NFIR

No. IV/NFIR/7 CPC (Imp)20l7/R.B.-Part II

Dated: 19/02/2018

The Chairman,
Railway Board,
New Delhi

Dear Sir,

Sub: Grave injustice done by successive Pay Commissions to the category of Junior Engineers and Senior Engineers in Railways-growing dissatisfaction, discontentment and frustration among Technical Supervisors – kind intervention requested.

The Junior Engineers and Senior Section Engineers in the Railways are field level Supervisors whose contribution for safe and efficient running of the system has been very significant. These Engineers ensure quality and efficiency in the course of performing their duties on Open Line/Construction and as well in Workshops/Production Units. Unfortunately, this core section of Supervisors has not been looked after matching with their duties and responsibilities over a period of time, consequently their pay structure as on date, got relegated to two levels only i.e. Pay Level 6 & 7 (7th CPC).

An honest review into the pay structure existed decades back for these Supervisory Staff and fair comparison with that of 5th, 6th & 7th CPC Pay Structures would establish the truth that these vital field leaders have been subjected to grave injustice, which led to deep sense of frustration among them. The following table reveals how the Junior Engineers and Senior Section Engineers have been put to perpetual injustice not only by the Pay Commissions but also at the hands of Ministry of Railways.

NFIR has been fighting for the cause of this neglected category at all fora, demanding review and justice. Though in the year 2006, the Railway Board had agreed for upgradation of 15% apex level Group ‘C’ posts to Group ‘B’ Gazetted, for facilitating promotion-of Senior Supervisors and written commitment was also given by the full Board on 7th February 2014, but sadly till date no positive results have emerged.

Railway Board have also given incorrect picture to the 7th CPC stating that these Engineers get promoted from one grade to the other on completion of every four years service. This incorrect position led the VIIth CPC not to recommend appropriate improved pay structure.

It is disheartening to mention that those technocrats recruited from Open Market through RRBs as Sr. Section Engineer (GP 4600 of 6th CPC/Level 7 of 7th CPC) have no career growth at all, due to non-provision of higher pay levels in the cadre structure, with tie result large percentage of these Engineers stagnated. In this context, NFIR brings to the kind notice of CRB that during 3rd CPC period the apex pay scale of Rs. 840-1040 & 840-1200 was allotted to the Technical Supervisors and these scales were higher than the pay scale of Group ‘B’ Gazetted Officer, but sadly the said position got demolished, causing demoralizing effect on Technical Supervisors who are the core Supervisory force accountable for safety, efficiency, punctuality and productivity.

NFIR has already taken up this issue through its PNM agenda given to Railway Board on 4th January, 2018, while the related subject raised by the Federation is also pending in the Departmental Anomaly Committee (DAC). A copy of NFIR’s PNM Agenda Item No.03 is enclosed for kind perusal.

Incidentally, NFIR also brings to the kind notice of CRB that in the General Managers Conference held at Rail Bhavan on 1lth January, 2010, the General Secretary, NFIR had pointed out to the Hon’ble Railway Minister, the miserable plight of Track Maintainers with no carrer growth at all for them, as a result of implementation of 6th CPC Pay Structure whereby, 94% of Track Maintainers got placed in Recruitment Grade Pay 1800/- while only 6% were placed in Gp 1900/- (benefit of Rs.100/- only p.m. on promotion). The Federation also explained to the Hon’ble Railway Minister in the GMs Conference that vast percentage of Track Maintainers retire/die in the recruitment Grade Pay itself. Responding to NFIR’s point, the Hon’ble Railway Minister had directed the Railway Board to constitute a Joint Committee to examine and propose special package.

The Committee met and reviewed the Track Maintainers cadre structure viz-a-viz working and service conditions and given its report to the Railway Ministry. After having considered the said report, the Railway Ministry had decided to grant cadre restructuring to this category, duly introducing new grade pay GP 2400/- and 2800/- respectively. This decision was taken by the Railway Ministry independently, without approaching Ministry of Finance.

In the case of JEs/SSEs, NFIR strongly feels that total revamping of cadre structure is the need of the hour, considering multifarious duties being performed by the Supervisors who are also buffers in between the management and workers at grass root level. Though the Hon’ble Railway Minister had sought approval of Finance Ministry for placement of 75% of posts of GP 4600/- in GP 4800/- Pay Level 8, there has been no positive result till date. This reveals that the Railway Ministry has failed to deliver justice to these unfortunate Engineers who are the backbone of the system and contributing for improved efficiency of the Railways. It may also be noted that the duty hours of these staff are unlimited, while they shoulder “stores/Materials” responsibilities in addition to their field duties and establishment matters.

In order to mitigate the problems and ensure justice to JEs/SSEs of Indian Railways, NFIR requests the Railway Board (CRB) to kindly get examined the Pay Structure of JEs/SSEs denovo, taking into account the cadre structure from 3rd CPC and onwards for the purpose of granting revised cadre structure. In this context, NFIR proposes the following for early consideration and approval.

Federation hopes that the Railway Board (CRB) would kindly give personal attention to this issue, so as to mitigate the injustice caused to JEs/SSEs of Indian Railways.

DA/As above

Yours Faithfully,
(Dr.Raghavaiah)

General Secretary

The 7th pay commission has recommended a 14.27% increase in the basic pay of government employees.

1. In the last 70 years, the government has announced 7 pay commissions.
2. In 1947, govt officials lowest salary was Rs 55 per month.
3. The 7th pay commission has recommended a hike of 14.27 pc in govt employees salary.

In the last 70 years, the Central government has announced seven central pay commissions. The 7th pay commission has recommended a 14.27 per cent increase in the basic pay of govt employees.

In 1947, after India’s Independence, the lowest salary of a central government employee was Rs 55 per month while the senior most officials took home a salary of Rs 2000 per month. After the 6th pay commission, the monthly salary of senior government officials rose to Rs 90,000 with the lowest salary being Rs 7000 per month.

Central Pay Commission’s previous recommendations:

Following was the salary slabs of government employees in different pay commissions:

The government employees’ salaries saw a significant rise with the 7th pay commission. Now, after the 14.27 per cent increase in basic salary, the lowest salary has been increased to Rs 18,000 from Rs 7,000 while the salary of senior government officials has gone up to Rs 2.50 lakh from Rs 90,000.

In the last 70 years, the Centre has increased the minimum salary of its employees from Rs 55 to Rs 18,000 per month – a hike of 32,727 per cent.

Whereas the salary of senior officials has seen a quantum jump of 12,500 per cent in the same period, from Rs 2,000 per month to Rs 2.50 lakh.

How Pay Commissions Play a Key Role in Boosting India’s Growth

Pay Commissions, which are regularly constituted to review salaries of Central government employees, give a fillip to the Indian economy, according to analysts.

The sixth Pay Commission partly offset the after-effects of the 2008 Lehman crisis on India because of the 35% increase recommended.

The implementation of the hike boosted two-wheeler and car sales and increased demand in the cement sector, according to global brokerage firm Bank of America Merrill Lynch.

Pay packages of government employees rose by an average of 35% as per the recommendations of 6th Pay Commission. They also received arrears of more than 30 months due to delay in the implementation.

“The arrears resulted in robust demand for consumer discretionary products that resulted in sustained stock performance over 3-5 years,” Jai Shankar, chief India economist of Religare, told NDTV Profit.

Due to this co-relation between Pay Commissions and economic growth, many analysts are eagerly awaiting the 7th Pay Commission report.

The 7th Pay Commission was appointed in February last year by the outgoing Congress-led UPA government, is likely to submit its recommendations by August-end or latest by October. The recommendations are likely to be implemented by the Central government next year.

About 50 lakh central government employees (including 15 lakh defence personnel) and more than one crore state and local government employees will gain from the recommendations to be made by 7th Pay Commission, according to Religare.

Besides, it will also result in an upward revision of pension for about 30 lakh retired Central government employees.

While there is no consensus on the amount of salary hike likely to be recommended by the 7th Pay Commission, analyst expects it to be in the range of 15 to 40%.

While Bank of America estimates the salary raise to be at 15%, Religare puts it at 28 to 30%. Credit Suisse expects a salary hike of 40%.

Economists see the 7th Pay Commission as improving the economic activity in the country by increasing consumption.

“The most important factor is economic activity itself which is gaining pace and, together with greater employment generation and policy reform, the 7th Pay Commission salary hike may help India enter a larger virtuous cycle,” said Religare.

“A 15 per cent salary increase would push up the central government’s salary bill by Rs 25,000 crore (or $4 billion), which is 0.2 per cent of India’s GDP. This will help in a consumption-driven recovery in the domestic economy,” said Indranil Sen Gupta of Bank of America Merrill Lynch.

TN Government Finance Department has issued an Abstract for Tamil Nadu Revised Scales of Pay Rules, 1989 for the Selection Grade/ Special Grade Scales also applicable to Secondary Grade Teacher and Headmaster Primary School.

ABSTRACT

1. G.O.Ms.No.210, P&AR(S) Department, dated: 11-03-1987.
2. G.0.Ms.No.666, Finance (PC) Department, dated: 27-6-1989.
3. G.O.Ms.No.304, finance (PC) Department, dated: 28-3-1990.
4. G.O.Ms.No.216, Finance (PC) Department, dated: 22-3-1993.

ORDER:

In the Government Order third read above, orders were issued re-introducing the Selection Grade/ Special Grade scales of pay and indicating the same in the annexure appended therein. It has also been ordered therein that the Selection Grade/Special Grade scales of pay should be restricted to the level of first level and second level promotion posts scales of pay.

2) Subsequently, the Tamil Nadu Administrative Tribunal in O.A.No.1625 of 1991 setting aside the entire para-4 of the Government Order third read above. Consequently, necessary fresh orders were issued to protect certain special categories in the matter of award of Selection Grade/ Special Grade scales of pay like Office Assistants in all departments and Secondary Grade Teachers in School Education Department.

3) Consequent on the issue of the above Government Order, the following deviations have been brought to the notice of Government:–

a) The spirit of the Government Order is to award Selection Grade/ Special Grade to the Secondary Grade Teachers by counting the services rendered prior to 1-6-1988 on identical scales of pay. But the services rendered beyond 1-6-1988 on lower scales of pay has also been taken into account which is against the general guidelines issued by Personnel and Administrative Reforms Department on award of Selection Grade/ Special Grade.

b) In respect of awarding of Selection Grade/ Special Grade in High Schools I Higher Secondary Schools in the post of Secondary Grade Teacher, the services were counted and they were granted the scale of pay applicable to the promotion post of Primary School Headmaster, eventhough there is no scope for all the Secondary Grade Teachers to become Primary School Headmaster.

c) The Special Teachers and Physical Education Teachers who do not form part of a feeder category to the post of Primary School Headmaster have also been granted the scale of pay of Primary School Headmaster without considering the financial implications due to Judgement Orders and on wrong misconception of the orders issued in the Government Order third read above.

4) Subsequent Pay Commissions have been implemented with effect from 1-1-1996 and 1-1-2006 and the scales of pay of Secondary Grade Teacher and Primary School Headmaster are fixed on two different pay scales are as follows:-

Pre-revised scale of
pay (01-01-1996)

Revised scale of pay

Rs.

Secondary Grade Teacher

4500-7000

5200-20200 +
Grade Pay of Rs.2800

Headmaster Primary School

5300-8300

9300-34800 +
Grade Pay of Rs.4300

As such, the services rendered in the post of Secondary Grade Teacher on a lower scale of pay cannot be counted for awarding Selection Grade/ Special Grade in the higher post of Primary School Headmaster on or after 01-01-1996.

5) Persons who are not entitled to get the benefit of higher Selection Grade/ Special Grade scales of pay applicable to Primary School Headmaster such as Secondary Grade Teachers in High Schools I Higher Secondary Schools as well as Special Teachers I Physical Education Teachers filed writ petitions in the Hon’ble High Court seeking legal remedies. In all such cases the court has passed favourable orders. It is observed that such orders were passed on the following grounds:–

(i) Counter Affidavits were not filed properly resulting in ex-party orders passed by the Hon’ble High Court.

(ii) Appeals were not filed in time.

(iii) Consultation of Personnel and Administrative Reforms Department, Finance

Department and Law Department for filing effective counter affidavits .

(iv) Delays in filing of Writ Appeals or Special Leave Petitions resulted confirmation of the orders of the Hon’ble High Court.

(v) Such court orders have been implemented and the undue benefits have been extended to the Secondary Grade Teachers as well as Special Teachers I Physical Education Teachers, consequent on filing of contempt petitions without examining the merits of individual cases which has caused a huge financial commitment to the State Exchequer running to several crores of rupees.

6) As per the general orders in vogue, as ordered in the Government Order first read above, the services rendered on identical and as well as higher scales of pay in the lower post can alone be taken into account for awarding Selection Grade/ Special Grade in the promotion post and no dispensation can be made in respect of any Government employee including Teachers for award of Selection Grade/ Special Grade due to misinterpretation of the orders issued in the Government Order fourth read above. Government have therefore decided to issue necessary amendment to the said Government Order to regulate the grant of Selection Grade/ Special Grade scales of pay of the employees including Teachers to avoid re-opening of settled issues.

7) Accordingly, the following amendment is issued to para-3 (ii) of the Government Order fourth read above:–

(1) In respect of Secondary Grade Teachers in High Schools I Higher Secondary Schools there is no promotion post for them. Whereas, there is a promotion post for the Secondary Grade Teachers in Primary Schools viz. Primary School Headmaster which envisages the restrictive proviso in para–4 of G.0.Ms.No.304, Finance (PC) Department, dated: 28-3-1990. As a measure of uniformity in the Selection Grade/ Special Grade scales of pay of Secondary Grade Teachers Government directed that the Secondary Grade Teachers in all schools be made eligible for the Selection Grade/ Special Grade scales of pay as indicated in the Annexure-1 to the Government Order third read above.

(2) The Selection Grade/ Special Grade scales of pay indicated in the Annexure-1 to the G.O.Ms.No.304, Finance (Pay Cell) Department, dated: 28-3-1990 is applicable for the Fifth Tamil Nadu Pay Commission period only i.e. from 1-6-1988 to 31-12-1995. As such, the benefit of Selection Grade/ Special Grade scales of pay as contemplated in para-3 (ii) of G.O. Ms.No.216, Finance (Pay Cell) Department, dated: 22-3-1993 shall be made applicable only to the cases of Secondary Grade Teachers and other employees who were awarded Selection Grade/ Special Grade between 1-6-1988 and
31-12-1995 and the same cannot be extended beyond this date as subsequent Pay Commission revisions were implemented with effect from 1-1-1996 and 1-1-2006 respectively on par with the counterparts in Government of India.

(3) As the Secondary Grade Teachers in Primary schools is the feeder category for the post of Primary School Headmaster, they were allowed to count the services rendered on identical scales of pay prior to 01-06-1988 in the post of Secondary Grade Teachers for awarding Selection Grade/ Special Grade in the promotion post of Primary School Headmaster. In the case of Special Teachers and Physical Education Teachers they have no chance for promotion as Primary School Headmaster and are not considered as a feeder category to the post of Primary School Headmaster with reference to Rule-2 of Tamil Nadu Elementary Education Subordinate Service Special Rules. Hence, the Special Teachers I Physical Education Teachers are not entitled for Selection Grade/ Special Grade applicable to the post of Primary School Headmaster considering the services rendered in the post of Special Teachers/ Physical Education Teachers.

8) The above revised order shall not be applicable to the cases where orders have already been issued by the competent authority in pursuance to the court orders and in cases where the court verdict reached finality.
