<p>Subject: <strong>Up gradation of pay scale for Laboratory Technicians working in the DGOF Organisation &#8211; Clarifications regarding</strong></p>



<p>Refer OFB ID No. 044/01/15/ NIE/PER/M dated 30.07.2018 &amp; 042/BPMS/CAT/ PER/M dated 25.11.2019 on the above mentioned Subject.</p>



<p>2. Clarification/ comments with regard to (i) the review of ACP/ MACP benefits for awarding Grade Pay Rs. 4600 to Laboratory Technicians in <a href="https://centralgovernmentnews.com/tag/OFB/" target="_blank" rel="noreferrer noopener">OFB</a> Hospitals who has already been awarded ACP-I in the scale of Rs. 5000-8000 corresponding to Grade Pay Rs. 4200 and (ii) grant of Upgraded Pay to Laboratory Technicians who do not possess qualification as per RRs of 2005 have been examined in this Department in consultation with DoP&amp;T and Department of Expenditure, Ministry of Finance. The clarifications in this respect as provided by the <a href="https://centralgovernmentnews.com/latest-dopt-orders-2020/" target="_blank" rel="noreferrer noopener">DOPT</a> &amp; concurred in by Department of Expenditure, Ministry of Finance are as follows</p>

<ul class="wp-block-list"><li>Two Laboratory Technicians, whose case has been referred to the DOPT, would, be eligible to get their pay fixed as on 01.01.2006 under the CCS(RP) Rules, 2006 initially in PB-2, Grade Pay of Rs. 4200/-, being their replacement scale as they fulfil the eligibility norms under the RRs notified in 2005. Thereafter, as per para &#8216;5&#8217; of the <strong><a href="https://centralgovernmentnews.com/category/macp/" target="_blank" rel="noreferrer noopener">MACP</a></strong> guidelines, the 1st ACP earned by them in 2001 in the scale of pay of Rs. 5000-8000 (pre-revised) shall be ignored, and they would be entitled to get their pay refixed as on 01.09.2008 on grant of 1st MACP in PB-2, Grade Pay of Rs.4600/- and further grant of 2nd MACP as on 28.04.2009/03.05.2009, on completion of 20 years of service, in PB-2, Grade Pay of Rs. 4800/-, provided they fulfil the other eligibility norms prescribed under DOPT’s OM dated 19.05.2009, as amended from time to time.</li><li>For the remaining 5 Laboratory Technicians, who do not fulfil the eligibility norms prescribed under the revised Recruitment Rules of 2005, the financial upgradation granted under the erstwhile ACP Scheme, if any, in the pre-revised Day scale of RS. 5000-8000 prior to 0.01.2006 or revised pay scale of PB-2, Grade Pay of Rs.4200/- between 01.01.2006 to 30.08.2008, as the case may be, shall be counted against their entitlement of benefits under the MACP scheme w.e.f. 01.09.2008 and they shall be eligible for only 2nd MACP on completion of 20 years of regular service and that too in PB-2, Grade Pay of Rs. 4600/-.</li></ul>

<p>The petitioner has filed this petition under Article 226 of the Constitution of India seeking following relief:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(i) To issue a writ in the nature of mandamus by directing the respondents to pay the annual increment fell due on 01.07.2015 to the petitioner.</p><p>(ii) To direct the respondents to pay the annual increment i.e. pay scale of 20440-5400 and arrears due from 01/07/2015 with interest of 6% per annum.</p><p>(iii) To grant any other relief, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case including cost of the litigation in favour of the petitioner.</p></blockquote>



<p>On 30.09.2019, learned counsel for the respondents was granted time to seek instructions as to how the petitioner can be refused the benefit of grant of annual increment which is to be added on 1st of July of every year, but, no response has been filed.</p>

<p>The petitioner was retired from service w.e.f. 30.06.2015. The increment, which was to be granted on 1st of July, 2015 was denied to him on the ground that he retired on 30.06.2016 and was not in service on 1st of July, 2015.</p>



<p>Learned counsel for the petitioner has relied upon a decision of the Madras High Court in the case of P. Ayyamperumal vs. The Registrar, Central Administrative Tribunal and others-WP No.15732/2017 decided on 15.09.2017, which was later on affirmed by the Supreme Court. Considering the law laid down by the Division Bench of the Madras High Court it is clear that the petitioner cannot be denied the increment which was due on 01.07.2015 merely because he got retired on 30.06.2015, since he has completed full years of service and was eligible to get the said increment. Since the case on which the petitioner is placing reliance is squarely covered with the case of the petitioner, nothing is required to be adjudicated in this petition.</p>



<p>Accordingly, the petition is allowed directing respondents to extend the benefit of annual increment to the petitioner which was due on 01.07.2015 and accordingly the retiral dues of the petitioner be revised and he be also paid arrears within a period of three months from submitting certified copy of this order.</p>

<p>Vide Board&#8217;s letter dated 10.04.2018 (RBE No.56/2018) higher grade pay of Rs. 2000/- was made applicable to all the Drivers Gr. III (Constable) of RPF/RPSF only who are similarly placed as compared to the petitioners in W.P. No. 15763/2013.</p>

<p>In this connection, a reference was received seeking clarification as to whether direct recruited Driver Gr.III of RPF/RPSF {who were enlisted in service as Driver Gr. III on 15.07.2010 in the pay scale of Rs. 5200-20200 + GP Rs. 1900/-) are to be treated at par with the petitioners of Writ Petition No. 15763/2013 (Shri Valibhai Y Darvodiya &amp; 17 Ors Vs CSC/ RPF,  CCG/ Mumbai and DC /RPF) for the purpose of granting {higher grade pay of Rs. 2000/-.</p>



<p>The matter has been examined in depth and it is accordingly clarified that all the Drivers Gr.III of RPF/ RPSF are to be considered similarly situated as the petitioners in W.P.No. 15763/2013 for grant of higher grade pay of Rs. 200/-.</p>



<p>4. Further, the recruitment at the revised upgraded pay in future will be made after duly incorporating the revised pay in the relevant Recruitment Rules.</p>



<p>This issues with the concurrence of Finance Directorate of this Ministry.</p>

<p>Sub: <strong>Revision of Scales of Pay and Allowances in respect Of Non-Executives (Workmen) of AAI w.c.f. 01.01.2017</strong></p>



<p>The Management of Airports Authority. of India (AAI) is pleased to announce the revision in pay scales for non-executives (workmen) of AAI w..e.f. 01.01.2017 consequent upon signing of Memorandum of Settlement (MoS) between the AAI Management and the Airports Authority Employees Union (Recognized Union) and confirmity of Ministry of Civil Aviation bide Letter No. AV-24015/6/2016-AAI-MOCA Dated: 19th February. 2019.</p>



<p>2. Accordingly, pay-scales, DA, perks &amp; allowances, etc. in respect of non-executives (workmen) of AAI stands revised w.e.f. 01.01.2017 as under:</p>



<p><strong>3. APPLICABILITY &amp; COVERAGE</strong></p>



<p>(i) All the regular Non-Executives of AA1 who were on the rolls of AAI is on 01.01.2017 and continue to be on the rolls of AAI and those joining, thereafter.</p>



<p>(ii) The employees who have left the services of the organization on or after 01.01.2017 due to resignation, retirement or death will be paid arrears on account of wage revision upto the date they were in service.</p>



<p>(iii) The benefit of wage revision will, however, not be allowed to employees from the date they have ceased to be in the services of the organization on the following grounds:</p>



<p>a) Dismissal/ removal</p>



<p>b) Left service without acceptance of resignation</p>



<p><strong>4. DURATION</strong></p>



<p>The existing scales of pay of Non-Executives are revised w.e.f. 01.01.2017. the revised scales will be effective for a period of 10 years.</p>

<p>Subject:- <strong>Rate of Dearness Allowance applicable w.eJ. 01.07.2018 to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scales as per 5th Central Pay Commission</strong></p>
<p>The undersigned is directed to refer to this Department&#8217;s O.M. of even No. dated 28th March, 2018 revising the rate of Dearness Allowance w.e.f. 01.01.2018 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the prerevised pay scales as per 5th Central Pay Commission.</p>
<p>2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing 274% to 284% w.e.f. 01.07.2018.</p>
<p>3. The provisions contained in paras 3, 4 and 5 of this Ministry&#8217;s O.M.No.1(13)/97-E.II(B) dated 3rd October, 1997 shall continue to be applicable while regulating Dearness Allowance under these orders.</p>
<p>4. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</p>

<p>30 AUG 2018</p>
<p>A new wage settlement agreement has been signed for Group C &amp; D category of Port and Dock Workers in Mumbai in the presence of Shri Nitin Gadkari, Union Minister for Shipping, Road Transport &amp; Highways and Water Resources, River Development &amp; Ganga Rejuvenation.</p>
<p>The settlement provides for 10.6% fitment on basic pay plus DA. The lowest grade of workers would get a pay-scale of Rs.20900-43600 and the highest grade worker would get a pay-scale of Rs 36500-88700.</p>
<p>More than 32,000 Port and Dock workers and 1,05,000 Group C&amp;D pensioners across all Major Ports will be benefitted from of this settlement. The Overall financial implication of this settlement for all the Major Ports for serving and pensioners is likely to be about Rs.560 crore per annum.</p>
<p>Speaking on the occasion Shri Gadkari said, &#8220;As per the vision of Prime Minister Shri Narendra Modi, welfare of the people is the chief priority of the Government, and I am glad that Major Ports are becoming drivers of socio-economic change. Major Ports have become pioneers in taking this initiative, being the first to sign the wage settlement for Group C &amp; D employees.&#8221;</p>
<p>The settlement has been signed between six Port and Dock Workers&#8217; Federations and the Port Management under Section 12(3) of Industrial Disputes Act, 1947, before the Regional Labour Commissioner, representing Chief Labour Commissioner. The Settlement would come into force from January 1, 2017 in retrospect. This is a five-year settlement arrived at in the port sector against the ten-year periodicity in many of the major public sector enterprises.</p>

<p>In pursuance of the recommendation of 7th Central Pay Commission as contained in Para 11.12.140 of the Report, read with this Ministry’s Resolution No. 1-2/2016-IC dated 25th July 2016, the undersigned is directed to say that the pay scales of the post of Assistant Accounts Officer in Indian Audit &amp; Account Department, Indian Civil Accounts Organization and P&amp;T Accounts shall be as under in the pay structure of 7th Central Pay Commission w.e.f 01/01/2016.</p>

<p>Subject: <strong>Proposal for grant of Apex Scale to Director General (DG) level officers at the Centre on Seniority basis instead of post specific basis.</strong></p>
<p>Sir,</p>
<p>I am directed to say that the Ministry of Home Affairs in consultation with this Department proposes to amend Part &#8216;C&#8217; and Part &#8216;D&#8217; of Schedule II of IPS (Pay) Rules, 2016 as under:</p>
<p>(i) In the Part C of Schedule -II of the IPS (Pay) Rules, 2016 (hereinafter referred to as the said rules), at Serial Nos. 1,2,3,4,5,6,7,8,9,11,13,14,17,19 under column (4), for the entry relating to the posts of Director (IB), Director (SVPNPA), DG (BSF), DG(CRPF), DG (ITBP), DG (CISF), DG (BPR &amp;D), DG (NSG), DG (RPF), DG (SSB), DG (Civil Defence Home Guard and Fire Services), DG (HRC) and DG (NIA), the following entries shall be substituted , namely:</p>
<blockquote><p><strong>&#8221; Apex or HAG+ pay scale as decided by the Appointment Committee of the Cabinet&#8221;.</strong></p></blockquote>
<p>(ii) In the Part (D) of Schedule -II of the IPS (Pay) Rules, 2016 (hereinafter referred to as the said rules) column (2) of the table for the entry relating to the post of Special Secretary to the Government of India, the following entries shall be substituted, namely:</p>
<blockquote><p><strong>&#8221; Apex of HAG + pay scale as decided by the Appointment Committee of the Cabinet&#8221;.</strong></p></blockquote>
<p>2. The amended Rules shall deemed to have come into force w.e.f. 21st July 2016.</p>
<p>3. You are requested to furnish comments on the proposed amendments latest by 5th October 2017, falling which it will be presumed that the State Government has no comments to offer.</p>

<p><b>           (iii) Brief of today&#8217;s meeting with Cabinet Secretary</b></p>
<p>Two very important issues, being persuaded by AIRF at the Railway Board level, have been resolved, one is -1S grade, which had been abolished by the VII CPC, has been restored, and the other issue regarding mutual transfer from one railway to other will be treated as inter-division transfer and need not to take NOC from the Zonal Railway Headquarters. Divisions at their own level will issue NOC, lot of time consumed for this purpose will be saved.</p>
<p>Comrades! Today I met the Cabinet Secretary (Government of India) and raised the issue of &#8220;Very Good&#8221; benchmark along with other issues of National Pension System (NPS), Minimum Wage and Fitment Formula and non-holding of JCM Meetings.</p>
<p>The Cabinet Secretary&#8217;s views were positive and he stated that he has already communicated to Chairman Railway Board and Secretary (DoP&amp;T) that benchmark for MACPS cannot be more than the benchmark prevalent for promotion/ selection.</p>
<p>He also stated that the issue of National Pension System (NPS) is under active consideration of the Government of India and he will try to derive the best formula to resolve the problems arrived out of NPS</p>
