<p>Subject: <strong>76th Report of the Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice Recommendation regarding suo-motu disclosure under Section 4 of justify to Information Act, 2005.</strong></p>
<p><strong> </strong></p>
<p>Reference is invited to this Department’s Office Memorandum No.1/6/2011-IR, dated the 15th April,2013 wherein all Ministries / Departments were advised to appoint a senior officer not below the rank of a Joint Secretary and not below the rank of Additional HoD in case of attached offices for ensuring compliance with the proactive disclosure guidelines. Subsequently, vide O.M.No.1/1/20-13~IR dated 21st October,2014, all Ministries / Departments were requested to take action to upload the replies to RTI applications and first appeals on their respective websites. in this context, the Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice has, in Para 4.40 of its 76th Report, inter-alia made the following observation / recommendations:</p>
<blockquote><p><strong><em>“The direction given by DoPT in their guidelines for implementation of Section 4 of the RTI Act which required appointment of a Joint Secretary rank officer as the Nodal Officer should be followed in letter and spirit. The Committee feels that all Ministries/ Departments/ Organisations themselves must encourage suo-motu disclosure of relevant information. The Committee suggests the publishing of RTI requests and their replies on the websites of the Departments so that duplicity of requests is avoided. All Departments must make an analysis of information which is sought most often from applicants and provide it on their website as suo-motu disclosure.”</em></strong></p></blockquote>
<p>The above mentioned recommendations of the Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice are hereby brought to the notice of all Ministries / Departments and Public Authorities for strict compliance.</p>

<p>The contents of this O.M. may also be brought to the notice of Attached Subordinate Offices and Public Sector Undertakings for necessary compliance.</p>

										<content:encoded><![CDATA[<p><strong>Recommendations on Prevention of Corruption Bills</strong></p>
<p>The Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice presented its 69th Report on the Prevention of Corruption (Amendment) Bill, 2013 on 6th February, 2014.</p>
<p>The recommendations made in the aforesaid Report are under consideration of the Government. The Bill was introduced in the Rajya Sabha, in order to fill certain gaps in description and coverage of the offence of bribery so as to bring it in line with the current international practice and also to meet more effectively, the country’s obligations under United Nations Convention Against Corruption (UNCAC).</p>
<p>The said Bill, inter alia, proposes to address the supply side of corruption (punishment to bribe-giver), to protect honest public servants from vexatious prosecution for any bona fide omission or commission in the discharge of official duties and to lay down clear criteria &amp; procedure for sanction of prosecution.</p>
<p>Having regard to the fact that the Bill contemplates an important paradigm shift in defining the offences relating to bribery, Government sought the views of the Law Commission of India on the proposals contained in the Bill. The Law Commission of India, in its 254th Report on the Bill, presented to the Government on 12th February, 2015, has suggested a number of significant improvements in the Bill which are also presently under consideration of the Government, with a view to moving necessary official amendments in the said Bill.</p>
<p>Government is keen to have the Bill passed by Parliament at the earliest. However, since the Bill will have to be considered and passed by both Houses of Parliament, it is not possible to indicate any timeframe for the purpose.</p>
<p>This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office, Dr. Jitendra Singh in a written reply to a question by Shri B. Sriramulu, Shri D.K. Suresh and Shri Anto Antony in the Lok Sabha today.</p>

Subject:- Recommendation of Department Relates Parliamentary Standing Committee on Compassionate Appointment &#8211; reg.</p>
<p>The undersigned is directed to refer to para 9.3 of the 23rd Report on Government Policy on Compassionate Ground given by Department Related Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice, Rajya Sabha. The Committee inter-alia recommended as under:</p>
<p>i. The guidelines/circulars issued by the Government must be complied with and a feedback must be obtained from each of the administrative Ministries so that a cross check can be in place to see that the instructions issued are followed properly.</p>
<p>ii. The role of the administrative Ministries under which the particular PSU comes become all the more important and it should pass on each and every instruction issued by the Government of India to the PSUs and receive the confirmation from them and send the feedback to the Government of India.</p>
<p>iii. A yearly report must be sent to the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) by the administrative Ministries to ensure whether the instructions issued by the Government are complied with and the Ministry of Personnel must also call for a report on the issue per annum.</p>
<p>2. The Department of Public Enterprises vide their letter no.2(63)07-DPE(GM) dated 11th March 2008 informed the Committee that Vittal Committee has reviewed the guidelines issued by them in the matter of compassionate appointment. CPSEs were given autonomy to frame their own guideline on compassionate<br />
appointment keeping in view their operational / business requirements. The Department of Financial Services informed that the scheme formulated and circulated by the Indian Banks’ Association to all the public sector banks, ensures the uniform application of the appointment on compassionate grounds or ex-gratia in lieu thereof.</p>
<p>3. All the administrative Ministries/Department are requested to furnish an annual report in the enclosed proforma latest by 30th April of every year, indicating the status of implementation of government instructions on compassionate appointment as on 31st March of that year. Initially separate reports for three years covering the period from 01.04.2010 to 31.03.2011, 01.04.2011 to 31.03.2012 and 01.04.2012 to 31.03.2013 should be sent. Thereafter, an annual report covering the period from 1st April of the preceding year to 31 March of the current years be sent. While forwarding the report, the status of compassionate appointment in public sector units/banks/Insurance companies, autonomous bodies etc. may be indicated.</p>

										<content:encoded><![CDATA[<p>Parliamentary Consultative Committee meeting on Comprehensive Amendments in Labour Laws Moots Effective Implementation and speedy Grievance Redressal</p>
<p>Members participating in the meeting of Parliamentary Consultative Committee on Comprehensive Amendment in Labour Laws have urged the government for the effective and speedy implementation of labour laws along with the timely redressal of Grievances. In meeting held yesterday the members raised the issue of Child labour Laws alongwith the Contract Labour Law reforms. Union Labour &amp; Employment Minister Shri Mallikarjun Kharge, who chaired the meeting assured the members for due consideration on the issue raised.</p>
<p>Welcoming the members the minister the minister said Labour being a subject in the Concurrent List where both Central and State Governments are competent to enact legislations. Ministry of Labour &amp; Employment is presently administering 44 Labour Laws catering to diverse subjects, namely, occupational health &amp; safety, employment services, training of apprentices, skill development, minimum wages, social security, industrial dispute, labour welfare, child labour etc. He said the Ministry has been reviewing various labour laws from time to time and taking action towards amendment of the labour laws keeping into consideration the changes in the socio economic scenario and the requirements of the workers in organized as well as in the unorganized sector.</p>
<p>Shri Mallikarjuna Kharge informed the members that last few years, amendments have been carried out in Payment of Wages Act, 1936 enhancing ceiling of workers from Rs.1,600/- to Rs.6,500/- per month and subsequently to Rs.10,000/- per month, Payment of Bonus Act, 1965, wherein the calculation ceiling and eligibility limit under the Act has been enhanced from Rs.2,500/- to Rs.3,500/- and from Rs.3,500/- to Rs.10,000/- per month respectively.</p>
<p>The Apprentices Act, 1961 has been amended to provide reservation for other backward classes. The Maternity Benefit Act, 1961 has been amended to enhance the medical bonus from Rs.250/-to Rs.1000/- and also empowering the Central Government to further increase it to maximum of Rs.20,000/- through Gazette Notification.</p>
<p>The Workmen’s Compensation Act has been amended to make it gender neutral and it is now called “the Employees’ Compensation Act, 1923. Besides this, the Compensation in case of death, disablement and funeral expense paid under the Act have also been enhanced. The Plantation Labour Act, 1951 has been amended to provide safety and occupational health care to plantation workers.</p>
<p>The minister said his Ministry has amended the Employees’ State Insurance Act, 1948 to improve the quality of delivery of benefits under the scheme and also to enable ESI infrastructure to be used to provide health care to workers of the unorganized sector. The Payment of Gratuity Act, 1972 has been amended to enhance ceiling on gratuity from Rs.3.5 lakh to Rs.10 lakh and to cover the teachers in educational institutions.</p>
<p>Also, the Industrial Disputes Act, 1947 has been amended to amplify the term “appropriate Government” defined under section 2(a) of the Act. The wage ceiling for coverage under the Act has been enhanced from Rs.1600/- to Rs.10,000/- per month to cover workmen working in supervising capacity. The amended provisions also provide direct access for the workman to the Labour Court or Tribunal.</p>
<p>Shri Kharge also informed that the Government has also introduced Bills in Parliament for Amendment in the following Labour Acts: &#8211;</p>
<p>(i) The Mines Act, 1952.<br />
(ii) The Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988.<br />
(iii) The Inter-State Migrant Workmen (Regulations of Employment and Conditions of Service) Act, 1979.<br />
(iv) The Child Labour (Prohibition &amp; Regulation) Act, 1986.</p>
<p>It was also highlighted that other major Labour Acts which are under various stages of consideration for amendments are: &#8211;</p>
<p>(i) The Building and Other Construction Workers (Regulation of Employment &amp; Conditions of Services) Act, 1996<br />
(ii) The Factories Act 1948,<br />
(iii) The Minimum wages Act 1948,<br />
(iv) The Employees Provident Fund and Miscellaneous Provisions Act 1952,<br />
(v) The Apprentice Act 1961<br />
(vi) The Contract Labour (Regulation and Abolition) Act 1970<br />
(vii) The Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959.</p>
<p>Shri Khrge solicited members cooperation &amp; guidance in the formulation of amendments as well review of Labour Laws in the course of discussions. Shri Mangala Kisan (BJD) &amp; Shri Ram Sunder Das (SP) were the members who participated in the dissussions. Besides, the Minister of State in the Labour &amp; Employment Ministry Shri K.Suresh, Dr. Mrutunjay Sarangi, Secretary Labour &amp; Employment and senior officers from the ministry were present in the meeting.</p>
