OFFICE MEMORANDUM

Subject: Fixation of Pay on promotion/NFS of PSs of CSSS on or after 1.1.2016, who have already availed pay fixation and increment under MACP – clarification regarding.

The undersigned is directed to refer to this Department OM No.10/3/2004-CS. II (Pt.)(A) dated 18.4.2012 vide which Private Secretaries of CSSS who have already been granted increment and Grade Pay of Rs.5400 in the PB-2 of Rs. 9300-34800 under MACPS, have been allowed the benefit of one increment @3% when placed in Non-functional pay scale in PB-3 of Rs.15600-39100+GP Rs. 5400. After implementation of 7th CPC recommendations, the MACP guidelines have been amended vide OM No.35034/3/2008-Estt.(D) Vol.III dated 04.7.2017 modifying para-4 of the earlier MACP guidelines dated 19.5.2009. The OM dated 4.7.2017 inter alia states that .. “…. benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. There shall, however, be no further Fixation of pay at the time of regular promotion/ Grant of Non-functional Scale, if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion/grant of Non functional Scale, if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available. 

2. The issue of pay fixation and grant of increment to PSs of CSSS as per OM dated 18.4.2012 in the light of the revised guidelines issued vide OM dated 4.7.2017 has been examined in consultation with Establishment Division, DOPT and Dept. of Expenditure and it is clarified that the dispensation of pay fixation to PSs of CSSS as available under OM No.10/3/2004-CS.1l (Pt.)(A) dated 18.4.2012 shall not be available w.e.f. 1.1.2016 in view of the amendments made in the MACPS guidelines vide OM No.35034/3/2008-Estt.(D) Vol.II dated 04.7.2017. Accordingly, pay fixation and grant of increment on promotion/NFS on or after 1.1.2016 to PSs of CSSS, who have already availed pay fixation and increment under MACP, shall be regulated as per the guidelines vide OM No.35034/3/2008-Estt.(D) Vol. I dated 04.7.2017 and the provisions of OM dated 18.4.2012 of this Division shall not be applicable.

3. If any benefits based on this Division’s OM dated 18.4.2012 have been extended to any PS of CSSS on or after 1.1.2016, the same shall be reviewed based on the guidelines dated 4.7.2017 and recoveries, if any due, shall be made accordingly.

Sub: Restoration of pay fixation benefit on promotion from the post of SO(A) to AAO during the period 01.01.2006 to 29.08.2008.

Ref: This HQrs office circular bearing No. AN/XIV/14162NI CPC/Circular/Vol-IV, dated 04.09.2009.

Reference is invited to contents of circular cited under reference, wherein instruction was issued to discontinue the practice of allowing the benefits of pay fixation/allowances under RPR 2008 at the time of promotion from SO(A) to AAO in anticipation of clarification to be issued by Ministry of Finance (Department of Expenditure).

2. An OA No. 489/2011 was filed by Sh. S. Vijaya Kumar Naidu and 12 others before the Hon’ble CAT Bangalore Bench praying for restoration of pay fixation benefit of 3% allowed to the applicants on their promotion grade after 01.01.2006 and consequential benefits upon restoration of pay fixation benefit. The OA was allowed by the Hon’ble CAT and the order implemented by the Competent Authority in respect of the applicants only.

3. The issue was referred to DoP&T, Ministry of Law & Justice and Ministry of Finance for general implementation to all similarly placed persons. Having been approved by Ministries/DoP&T, the competent authority has decided to extend the benefit of Hon’ble CAT Bangalore Bench order dated 10.10.2012 in OA No. 489/2011 to all similarly placed persons, who were promoted to the post of Assistant Accounts Officer during the period from 01.01.2006 to 29.08.2008.

4. Hence, it is requested to restore the pay fixation benefit of 3% granted at the time of promotion to AAO grade from SO(A), which was withdrawn earlier. Necessary fixation may be carried out with all consequential benefits.

Action taken in this regard may be intimated to HQrs office.

 Recently, a reader’s query was published in Swamy’s News publication.

“After getting one promotion under ACP or MACP, and a subsequent regular promotion, will the employee qualify for another pay fixation?” This was the question’s summary.

An employee is given promotion under MACP only if he/she didn’t get any, under Regular Promotion. The pay is fixed based on 3% increment and Grade Pay difference. So, when regular promotion is given, the pay is revised only if there is a difference in the grade pay.

If another pay fixation is given, it would only result in confusion between Seniors and Juniors.

Let us assume that an employee named X gets a hike in basic pay from Rs. 2800 to Rs. 4200, after a regular promotion.
His Basic pay 12200 + 2800 = 15000
After promotion 15450 + 4200 = 19650

His junior, an employee named Y, gets a promotion from Rs. 2800 to Rs. 4200 under MACP.
His Basic pay 12200 + 2800 = 15000
After MACP 15450 + 4200 = 19650
Incase of getting regular promotion, no change in basic pay and no need of pay fixation.

If a second time pay fixation is given, then the Junior will draw a bigger salary than the Senior.
