Sub : Revised rate of stipend to Trade Apprentices

A copy of Ministry of Labour & Employment, Directorate General of Employment and Training, Gazette Notification dated 27-09-2013 issued under GSR 662(E), received under Ordnance Factory Board, Kolkata letter No. 13/06/2013/TA/STIP-A/HRD dated 06-11-2013 is forwarded herewith for information and guidance of all concerned.

The rates of stipend of Trade Apprentices have been revised as follows:

i) During first year of training – Rs.2100/- per month

ii) During second year of training – Rs.2400/- per month

iii) During third year of training – Rs.2800/- per month

iv) During fourth year of training – Rs. 3100/- per month

The monthly stipend to the trade apprentices may be paid accordingly with effect from 27-09-2013.

All Branch Accounts Offices under your administration may please be informed accordingly.

Subject : Entitlement of LTC in Ordnance Factories

It has come to the notice that some local Accounts Offices are not allowing LTC to travel by air from their place of posting (or nearest airport) to a city in the NER to the MCMs who are Non-Gazetted Group ‘B’ officers working in Ordnance Factories.

In this connection Government of India, Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training, Estt(A)Section, New Delhi OM No.31011/4/2007-Estt.(A) dated 14.05.2008 regarding clarification of entitlement of travel air to visit NER and order dated 09.04.2009 alongwith OFB, Kolkata Note : A/I(ID No.01/CR/A/I/Vol.III/658/LTC dated 08.11.2013) regarding classification of the posts of MCM with reference to Grade Pay are forwarded herewith for information and necessary action of all conerned. As OFB Note is specific on a particular post, i.e., MCM, it is directed to treat MCM posts as Group ‘B’ for all purposes including LTC and CGEGIS.

It is, therefore, requested to take necessary action accordingly. The same may please be circulated to all Brach Accounts Offices under your jurisdiction.

CGDA Orders regarding the subject of ‘Home Town LTC to the employees whose headquarter and home town and within the same district’.

The below order said that Home Town LTC may be admitted to the employee whose headquarter and home town are within the same district provided they do not come within the purview of same station as has been defined under SR 116 of FRSR Part 11 TA Rules.

This department has already issued an order regarding the subject of ‘LTC entitlement of fresh recruits’ on 12.02.2013 vide AN/XIV/14162/TA/DA/LTC/VoI.II , In this order, ‘Fresh recruits would be entitled to All India LTC only in the fourth occasion i.e in the fourth year of a block irrespective of whether their home town and HQrs are same or different’.

Subject : Home Town LTC to employees whose headquarter and home town and within the same district.

The matter regarding admittance of Home Town LTC to employees whose headquarters and home town within the same district, are under examination at HQr’s office.

2. After taking into consideration of views and opinion of different Controllers, the matter has been examined at this HQr’s office and the undersigned has been directed to inform Home Town LTC may be admitted to employees whose HQr’s and Home Town are within the same district provided they do not come within the purview of same station as has been defined under SR 116 of FRSR Part-II TA Rules.

4. All LTC Claims may be regulated accordingly.

Sub :- Fixation of pay in the revised pay structure in the case of the persons promoted as SO(A) and AAO during the period from 1.1.2006 to 29.8.2008 and  opt for fixation of pay from the date of their promotion after 1.1.2006.

Ref: Your office letter No.115/AN-Pay/V/6th CPC/III dated 09.04.2013.

With reference to your office letter under reference, it may be intimated that Ministry of Finance (Deptt. Of Expenditure) has informed that a petition has been filed by the IA&AD in the Jaipur Bench of the CAT seeking restoration of the benefit of fixation of pay under FR 22 (1) (a) (1) in case of promotion from SO (A) to AAO during 1.1.2006 to 29.8.2008 in the pre-revised scale of Rs. 7500 – 12,000/- .

Therefore, any decision in this regard can be taken only after hearing the outcome of the above case, since any ruling in favour of the petitioners my have a bearing on the principle of pay fixation allowed by the office of the C&AG.

Subject: Stepping up of pay of the senior with reference to the revised pay of juniors applicability of Notes 7 & 10 below Rule 7 (1) of CCS (RP) Rules, 2008.

Several references have been received from some of the Factories as well as Br. AOs seeking clarification for stepping up of pay to the senior Fireman at par with their juniors appointed on or after 1.1.2006 in terms of Ministry of Defence I D No.11(4)/2008/D (Civ-I) dtd 06-05-2011.

The matter was taken up with the OFB for preparation of common seniority list in respect of Firemen grade to fulfill one of the conditions stated in the ibid MOD order.

The OFB after repeated reminders has intimated that the seniority of the Fireman grade in OF Organisation is maintained locally at the Factory Level. The Staff Side has also agreed in the JCM Level-III to continue present system of maintaining seniority of the Fireman grade at the Factory level as the these employees are not susceptible to transfer from one Factory to another Factory.

The availability of element of Direct Recruitment, the other condition stated in the above MOD order 6.5.2011, has been provided in the SRO-32 of 4.5.2012.

Keeping in the view of the above, this office is of opinion that the benefit of steeping up may be extended to the senior Firemen in those factories where a junior Fireman appointed on or after 1.1.2006 is actually drawing higher pay than his senior provided the senior and the junior belongs to the same seniority list maintained in the concerned Fy. The benefit will not be admissible in the grade of Leading Fireman as in that grade the element of direct recruitment is not available.
