCA/PCA to the Kitchen Staff working in the Railway Hospitals/Health Units/Clinics i.e. form 01/01/2008.</p>
<p>• Railway Board have issued orders granting HPCA/PCA to a few more categories such as Physiotherapist, Pharmacist working in the Railway Hospitals/Health Units/Clinics and these staff have been paid the HPCA/PCA w.e.f. 01/01/2008.</p>
<p>The Kithchen staff working in the Northern Railway Central Hospital are disappointed consequent upon issuance of unjustified order by the Railway Board for payment of HPCA/PCA from prospective date i.e. 02/06/2016 instead from 01/01/2008. A copy of representation dated 08/11/2016 received by the Federation from the Kitchen Staff of Northern Railway, Central Hospital is enclosed for reference as the representationists have been rightly demanding payment of HPCA/PCA from 01/01/2008.</p>
<p>NFIR, therefore, requests the Railway Board to re-consider the matter and issue instructions for allowing payment of HPCA/PCA to all Kitchen Staff working in Railway Hospitals/Health Units/Clinics w.e.f. 01/01/2008.</p>
<p>The issue will be discussed in NFIR&#8217;s PNM meeting to be held with the Railway Board on 22nd/23rd December 2016.</p>

<p>We the following staff working the Kitchen of Northern Railway Central Hospital are thankful to the Railway Board for issuing orders for payment of Hospital Patient Care Allowance/Patient Care Allowance vide Railway Board&#8217;s orders dated 02/06/2016, pursuant to the demand raised vide NFIR&#8217;s PNM Item No. 12/2016. We are however, constrained to bring to your kind notice that our case has not been dealt with on merit and the payment of HPCA/PCA has been made w.e.f. 02/06/2016 only which is not justified.</p>
<p><strong>In this connection, we place below following facts for the kind consideration and passing further orders in this case:</strong></p>
<p>• That pursuant to the directives issued by the Ministry of Health &amp; Family Welfare, Railway Board vide letter No. E(P&amp;A)II-98/HW-6 dated 09/01/2008 issued order for payment of HPCA/PCA to the categories of Group &#8216;C&#8217; &amp; &#8216;D&#8217; staff working in the Railway Hospitals and Health Units/Clinics w.e.f 01/01/2008.</p>
<p>• Subsequently, some more categories of staff working in Railway Hospitals/Health Units/Clinics like Physiotherapist, Pharmacist etc., were added by the Railway Board who have also been paid HPCA/PCA w.e.f 01/01/2008.</p>
<p>• We are disappointed to note that in our case justice has not been awarded because payment of HPCA/PCA has been ordered only with effect from 02/02/2016, though our categories have been included vide Board&#8217;s order dated 02/06/2016.</p>
<p>The points mentioned above clearly established that the orders issued vide Board&#8217;s letter dated 02/06/2016 are discriminatory and do not impart justice to us.</p>
<p>We, therefore, request your kind honour to kindly consider our case for payment of Hospital Patient Care Allowance/Patient Care Allowance (HPCA/PCA) to us w.e.f. 01/01/2008, similar to other categories of staff receiving the Allowance since 01/01/2008 and remove discrimination.</p>
