										<content:encoded><![CDATA[<div><strong>Brief note on the discussions took place in the 30th meeting of the National Council, held on 23.04.2014 &#8211; BSNL Employees Union</strong></div>

<div>(1) <strong>Lesser standards of evaluation for the JAO and JTO exams. </strong></div>
<div>The Staff Side made a strong appeal to the Management, to review the JAO and JTO exams that had taken place, by adopting lesser standards of evaluation. The vehement, lengthy and detailed arguments of the Staff Side to grant grace marks, were however not accepted by the Management.</div>
<div></div>
<div>As regards taking remedial measures in respect of question papers with discrepancies, it was agreed that the Recruitment Branch will issue a letter to all the CGMs, as has been done in the case of MP and AP circles, for taking necessary remedial action.</div>
<div></div>
<div>(2)<strong> Regular promotion to officiating JTOs. </strong></div>
<div>Management replied that a provision is already made in the New Recruitment Rules for the absorption of all the 1500 officiating JTOs. The RR will soon go for the approval of the Management Committee.</div>
<div></div>
<div>(3) <strong>Eligibility of the Non-Executives to appear Management Trainee exam. </strong></div>
<div>Very serious arguments were placed by the Staff Side for the amendment of the Recruitment Rules of the Management Trainees, so as to make the Non-Executives, with the requisite qualification, eligible to appear the MT exam. But this was not accepted by the Management. Due to the persistent requests made by the Staff Side, Management agreed to review the RR, after one exam is held. It was informed that the notification for holding the MT exam would be issued within 3 months.</div>

<div>(4) <strong>Amendments to JTO(T), JTO(E), JTO(C) and JAO Recruitment Rules.</strong></div>
<div>Management informed that the new RR of JTO(T) is going for the approval of the MC shortly and that the qualifying service has been reduced from 7 years to 5 years. The demand of the Staff Side to reduce it to 4 years was not accepted. Management also informed that the work to frame new RRs of JTO(E), JTO(C) would be taken up shortly.</div>

<div>(5) <strong>Filling up of SC/ST back log vacancies</strong></div>
<div>Management replied that there is no unfilled back log vacancies in Non-Executive posts.</div>
<div></div>
<div>(6) <strong>Regularisation of TSMs and casual labourers appointed on compassionate grounds</strong>.</div>
<div>There was a detailed discussion on this issue. However, Management finally replied that regularization of any TSM or casual labourer could not be done in view of the Hon’ble Supreme Court judgement in the Uma Devi case.</div>

<div>(7) <strong>Revision of stipends of trainees. </strong></div>
<div>Management has already issued order on 07.04.2014, (after this item was submitted for discussion in the National Council) stating that 70% of the minimum pay of the respective pay scale + IDA shall be paid as stipend for TTAs / Sr.TOAs and TMs.</div>
<div></div>
<div>Staff Side demanded that revised stipends should be implemented from 01.01.2007 and arrears should be paid. Management accepted this.</div>
<div></div>
<div>(8)<strong> Fresh Recruitment of Staff. </strong></div>
<div>Staff Side argued about the need for fresh recruitment, since there is acute shortage in cadre like Sr.TOA. Management agreed that fresh recruitment is required, howeverthey told that it should be done for a multi-skilled cadre. Further, they told that this issue would be referred to the consultant.</div>
<div></div>
<div>(9<strong>) Empowerment of women staff in BSNL.</strong></div>
<div>Staff Side argued that the role being played by the women staff, for the growth of BSNL as well as for the society as a whole, should be recognised. It was also pointed out that the women employees, after crossing certain age, are facing specific health problems and thus require a special consideration. In view of the above, the Staff Side demanded the women employees should be granted special leave of one day for every completed one month’s service. However, Management said that it is following the Government Rules in the matter of leave, and whatever is not mentioned in those Rules would not be granted.</div>

<div>(10) <strong>Pay fixation in case of Non-Executives absorbed in BSNL, who had opted for IDA pay scale from the date of promotion after 01.10.2000. </strong></div>
<div>Management said that this issue is being actively persued with the DoT and expressed hope that a favourable order would come soon. The Staff Side demanded that in the meanwhile recovery being made at the field level should be stopped. Management agreed to look into this.</div>
<div></div>
<div>(11) <strong>Provision of Rs.200/- BSNL SIM to all the Non-Executives.</strong></div>
<div>BSNL SIM worth Rs.200/- has already been issued to the Non-Executives working in the outdoor. Staff Side demanded that this facility should be extended to the Non-Executives working in Indoor / offices also. They also demanded that access to other network customers and also to the CUG of Executives should be provided. Management said that this would be looked into.</div>

<div>(12) <strong>Inordinate delay in the finalization of disciplinary cases. </strong></div>
<div>Staff Side pointed out that there is inordinate delay in finalising disciplinary cases, which has also resulted in acute delay in the issuing of Presidential Orders, and demanded prompt action on this count. Management replied that the CVO office has already issued letter to all CGMs to finalise disciplinary cases without further delay.</div>
<div></div>
<div>(13) <strong>Creation of Section Supervisor posts in the circle / administrative offices.</strong></div>
<div>After detailed discussion, Management suggested to hold separate discussion on this issue. Staff Side agreed.</div>
<div></div>
<div>(14)<strong> Independent SSA status for Anantnag and Baramullah. </strong></div>
<div>Staff Side demanded that Anantnag and Baramullah in J&amp;K circle should be granted full SSA status, in view of the fact that TDE and AO are already posted in these places with full administrative and financial powers. Staff Side also pointed out how SSA status has been already granted for smaller districts. Management replied that the proposal to form a separate SSA has come from the CGM J&amp;K, only in respect of Anantnag and that no proposal has come for Baramullah. In respect of Anantnag, Management said that it would be looked into.</div>

<div><strong>(15) Issue of Presidential Orders to TSMs regularized on or after 01.10.2000. </strong></div>
<div>Staff Side pointed out that how POs are not yet issued for a number of TSMs who are regularised on or after 01.10.2000.</div>
<div></div>
<div>Management shared the concern of the Staff Side and told that even 10 days ago a letter had been issued to all the CGMs to forward such cases to the Corporate Office.</div>

<b>JCM Functioning raised in the National Anomaly Committee Meeting on 17th July 2012</b></div>

We have already placed a gist of discussions and decision of the 4th National anomaly Committee meeting held today on agenda items that came up for consideration. &nbsp;The Staff Side of the National Council met on 16th. &nbsp;The issue of the non functioning of the JCM at the Departmental level and the ineffectiveness of the council meetings wherever it meets were the subject matter of serious discussions at the Staff Side. &nbsp;The last meeting of the National Council was held in 2010. &nbsp;The non acceptance of the arbitration awards, the inordinate delay in taking final view of items introduced as agenda by the official side and the non issuance of orders on agreed items, the refusal to record disagreement and refusal to refer the issue to arbitration etc. were raised by the members of the Staff Side. &nbsp;It was therefore, decided that this issue should be taken up seriously by the leader and Secretary in their initial remark at the NAC meeting and should elicit concrete response from the official side.</div>

Accordingly the Leader, Com. Raghaviah and Com. Umraomal Purohit, Leader and Secretary, Staff Side in their opening remakrs made a strong presentation of this issue and conveyed the growing resentment of the employees. &nbsp;Both the Secretary General and President supplemented this presentation with further information and conveyed to the official side that while the non functioning of the Departmental Councils were restricted to a few Ministries in the past, as at present, it has been spread to almost all Ministries barring Railways, Defence and to a small extent to the Postal Department.</div>

The Chairman, while responding to this complaint said that he would elicit the information &nbsp;from all Ministries/Departments as to when the last meeting of the Council was held, whether the Anomaly Committee had been constituted and if so what was the stage at which its deliberations are and monitor its functioning effectively and take up the grievance expressed by the staff in this regard with the highest authority in the Government to ensure that the machinery is brought to effective functioning system.</div>

The 4th meeting of the National Anomaly Committee was held on 5th January, 2012. &nbsp;All the items could not be discussed on that day. &nbsp;The meeting was postponed and the same was held today on 17th July, 2012. &nbsp;The gist of discussions and decisions are given hereunder.</div>

Item No.1. Pay band of the merged pay scales: The demand to reconstruct the pay band in respect of merged pay scales (S8 to S10) by multiplying the minimum of the highest pay scales (6500-10,500) with 1.86 by virtue of which the pay band will commence with Rs. 12100 instead of 9300 is not agreed and as per the scheme disagreement has been recorded.</div>

Item No.2. Extending the date for exercise of option: &nbsp;Extending the date for exercise of option to come to the new pay scale as also to the next increment date on promotion was discussed at length. &nbsp;While the official side will agree to reopen the promotional cases where such change of option becomes necessary on account of an unforeseen event, the question of extending the date in general will have to be examined. &nbsp;The case of necessity to change the option once exercised in view of the recent order on increment was raised by the Staff Side. The Official side agreed to issue a clarificatory order.</div>

Item No. 3. Special allowance and qualification pay: Order has been issued in respect of Auditors. In respect of SAS passed hands necessary orders will be issued shortly.</div>

Item No.4. Fixation of pay of Promotees at the level of entry &nbsp;pay of Direct recruitees: The official side agreed to consider grant of entry pay in all such cases, wherever the RR provides for direct recruitment.</div>

<div style="text-align: justify;">
Item No.5. Date of next increment: &nbsp;Orders have already been issued. Item is treated as settled.</div>
<div style="text-align: justify;">
</div>
<div style="text-align: justify;">
Item No. 6. Grant of minimum pay of Rs. 5200 +1800 to temporary status employees: &nbsp;Orders issued.</div>
<div style="text-align: justify;">

Item No. 7. Grant of revised allowance with effect from 1.1.2006: &nbsp;The item has been withdrawn after discussion.</div>

Item No. 8. Transport allowance: &nbsp;The revision of transport allowance was not agreed upon. &nbsp;However, taking a percentage of the TA representing the CCA submerged for the purpose of OTA and grant of a portion of the TA in respect of persons on tour for more than one month at a stretch will be considered.</div>

Item No. 9. &nbsp;Doubling the Existing risk and patient care allowance: &nbsp;The matter has been submitted to the Cabinet for its approval and orders are likely to be issued shortly. The Staff side raised the issue of doubling the daily allowance on tour. The Official side agreed to examine this matter also.</div>

Item No. 10. Parity in Pension to pre 2006 retirees: &nbsp;The matter is sub-judice. Therefore it could not be discussed.</div>

Item No.11. Commutation of pension: The difference in the application of commutation table between the pre-2008 and post 2008 retirees was discussed. &nbsp;It has been agreed that the difference would be quantified with reference to certain cases as an example. &nbsp;If it has no huge financial implication on the post 2008 retirees, the Govt. may consider the acceptance of the demand of the Staff.&nbsp;</div>

Restoration of commuted value of pension after 12 years instead of 15years would be considered in the light of the Supreme Court judgement of 1996, a copy of which would be made available to the Staff Side.</div>

Item No.12. Grant of Rs. &nbsp;5400/- to the Assistant Accounts and Audit Officers: To be discussed with the JS(per)/JS(E) separately. The date of the meeting will be fixed soon.</div>

Item No.13. Revision base index for DA: The Staff Side will be provided with the computation made by the 6th CPC in the matter and on the basis of the same the issue will be discussed further.</div>

Item No.14. Child Care leave: Orders issued. Item treated as settled.</div>

Item No.15. Income criterion for dependency of parents: &nbsp;The item is dropped after discussion.</div>

Item No. 16. Revision of Grade Pay fixation: After discussion, the item has been dropped.</div>

<div style="text-align: justify;">
Item No. 17. Reconstruction of Pay bands: dropped.</div>

<div style="text-align: justify;">
Item No. 18. Fixation of pay on promotion to the post carrying same grade pay and PB: &nbsp;Agreed to grant one increment to the holders of post with higher pre-revised pay scale.</div>

<div style="text-align: justify;">
Item No. 19. All MACP items: will be discussed further in the subcommittee on 27th July, 2012.</div>

<div style="text-align: justify;">
Item No.20. Anomaly in the grade pay of Library information Assistants: The official side will consider the &nbsp;issue in consultation with the Ministry of Culture and take appropriate decision before the next meeting.</div>

Item No.21. Anomaly in pension of those in receipt of stagnation increments in the pre revised scales of pay: The inclusion of stagnation increment for the purpose of fixation of pay in respect of the persons retired between 2006 and 2008, if not done, will be examined and suitable orders issued.</div>

Anomaly in the pay scales of Stenographers of field offices with reference to Central Secretariat: &nbsp;It was pointed out that Senior PS in the field offices were on identical pay scale of PPS &nbsp;of the Central Secretariat and therefore, they must be granted grade pay of Rs. 5400 in PB3. &nbsp; They have agreed to grant Grade pay of Rs. 5400 in PB.2 applicable to the field offices if not already done. &nbsp;In respect of parity with Central Sectt, the proposal of Railway Board will be expeditiously examined by the Finance Ministry and suitable orders issued.</div>

Item No.23.Date of Annual increment in EOL cases: Orders were issued earlier and the matter is treated as settled. The Staff Side raised the issue of denial of encashment of earned leave and half pay leave for industrial employees. &nbsp;The official side agreed to issue clarificatory orders in the matter.</div>

Feedback of the 5th meeting of the National Anomaly Committee 5th meeting of the National Anomaly Committee was held today under the chairmanship of &nbsp;Secretary, DoP&amp;T.</div>

At the outset Com. Umraomal Purohit, Secretary, Staff Side, National Council(JCM), raised the following points:-</div>

<div style="text-align: justify;">
He explained the background of setting-up of JCM Scheme and emphasized that the scheme has been effective to resolve the disputes between the Central Government employees and Government of India. But of late, the scheme is not been administered properly causing frustration among the Central Government employees.</div>

<div style="text-align: justify;">
He reminded the Secretary, DoP&amp;T that since he is the custodian of the scheme, it would be appropriate for him to see that the scheme functions both at the National and Departmental levels in its letter and spirit.&nbsp;</div>

He said that the meeting of the Ordinary Meeting of the National Council, JCM(full-fledged meeting) was held on 15.05.2010 and after that no meeting has been held. He mentioned that, as per JCM Constitution, minimum 3 meetings should be organized after every 4 months.</div>

He further said that, earlier 4/5 Sub-Committees have been formed to deal with the items in the agenda, but nowadays Sub-Committees are also not being formed.</div>

He also said that in many departments, Departmental Council has not yet been formed on some plea or the&nbsp;</div>
<div style="text-align: justify;">
other, and where Departmental Councils are yet to form, the Anomaly Committee is totally absent.</div>

<div style="text-align: justify;">
He also stated that, wherever Departmental Council and Anomaly Committee have been formed, they have not been allowed to take independent decision and they are to depend on everything on Ministry of Finance or DoP&amp;T.</div>

He said that we are crossing six years of the VI CPC report and shortly there is likely demand of setting-up of Seventh Central Pay Commission. Unfortunately, anomalies of the VI CPC are yet to be settled.</div>

He said that separate discussion should be held in respect of MACP Scheme matters, and the date for the same should be fixed very shortly.</div>

Reciprocating, the Secretary DoP&amp;T advised all the departments to send their status position in respect of formation of Departmental Council, expansion and formation of Departmental Anomaly Committee.</div>

He also demanded that the pending issues should be settled early and meeting of the National Council(JCM) should be convened after Monsoon Session of the Parliament. He also said that separate meeting for deciding MACP Scheme should be fixed within this month. &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;</div>

General Secretary AIRF, Com. Shiva Gopal Mishra, stated that the unanimous recommendations made by the Railways’ Departmental Anomalies Committee &nbsp;are not being implemented because &nbsp;these &nbsp;have &nbsp;not&nbsp;</div>
<div style="text-align: justify;">
been cleared by the DoP&amp;T and MoF(Exp.). He demanded de-centralization and delegation of powers to the ministries for smooth and quick decisions. He also mentioned that where already fundamental rule&nbsp;</div>
<div style="text-align: justify;">
exists, like fixation under FR-22(C), why MoF(Exp.) insists for reference to them. It should be done by the ministries themselves.</div>

3. &nbsp;General Secretary AIRF, Com. Shiva Gopal Mishra, Working President AIRF, Com. Rakhal Das Gupta and Asstt. General Secretary AIRF, Com. Ch. Sankara Rao raised the issue of granting promotional benefits to Loco Pilots under Rule FR-22(C) and they also expressed dissatisfaction over the functioning of NC/JCM. The matter of resolving problems of MACP Scheme was also raised by the AIRF representatives.</div>

The Official Side stated the matter of granting one increment on promotion is under active consideration of the Government of India and decision in this regard would be taken shortly.</div>

Despite lots of deliberations, Official Side did not agree to revise the Pay Band of GP Rs.9300-34800, and ultimately disagreement has been recorded.</div>

<b>Item No.5(ii), (iv)(with 32 &amp; 33), (v)(vii) &ndash; Rule 8 of the revised pay rules&nbsp;</b></div>

<b>Fixation of pay on promotion&nbsp;</b></div>
<div style="text-align: justify;">
It was agreed that, wherever there is provision of direct recruitment in the recruitment rules, pay on promotion would be fixed to minimum of the Entry Pay as provided for in the revised rules, irrespective of the fact whether direct recruitment has actually taken place or not.</div>

<b>Item No.12 &amp; 13 &ndash; Transport Allowance&nbsp;</b></div>
<div style="text-align: justify;">
Earlier Overtime Allowance was admissible on City Compensatory Allowance(CCA) also. The VI CPC has sum the CCA with Transport Allowance. Official Side agreed to consider the provision of Transport Allowance to be paid for the purpose of OTA. It was also agreed to consider something for the residents of NCR, i.e. Ghaziabad, Faridabad and Gurgaon on the line of CCA.</div>

<b>Item No.14 &ndash; Revision of existing allowances which are to be withdrawn and replaced by new schemes&nbsp;</b></div>

<span style="background-color: white;">NFIR General Secretary <b>Shri.Raghavaiah JCM Staff Side Leader</b>,</span><span style="background-color: white;">&nbsp;published the outcome of discussion on some important issues on its website.&nbsp;</span></div>

<div style="text-align: justify;">
1. Special Allowance and Qualification Pay : The demand for taking special allowance and qualification pay for fixation prupose on promotion w.e.f.1.1.2006 is agreed to be considered and finalized within one month.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
2. Rule 8 of Revised Pay Rules : It was agreed that taking into considereation, Recruitment Rules the Senior promotee&#8217;s pay will be allowed to be fixed at the same stage (especially at the minimum of pay) thus the seniors will get the entry stage pay fixed for direct recruits.</div>

3. Transport Allowance : Since CCA got subsumed in the Transport Allowance resulting denial of Overtime, action will be taken to review this particular aspects to mitigate the hardship.</div>

4. Revision of Existing Allowance : Agreed to process the dobling the allowances (Hospital Patient Care Allowance etc.) Cabinet&#8217;s approval will be sought. Target date for finalization is one month.</div>

5. Commutation of additional Pension or Revision of pension in respect of post 31.12.2005 retirees : Department of Pension to make calculation for knowing the difference of amount between pre1.1.2006 and post 1.1.2006. Thereafter a view will be taken.</div>

6. Commutation of Revised Pension : Will be examined further. Copy of Supreme Court Judgement will be given to Staff Side.</div>

7. Revision of Base Index for Dearness allowance : Calculation sheet will be sent to Staff Side for comments.</div>

8. Fixation of pay on promotion (shouldering higher responsibility) to a post carrying same Grade pay : Agreed to grant additional increment erstwhile FR-22-C.</div>

9. Anomaly in the Pay Scale, Pay Band and Grade Pay &#8211; Library Information Assistant : Will be referred to Department of Culture for comments for considering allotment of Grade Pay of Rs.4600/- in PB-2.</div>

10. MACP Anomalies : Secretary (Personnel) while appreciating the points raised by Staff Side has decided that a separte meeting will be held shortly (tentative date 27th July, 2012).</div>

11. 15 Years Period fixed for Commutation is Arbitrary/unjustified : Official Side stated that the issue will be examined further.</div>

12. Anomalies in the Pay Scale of Official Language Staff &#8211; Grant of parity to Rajbhasha Sahayaks : Railway Ministry&#8217;s proposal for granting parity is under active consideration Favourale decision is expected.</div>

13. Grant of parity in the case of Indian Railways Stenographers : Staff Side insisted that int he light of &nbsp;Cabinet&#8217;s approval for granting parity, the Railway Ministry should issue orders without referring to Minisry of Finance. It was however stated by the Official Side that this being a common category, Ministry of &nbsp;Finance will have to be approached by Railway Ministry. After discussion it was agreed to expedite decision.</div>

14. Eleven additional Items given by Staff Side in the last meeting will be proritized for further examination ad discussion.</div>

15. Replacement of Grade Pay of Rs.4600/- with Rs.4800/- in the Railways : Official Side stated that Railway Ministry&#8217;s proposal will be considered and a decision given.</div>

16. Transport Allowance at Delhi for employees fo Faridabad, Gurgaon, Ghaziabad and Noida : After discussion it was agreed to consider positively. Staff Side also pointed out that HRA at Delhi rates are already paid to staff and hence Transport Allowance at Delhi rates should be allowed.</div>

17. Grant of another option to the employees promoted in between 1.1.2006 and 2010 : Staff Side pointed out that the Field staff who were promoted after 1.1.2006 were unaware of the advantage of option as they were in the 5th CPC Pay Structure till the implementation of 6th CPC Revised Pay Structure and hence another option should be granted in such situation. After lengthy discussion, Secretary (Personnel) has agreed that thre is hardship involved and assured to decide favourably.</div>
