<p>Subject:- <strong>Board level and below Board level posts including Non-unionised Supervisors in Central Public Sector Enterprises (CPSEs) &#8211; Revision of scales of pay w.e.f. 01.01.2017 &#8211; Payment of IDA at revised rates-regarding.</strong></p>



<p>The undersigned is directed to refer to the para / and Annexure-III (B) of DPE’s OM dated 03.08.2017 wherein the rates of DA payable to the Board level and below Board level executives and non-unionized supervisors of CPSEs have been indicated. The next installment for revision of rates of DA Is due from 01.07.2020. Accordingly, the rate of DA payable to the executives and non-unionized supervisors of CPSEs is as follows:-</p>

<p>2. The above rate of<strong><a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener"> DA</a></strong> i.e. 18.4% would be applicable in the case of IDA employees who have been allowed revised pay scales (2017) as per DPE O.Ms. dated 03.08.2017, 04.08.2017 &amp; 07.09.2017.</p>



<p>3. All administrative Ministries /Departments of the Government of India are requested to bring the foregoings to the notice of the CPSEs under their administrative control for necessary action at their end.</p>

<p>Subject: <strong>Payment of DA to the CPA pattern employees of CPSEs on 5th CPC pay scales governed by HPPC recommendations w.e.f. 01.07.2018-reg.</strong></p>
<p>The undersigned is directed to refer to Para No. 2 and Annexure-III to this Department’s O.M. dated 24.10.1997 wherein the rates of DA payable to the employees of CPSEs following CDA pattern pay scales, who are governed by HPPC recommendations had been indicated.</p>
<p>2. In continuation of this Department’s OM of even number dated 04.04.2018, the rates of Dearness Allowance payable to the employees of CPSEs governed by the recommendations of HPPC, which have not revised their pay scales in terms of DPE O.M. No. 2(54)/2008-DPE(WC) dated 14.10.2008 may be as follows:-</p>
<blockquote><p>a) In case of CPSEs who have not allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees, the DA payable maybe enhanced from existing rate of 324% to 334% w.e.f. 01.072018.</p>
<p>b) In case of CPSEs who have allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees.. the DA payable may be enhanced from existing rate of 274% to 284% w.e.f. 01.07.2018.</p></blockquote>
<p>3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>
<p>4. All administrative Ministries/Department of Government of India are requested to bring the foregoing to the notice of the Central Public Sector Enterprises under their administrative control for action at their end.</p>

<p>3. The 6th Central Pay Commission has merged the post of Section Officer with Assistant Accounts Officer from 01-01-2006. The 6th Pay Commission has recommended the Pay Band 2 in the Pay Scale of Rs. 9300-34800 Plus Grade Pay of Rs. 4200/- to the Senior Accountant. The Asst. Accounts Officer were also given the Pay Band No. 2 but they were given the Grade Pay of Rs. 4800/-.</p>
<p>4. The Government of India, Ministry of Personnel, Public Grievances and Pensions under O.M. No. 35034/3/2008-Estt (D) dated 19-05-2009 has introduced the Scheme of Modified Career Progression Scheme (for brevity M.A.C.P.) which is the modified version of earlier A.C.P. Scheme. As per the Scheme the Government Servants will be granted 3 financial upgradations after completion of 10, 20 and 30 years of service if they have not received any regular Promotion. The condition No. 2 read with 6.2 of the Annexure 1 of the OM. laid down that:</p>
<p>&#8220;….financial upgradations under the Scheme should be done strictly in accordance with the hierarchy of grade pays in pay bands as notified vide CCS (Revised Pay) Rules, 2008&#8221;</p>
<p>According to the information available to this Association, the Senior Accountants are being granted Grade Pay of Rs. 4600 /-(level 7 of pay matrix) on grant of benefits under M.A.C.P.</p>
<p>In this connection, your kind attention is invited to the following orders/Judgments of the various Tribunals/ High Courts/Supreme Court wherein the Tribunals/ High Courts have held that the Grade Pay of hierarchical Promotion Post has to be given on grant of financial benefits under M.A.C.P.</p>
<p>1. Central Administrative Tribunal (C.A.T.) Ernakulam Order dated 27-09-2011 in T.P.Leena Vs. Union of India.</p>
<p>The Tribunal has granted the Grade Pay of Rs. 4800/- on grant of 1st Financial Benefit under M.A.C.P. from Rs. 4200/-</p>
<p>2. The High Court of Ernakulam has by Judgment dated 21-06-2012 in the case of Union of India Vs. T.P.Leena has upheld the Order of CAT. and Hon’ble Supreme Court has dismissed the S.L.P. by Judgment dated 15-10-2012 holding that there is no reason to interfere with Impugned Order.</p>
<p style="text-align: center;">[Copies of above Order/ judgments are enclosed as Annexure &#8216;A&#8217;)</p>
<p>3. CAT New-Delhi by Order dated 26-11-2012 in Sanjay Kumar &amp; others Vs. Ministry of Defence &amp; others has granted the Grade Pay of Promotion Post (Copy enclosed).</p>
<p>Sir, it would not be out of place to submit that the Controller of Accounts C.B.D.T. Mumbai in compliance of C.A.T. Mumbai order has by order No. ZAO/MACP/ADMN/12015-16 dated 01-02-2016 has granted Grade Pay of Rs. 4800[- (level 8 of Pay Matrix] to 13 Senior Accountants on grant of benefits of 2“d M.A.C.P. The copy of the Order is enclosed as Annexure ‘B’ for your perusal.</p>
<p>It is further submitted that the Principal Chief Controller of Accounts. Zonal Accounts Office, CBDT, Mumbai has, while quoting Principal Chief Controller of Accounts C.B.D.T. New- Delhi letter No. -PCCA/CBDT/Estt/Rep/2018-381-382 dated 01-08-2018 has granted benefits of 3rd M.A.C.P. to 16 Senior Accountants under order No. ZAO/CBDT/MUM/ADMN/MACPS/2018-191 742 dated 04-09-2018 [Copy enclosed]. The perusal of the order would exhibit that all the Senior Accountants were in receipt of Grade Pay of Rs. 4800/- (level 8 ef Pay Matrix] on grant of benefits of 2nd M.A.C.P. and they have been granted Grade Pay of Rs. 5400/-[level 9 of Pay Matrix) which is the Grade Pay of hierarchical Post of Asstt. Accounts Officer.</p>
<p>In View of submission made in the letter, it is clear that the members of our Association are meted out with discrimination as far as grant of Grade Pay of Rs. 4800/-[level 8 of Pay Matrix) on grant of benefits of M.A.C.P. to Senior Accountants are concerned. They are given the Grade Pay of Rs. 4600/- [level 7 of Pay Matrix). This amounts to discrimination and violative of Article 14 and 16 of the Constitution of India. It is therefore requested that the Grade Pay of Rs. 4800/-(level 8 of Pay Matrix) may please be granted to all the Senior Accountants who have been granted benefits of M.A.C.P. A comprehensive review may please be taken and set right the grave injustice caused to our members.</p>
<p>In this context the observation of Principal Bench New Delhi in the case of All India Defence Civilian Clerks Association of ADC and Records Office and another Vs. The Secretary, Ministry of Defence and others in order dated 01-02-2012 (Copy enclosed) assumes importance.</p>
<p>We do not understand the logic of the Ministry of Defence, D.0.P &amp; T. Ministry of Finance or even the Ministry of Law as to how the aforesaid directions as upheld by Hon&#8217;ble High Court of Delhi and the Apex Court cannot be made applicable to the Applicants who are admittedly similarly placed. In our considered opinion the Respondents/Departments should desist from rejecting the genuine request of the employees and force them to knock the door of Courts unnecessarily without any justifiable grounds.</p>
<p>In view of above observation of Hon&#8217;ble Principal Bench 1 request you to consider our request positively and arrange to do justice by removing the discrimination between the two set of similarly situated employees.</p>

<p>In modification of this Department&#8217;s O.M. of even No. dated 03.04.2018, the rate of DA payable to the executives and non-unionized supervisors of CPSEs (2007 pay revision) is as follows:</p>

<p>c) Link Point: 126.33 (as on 01.01.2007)</p>
<p>d) Increase over link point: 161.67 (288 minus 126.33)</p>
<p>e) DA Rate w.e.f. 01.07.2018: 128% [(161.67 / 126.33) x 100]</p></blockquote>
<p>2. The above rate of DA i.e. 128 % would be applicable in the case of IDA employees who have been allowed revised pay scales (2007) as per DPE O.Ms. dated 26.11.2008, 09.02.2009 &amp; 02.04.2009.</p>
<p>3. All administrative Ministries/ Departments of the Government of India are requested to bring the foregoings to the notice of the CPSEs under their administrative control for necessary action at their end.</p>

<p><strong>Sub: Grant of Overtime Allowance (OTA) to Railway employees Consequent upon revision of pay scales and allowances- date of effect.</strong></p>
<p>Ref: Board&#8217;s letter of even No. dated 28-11-2017 (RBE No. 175/2017)</p>
<p>Pursuant to the recommendations of the Seventh Central Pay Commission, the rates of OTA have been revised w.e.f. 01-7-2017 vide Board&#8217;s letter of even number dated 28-11-2017 (RBE No.175/2017). The issue of revising the date of effect of OTA w.e.f. 01-01-2016 had been under consideration and it has been decided that the basic pay and DA element for the purpose of OTA may be antedated to 01-01-2016 and other elements constituting emoluments for the purpose of OTA viz. HRA and Transport allowance etc. shall be taken into account at revised rates w.e.f. 01-7-2017 as per the 7th CPC recommendations.</p>
<p>2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>1352. SHRI MALLIKARJUN KHARGE:</p>
<p>Will the Minister of LABOUR AND EMPLOYMENT be pleased to state:</p>
<p>(a) whether the Government reviews the working conditions and pay scales of the workers working in unorganized sector by appointing commissions at regular intervals on the lines of employees of the Central Government;</p>
<p>(b) if so, the details thereof;</p>
<p>(c) if not, whether the Government has any such proposal in this regard at present; and</p>
<p>(d) if so, the details thereof along with the time by which final decision is likely to be taken in this regard?</p>
<p><strong>ANSWER</strong><br />

<p>(a) to (d): The Minimum Wages Act, 1948, provides for fixation/periodic revision of minimum wages in employment to prevent exploitation of workers. Under the Act, the appropriate Government, both the Centre and the States, fixes/revises the minimum wages in scheduled employments falling in their respective jurisdiction. This Act provides for fixation of hours of work, payment of overtime wages besides providing penalties for offences under the Act and the Rules made thereunder.</p>

<p><strong>Subject:- Rate of Dearness Allowance applicable w.e.f.1.7.2016 and w.e.f.1.1.2017 to employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scales as per 5th Central Pay Commission</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M.of even No. dated 22nd April, 2016 revising the rates of Dearness Allowance w.e.f.01.01.2016 in respect of employees of the Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scales as per 5th Central Pay Commission.</p>
<p>2. The rate of DA admissible to above categories of employees of the Central Government and Central Autonomous Bodies shall be enhanced from the existing rate of 245% to the revised rates as under:</p>

<p>4. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</p>

<p><em>7th Pay Commission &#8211; Nearly two weeks after soldiers from several central paramilitary forces went public with their grievances, documents reveal the stark disparity between the Indian Army and the Border Security Force (BSF).</em></p>
<p>Salary documents provided by the BSF, reveal there is a difference ranging from 2.5% to 48%, after the 7th Pay Commission was implemented, between pay scales of the BSF and the Army.</p>
<p>They show that a head constable in the BSF earns Rs.25,500 a month &#8211; Rs.3,700 less than his Army counterpart. A deputy commandant earns Rs.1,700 less than a major in the Army, a commandant draws Rs.7,200 less than a colonel, and a deputy inspector general of the BSF draws Rs.8,500 less than a brigadier in the Army. The biggest disparity is between the second-in-command (2IC) of the BSF and a Lt. Colonel of the Army-a pay gap of Rs.37,900.</p>
<p>&#8220;This debate has been going on for the last 50 years. But there has been no resolution as yet to bring the BSF and the Army on a par as far as salaries are concerned. The line of duty and combat is the same for both forces, but there is a major distinction,&#8221; said a senior BSF officer on condition of anonymity.</p>
<p>While the home ministry is silent on the matter, the BSF bill of 1968, which was discussed in the Rajya Sabha in 1968, had argued that &#8220;the BSF in its functioning has all the disadvantages of the police and the Army without their corresponding advantages. This is a matter which needs looking into and remedial steps taken to redress balance in favour of the BSF with regard to leave, travel concessions, housing, education, allowance, etc.&#8221;</p>

<p>The undersigned is directed to refer to the OM of even number dated 29.08.2016 on the above mentioned subject informing about the meeting scheduled to</p>
<p>be taken by Joint Secretary (Establishment) to review the position with respect to the amendment in Service Rules/Recruitment Rules for various posts.</p>
<p>2. In this regard, the meetings scheduled to be held from 03.10.2016 onwards have been postponed. The revised schedule is given below.</p>

<p>The 7th Pay Commission report has recommended an average 23.55% hike in salaries and allowances of Central government staff and the same is likely to be replicated in all the states too, except Puducherry where the same system as in Centre is already applicable – minimum pay set at Rs 18,000 per month and maximum pay at Rs 2,50,000 per month &#8211; recommended date of implementation: 01, January, 2016.</p>

<blockquote><p><em><strong><span style="color: #008000;">1. 7th Pay Commission pension, pay scales, allowances &#8211; Minimum Pay: </span></strong></em></p>
<p>Based on the Dr Wallace Aykroyd formula (nutrition) , the minimum pay (salary) in government is recommended to be set at Rs 18,000 per month; Maximum Pay: Rs 2,25,000 per month for Apex Scale and Rs 2,50,000 per month for Cabinet Secretary and others presently at the same pay level. If passed, the salary hikes this report is recommending are likely to boost demand for consumer goods across the spectrum, even though it could also be inflationary. (Reuters)<br />
<span style="color: #008000;"><em><strong>2. 7th Pay Commission pension, pay scales, allowances &#8211; Advances: </strong></em></span></p>
<p>a. All non-interest bearing Advances have been abolished; b. Regarding interest-bearing Advances, only Personal Computer Advance and House Building Advance (HBA) have been retained. HBA ceiling has been increased to Rs 25 lakhs from the present Rs 7.5 lakhs. (PTI)</p>
<p><span style="color: #008000;"><em><strong>3. 7th Pay Commission pension, pay scales, allowances &#8211; Pension: </strong></em></span></p>
<p>The Commission recommends a revised pension formulation for civil employees including CAPF personnel as well as for Defence personnel, who have retired before 01.01.2016. This formulation will bring about parity between past pensioners and current retirees for the same length of service in the pay scale at the time of retirement. The 7th Pay Commission received many grievances relating to New Pension System (NPS). It has recommended a number of steps to improve the functioning of NPS. It has also recommended establishment of a strong grievance redressal mechanism. (PTI)<br />
<span style="color: #008000;"><em><strong>4. 7th Pay Commission pension, pay scales, allowances &#8211; Performance Related Pay: </strong></em></span></p>
<p>The Commission has recommended introduction of the Performance Related Pay (PRP) for all categories of Central Government employees, based on quality Results Framework Documents, reformed Annual Performance Appraisal Reports and some other broad Guidelines. The Commission has also recommended that the PRP should subsume the existing Bonus schemes. (PTI)<br />
<span style="color: #008000;"><em><strong>5. 7th Pay Commission pension, pay scales, allowances &#8211; New Pay Structure: </strong></em></span></p>
<p>Considering the issues raised regarding the Grade Pay structure and with a view to bring in greater transparency, the present system of pay bands and grade pay has been dispensed with and a new pay matrix has been designed. Grade Pay has been subsumed in the pay matrix. The status of the employee, hitherto determined by grade pay, will now be determined by the level in the pay matrix. The rate of Annual Increment is being retained at 3 percent. (PTI)<br />
<span style="color: #008000;"><em><strong>6. 7th Pay Commission pension, pay scales, allowances &#8211; Modified Assured Career Progression (MACP): </strong></em></span></p>
<p>a. Performance benchmarks for MACP have been made more stringent from “Good” to “Very Good”; b. The Commission has also proposed that annual increments not be granted in the case of those employees who are not able to meet the benchmark either for MACP or for a regular promotion in the first 20 years of their service; c. <p><span style="color: #008000;"><em><strong>7. 7th Pay Commission pension, pay scales, allowances &#8211; Military Service Pay (MSP): </strong></em></span></p>
<p>The Military Service Pay, which is a compensation for the various aspects of military service, will be admissible to the Defence forces personnel only. As before, Military Service Pay will be payable to all ranks up to and inclusive of Brigadiers and their equivalents. The current MSP per month and the revised rates recommended are as follows: (Reuters)<br />
<span style="color: #008000;"><em><strong>8. 7th Pay Commission pension, pay scales, allowances &#8211; Short Service Commissioned Officers: </strong></em></span></p>
<p>Short Service Commissioned Officers will be allowed to exit the Armed Forces at any point in time between 7 and 10 years of service, with a terminal gratuity equivalent of 10.5 months of reckonable emoluments. The Seventh Pay Commission also says they will further be entitled to a fully funded one year Executive Programme or a M.Tech. programme at a premier Institute to better their prospects in later life. <span style="color: #008000;"><em><strong>9. 7th Pay Commission pension, pay scales, allowances &#8211; Allowances: </strong></em></span></p>
<p>The Commission has recommended abolishing 52 allowances altogether. Another 36 allowances have been abolished as separate identities, but subsumed either in an existing allowance or in newly proposed allowances. Allowances relating to Risk and Hardship will be governed by the proposed Risk and Hardship Matrix. a. Risk and Hardship Allowance: Allowances relating to Risk and Hardship will be governed by the newly proposed nine-cell Risk and Hardship Matrix, with one extra cell at the top, viz., RH-Max to include Siachen Allowance. <span style="color: #008000;"><em><strong>10. 7th Pay Commission pension, pay scales, allowances – Financial Implications: </strong></em></span></p>
<p>The total financial impact in the FY 2016-17 is likely to be Rs 1,02,100 crore, over the expenditure as per the “Business As Usual” scenario. Of this, the increase in pay would be Rs 39,100 crore, increase in allowances would be Rs 29,300 crore and increase in pension would be Rs 33,700 crore. In percentage terms the overall increase in pay &amp; allowances and pensions over the “Business As Usual” scenario will be 23.55 percent. Within this, the increase in pay will be 16 percent, increase in allowances will be 63 percent, and increase in pension would be 24 percent. (Image by PTI)</p></blockquote>
