<p>Subject:- <strong>Implementation of Govt. decision on the recommendation of the Cabinet Secretary&#8217;s Committee &#8211; Revision of pension in respect of Personnel below Officer Rank (PBOR) discharged prior to 01.01.2006.</strong></p>
<p>Reference:- <strong>Circular No. 430 dated 10.03.2010</strong>.</p>
<p>Complaints/representations are being received in PSAs regarding revision of pension w.e.f. 01.07.2009 by various PDAs in respect of three trades of Air Force viz. ACH GO, Catering Assistant and MT Driver in Group Z instead of Group Y inspite of up gradation of these trades w.e.f. 10.10.1997.</p>
<p>2. Now, it has been decided by the competent authority vide MoD letter no. 1(4)/2012/D(Pension/Policy) dated 08.03.2018 that revision of pension of under mentioned trades be carried out as per pension revision tables meant for Group Y under Ministry&#8217;s letter no. PC 10(1)/2009-D(Pen/Pol) dated 08.03.2010.</p>

<p>3. In view of above, it is requested that such type of cases where PDAs are unable to revise pension due to change of group of trades, the same may be referred to the PSAs concerned through Record Office (who in turn will provide certificate/document showing trade of individual at the time of entry and also at the time of discharge) so that Carr. PPO, if necessary, may be issued in case to case basis.</p>
<p>4. All other terms and conditions shall remain unchanged.</p>
<p>5. The above amendments shall take effect from date of implementation of their respective orders. Arrears in affected cases shall be released by the Pension Disbursing Agencies.</p>
<p>6. This circular has been uploaded on this office website www.pcdapension .nic.in for dissemination across the all concerned.</p>

<div>Sub: &#8211; <strong>Non payment of Dearness Relief on Disability Element While on Re Employment.</strong></div>
<div></div>
<div>The payment of dearness relief during re-employment / employment / permanently absorption of pensioners / family pensioners under the Central or State Government or in a Statutory Corporation / Company / Body / Bank under them in India or abroad is not being regulated correctly by various Pension Disbursing Authorities. Where some Pension Disbursing Authorities are disallowing dearness relief to re-employed pensioner of commissioned officer on disability element, others are allowing in few cases.</div>
<div></div>
<div>Similar irregularities have been noticed in case of pensioners of PBOR. The instances of not allowing dearness relief to family pensioners during their employment are also drawing attention of this office/Ministry from time to time. The position on the subject is though clearly stipulated in Ministry of Personnel, Public Grievances &amp; Pensions. Deptt of P&amp;PW letter No. 45/73/97-P&amp;PW(G) dt. 2nd July, 1999 and Ministry of Defence letter No. 79(1 )/95/D (Pen/Services) dated 2th August 2000 and Deptt of P&amp;PW UO No. 41/42/2007-P&amp;PW(G) dt. 3-4-2008. However, position is re-clarified as under for uniform implementation of above orders.</div>
<div></div>
<div>(a) In case of re-employed pensioners who hold Group &#8216;A’ post or posts of the ranks of commissioned officers at the time of their re-employment will not he entitled to any dearness relief on pension on the fact that:</div>
<div></div>
<blockquote>
<div>(i) A certain portion of pension is taken into account and is not entirely ignored.</div>
<div></div>
<div>(ii) The pay in the post of re-employment is not required to he fixed at the minimum of the scale in all cases, and</div>
<div></div>
<div>(iii) Dearness allowance at the rates applicable from time to time is also admissible on the pay fixed on re-employment.</div>
</blockquote>
<div></div>
<div>(b)</div>
<blockquote>
<div>(i) The entire pension admissible is to be ignored in the case of civilian pensioner who held posts below Group &#8216;A’ and those ex-servicemen who held posts below the ranks of commissioned officers, at the time of their retirement. Their pay on re-employment is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such civilian pensioners will consequently be entitled to dearness relief on their pension at the rates applicable from time to time.</div>
<div></div>
<div>(ii) The ex-servicemen (PBOR) who retired before attaining the age of 55 years and re-employed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given, the pay should he treated as fixed at a minimum only for the purpose of ignoring the entire pension and allowing dearness relief on pension.</div>
</blockquote>
<div></div>
<div>(c) The disability element is part of disability pension. therefore position explained at a &amp; h above will also apply for regulating dearness relief on disability element during re-employment of pensioner drawing disability</div>
<div>pension.</div>
<div></div>
<div>(d) The family pension received by the eligible central Govt. employees/Armed Forces pensioners is, in any case, not taken into account in determining their pay on employment therefore, dearness relief at the rates applicable from time to time shall he admissible on their family pension.</div>
<div></div>
<div>Incorrect payment of pension is not only infringement of Govt. orders but also cause of concern to pensioners. It is, therefore, requested o instruct Pension Paying Branches / CPPC / Offices / Treasuries under your jurisdictions to regulate the payment of dearness relief on pension /family pension on re-employment / employment / permanently absorption of pensioners/family pensioners as explained above.</div>

<div>This information was stated by the Minister of State in the Ministry of Defence Shri.Jitendra Singh in written reply to a question by Shri.Prakash Keshav Javadkar in the Rajya Sabha on 5.12.2012.</div>
<div></div>
<div>Government has always been sensitive to the demand of One Rank One Pension. Keeping in view the spirit of the demand, several Commissions / Committees were appointed. Though the demand was not accepted, their recommendations resulted in improving the pension of past pensioners.</div>
<div></div>
<div>A Committee was set up under the Chairmanship of the Cabinet Secretary in June, 2009. The Committee went into the demand and other related issues. It made seven recommendations aimed at narrowing the gap between earlier and current pensions. This has benefited about 12 lakh retired PBORs / Officers at an annual cost of Rs.2200/- crores approximately.</div>
<div></div>
<div>Government constituted another Committee in July, 2012, headed by Cabinet Secretary for looking into the pay and pension related issues of relevance to Defence service personnel and Ex-servicemen. The Committee submitted its report. Its recommendations have been accepted by the Government and are in the process of implementation.</div>
<div></div>
<div>Substantial improvements have been made in the pensions of Armed Forces Personnel after 01.01.2006. However, improvement of pensionary benefits is an ongoing process.</div>

<p>Subject: <strong>Implementation of the Government decision on the recommendations of the Sixth Central Pay Commission &#8211; Pension of Personnel Below Officer Rank (PBOR) discharged from service on or after 1.1.2006.</strong><br />
Sir,<br />
This Ministry’s letter No. 17(4)/08(2)/D(Pen/Policy) dated 18.08.2010 is amended as follows :-</p>
<p>Following may be inserted as Note below Para 3(v) &#8211;</p>
<p>&#8220;Note &#8211; The provisions of this letter are not applicable to JCOs granted honorary Commission as Lieutenant and Captain. Service Pension for these ranks should continue to be determined in terms of Para 6.2 of this Ministry letter No. 17(4)/2008(2)/D(Pen/Policy) dated 12.11.2008.”<br />
2. All other entries remain unchanged.<br />
3. This issues with the concurrence of the Finance Division of this Ministry vide their UO No. 31(1)2008/Fin/Pen, dated 12.09.2012.<br />

<div>1. The ‘One Rank One Pension’ issue has been raised before both the V and VI pay commissions.</div>
<div></div>
<div>2. The issue is about the considerable disparity in pension between pensioners that retired pre 1996, between 1996-2006 and post 2006.</div>
<div></div>
<div>3. The tying up of pensions with the last drawn pay is applied universally to both civilian and defence personnel.</div>
<div></div>
<div>4. Since the pay scales were revised by the V and VI pay commissions, the tie up with the last drawn pay had widened the disparity in pensions (as referred in the note)</div>
<div></div>
<p>5. But for the senior officers in both the Officers cadre (e.g. Lt. General) and PBOR (Personnel Below Officers Rank) cadre (e.g.  Honorary Captain), the pensions are based on rank and not on the last drawn pay.</p>
<div></div>
<div>6. The V pay commission, in 1996, has recommended parity in pension between pre and post 1986 pensioners. This was a follow up to the KP Singh Deo report in 1984 and a One Time Increase in 1992 towards bringing parity in pensions.  But the V pay commission’s recommendations on the pension of ‘post 1996’ retirees, was still tied to the last drawn pay.</div>

<div>7. The V pay commission has also made provisions for neutralization of price rise.</div>

<div>8. The VI pay commission has given a ‘fitment benefit’ to all retired employees, both civilian and defense, to partially compensate for the disparities in the pre 2006 and post 2006 retirees.</div>

<div>9. Also in order to compensate for the reduced employment of defence personnel period a ‘year weightage’ is included in calculation of benefits.</div>
<div></div>
<div>10. Due to the widening disparity, the note asks for pay to be not tied to the last drawn pay but to the rank thereby making all future increases applicable to existing pensioners also.</div>
<div></div>
<div>11. It is a highly emotive issue, since the soldiers retain their titles post retirement and the financial benefits accruing to them is determined by the retirement date.</div>
<div></div>
<div>12. Fiscal outlay for implementing the ‘One Rank One Pension’ is going to be modest &#8212; only in the order of Rs.1500 crores.</div>
<div></div>
<div>Considering the fact that the soldiers serve the best years of their lives in defense of the country in life threatening environments and retiring early, the ‘One Rank One Pension’ demand deserves to be implemented in an expedient way to honor our soldiers. A future BJP-led government, if elected, will implement this demand without any delay.</div>

<p>Ex-servicemen with service less than 15 years are not entitled to pension as it is a mandatory requirement for a Personnel Below Officer Rank to render 15 years and for Commissioned Officers 20 years qualifying service to earn pension. Minimum qualifying service is an essential criterion for pension in the Government.</p>
<p>The Short Service Commissioned Officers who are not pensioners are eligible for certain schemes of DGR like Training, Security Agencies and other self-employment schemes. Ex-Defence personnel with more than 5 years of service are entitled to CSD canteen facilities available in units / establishment apart from being employed as security guards. Some grants out of RakshaMantri Discretionary Funds is also provided to non-pensioners upto the rank of Havaldar.</p>
<p>This information was given by Minister of State for Defence Dr MM PallamRajuin a written reply to Shri Gopal Singh Shekhawatin Lok Sabha today.</p>
