<h3 class="wp-block-heading">Sub: <strong>Upgradation of pay structure of certain cadres under RBE No. 155/2022 dated 17.11.2022.</strong></h3>



<p>Please refer to Board’s letter No. PC-VII/2019/RSRP/3 dated 17.11.2022 (RBE No. 155/2022) regarding upgradation of pay structure of certain Group ‘C’ cadres of Ministry of Railways as per the guidelines mentioned therein.</p>



<p>2. Vide Annexure-II (Point 2) of letter RBE No. 155/2022, it has been stipulated that in Phase-I of the implementation, on the cutoff date, 50% posts of the cadre strength of Level -7 (PB-2/GP-4600) is to be upgraded from Level-7 (PB-2/GP-4600) to Level-8 (PB-2/GP-4800) and in the Phase &#8211; II, further upgradation of the 50% of these posts in Level-8 (PB-2/GP-4800) to Level-9 (PB-2/GP-5400) on non-functional basis after 4 years of service in Level-8 (PB-2/GP-4800).</p>



<p>3. Now, in consultation with Ministry of Finance and with the approval of Competent Authority, it has been decided that percentage and mode of upgradation in Phase-II is to be modified to the extent that after completion of 4 years’ service in Level 8, all incumbents in Level 8 are to be upgraded to Level-9 on non-functional basis. The upgradation from Level-8 to Level-9 is non-functional in nature and the same is to be done for incumbents and not for the posts.</p>

<h3 class="wp-block-heading">Sub: Clarification regarding upgradation of pay structure of certain cadres &#8211; reg.</h3>



<p>Vide Board’s letter RBE No. 155/2022 dated 17.11.2022, orders for upgrading the pay scales of 46 Group ‘C’ categories of certain departments were issued.</p>



<p>2. Subsequently queries have been received from various field units regarding modalities to be followed while implementing the aforesaid orders. The queries have been examined in consultation with concerned directorates of Railway Board and clarified as under:-</p>

As such, the upgraded posts may be classified as Non selection and may be filled up on the basis of seniority, scrutiny of service records and Confidential Reports, without holding any written tests and / or viva voce. The extant instructions issued by Establishment Directorate in this regard may please be referred.</td></tr><tr><td>(ii)</td><td>Whether Vigilance/D&amp;A clearance will be applicable on upgradation in Level-8</td><td>The extant practice being followed for promotion in level-7 in respect of Vigilance/D&amp;A Clearance will be applicable for upgradation from Level-7 to Level-8 and Level-8 to Level-9 as per extant instructions</td></tr><tr><td>(iii)</td><td>Provision of Reservation</td><td>Reservation will apply as per extant rules.</td></tr><tr><td>(iv)</td><td>While determining the number of posts for the purpose of upgradation, the entire cadre strength of a category has to be taken into consideration or not.</td><td>Yes, while determining the number of posts for upgradation, the permanent regular cadre strength of that particular category in Level-7 (excluding surplus &amp; supernumerary posts) has to be taken into consideration.<br />As regards, counting of temporary posts for the purpose of determining the cadre strength, only those temporary posts which are in operation for at least three years may also be taken into account. This will be subject to certification that these posts are meant for regular activities which will continue and not for any sporadic requirements. These orders will not be applicable to ex-cadre work- charged posts which will continue to be based on worth. of charge.</td></tr><tr><td>(v)</td><td>The procedure to be adopted for future direct recruitment.</td><td>Since all the posts in three grades remain in Group ‘C’ and there is no change in designation, for the purpose of calculation of -vacancies for Direct Recruitment, the vacancies occurring in all three grades i.e. Level-7, Level-8, Level-9 (non-functional) will be taken altogether. However, Direct Recruitment will only be made in the grade of Level-7.</td></tr><tr><td>(vi)</td><td>Whether any minimum services required for upgradation to Level-8 which is being materialised w.e.f. 01.12.2022.</td><td>Minimum residency period as per extant rules as prescribed for promotion to non selection posts would be applicable for up gradation to Level-8. Further probationers will not be eligible for the benefit of up gradation.</td></tr><tr><td>(vii)</td><td>Whether any rounding off post is to be adopted while upgrading the number of post.</td><td>Only the whole number may be taken for the purpose of granting degradation. To illustrate further, if the cadre is of 675 posts, while granting the upgradation to 50% post the number comes to 337.5 posts. In this case the number of 337.5 may not be rounded off to 338 but the whole number of 337 may be taken into consideration for operating in the upgraded in the Level-8 and remaining 338 posts will be operated in Level-7.</td></tr><tr><td>(viii)</td><td>Whether rounding off has to be adopted while deciding the matching saving.</td><td>While calculating the matching savings, number of posts equivalent to the money value required, are required to be surrendered. To illustrate further, in case the number of posts is required to be surrendered is coming in fractions (for example 7.2), if it is decided to surrender only 7 posts, the equivalent money value can not be arrived at. Hence, the figure may be rounded off to 8 and the surplus value generated against surrender-of 8 posts may be transferred to the vacancy bank for future utilization.The illustration issued along with RBE No. 155/2022 stands modified to this extent.</td></tr><tr><td>(ix)</td><td>If number of posts equivalent to the money value are not available for surrender, whether upgradation can be granted</td><td>In this scenario, upgradation may be granted to the posts which are available for surrender. For granting the benefit of upgradation to the remaining posts, point 4(iv)(Annexure-II) under RBE No. 155/2022 may be referred to.</td></tr><tr><td>(x)</td><td>Inclusion of SSE Drawing/ Design etc. in Civil and Electrical in the list.</td><td>It has already been mentioned in the letter RBE No. 155/2022 that certain categories exist in certain Railways only. Hence the identically placed categories under the broad designation of SSE such as SSE(Drawing/Design) etc. in Level-7 under Engineering Departments are part of the upgradation as per RBE No. 155/2022.</td></tr><tr><td>(xi)</td><td>Inclusion of Commercial Inspectors and Sr. Wagon Movement Inspectors working in Level-7.</td><td>It has already been specified in the letter RBE No. 155/2022 that certain designations exist in certain Railways only. Since, categories of Commercial Supdt. and Traffic Inspector in Level-7 has already been granted the benefit, identically placed categories of Traffic/ Commercial departments in Level-7 are part of the upgradation as per RBE No. 155/2022.</td></tr><tr><td>(xii)</td><td>Whether upgradation to Level-8 and further to Level-9 (non-functional) in terms of Board’s instructions RBE No. 155/2022 are to be reckoned for the purpose of MACPS.</td><td>Yes. As every financial upgradation has to be counted and offset against the financial upgradation under MACPS in terms of extant instructions for regulation of MACPS.</td></tr></tbody></table></figure>



<p>3. This issues in consultation with Estt.(NG) and E(SCT) Directorate of Railway Board and with the approval of Competent Authority.</p>

<h3 class="wp-block-heading"><strong>Sub: – Upgradation of pay structure of certain cadres.</strong></h3>



<p>Consequent upon approval conveyed by Ministry of Finance vide their ID Note No. 36(1)/E.TI(B),2015 dated 01.11.2022, the President has now accorded his approval for upgrading the pay structure of certain Group ‘C’ cadres of Ministry of Railways detailed in the list enclosed as&nbsp;<strong>Annexure-I</strong>&nbsp;in following manner :-</p>



<ul class="wp-block-list">
<li>(i) Upgradation of 50% posts from <strong>Level-7</strong> (PB-2/GP-4600)/Group ‘C&#8217;* to <strong>Level-8</strong> (PB-2/GP-4800)/Group *C’.</li>



<li>(ii) Further upgradation of these 50% posts in&nbsp;<strong>Level-8</strong>&nbsp;(PB-2/GP-4800)/Group ‘C’ to&nbsp;<strong>Level-9</strong>&nbsp;(PB-2/GP-5400)/Group “C* on non-functional basis after 4 years of service in&nbsp;<strong>Level-8</strong>(PB-2/GP-4800).</li>
</ul>



<p>2. Modalities governing above upgradation are enclosed as <strong>Annexure-II</strong>.</p>

<h3 class="wp-block-heading">Sub: Upgradation of pay structure of certain cadres &#8211; Regarding case of Technical Supervisors / Rail Engineers.</h3>



<p>Ref : Railway Board’s letter No. PC-VII/20l9iRSRP/3 (RBE No.155/2022) dated 17.11.2022.</p>



<p>1.1) We thank Hon’ble Prime Minister, Minister for Finance and Minister for Railways for improving the promotional avenues of the Supervisory Staff on the Railways.</p>



<p>1.2) Your goodself, as the Minister For Railways, in your speech in the GMs Conference and briefing to the Media, on 16th November 2022, appreciated the role of Technical Supervisors cadre, described them as the back bone of the functioning of the Railways and said that they are stagnated since long and do not have any promotional avenues. Their promotion is restricted to one even after completion of 30 years of service and they are highly stagnated and do not reach the gazetted cadre. Your goodself said that the Hon’ble Prime Minister and Hon’ble Finance Minister issues orders to remove the stagnation and each stagnated engineer will get minimum monthly financial benefit of Rs 2500/- to 4000/- and will be able to reach Group ‘A; and ‘Group “B’ Levels.</p>



<p>1.3) But the Railway Board’s orders, issued vide their letter dated 17-11-2022 Reg. “upgradation of Pay Structure of certain cadres” for improving the promotional avenues of Supervisory staff on the Railways, fall much short of the above said announcement made by the Hon’ble Minister of the Railways as it provides only upgrading of 50% posts in Level 7 to Level 8 in Phase 1 and upgrading of 50% posts thereof from Level 8 to Level 9 as Non-Functional promotion after 4 years in Phase 2, without change of designation and without change of Classification from the existing one in Group ‘C’ phase-I w.e.f. 1-12-2022 and phase-II after four years.</p>



<p>1.4) The Railway Board’s order no RBE/155-2022 dated 17/11/2022 doesn’t reflect the spirit of Hon’ble Railway Minister’s wish as large number of senior Technical Supervisors will remain stagnated and will not get Group ‘B’ or Group ‘A’.</p>



<p>2. Hence, your kind attention is invited to the following points:-</p>



<p>2.1) That the Technical Supervisors /Senior Section Engineers (SSEs) on the Railways will be least benefitted by the said orders even though they are the most stagnated cadre on the Railways as mentioned by 7th CPC and as mentioned by the Minister for Railways himself in his speech in the Video conference with the GMs on 16.11.2022. This may please be remedied by upgrading substantially more posts of Senior Section Engineers (SSEs) to higher pay levels.</p>



<p>2.2) Majority of the SSEs are already placed in the Pay Level-8 &amp; 9 under the MACPS and as such will not get any benefit from the above orders.</p>



<p>2.3) Effect of upgradation in phase-I from 01.12.2022 won’t give any relief to existing stagnated SSEs.</p>



<p>2.4) A large number of SSEs are already working in Pay Level-8 under MACPS for the last many years but will not get any promotion related benefit of the said orders as they will have to wait for another 4 years from the date of effect of the said orders that is 1.12.2022 for getting non-functional promotion to Level 9.</p>



<p>2.5) Restricting further upgradation in phase-II, non-functional upgradation from Pay Level-8 to Level-9 after 4 years of service to 50% posts in Level-8, further narrows down the promotional avenues.</p>



<p>2.6) As per the said order, there will be no change in the nomenclature/designation and classification of the posts after upgradation and they will remain classified as Group ‘C’ which would be totally unjustified and against the existing orders of the Railway Board for Classification of Posts on the Railways.</p>



<p>2.7) Surrender of posts as per said orders of equivalent financial value will further downsize the technical departments and will affect the functioning. There are only a few SSEs who are in Level-7, since around 60% to 70% of SSEs are already placed in Level-8 &amp; Level-9 through financial upgradation under MACPS.</p>



<p>2.8) One of the important cadres of IT engineers working in Indian Railways is not covered in this order. Recommendations of Railway Board’s order No:ERB- I/2011/25/4 dated 14.07.2011 in para 6.v &amp; 6.vi that, existing posts of JE/IT in the Grade Pay of Rs.4200 and Senior Engineer/IT in the Grade Pay of Rs.4600 shall be placed in the Grade Pay of Rs.4600 &amp; Rs.4800 respectively in line with staffing pattern at Railway Board’s computer centre has not been considered.</p>



<p>2.9) Junior Engineers (JEs) working in four technical departments of Railways have been totally left out of the upgradation.</p>



<p>2.10) This order will not clear the stagnation of SSEs at GP Rs.4600 as recommended by 7th CPC in para 10.40.113.</p>



<p>2.11) Ministry of Railways in its proposal sent to Ministry of Finance after 6th CPC, O.M. No. PC VI/2009/DAC/1 (Pt2) dated 11.06.2010, has asked approval for 100% upgradation for JEs from GP Rs.4200 to Rs. 4600 and SSEs from Rs.4600 to Rs.4800.</p>



<p>3) Considering the above short comings in the order dated 17.11.2022, following suggestions may please be considered and accepted.</p>



<p>3.1) All posts of Senior Section Engineers (SSEs) in Level-7 may please be upgraded to Level-8 in all the Departments including Mechanical, Electrical, Engineering, S&amp;T and Drawing/Design etc..</p>



<p>3.2) All Posts of CMS in CMT Labs, CDMS in Stores and Senior Engineer (IT) may please be upgraded from Level 7 to Level 8.</p>



<p>3.3) Effect of upgradation in phase-I may be made from 01.01.2016, ie from the date of implementation of 7th CPC recommendations.</p>



<p>3.4) It is requested that the SSEs who have already put in more than 4 years in Level 8 under MACPS may be given non-functional promotion to Level 9.</p>



<p>3.5) Similarly SSEs who have already put in more than 4 years in Level 9 under MACPS may be given non-functional promotion to Level 10 from the date of implementation of these orders and a Non-Functional promotion to Level 11 after working for 4 years in Level 10, as already provided for the Group ‘B’ Officers.</p>



<p>3.6) 50% restriction in phase-II upgradation may please be removed and who ever completes 4 years of service in Level-8 may be given non-functional financial upgradation to Level-9 without any restriction.</p>



<p>3.7) All posts in Level 8 &amp; above may please be classified in Group B Gazetted as per RBE No.5/2010, dated 08.01.2010. Also, DoPT OM F. No. 11012/10/2016-Estt.A-III,<br />dated 8th December 2017 classify a Central Civil Post carrying the pay in the Pay Level from 6 to 9.</p>



<p>3.8) Designation of posts of SSEs upgraded to Level 8 may please be designated as Chief Section Engineer (CSE) &amp; the Posts in Level 9 may please be changed as Principal Section Engineer. Since they will be holding vital and hierarchical position in the technical cadre and as such, they cannot be given same Designation for three Pay Levels of SSEs, for effective and hierarchical management.</p>



<p>3.9) Similarly the Designations of CMS &amp; CDMS in upgraded Posts in Pay Level 8 &amp; Pay Level 9 be changed as Principal CMS &amp; Principal CDMS.</p>



<p>3.10) Surrender of posts should not be done for the strength of Supervisory Staff who are already in Pay level 8 &amp; Level 9 under MACPS as there will be no financial implications for upgrading the Posts for this strength of Staff who are getting the higher pay under MACPS.</p>



<p>3.11) Senior Engineers (IT) working in Railways may please be given upgradation staffing pattern equal to that of Computer centre in Railway Board.</p>



<p>3.12) Junior Engineers (JEs) working in four technical departments of Railways may please be placed in Level -7, since they hold direct responsibility of safe, efficient &amp; failure proof production, repair, maintenance and operation of trains, P.Way, Bridges, S&amp;T, OHE and other assets &amp; equipment.</p>

<p>Proposals are being received from Railways/ Production Units for upgradation of Stenographers cadre by granting GP 6600/- in PB-3 (6th CPC scales) to senior PSs-I in the Railway/ Unit.</p>
<p>2. In above context, it is hereby clarified that in terms of the extant rules/position such a grade in GP Rs.6600/- is not available/ sanctioned in the category of Stenographers on zonal Railways (Field Offices). Further, based on the recommendations of Pay Commissions and decisions of the Government/Railway Board, there is no provision for a grade in pay structure higher than GP Rs.4800/5400 (Level 8/Level 9) in field offices including zonal Railways. Any local Office Order wherever issued by any Railway contrary to this established position is irregular and is to be withdrawn immediately under intimation to this office.</p>

<p>Please refer to NFIR&#8217;s representation dated 23.07.2018 addressed to Hon&#8217;ble MR requesting intervention of Hon&#8217;ble for obtaining approval of Ministry of Finance (MoF) for upgradation GP-4600 to GP-4800.</p>
<p>2. With respect to above, it is stated that Railway Board have been making persistent efforts with various levels for obtaining approval of proposal sent MoF vide Board&#8217;s OM dated 08.02.2017 proposing revision of pay structure of Sr.Supervisors in Group &#8216;C&#8217; of all departments (other than Account Department) to upgrade 75% of such Supervisor posts from Level-7 (erstwhile GP-4600) to Level-8 (erstwhile GP &#8211; 4800) and to bring parity in the pay scales of Group 13 Officers Accounts/Non-Accounts department.</p>
<p>3. It has already been intimated to NFIR through ATS on PNM-NFIR Item Nos. 3 &amp; 10/2018 that a D.O. letter dated 20.04.2017 was sent from Hon&#8217;ble MR to Hon&#8217;ble FM for expediting approval on above proposal. Thereafter, a reminder dated 15.05.2018 from EDPC-­II to JS(Pers)/MoF was also sent in this connection. Recently, a D.O. letter dated 13.07.2018 (Annex-I) from Board (CRB) to Finance Secretary has also been sent requesting them to expedite approval on Board&#8217;s proposal dated 08.02.2017.</p>

<p>Pursuant to Federation&#8217;s communication vide letter of even number dated 19/01/2016 on the subject wherein Board was requested to issue instructions extending the validity of the revised classification beyond 31/12/2015, the Railway Board vide letter dated 09/02/2016 though extended the currency of the instructions, but however a restriction has been clamped that the said extension shall be upto 31/12/2016. The said extension period has again expired on 31/12/2016, consequently the processing of promotion of staff has been halted on Zonal Railways etc., from 1st January 2017 onwards.</p>
<p>NFIR, therefore, urges upon the Railway Board to extend the scheme beyond 31/12/2016 for ensuring promotions against vacancies.</p>
<p>Federation may be kept advised of the action taken.</p>

<p>The NFIR had raised a demand in the PNM Forum for revising the rates of Daily officiating allowance in the pay structure recommended by the VI CPC. A reference in this regard was also received from AIRF.</p>

<p>2. The matter has been considered by Board and have decided to revise the existing rates of Daily officiating Allowance in the VI CPC pay structure as indicated in the enclosed Annexure.</p>

<p>3. The revised rates of Daily Officiating Allowance are admissible from 01.09.2008. All other terms and conditions shall remain unchanged.</p>

<p>4. This has the sanction of the President and issues with the concurrence of the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p><strong>Sub: Suggestion over various negative recommendations of 7th C.P.C. to Govt of India for correction of the same to the advantage of Employees and for the sake of constitutional provisions. –regarding..</strong></p>
<p>Respected Sir,</p>
<p>The Government Employees National Confederation studied the report containing the recommendations of Seventh Central Pay Commission and observed that although there are some positive recommendation in it but also there are several instances came to notice the sprit and promises made by Chairman Shri A.K. Mathur as mentioned in para 1.29 that Govt. services are not merely only contract but is a status and employees expect fair treatment from the Govt. are not reflected in the recommendations properly. Some recommendations are negative to extent that they went against the constitutional rights of the employees. Few of them are :</p>
<p>(1) It tried to rationalize the Pay structure by devising “Index of Rationalization “but ended with several unwanted discrepancies.</p>
<p>(2) It is the fact that the Allowances were allowed by Departments as per their operational &amp; administrative needs, but 7th C.P.C. on its own initiative has declared them “outlived their utility “and recommended for their discontinuance.</p>
<p>(3) Vide para 1.17 it expresses its views that status in society due to becoming a Govt. employee cannot be monetized. The commission has erred in considering the fact that the status requires money to maintain it. It wrongly computed consumption units of a normative family as per present policies towards women, Children and senior parents and, therefore, could not arrive at correct minimum salary demanded.</p>
<p>(4) It says that the concept of Grade Pay and pay Band has been done away and all grade pay at all levels has been subsumed into the pay matrix but has also done away with the promotional benefit of difference of Grade pay provided earlier on promotion and restricted itself to recommend only 3% increment on promotion.</p>
<p>(5) Vide para 9.1.1 it remarked that with increased salary packages these advances have lost their relevance and recommended that all 12 interest free advances like Medical, LTC, Cycle etc. should be abolished without considering its validly to the employees, its family and the Govt. policies towards extension of these advances.</p>
<p>(6) By recommending increase in bench mark to “very good” for grant of MACPS benefits and recommending stoppage of further increment for not attaining it depicts criminal action over the employees for his no fault .</p>
<p style="text-align: center;"><span style="text-decoration: underline;"><strong>G.E.N.C. suggestions</strong></span></p>
<ol>
<li><span style="color: #800000;"><strong>Deficiency in PAY MATRIX</strong></span></li>
</ol>
<p>Although the intentions and promises made in Para 5.1.1 of 7th CP.C. are “simplification and rationalization” ,the 7th C.P.C. has wrongly taken up the entry pay for each grade pay devised by 6th CPC as the basis of rationalization and a “ index of renationalization” have been formed which is , for PB-I it is 2.57, for PB-2 it is s 2.62 , for PB-3 it is 2.67. It is amazing that at one hand 7th CPC says that the entry pay designed by 6th C.P.C. was disproportionate and on other hand chooses same for future rationalization in the form of recommended pay matrix.</p>
<p>Therefore, the G.E.N.C makes question that how a disproportionate entry pay, after going through process of rationalization through Index of rationalization .</p>
<ol>
<li>Will produce equidistant levels as promised ?</li>
<li> Will produce a judicious and caring horizontal matrix of entry pay of each level containing the exact compensation to Qualification, skill set required as well as increasing roles and responsibilities at each step of level?</li>
<li>Will produce Proportionate increase in quantum of pay as promised in para 5.1.19?</li>
<li>Will produce Levels, as status determiner as mentioned in para 5.1.18?</li>
<li>Will Satisfy holistic approach of 7th pay commission towards salaries allowances and other perquisites of compensation structure at each level as promised in para 1.18.</li>
</ol>
<p>In view of all above questions, the G.E.N.C. is proposing following modification while devising New pay matrix</p>
<p>(a) The Index of rationalization may be 15% enhancement in each 18 levels starting from G.P. 1800 and moving up to PB-3 onward instead of proposed disproportionate Index of rationalization of 7th C.P.C.</p>
<p>(b) After devising Pay matrix as above, the Post existing is G.P. 1900 may be merged with G.P. 2000 and similarly G.P. of 2400 may be merged with G.P. of 2800 as a provision of rationalization of Grade Pay in General. This method has been recommended by 7th C.P.C. to general commercial cadre existing in Ministry of Railways.</p>

<p>For others level the same method can be adopted , if deemed fit. The GENC has taken up this rationalization up to cadre in which direct recruitment takes place.</p>
<p><span style="color: #800000;"><strong>2.MINIMUM PAY :</strong></span></p>
<p>The minimum pay computed by 7th CPC vide Table Annexed to Chapter 4.2 needs careful modification as below.</p>
<ol>
<li>The rates mentioned as par 4.2.8 are taken as per product prices. Here, it is to say that any consumer has to buy the products at retail prizes which are always ahead of these product prizes because of middle man profit , sales tax , VAT etc. which when combined are at least ahead by 12% of product prize.</li>
</ol>
<p>Therefore, adding 12% of 18000 i.e. 2160 to 18000 makes minimum wage of three consumption unit Rs. 20160. On this basis, the share of one consumption unit comes out to be Rs. 6720</p>
<ol start="2">
<li>Several initiatives from side of Govt. has come forward these years with respect to women, Children &amp; senior parents which are necessary to be included in the consumption unit as given by Doctor aykroyd . They are</li>
</ol>
<p>(a) Senior Citizen and parents maintenance Act 2010 which provides liability of Mother and Father over employed Sons/Daughters.</p>
<p>(b) Gender bias reflected in ackroyed formula in respect of women employees as well as house wife, mother is not acceptable as per Govt. policy. The provisions of full unit for these dependents are to be included in consumption unit.</p>
<p>(c) Full consumption unit to Children below age 14 has to be made compulsory as the present day Govt. is health sensitive, therefore, we have to consider that the quantity and prizes of commodities used by children is much higher than commodities used by adults.</p>
<p>(d) Dating back to First CPC the lowest entering Govt. employee was mere 5th pass but as per the recommendations of 6th CPC, accepted by Govt., the lowest employee being inducted into Govt. service is 10th pass. Therefore mental labour of this skilled employee has also to be considered and monetized.</p>
<p>By computing all factors mentioned in 1 and 2 above following computation from minimum wage comes out</p>
<blockquote><p>(i) 20160 minimum wage arrived at 1 above divided by 3 makes Rs. 6720 as full unit consumption.</p>
<p>(ii) Employee, wife, two Children below 14, Mother, &amp; Father makes 6 consumption unit of newly recruited MTS in the Govt. sector.</p>
<p>(iii) Therefore, as per (i) &amp; (II), Rs. 6720 X6 equals to Rs. 40320</p>
<p>(iv) 25% of 6720 i.e. 1680 being mental labour for 10th pass MTS, has to be added to Rs. 40320 above .</p>
<p>(v) Therefore , Rs. 40320 + Rs.1680 equal to Rs. 42000 as minimum wage.</p></blockquote>
<p>The Govt. may also consider and arrive at the minimum wage on the basis of NET NATIONALPER CAPITA INCOME (neutralized inflation ) data of CSO ( Central statistical organization ) which is Rs. 6175 per consumption unit.</p>
<p>However, keeping in view the paying capacity of employees and economic situation of newly developing country of India, the GENC is proposing Rs. 24000 as minimum wage to a newly recruited employee.</p>
<p><span style="color: #800000;"><strong>3. FITMENT BENEFIT :</strong> </span>Fitment benefit provided by the 7th C.P.C. is 2.57 which is 14.29 % more than 2.25. equivalent to the fitment benefit provided by 2nd CPC .</p>
<p>The GENC, therefore, demands that it should not be less than 51% of 2.25 as provided by 6th CPC. Which comes out to be 3.42.</p>
<p><span style="color: #800000;"><strong>4. INCREMENT AT THE TIME OF PROMOTION :</strong></span></p>
<p>The GENC intends to remind you that the employees are getting only 3% replacement benefit in new pay Matrix on promotion. Previously the employees were getting 3% benefit along with difference of grade pay on promotion.</p>
<p><em>Therefore, we suggest that:-</em></p>
<blockquote><p>(i)On each promotion, one extra increment in that promotional level may be provided. OR<br />
(ii)The pay in new pay matrix may be fixed by providing one extra increment in the concerned level.</p></blockquote>
<p><span style="color: #800000;"><strong>5. ANNUAL INCREMENT RATE :</strong></span> The Annual increment Rate provided by previous C.P.C. were calculated when pay scale system was prevalent and age for full pension was 33 years. In worst cases an employees with 3% increment Rate can reach to maximum from minimum in 33 years.</p>
<p>The 6th CPC has also endorsed the concept of 3% annual increment in pay band system but has suggested full pension in 20 years . This recommendation was later on accepted by Govt. and revision in pension rules were made accordingly.</p>
<p>Now it was turn of 7th CPC to take into account above facts and, therefore, would have devised annual increment of 5% considering that the employee in new pay matrix will reach in 20 Years for full pension benefit . Unfortunately this has not been done.</p>
<p>Therefore, in order to have coordination between previous and present criterion for providing increment on the basis of pension computation, the 5% annual increment rate may be considered to devises new pay Matrix.</p>
<p><span style="color: #800000;"><strong>6. Date of Annual Increment:-</strong></span> With present formula that each employee completing 6 months in a year will get increment, on 1st July. The concept of 1st July of year is not adequate for those entering in the service in any month between January and June &amp; for those retiring any of the month of the year. Therefore, the GENC proposes that both type of above employees may be provided one increment irrespective of date of entry or date of retirement. Similarly, two dates i.e. 1st January or 1st July can be made for assessing and providing annual increment.</p>
<p><span style="color: #800000;"><strong>7.With holding of Annual increment to Non performer after 20 years – increase in MACPS benchmark and introducing efficiency Bar</strong>.</span> Vide para 5.1.46 “there is a vide spread perception that increment as well as upward movement in the hierarchy happens as a matter of course. Also, grant of MACP is taken for granted. “</p>
<p>These lines are totally against the promises of Shri A.K Mathur Chairman 7th CPC quoting apex court judgement in para 1.29 “ it should always born in mind that legitimate aspirations of an employee are not gullitoned and a situation is not created where hopes ends in despair. Hope for everyone is gloriously precious and that a model employer should not convert it to be deceitful and treacherous by playing a game of chess with their seniority also vide para 1.30 it quotes that the employee should not be thought as criminal and unnecessary suspicion should not be made about him.</p>
<p>On availability of such sprit and promises, the bench mark “ Very good” should not be taken in a way that “average” and “good “remark are criminal activities and without any disciplinary proceeding their annual increment can be withheld. Similarly these remarks cannot declare employee a non performer. The GENC, therefore, request that the para 5.1.45 pertaining to MACPS &amp; para 5.1.46 pertaining to efficiency Bar may not be considered for implementations. .</p>
<p><span style="color: #800000;"><strong>8.MACPS :</strong> </span>(1) The 7th CPC has compiled the key demands received by it and quoted regarding MACPS demand in 5.1.12 (e) that the MACPS providing benefits in grade pay hierarchy, was giving in adequate benefit after long gap of 10, 20 &amp; 30 Years and demanded that, it should be provided in promotional hierarchy instead of grade pay hierarchy. Similarly, the demand for increase in the frequency of administering MACP has also came for consideration. .</p>
<p>In view of all above, the 7th C.P.C. restricted itself to recommend that the frequency of MACP will remain 10, 20 &amp; 30 years but in process to provide adequate MACPS benefits , it recommended , that it will be provided in immediate next level in the hierarchy.</p>
<p>The GENC is trying to analyze the words immediate next level in the hierarchy and concludes that it should simply mean the immediate next level in the hierarchy existing in the department.</p>
<p>After going through entire recommendation it has been observed that the word hierarchy was used for hierarchy existing in the department or a cadre. In case the meaning of immediate next level in the hierarchy is level hierarchy then It can be said that 7th CPC has not done there any modification in the MACPS scheme and it only tried by deceitful and treacherous method to take away the benefit as promised.</p>
<p>Therefore, the GENC strongly demand that the word immediate next level in the hierarchy may be made clearer so that it may mean immediate next level in the cadre / promotional hierarchy.</p>
<p>(2) Similarly, recommendation of stepping up has been made by 7th CPC in its para 11.40.82 in respect of Railway Accounts for MACPS anomalies.</p>
<p>Therefore the GENC strongly demand that the stepping up of pay of senior for MACPS anomalies with Junior to all seniors drawing lesser pay than junior in entire Central Govt. Employees may be made. It is to remind that MACPS scheme is common to all and is not restricted to any cadre or Department.</p>
<p><span style="color: #800000;"><strong>9.House Rent Allowance:</strong></span> The factor of 0.8 has been introduced illogically and without any justification. This factor should be removed &amp; H.R.A. should be to restored on the basis of Metro and Non metro classification of cities only with percentage 40 &amp; 30 respectively .</p>
<p><span style="color: #800000;"><strong>10.CGEIS Benefit :</strong> </span>Many banks especially corporation Bank of India is providing Insurance cover on natural death over salary account to the tune of 10 to 20 Lacks . Therefore, it is not advisable to increase the Insurance Benefit heavily and also its premium.</p>
<p>If saving fund is the basis of this increase in CGEIS premium then all New entrant may be allowed for G.P.F. contributions.</p>
<p><span style="color: #800000;"><strong>11. Child Care leave:</strong> </span>This leave for all two years may be granted with full salary. Its benefit should also be extended to Male employees.</p>
<p><span style="color: #800000;"><strong>12.Medical Advances :</strong></span> As the terms of Children Education Allowance and Traveling Allowance were made easier , the terms of Medical Advance may also be made easier and advances up to 1 lacs amount should be allowed to be sanctioned by the Head of the office instead present 10 thousand ceiling.</p>
<p><strong><span style="color: #800000;">13. Leave Travel Concession:-</span></strong> should be allowed exactly on same terms as it is presently. It is to remined that the facilities was devised to boost up the tourism Industry and also to get relief to the employees and its family from getting tired due to routine work.</p>
<p><span style="color: #800000;"><strong>14. Bonus:</strong></span> Bonus in all forms may be continued as it is considered as deferred wage.</p>
<p><span style="color: #800000;"><strong>15. Income Tax issues:</strong> </span>Present limit of income tax may be enhanced to 2.57 times . All allowances of Central Govt. employees may be kept out from preview of Income tax. The Pension amount should be exempted from tax .Death cum retirement gratuity should be exempted form income tax.</p>
<p><span style="color: #800000;"><strong>16. Fitment benefits of to decide quantum of minimum pension:</strong></span> should be equal to minimum wage and fitment benefit of 2.57 may be increased to 3.</p>
<p><span style="color: #800000;"><strong>17. Allowances:</strong></span> All Allowances were devised as per requirement of existing Govt. policies and conditions of service in the Department. Therefore, any decision taken abruptly is certainly going to produce unrest. The GENC quotes certain allowances that are certainly to be restored and instead its rate should also be enhanced and rationalized.</p>
<p>Assisting Cashier Allowance , Caretaking Allowance , Family planning Allowance , FMC, Funeral Allowance, Ghat Allowance , Handicapped Allowance, Head quarter Allowance, Kit Maintenance Allowance., ,Over times Allowance, Rent free Accommodation, Risk Allowance , Training stipend , Treasurer Allowance Washing allowance , Cash Handling Allowance ., Cycle Allowance etc.</p>
<p><span style="color: #800000;"><strong>18.Compassionate Appointment:</strong></span> Ceiling of 5% over DR vacancies imposed over Central Govt. employees at the time of compassionate appointment may be removed and it may be made 100%</p>
<p><span style="color: #800000;"><strong>19. Gramin Dak Sewak:</strong></span> GENC demands that Negative recommendation of 7th C.P.C. to treat GDS a non Govt. employees to the extent that their salary may be separated from salary other regular employees being drawn from consolidated fund of India may be expunge out from recommendation of 7th C.P.C. as Department of Posts has already constituted a GDS committee to look into to all service condition and employment matters in entirety.</p>
<p><span style="color: #800000;"><strong>20. New Pension Scheme:</strong></span> It is to emphasis that Article 366 (17) defines Pension. On its basis AIR 1983 SC 130 held that Pension is not an exgratia payment but it is payment of past services rendered. Similarly, Supreme Court reiterated that pension is not a bounty of state. It is earned by the employees for services rendered to fall back upon after retirement. It is attached to the office it cannot be arbitrarily denied.</p>
<p>In a judgement in U.O.I. &amp; others (1990) 4 SSC 207) – It was never held that both the pension retiree and PF release form a homogeneous class and that any further classification among them would be voilative of Article -14.</p>
<p>The 7th CPC held that under the pension scheme, the Govt. obligation begins on his retirement and then continuous till the death of employees. In Para 10.1.64 the 7th CPC quotes there is clear evidence that Govt. has progressively moved towards liberalized regime for past pensioners. The 6th CPC has provided additional pension and 7th CPC has provided one Rank one pension.</p>
<p>Unfortunately no promise has been made by the 7th CPC. But vide para 10.3.3 it quotes that the commission notes that the NPS is the culmination of a series of social securities and pension related reforms initiatives in India . At present OASIS has concluded that instead of defined benefit scheme for pension , the defined contribution scheme should be introduced. In NPS 40% of accumulated wealth is invested for pension purpose and 60% is paid at the time of retirement. NPS is not covered in GPF. On the death of employee 80% wealth is utilized for purchase of annuity and 20% is paid to legal heir.</p>
<p>7th C.P.C. Vide para 10.3. clearly speaks that uncertainty over the NPS scheme should be removed. Therefore the BPEF suggest that</p>
<blockquote><p>1.The quantum of pension should be made equivalent to old pension scheme and this decision may be notified along with 7th C.P.C. recommendations.</p>
<p>2.The amount of gratuity for NPS should be made equal to old pension.</p>
<p>3.Family pension &amp; other benefit to the NPS employees should be declared along with 7th CPC recommendations.</p></blockquote>

<p>Ref:(i) <strong>Railway Board’s letter No. E(NG)Il/2001/RR-1I45 dated 22/05/2015.</strong></p>
<p>(ii) <strong>NFIR’s letter no. Il/Part X dated 17/08/2015 addressed to the Member Staff and copy endorsed to the DGIRHS, Railway Board.</strong></p>
<p>With reference to Board’s letter dated 22/05/2015, cited above (item no.i), NFIR vide Letter dated 17/08/2015, brought to the notice of the Railway Board the revised designation and pay structure of Lab Staff working in the Hospitals of the Central Government as mentioned in the O.M. No. F. No. A-28020/l1/2008-PMS(Part I) dated 17th July 2015 issued by the Ministry of Health &amp; Family Welfare, the nodal ministry for issuing similar instructions in respect of Lab Staff working in the Railway Hospitals duly rectification of the existing designation and the pay structure. A period of more than two months has passed; Federation is yet to receive a response from the Board. This is causing deep sense of frustration and resentment among the Lab Staff of Medical Department of Medical Department.</p>
<p>NFIR, therefore, once again requests the Railway Board kindly see that the corresponding instructions are issued in the case of Lab Staff working in the Railway Hospitals etc., at an early date. Copy of the instructions issued may be endorsed to the Federation.</p>
