<p><strong>Reg: Staff &#8211; Payment of Bonus &#8211; As per Bonus (Amendment), Act 2015. For the Year 2016-17.</strong></p>
<p>Payment of Bonus Act was amended recently. As per the amended provisions the ceiling on salary and wage has been increased from Rs.10000/- to Rs.21000/- per month. As such, employees whose salary/wage does not exceed Rs.21000/- per month are now eligible for bonus.</p>
<p>It has been decided to pay Bonus at the rate of 8.33% of salary to all the eligible employees for the period 01.04.2016 to 31.03.2017.</p>
<p>Salary for this purpose includes 1) Basic pay (including FPP &amp; PQP) 2) Special Pay 3) Dearness Allowance 4) Special Allowance with DA only.</p>
<p>All the branches / offices may note to disburse the Bonus to all the eligible employees as per the procedure given here under:</p>
<p>Tentative list of eligible employees together with Bonus Calculation as per the data extracted from HRMS shall be provided to all Zones.</p>
<p>Zonal Offices should get the data verified and confirm the correctness of eligibility and amount of Bonus paid and payable.</p>
<p>For any modifications required to be undertaken in the list, Zonal Office should submit the details to HO with suitable justification</p>
<p>On receipt of the &#8220;Branch-wise difference and addition of Bonus payable details &#8211; as per the format given in Annexure-IV&#8221; from the Zonal offices, the Bonus Amount will be credited to the &#8220;Cheque Proceeds Account&#8221; of the Zonal Office for onward distribution to branches.</p>
<p>Branches should enter details of Bonus paid in the Bonus Register for verification by the Labour Department Officials.</p>
<p>The entire exercise of verification of calculation and Payment of Bonus to eligible employees should be completed by 25.09.2017.</p>
<p>For the information of our branches/offices, the important guidelines and illustrations are given in Annexure-I, II and III</p>
<p>All the salary disbursing authorities are advised to go through the contents of this circular carefully and adhere to the stipulations mentioned without any deviation.</p>

<p>Defence circular on increase of bonus to guards based on the Payment of Bonus (Amendment) Bill, 2015</p>
<p><b>ADVISORY ON BONUS</b></p>
<p>The Payment of Bonus (Amendment) Bill, 2015 notified : Increase in the Eligibility Limit under clause (13) of Section 2 and Calculation Ceiling under Section 12 of the Payment of Bonus Act 2015</p>
<p>1. The Payment of Bonus (Amendment) Bill, 2015 was passed by the Parliament in the just concluded Winter Session of the Parliament. The Payment of Bonus (Amendment) Act, 2015 has been published in the Gazette of India, Extraordinary on 1st January, 2016 as Act No.6 of 2016. The provisions of the Payment of Bonus (Amendment) Act, 2015 shall be deemed to have come into force on the 1st day of April, 2014.</p>
<p>2. The Payment of Bonus (Amendment) Act, 2015 envisages enhancement of eligibility limit under section 2(13) from Rs.10,000/- per month of Rs. 21,000/- per month and Calculation Ceiling under section 12 from Rs.3500 to Rs.7,000 or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher. The Payment of Bonus (Amendment) Act, 2015 also mandates previous publication of draft subordinate legislations, framed under the enabling provisions under the said Act, in the Official Gazette for inviting objections and suggestions before their final notification.</p>
<p>3. The Government has been receiving representations from trade unions for removal of all ceilings under the Payment of Bonus Act, 1965. It is also one of the demands made by them during the country-wide General Strike held in February, 2013 and September, 2015. As the last revision in these two ceilings were made in the year 2007 and was made effective from the 1st April, 2006, it was decided the Government to make appropriate amendments to the Payment of Bonus Act, 1965.</p>
<p>4. These changes in the Payment of Bonus Act, 1965 will be benefit thousands of work force.</p>

<p><strong>LS passes Bonus Bill; benefits to accrue from April 2014</strong></p>
<p>The Lok Sabha on Tuesday passed a bill allowing doubling of wage ceiling for calculating bonus to Rs 7,000 per month for factory workers with establishments with 20 or more workers, with the benefits being applicable retrospectively from April 2014.</p>
<p>The Payment of Bonus (Amendment) Bill, 2015, was passed by a voice vote, with some members objecting to the raising of eligibility limit for payment of bonus from a salary of Rs 10,000 per month to Rs 21,000.</p>
<p>Replying to a debate on the legislation, Labour Minister Bandaru Dattatreya said the Government has ensured that the interest of workers are protected and there is no infringement on their justifys.</p>
<p>“Because of Bihar Elections this bill got delayed… The Prime Minister spoke to me and asked why should the benefits of this Act should accrue to workers from 2015. It should be made available from the April 2014,” he said while moving an official amendment to the Bill.</p>
<p>The official amendment provides that the benefits of the Act would be deemed to have come into force on April 1, 2014, instead of April 1, 2015.</p>
<p>Dattatreya said the Ministry has held 21 tripartite meetings with all central trade unions while arriving at a decision.</p>
<p>The Bill provides for enhancing monthly bonus calculation ceiling to Rs 7,000 per month from the existing Rs 3,500.</p>
<p>It also seeks to enhance the eligibility limit for payment of bonus from Rs 10,000 per month to Rs 21,000 per month.</p>
<p>“The Government’s paramount intention is to safeguard the interest of workers… There is no infringement of workers’ justifys and whatever the government does will be in the interest of workers,” Dattatreya said.</p>
<p>After the bill was passed, Deputy Speaker M Thambidurai, who was in the Chair, said the government should be congratulated for bringing the measure as also for effecting the benefits retrospectively.</p>

<p>With only 3 sittings left next week for the current Winter session of Parliament and hardly any legislative business transacted in Rajya Sabha so far, the All Party meeting convened by the Chairman of Rajya Sabha on Friday this week raised the prospects of passage of some of the pending Bills in the Upper House during the remainder of this session.</p>
<p>&nbsp;</p>
<p>A total of 18 Bills for which the Business Advisory Committee of Rajya Sabha has allotted a total of 43.50 hours for discussion is on the unfinished agenda of the House. Of these, the House is likely to take up The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Bill, 2015, The Arbitration and Conciliation (Amendment) Bill,2015, The Atomic Energy (Amendment) Bill,2015, The Appropriation Bills pertaining to Supplementary Demands for Grants (General) for 2015-16 and Excess Demands for Grants (General) for 2012-13, all passed by the Lok Sabha during this session and The Whistle Blower Protection (Amendment) Bill,2015, The Juvenile Justice (Care and Protection of Children) Amendment Bill,2015, as passed by the Lok Sabha earlier and The Child Labour (Protection and Regulation) Amendment Bill,2012, on which the Standing Committee presented its Report in December,2013.</p>
<p>&nbsp;</p>
<p>Rajya Sabha is also likely to discuss next week the role of Governor of Arunachal Pradesh as agreed to by the Government at the All Party Meeting besides growing intolerance endangering the unity and diversity of the country and prices of essential commodities and food grains.</p>
<p>&nbsp;</p>
<p>Lok Sabha during next week will take up The Payment of Bonus (Amendment) Bill,2015 and The National Waterways (Amendment) Bill,2015 for which discussion time of 2 and 3 hours respectively has been allotted.</p>
<p>&nbsp;</p>
<p>Besides, the Lower House will take up short duration discussion on the situation in Nepal and the State of Indo-Nepal relations and resume discussion on Sustainable Development Goals, which was part discussed during the last session.</p>

<p>Work done during Winter session so far During the current Winter session that commenced on November 26th, 12 Bills have been passed by Lok Sabha while 6 new Bills have been introduced.</p>

<p>Bills Passed were : The Carriage by Air (Amendment) Bill,2015, The Bureau of Indian Standards Bill,2015, The High Court and the Supreme Court Judges (salaries and Conditions of Service) Amendment Bill,2015, The Indian Trustees(Amendment) Bill,2015, The Industries (Development and Regulation) Amendment Bill,2015, The Negotiable Instruments (Amendment) Bill,2015, The Atomic Energy (Amendment) Bill,2015, Discussion and Voting on Supplementary Demands and Excess Demands for Grants and the related Appropriation Bills, The Sugar Cess (Amendment) Bill,2015, The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts (Amendment) Bill,2015 and The Arbitration and Conciliation (Amendment) Bill,2015.</p>
<p>&nbsp;</p>
<p>All the 6 new Bills introduced relating to arbitration and conciliation, commercial jurisdiction of High Courts, atomic energy, payment of bonus to workers, industries and sugar cess were passed by the Lok Sabha.</p>
<p>Lower House held two day special discussion on commitment to the Constitution the occasion of 125th Birth anniversary of Dr.BR Ambedkar besides taking up issues of intolerance, floods in Tamil Nadu and Andhra Pradesh, drought situation in the country and price rise.</p>
<p>&nbsp;</p>
<p>Three suo-moto statements were made in the house by the concerned ministers regarding the visit of External Affairs Minister to Islamabad, initiatives relating to road transport and highways for regional connectivity with focus on North-East and climate change.</p>
<p>&nbsp;</p>
<p>On the other hand, Rajya Sabha passed only Bill pertaining to Negotiable instruments while no new Bills were introduced in the House during the ongoing winter session so far.</p>

<p>The Upper House discussed commitment to the Constitution, floods in Tamil Nadu and Andhra Pradesh and Indo-Nepal relations. External Affairs Minister made a suo-moto statement on her visit to Islamabad.</p>

<p>Sub: <strong>Revision of Ceiling for payment of Bonus in the Bonus Act 1965</strong></p>
<blockquote><p>The Payment of Bonus Act 1965 was amended in the year 2007. This Act was called as Payment of Bonus (Amendment) Act, 2007.</p></blockquote>
<p>In Section 12 of the Principal Act(1965), payment of minimum bonus was revised from Rs.2500 to Rs.3500 w.e.f. 1st April, 2006 through Payment of Bonus(Amendment) Ordinance 2007(8 of 2007) and subsequently passed by the Parliament through Bill No.89/2007. The same was incorporated in the PLB Orders issued for payment of PLB for the year 2006-07 and 2007-08(RBE No.142/2008).</p>
<p>The Ministry of Railways was requested several times by the All India Railwaymen’s Federation for approaching the Government of India for amendment to Section 12 of the Bonus Act 1965 to remove the ceiling of Rs.3500, mentioned in the Section 12 of the Payment of Bonus(Amendment) Act, 2007. But so far Ministry of Railways has not approached the Government of India to amend the Act to pay real wages to the Railwaymen as PLB, which is causing lot of hardship to the Railway Workers due to high escalation of prices of all commodities after the enactment of the amendment to the Bonus Act 1965 in the year 2007.</p>
<p>You are, therefore, requested to consider the plea made by the All India Railwaymen’s Federation and approach the Ministry of Labour, Government of India to amend Section 12 of the Bonus Act, duly removing the ceiling, mentioned in Section 12 of the Payment of Bonus(Amendment ) Act, 2007 so as to enable the Railways to pay real wages as PLB.</p>
<p>As Pooja Festival is approaching fast and orders for payment of Productivity Linked Bonus to Railway employees are likely to be issued shortly, you are requested to approach Hon’ble Minister for Labour to propose an amendment to Section 12 of the Payment of Bonus(Amendment) Act, 2007 to remove the ceiling so as to enable the Railwaymen to get real wages as Bonus.</p>

<p>Sub:- <strong>Payment of Productivity Linked Bonus to Railway employees for the year 2012- 13—reg.</strong></p>
<p>The Railway Board are aware that due to the continued initiatives of both the Federations involving all categories of employees, the efficiency of the Indian Railways has been improving from year to year. It is worth-mentioning that over three decades, not a single man day was lost and this has been possible due to the matured approach on the part of the two major railwaymen’s Federations.</p>
<p>2. Last year, the railway employees have been paid PL Bonus equivalent to 78 days wages with notional calculation at Rs. 3500/- p.m. On comparison with the performance of the year 2011- 12, the Indian Railways have achieved still better results during the year 2012-13 with the freight traffic exceeding one Billion Tonnes, and emerging as 4th best Railways in the World. Due to the dedication of railway employees, the Operating Ratio of 88.8% could be achieved during the year 2012-13.</p>
<p>3. The Federations are however shocked to note that the PL Bonus days are proposed to be reduced in the name of “Capital Weightage and modified Staff Strength”. This news has spread to the different corners of Indian Railways, consequently disappointment and anger is growing among rank and file of the Railway employees. In fact, Railway employees are expecting more bonus this time than the previous year in view of good results achieved during the year 2012-13.</p>
<p>4. During discussions with the Railway Board (CRB, FC &amp; MS) on 16th September, 2013 the leaders of the two Federations (AIRF and NFIR) have conveyed the hurt feelings of workers on the proposed reduction of PL Bonus and urged upon the Board to take note of the serious field situation, It was also made clear that the Federations are not in a position to accept any reduction in PLB days.</p>
<p>5. It is also relevant to mention that the PL Bonus Scheme was evolved in the year 1979 for providing substantial motivation to the workforce towards achieving higher production by way of increased output and improved quality of service. The railwaymen/women have given best account of themselves during the year 2012-13, consequently the freight performance was highest ever and equally the Operating Ratio was good. In view of this, the Railway employees cannot afford to accept any reduction in the PL Bonus days. They, in fact, expect more Bonus this time.</p>
<p>6. We, therefore, appeal that Railway Ministry should take initiative for ensuring payment of PL Bonus more than the previous year in order to create motivation among the Railway employees.</p>
<p>The infirmities in the present calculation formula are required to be reviewed through negotiations later on and for reaching consensus, the Federations will participate in the discussions with open- mindedness.</p>
<p>Summing up, the Federations trust that the Railway Ministry would solve the matter satisfactorily for preserving the decades long industrial peace and preventing agitation in the Railways.</p>
