<p>Sub: <strong>Filling up of posts of Multi-Tasking Staff (erstwhile Group &#8216;D&#8217; post) in Railway Board by absorption basis in Level-I of Pay Matrix (Pre-revised: Pay Band-1 (Rs.5200-20200) and Grade Pay Rs.1800) from the employees of Zonal Railways/Production Unions.</strong></p>
<p>Ref: Railway Board&#8217;s letter No.20l8/ERB-515 (4)l0l dated 08/0812018 addressed to<br />
Zonal Railways and Production Units etc.,</p>
<p>With reference to Railway Board&#8217;s letter dated 08/08/2018 inviting applications from the staff working in Zonal Railways etc., for filling the vacancies of Multi-Tasking Staff in Rail Bhavan, New Delhi, it is informed that on some Zonal Railways the applications of staff are not entertained on the plea that no replacement is available and on a few Zones, the Board&#8217;s circular is not being circulated resulting the staff not able to submit their applications. Staff are disappointed over the negative approach of Zonal Railways and they also fear that the only opportunity now provided for them to join Rail Bhavan, New Delhi will be lost.</p>
<p>NFIR therefore requests the Railway Board to kindly issue clear instructions to the GMs etc., to circulate widely Board&#8217;s letter and forward the applications of staff promptly.</p>

<p>(D) Monetary ceiling for free diet for beneficiaries suffering from TB or Mental disease</p>
<p>The monetary ceiling for free diet in case of beneficiary suffering from TB or Mental diseaseis revised to pay/pension/family pensionof Rs 69,700/-per month.</p>
<p>(E) Pay slab for determining the entitlement of Nursing Home facilities in Government / State Government / Municipal Hospitals</p>
<p>The monetary ceiling for determining the entitlement The monetary ceiling of nursing home facilities in Central Government / State Government / Municipal Hospitals is revised to pay / pension / family pension Rs. 47,600/- per month and above.</p>
<p>(F) Monetary Ceiling for direct consultation with Specialists in Central Government / State Government / Municipal Hospital</p>
<p>The monetary ceiling for determining the entitlement for direct consultation with Specialists in Central Government / State Government /Municipal Hospitals will continue at the existing rates until revision of the Same after consultation with Ministry of Finance. (G)Pay slab for determining the entitlement of accommodation in AIIMS, New Delhi. The revised entitlement, as per the pay drawn by the officials, is as follows:</p>

<p>Sub :- <strong>Remuneration to be paid to the Gramin Dak Sevaks engaged as substitutes in short term vacancies of Postmen/Mail Guards and MTS.</strong></p>
<p>1 , Attention is invited to this Directorate OM of even number dated 26.04.2017 vide which rate of remuneration of the <strong>Gramin Dak Sevaks</strong> engaged as substitutes in short term department vacancies of Postmen, Mail Guards and MTS was issued. In this context, references are being received from Service Unions that the words &#8220;In future&#8221; and &#8220;with effect from 01.01.2016&#8221; in the Para 3 of the said OM dated 26.04.2017 give different impression over date of implementation of the instructions and has requested to issue clarification.</p>
<p>2. The matter has, further, been examined in this Directorate in the light of the approval of Department of Expenditure, Ministry of Finance and it is clarified that the orders contained in the ibid OM dated 26.04.2017 (copy attached) are to be implemented w.e.f. 01.01.2016.</p>

<p>Subject: <strong>Remuneration to be paid to the Gramin Dak Sevaks engaged as substitutes in short term vacancies of Postmen/Mail Guards and MTS.</strong></p>
<p>Consequent upon the implementation of the Seventh Pay Commission&#8217;s recommendations, the matter regarding the rates of remuneration payable to Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen/Mail Guards and MTS has been reviewed.</p>
<p>2. It has now been decided that the remuneration of the Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards and MTS may be calculated on the basis of the minimum pay of the respective levels of the pay matrix in whiCh the substitute is engaged as defined in the CCS (Revised Pay) Rules 2016 and as mentioned in Table below:</p>

<p>3. In future, GDS who are willing to work as substitute will be paid at the minimum pay of the respective Levels of the Pay Matrix barring other allowances like HRA, Transport allowance etc. with effect from 01.01.2016.</p>
<p>4. This issues with the concurrence of Ministry of Finance, Department of Expenditure, Implementation Cell, DoE, ID Note No. 30-1/17 (ii) /2016-IC (Pt) dated 20.04.2017.</p>

<p>Subject:- <strong>Modified Assured Career Progression Scheme for the Central Government Employee Clarification regarding</strong>.</p>
<p>the undersigned is directed to invite reference to the Para 4 of Annexure-I of the Modified Assured Career Progression Scheme issued vide the Department of Personnel and Training Office Memorandum No. 35034/3/2008-Estt.(D) dated May 19, 2009 providing that benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation upder the scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion if it happens to be in a post carrying higher grade pay than<br />
what is availalable under MACPS, no pay fixation would be available and only difference of grade pay would be made available.</p>
<p>2. References have been received from varios Ministries/Departments whether at the time of regular promotion/grant of Non-Functional scale, the employee may be allowed to draw the difference in Pay after availing regular increment in the Pay Band and Grade Pay w.e.f. date of<br />
promotion or date of next increment consequent to MACP.</p>
<p>3. The matter has been considered in this Department in consultation with the Department of Expenditure and it has been decided that the para 4 of the Annexure-I of the MACP Scheme would be modified as under:</p>

At the time of such regular promotion/grant of Non-Functional Scale to the higher grade pay than what has been given under MACPS, the employee have the option to draw the difference of Grade Pays from the date of such regular promotion/grant of Non-Functional Scale or the date of accrual of next increment in the pay allowed under MACP&#8221;<br />
4. This modification in the MACP Scheme is being issued in consulation with the department of Expenditure.</p>

<p>G.S.R. 575(E).-In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, hereby makes the following rules to amend the Indian Administrative Service (Pay) Rules, 2016, namely:- 1.</p>
<p>1. These rules may be called the Indian Administrative Service (Pay) Amendment Rules, 20 I 7.</p>
<p>2. They shall be deemed to have come into force on the I st day of January, 2016.</p>
<p>2. In the Indian Administrative Service (Pay) Rules, 2016.-</p>
<p>(i) in rule 2, for clause (xi), the following shall be substituted, namely:-</p>
<p>&#8220;(xi) &#8220;Level in the Pay Matrix&#8221; shall mean the Level corresponding to the existing Pay Band and Grade Pay or scale specified in the <b>Pay Matrix in APPENDIX-I</b>&#8221; ;</p>
<p>(ii) for rule 7, the following shall be substituted, namely:-</p>
<p><b>&#8220;7. Pay protection to officers on Central deputation.-</b> If the pay of the officers posted on deputation to the Central Government, after fixation of their pay in the revised pay structure, either under these rules or as per the instructions regulating such fixation of pay of the post to which they are appointed on deputation, happens to be lower than the pay they would have entitled to, had they been in their parent cadre and would have drawn that pay but for the Central deputation, such difference in the pay shall be protected in the form of Personal Pay with effect from the 1st January, 2016&#8243;</p>

<p>Sub: <strong>Selection for Promotion to Group &#8216;B&#8217; post of Law Officers in Level 8 in Pay Matrix (equivalent to Pay Band PB-2 (Rs.9300-34800) with Grade Pay of Rs. 4800/-)</strong></p>
<p>Consequent upon restructuring of gazetted cadre of legal department of new Zones and Divisions, instructions were issued vide Board’s letter no.E(P)2005/2/26 dated 18/05/2007 for filling up of those upgraded Group &#8216;B&#8217; posts of Law Officers from amongst the senior most Chief Law Assistants after screening process consisting of written examination, viva-voce and assessment of record of service as prescribed for Group &#8216;B&#8217; selections. Thereafter, vide Board’s letters of even number dated 04/02/2008 and 16/11/2011, instructions were issued for filling up of normal Group &#8216;B&#8217; vacancies arising in the cadre through Selection from amongst eligible Chief Law Assistants.</p>
<p>2. Vide Board&#8217;s letter No. 2003 E (GC) 12-14(64) dated 30.05.2016, consequent upon restructuring of Gazetted cadre in the old zones and Railway Board, 43 posts of Chief Law Assistants have been upgraded to Group &#8216;B&#8217; posts of Law Officer.</p>
<p>3. The procedure for filling up all Group &#8216;B&#8217; posts of Law Officers (including all the upgraded posts) has been reviewed and it has been decided in supersession of the aforementioned earlier instructions on the matter that the Group &#8216;B&#8217; posts of Law Officers may now be filled up as per the provisions of Indian Railway Establishment Manual, VOLI and extant Rules i.e. through Selection comprising of written test and viva-voce (including assessment of record of service) from amongst Chief Law Assistants in Level 7 in Pay Matrix (equivalent to Pay Band PB-2 (Rs. 9300-34800) with Grade Pay of Rs. 4600/-) provided they have rendered not less than 2 years of non-fortuitous service in the grade (including non-fortuitous service rendered in the pre-revised scale).</p>
<p>4. It is further advised that the above procedure for filling up of upgraded Group &#8216;B&#8217; post of Law Officer may be followed subject to the outcome of SLP filed against Hon’ble High Court/Allahabad’s judgement dated 03.10.2007 in CMWP No.48471/2007 arising out against CAT/Allahabad’s order dated 02.02.2007 in OA No. 906/2006 filed by Late Shri H.K. Tiwari, CLA, N.C. Railway.</p>

<p>Central Electricity Regulatory Commission (CERC), statutory body under Ministry of Power constituted under an Act of Parliament, invites applications for the post of Secretary to be filled up by deputation, on foreign Service terms, from the Officers of Central/State Governments.</p>

<p>3. The general terms and conditions are as under:-</p>

<td>Apart from basic pay and grade pay, the posts carry Dearness Allowance, HRA, and Transport Allowance etc. at the rates applicable to Central Government officials from time to time.</td>
</tr>
<tr>
<td>ii)</td>
<td>Fixation of pay/Deputation (Duty) Allowance shall be governed by the instructions issued by Department of Personnel and Training from time to time.</td>
</tr>
<tr>
<td>iii)</td>
<td>Maximum age limit is 56 years on the last date of receipt of the applications.</td>
</tr>
<tr>
<td>iv)</td>
<td>The facility of retention or allotment of Government Accommodation is available at present. Moreover as per CERC (Leased Accommodation) Regulations, 2007, Leased accommodation for lease rental up to 60% of Basic pay and Grade pay would be permissible if opted, subject to the conditions laid down therein.</td>
</tr>
<tr>
<td>v)</td>
<td>The above post is exempted from the principle of immediate absorption.</td>
</tr>
<tr>
<td>vi)</td>
<td>Medical re-imbursement through Authorized Medical Attendants is admissible as per the CERC (Indoor/Outdoor Medical facilities) Regulations, 2005. This is in lieu of the CGHS benefits, who choose to opt for the CERC Regulations.</td>
</tr>
<tr>
<td>vii)</td>
<td>The normal period of deputation on foreign service terms is five years as per the CERC (Recruitment, Control and Service Conditions of Staff) Regulations, 2007.</td>
</tr>
<tr>
<td>viii)</td>
<td>Officials appointed to CERC shall be governed by the terms and conditions of Department of Personnel and Training’s O.M. No. 6/8/2009-Estt (Pay-II) dated 17th June, 2010 read with Central Electricity Regulatory Commission (Recruitment, Control and Service Conditions of Staff) Regulations, 2007 as amended from time to time.</td>
</tr>

<td>ix)</td>
<td>CERC reserves the right to keep any or all of the posts unfilled depending on the circumstances prevailing at the time of selection.</td>
</tr>
<tr>
<td>x)</td>
<td>CERC reserve the right to change the number of posts as may be required by the circumstances prevailing at the time of selection</td>
</tr>
<tr>
<td>xi)</td>

<p>5. The applications must be routed &#8220;Through Proper Channel&#8221; and the applications which are not in the prescribed format shall not be accepted. <p>7th Pay Commission recommended for bunching of two stages in the report para 5.1.36 , “however if situation does arise whenever more than two stages are bunched together, one additional increment equal to 3 percent may be given for every two stages bunched, and pay fixed in the subsequent cell in the pay matrix.”</p>
<p>Also Government released order on7th September 2016, with the following instructions</p>
<blockquote><p>1. One additional increment shall be given for every two stages bunched and the pay of Government servant drawing higher pay in pre-revised structure shall be fixed at the next vertical Cell in the applicable Level</p>
<p>2. Pay drawn by two Government servants in a given Pay Band and Grade Pay or scale where the higher pay is at least 3% more than the lower pay shall constitute two stages. Officers drawing pay where the difference is less than 3% shall not be entitled for this benefit.</p></blockquote>
<p><b>Illustration:</b></p>
<p>if two persons drawing pay of 53,000 and 54,590 in the GP 10,000 are to be fitted in the new Pay Matrix, the person drawing pay of 53,000 on multiplication by a factor of 2.57 will expect a pay corresponding to 1,36,210 and the person drawing pay of 54,590 on multiplication by a factor of 2.57 will expect a pay corresponding to 1,40,296. Revised pay of both should ideally be fixed in the first cell of Level 14 in the pay of 1, 44,200 but to avoid bunching the person drawing pay of 54,590 will get fixed in second cell of Level 14 in the pay of 1,48,500.</p>
<p><i>Based on this we have calculated bunching benefit for all the grade pay in 7th CPC salary</i></p>
