<p>Dear Sir,</p>
<p>Sub: &#8211;  <strong>Terms of Reference of the 7th Central Pay Commission.</strong></p>
<p>We have gone through the Terms of Reference of 7th Central Pay Commission approved and notified by the Government on 28.02.2014. We find that the Terms of Reference finalized by the Government is at variance in many respects to the Draft Terms of Reference the Staff Side had submitted to you on 25.10.2013 after holding in-house discussion on 24.10.2013.</p>
<p>At the conclusion of the meeting held on 24.10.2013, it was agreed that the Government would consider our suggestions in the matter and will convene another meeting with the presence of the Secretary (Expenditure) to iron out the differences, if any, and explore the possibilities of an agreement in the matter.</p>
<p>We regret to inform you that no such meeting was convened and no attempt was made by the Official Side to arrive at an agreed Terms of Reference. We find that the Government has rejected the suggestions of Staff Side for either taking a decision in the matter of Interim Relief, Merger of DA, representation of labour nominee in the Commission itself, inclusion of the Grameen Dak Sewaks within the purview of the 7th CPC, bringing parity in pension between the past and present pensioners, covering the employees appointed on or after 01.01.2004 within the ambit of the Defined Benefit Pension Scheme, date of effect, settlement of the pending items in the National Anomaly Committee etc. or referring those issues to the Commission itself for an Interim Report.</p>
<p>Besides, we are to state that the existing Productivity Linked Bonus (PLB) Scheme, being a bilateral agreement, cannot be subjected to scrutiny and examination by the 7th CPC.</p>
<p>We, therefore request you to kindly convene a meeting of the Standing Committee of National Council (JCM) to discuss the issue, so as to make amendments to the Terms of Reference finalized by the Government arbitrarily.<br />

<p>Comrade,</p>
<p>As decided in the meeting of Confederation of Central Govt. Employees Karnataka State ( COC ) held on 29-10-2013 at ITEF  and a one day State level  Seminar of all India Central Government Employees will be held on 18-12-2013, Wednesday at Bangalore to discuss common demands of the Central Government Employees for presenting the memorandum to the  7th Central Pay Commission . The Seminar will be addressed by Comrade <strong>K.K.N.Kutty</strong>, President of Confederation of Central Govt. Employees  New Delhi and Comrade <strong>M.Krishnan</strong> Secretary General Confederation of Central Govt. Employees  New Delhi .</p>
<p><strong>It is requested to give wide publicity to this seminar so that delegates from all over the State  to attend this Seminar</strong> representing  all Central Government Departments, we can a fruitful discussion on the common demands of Central Government Employees . Since the Central Government is likely to set up the 7th Central Pay Commission  in December 2013, hence this seminar will be very vital for CG Employees.</p>
<p>In order to meet the expenses towards food and snacks, printing of memorandum about 50 pages, traveling expenses of the  central leaders a sum of Rs 150/- (one hundred and fifty) will be charged as delegate fee.</p>
<p>The affiliates are requested to intimate well in advance regarding the participation in seminar so that arrangements can be made for the seminar such as food and  printing of memorandum. The affiliates of COC are requested to intimate by 1st December  to the undersigned.</p>
<p><em><strong>The  minimum delegates  shall be as follows :</strong></em></p>
<p>NFPE &#8211; 70 members   (RMS 10 P3 30 P4 20  DAP 10)<br />
ITEF 30 members, AG&#8217;s 10 members, SOI 10 members, Central Excise 10  members<br />
Ground water 10  members, CGHS 10  members, Census 10  members GSI 10  members<br />
CWC 5  members IMD 5 members   ASI  5 members others each 5 members.</p>
<p>If any outstation members require accommodation for stay at Bangalore it is available at  NGO rooms Cubbon park at Rs 250/- for three persons, they can book through their respective associations well in advance .</p>

<p>1) Providing proper minimum wage of Rs 25000/- for CG Employees including that of GDS employees and pay scales.</p>
<p>2) Increment rate should be 10% of basic pay. The present grade pay system should be removed, the time scale gap between one posts to another should be at-least Rs 1000/ not Rs 100/ at present and it should be uniform rate from starting to end. The Group B gazetted post should start from Rs 5400/- GP.   Grant of Grade Pay Rs.4800 to  Supervisors cadre. Removal of Grade Pay Rs.2000.  There should be uniform pay scales for similar posts.</p>
<p>3) Proper promotion policy that is in a career and   in same grade pay providing additional increment for those who got MACP promotion. Provide five promotion to all. Promotional benefit should be at-least Rs 2000/- per month.</p>
<p>4. Providing proper DA for CG employees &amp; rectification of DA formula and DA merger etc.</p>
<p>5) There are three demands of working women</p>
<blockquote><p>a)Flexi working  working hours due to traffic problems.<br />
b) CCL not granted as loop holes are their in the order.<br />
c)Posting  on promotion at same place.</p></blockquote>
<p>6) ) Proper entitlement of wards in hospitals under CGHS and proper health care system.</p>
<p>7)  Increasing tour TA/ DA  rates for field staff.</p>
<p>8 Transport Allowance for all field staff without any conditions.</p>
<p>9) Increase in OTA rates on par with Railways.</p>
<p>10) Night Duty Allowance on par with Railways.</p>
<p>11) Increase in rate of all Allowances including HRA it should be doubled.</p>
<p>12) Stitching charges for uniforms should be doubled.</p>
<p>13) VRS scheme on par with Railways.<br />
14) Compensate appointment on par with Railways remove ceiling.</p>
<p>15) Ensure 8.33% of the Gross salary as Bonus, Removal of ceiling on Bonus, etc<br />
16) Exemption of Transport Allowance from the purview of Income Tax &#8211; enhancement of exemption limit from Rs.800 to Rs.3200 plus DA thereon.</p>
<p>17) Providing good quality uniforms.</p>
<p>18) To exempt Children education Allowance from Income Tax.</p>
<p>19) To fill up all vacancies in all Central Government Establishments and remove ban on recruitment.</p>
<p>20) Provide additional increment w.e.f. 01.01.2006 to staff working in old pay scale Rs.7450-11500.</p>
<p>21) The daily wages of the casual labour are to be fixed as 1/30th of the monthly salary of a regular employee working in the same kind of job.</p>
<p>22) To remove the anomalies in the pay of Direct Recruitees and the promotees in the all cadre and stepping up of pay.</p>
<p>23) Merger of Jr. Clerk (LDC) and Sr. Clerk (UDC) and allotment of Grade Pay Rs.2800 as entry level in Clerical Cadre.</p>
<p>24) Parity in pay scales of the Ministerial and Stenographers   between Field and Secretariat offices.</p>
<p>25) Pay parity of Drivers on par with Central Secretariat Drivers.<br />

26 To abolish the license fee for the Departmental Quarters allotted to the employees since the HRA is recovering fully.</p>
<p>27 For improvement in the House Building Advances – To reduce the rate of interest, One more chance to avail HBA who already taken earlier to improve the existing accommodation, allowing to avail HBA for extension, renovation of exiting own accommodations, HBA for purchasing resale flats/houses.</p>
<p>28 To revise various Allowances such as Winter Allowances, Hill Compensatory Allowances, Tribal Allowances, etc. and to ensure the rate on par with the concerned state Governments.</p>
<p>29 To revise the Gratuity equal to last drawn one month salary and to extend the gratuity to the employees joined after 01.1.2004.</p>
<p>30  Restore two increments or more on acquiring additional qualifications.</p>
<p>31  To enhance – double the CEGIS coverage limit.</p>
<p>32  To enhance all Allowances such as DA, HRA, Special Allowances by 25% from the date of attaining DA 50%.</p>
<p>33  To modify the OM issued by Dept of Expenditure to fix the Pay on promotion to a post carrying higher duties and responsibilities carrying the same grade pay by deleting the reference previous OM by the Department issued in the year 2000, i.e. prior to the implementation of 6th CPC.</p>
<p>34  To stepping up the Pay Scale of Seniors on par with the juniors who are elevated on account of ACPs.</p>
<p>35  Rectification of all anomalies.</p>
<p>36  Holidays grant of 12 Casual Leave and Local CWCC should be given more powers.</p>
<p>37  Pension issues &amp; Scrapping of New Pension Scheme.</p>
<p>38  Provide ample facilities to Sports persons working in the Central Government.</p>

<p>Dear Comrade,</p>
<p>The Govt. of India have always kept Gramin Dak Sevaks (GDS) of the Postal Department numbering more than 3 lakhs outside the purview of the Pay Commission. It is a deliberate attempt to deprive them of their rights. This has been the policy all along. The Govt. have been confusing the issue of legal status of GDS as Govt. servants and taking negative stand. After sustained agitation by GDS, a Committee headed by justice Talwar was constituted by the Govt. The Committee came to the conclusion that GDS are Central Govt. employees and Recommended accordingly. This was also earlier the view of the First and Fourth Pay Commissions. In fact first CPC considered their claims &amp; made recommendations accordingly. Disregarding bureaucratic attempts at confusing the legal status of GDS, both these commissions refused to toe the official line and took an independent view that GDS are Central Govt. employees. The following points need specific attention.</p>
<p>The GDS have always been counted &amp; treated as part &amp; parcel of total Postal workforce. In fact they are more than 55% of the total postal workforce and are running more than 80% post offices in the country, whereas regular Postal employees are only 45%. Justice Talwar committee was firmly of the view Commission. The most important recommendation which Justice Talwar Committee made was that in future these employees should be included within the purview of the Pay Commissions, keeping in view their number, their work profile, effectiveness to the postal system and the services rendered to the public.</p>
<p>Attention is also invited to the landmark judgement of the Hon’ble Supreme Court in Gokulananda Dass case decided on 22.4.77 wherein it has categorically been held that GDS are holders of civil post under the union which means they are Central Govt. employees. Recently Central Administrative Tribunal Bench in Tamilnadu and Chandigarh have also held that GDS are Central Govt. employees.</p>
<p>The Gramin Dak Sevaks of the Postal Deptt. have made representation to the Govt. that their claims regarding revision of their pay scales and service conditions may be included in the Terms of Reference of Seventh Pay Commission and Commission may be asked to make recommendations as in the case of other Central Govt. employees. We are soliciting your kind support to our Demand with the request that you may kindly raise our demand when Govt. invites you for discussion to finalise Terms of Reference.</p>
