<p class="has-text-align-center"><strong>Allowances</strong></p>



<p>Department of Personnel &amp; Training has issued various instructions from time to time on various Allowances applicable to Central Government Employees. The essence of these instructions has been summarized in the following paras for guidance and better understanding.</p>



<h3 class="wp-block-heading">1. Children Education Allowance (CEA)</h3>



<p>Consequent upon the decisions taken by Government to implement the recommendation of 7th CPC, this department has issued an OM No. A-27012/01/2017-Estt.(AL) dated 17.07.2018. The salient features of CEA are:</p>



<ul class="wp-block-list">
<li>(i) CEA/Hostel Subsidy can be claimed only for the two eldest surviving children.</li>



<li><strong>(ii) The amount of CEA will be Rs. 2250/- per month per child.</strong></li>



<li><strong>(iii) The amount of hostel subsidy is Rs. 6750/- per month.</strong></li>



<li><strong>(iv) The reimbursement of CEA for Divyang Children of Government servant shall be payable at double the normal rate of CEA i.e. Rs. 4500/- per month.</strong></li>



<li>(v) The rate of CEA would be raised by 25% every time the DA on the revised pay structure goes up by 50%.</li>



<li>(vi) The CEA and Hostel subsidy is admissible in respect of children studying from two class before class one to 12th standard.</li>

<h3 class="wp-block-heading">2. Risk Allowance</h3>



<ul class="wp-block-list">
<li>(i) As per decision taken by the Government on the recommendation of 7th CPC rates of Risk Allowance were revised.</li>



<li>(ii) Risk Allowance is presently given to Central Government employees engaged in hazardous duties or whose work will have a deleterious effect on health over a period of time.</li>



<li>(iii) The Risk Allowance will not be treated as “Pay” for any purpose.</li>

<h3 class="wp-block-heading">3. Night Duty Allowance (NDA)</h3>



<p>Consequent upon the decision taken by Government on the recommendations made by 7th CPC on the subject following guidelines has been issued:</p>



<ul class="wp-block-list">
<li>(i) Night duty will be defined as duty performed between 22:00 hours and 6:00 hours.</li>



<li>(ii) A uniform weightage of 10 minutes shall be given for every hour of night duty performed.</li>



<li>(iii)&nbsp;<strong>The ceiling of basic pay for entitlement of NDA shall be Rs 43600/- per month.</strong></li>



<li>(iv) The hourly rate of NDA equal to [(BP+DA)/200] will be paid and the basic pay and DA for the calculation of NDA rates shall be the basic pay and DA prevalent as per 7th CPC.</li>



<li>(v) The amount of NDA will be worked out separately for each employee depending upon the basic pay the concerned employee is drawing on the date of performing the night duty.

<h3 class="wp-block-heading">4. Over Time Allowance (OTA)</h3>



<p>Consequent upon the recommendations of 7th CPC as accepted by the Government, it has been decided that:</p>



<ul class="wp-block-list">
<li>(i) “Ministries/Departments to prepare a list of those staff coming under the category of ‘Operational Staff’. Rates of Overtime Allowance not to be revised upwards”.</li>



<li>(ii) The following definition has been used to define Operational Staff: “All non-ministerial, non-gazetted Central Government Servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.”</li>



<li>(iii) The concerned Administration Wing of the Ministries/ Departments will prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of JS(Admn.) and Financial Adviser of the concerned Ministry/ Department.</li>



<li>(iv) The grant of OTA may be linked to biometric attendance.</li>

<h3 class="wp-block-heading">5. Special Allowance Payable to Parliament Assistants</h3>



<ul class="wp-block-list">
<li>(i) As per the decision taken by the Government on 7th CPC recommendations to enhance the rates of&nbsp;<strong>Special Allowance payable to those wholly engaged in Parliament work during Parliament session by 50% from the existing levels of Rs. 1500/- and Rs. 1200/- payable to Assistants and UDCs respectively to the level of Rs. 2250/- and Rs 1800/-.</strong></li>



<li>(ii) The allowance will be admissible at full rates for every calendar month in which the Parliament is in session for at least 15 days in that month. For month with shorter period, the allowance will be admissible half the rates prescribed for the full month.</li>



<li>(iii) No OTA shall be paid to Parliament Assistants for the calendar months in which the Parliament is in session.</li>

<h3 class="wp-block-heading">6. Special Allowance for Child Care for Women with Disabilities</h3>



<ul class="wp-block-list">
<li>(i) For providing extra benefits to women employees with disabilities especially when they have young children and children with disabilities, it has been decided that&nbsp;<strong>women with disabilities shall be paid Rs. 3000/- per month on Special Allowance for child care.</strong>&nbsp;The allowance shall be payable from the time of the child’s birth till the child is two years old.</li>



<li>(ii) The above limit would be raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%.</li>

<p>With the outbreak of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a> pandemic, the budgeted earning target of the current year i.e. 2019-20 has been adversely affected. In view of this, the above referred instructions have been issued by the Board to adopt various economy, austerity and cost control measures so that liabilities are met within available funds.</p>



<p>2. Payment of OTA to <a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railway Servants</a> governed by Para 10 of the Railway Servants (Hours of Work &amp; Period of Rest) Rules, 2005 and Travelling <a href="https://centralgovernmentnews.com/category/allowance/" target="_blank" rel="noreferrer noopener">Allowance</a> is one of the steps to control expenditure and thus, a decision has been taken in a Board meeting held on 29.6.2020 that the cases of OTA and TA should be critically reviewed by the General Managers and a ceiling of 50% be imposed on payment of OTA and TA. A copy of Item No. 4 of the Minutes of the Board Meeting held on 29.06.2020 to discuss “Measures to reduce cost and improve saving” is enclosed for ready reference.</p>



<p>3. It may also be kept in mind that deferment of bills/payment is not expenditure control and maximum utilization of existing manpower within the stipulated working hours should be ensured.</p>



<p>4. It has been desired by the Board that the cases of payment of OTA and TA should be monitored closely by PCPOs and PFAs of the Zonal Railways.</p>

<p>“<strong>Item No. 4</strong>: Impose 50% Ceiling on Over Time (Rs. 1300 Cr) and Travelling Allowance (Rs. 2300). There are other allowances which need to be reviewed by Zonal Railways and controlled. Broadly, such semi-variable allowances would be in the range of Rs. 13000 Cr. per annum.</p>

<p>Kind attention of Railway Board is invited to NFIR&#8217;s PNM Agenda Item No.24/2017 wherein it has been requested to kindly issue clarificatory instructions to the Zonal Railways in general and South Western Railway in particular to arrange payment of Over Time Allowance to the Sr. Technicians GP 4200/ Level-6 and. other eligible staff. While the subject could not be discussed in the PNM meeting held on 25th /26th April, 2019 due to paucity of time, the Official Side conveyed as follows :-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>&#8220;South Western Railway has been asked to comment on the status of the demand made by the Federation. No reply received yet. Reminder sent on 26/03/2019.&#8221;</strong></p></blockquote>



<p>Federation desires to reiterate that already considerable delay has taken in the matter as the first reference in this case was sent to the Railway Board by the Federation in August, 2016, therefore there is need to obtain facts from the South Western Railway immediately on priority.</p>



<p>NFIR, therefore, requests the Railway Board to kindly expedite and see that instructions are issued to the Zonal Railways including South Western Railway to ensure payment of OT Allowance to Sr. Technicians etc., as raised in the PNM agenda. A copy of instructions issued may be endorsed to the Federation.</p>

<p>I am directed to refer to Department of Personnel and Training OM No.A-27016/03/2017-Estt.(AL) dated 19.6.2018 circulated vide letter No.52-0/2018-PAP dated 4.7.2018 on the above subject. According to the said O.M. Government has decided to discontinue OTA for categories other than Operational Staff and industrial employees.</p>
<p>2. As per para 1 of this OM &#8220;Ministries/Departments to prepare a list of those staff coming under the category of &#8220;Operational Staff. The following definition shall be used to define Operational Staff.</p>
<p>&#8220;All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.&#8221;</p>
<p>3. In this regard, it is requested to prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular of a particular category of staff in the list of operational staff and submit it to this office latest by 04.02.2019.</p>

<td>In terms of the provisions of FR46 (b), the central government may grant or permit a government servant to receive an honorarium as remuneration for work performed which is occasional or intermittent in character and either so laborious or of such special merit as to justify a special reward. Except when special reasons, which should be recorded in writing, exist for a departure    from   this  provision,<br />
sanction to the grant or acceptance of an honorarium should not be given unless the work has been undertaken with the prior consent of the Central Government and its account has been settled in advance.<br />
Guidelines    for     payment   of Honorarium under FR 46 (b) have already been laid down inter alia vide this Department&#8217;s OM No. 17011/9/85- Est. (AL), dated 23.12.1985     and   OMNo.<br />
17020/1/91-  Estt.   (AL), dated 18.11.1991.  It has also  been clarified that no honorarium should be granted for temporary increases in work.</td>

<p>Subject: <strong>Implementation of the recommendation of 7th CPC on Over Time Allowance &#8211; reg.</strong></p>
<p>The undersigned is directed to say that as per Dept. of Expenditure&#8217;s Resolution No. 11-1/2016-IC dated 06.07.2017, following is the decision of Government on Overtime Allowance (OTA):</p>
<p>&#8220;Ministries/Departments to prepare a list of those staff coming under the category of &#8216;Operational Staff&#8217;. Rates of Overtime Allowance not to be</p>
<p>revised upwards&#8221;.</p>
<p>2. Further it has been clarified by the Dept. of Expenditure that the Government has decided that given the rise in the pay over the years, the recommendations of the 7th CPC to discontinue OTA for categories other than Operational Staff and industrial employees who are governed by statutory provisions may be accepted.</p>
<p>3. Accordingly, it has been decided to implement the aforesaid decision of the Government on Overtime Allowance across all the Ministries/Departments and attached and subordinate office of the Government of India. The following definition shall be used to define Operational Staff.</p>
<p>&#8220;All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.&#8221;</p>
<p>4. The concerned Administration Wing of the Ministries/Departments will prepare a list of operational Staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of JS (Adnm.) and Financial Adviser of the concerned Ministry / Department.</p>
<p>5. The grant of OTA may be linked to biometric attendance subject to the conditions mentioned below.</p>
<p>a) OTA should be paid only when his/her senior officer directs the concerned employee(s) in writing for staying back in office to attend urgent nature of work.</p>
<p>b) The OTA will be calculated on the basis of biometric attendance.</p>
<p>c) The OTA for Staff Car Drivers should be linked with biometric system as normally, the designated parking is allotted in the office building. However, in cases where the parking lot is provided far from office, the Staff Car Driver would mark his/her attendance while leaving from his office and a grace time of not exceeding 2 hours should be allowed to cover the distance travelled after leaving office, including the time to drop the officer and then reaching the parking lot. In such cases, calculation can be done from log books, duly verified by the officer concerned.</p>
<p>d) The OTA to field officials should be calculated on the basis of biometric attendance, as normally, such officers are given facility of official transport to attend the field work. Such officers are supposed to report in office before proceeding to field. In cases, where officials are required to attend the field work directly from home, they may be extended facility of official transport from home in lieu of transport allowance and OTA may be given on the basis of the log book of that vehicle, duly verified by their senior officers.</p>
<p>6. Since, the Government has decided not to revise the rates of OTA, the rates as prescribed in this Department&#8217;s OM dated 19th March, 1991 for Office Staff, Staff Car Drivers and Operative Staff will continue to operate subject to their fulfillment of the above conditions.</p>
<p>7. All the existing instructions, except lo the extent superseded by this O.M., will continue to remain in force.</p>
<p>8. These instructions will be applicable with effect from 01 July, 2017.</p>
<p>9. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these instructions are being issued after consultation with the Comptroller &amp; Auditor General of India.</p>

<p>Subject: <strong>Implementation of the recommendation of 7th CPC on Over Time Allowance &#8211; reg.</strong></p>
<p>The undersigned is directed to say that as per Dept. of Expenditure&#8217;s Resolution No. 11-1/2016-IC dated 06.07.2017, following is the decision of Government on Overtime Allowance (OTA):</p>
<p>&#8220;Ministries/ Departments to prepare a list of those staff coming under the category of Operational Staff’. Rates of Overtime Allowance not to be revised upwards&#8221;.</p>
<p>2. Further it has been clarified by the Dept. of Expenditure that the Government has decided that given the rise in the pay over the years, the recommendations of the 7th CPC to discontinue OTA for categories other than Operational Staff and industrial employees who are governed by statutory provisions may be accepted.</p>
<p>3. Accordingly, it has been decided to implement the aforesaid decision of the Government on Overtime Allowance across all the Ministries / Departments and attached and subordinate office of the Government of India. The following definition shall be used to define Operational Staff.</p>
<p>&#8220;All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.&#8221;</p>
<p>4. The concerned Administration Wing of the Ministries / Departments will prepare a list of operational Staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff with the approval of IS (Admn.) and Financial Adviser of the concerned Ministry / Department.</p>
<p>5. The grant of OTA may be linked to biometric attendance subject to the conditions mentioned below.</p>
<blockquote><p>a) OTA should be paid only when his/ her senior officer directs the concerned employee(s) in writing for staying back in office to attend urgent nature of work.</p>
<p>b) The OTA will be calculated on the basis of biometric attendance.</p>
<p>c) The OTA for Staff Car Drivers should be linked with biometric system as normally, the designated parking is allotted in the office building. However, in cases where the parking lot is provided far from office, the Staff Car Driver would mark his/ her attendance while leaving from his office and a grace time of not exceeding 2 hours should be allowed to cover the distance travelled after leaving office, including the time to drop the officer and then reaching the parking lot. In such cases, calculation can be done from log books, duly verified by the officer concerned.</p>
<p>d) The OTA to field officials should be calculated on the basis of biometric attendance, as normally, such officers are given facility of official transport to attend the field work. Such officers are supposed to report in office before proceeding to field. In cases, where officials are required to attend the field work directly from home, they may be extended facility of official transport from home in lieu of transport allowance and OTA may be given on the basis of the log book of that vehicle, duly verified by their senior officers.</p></blockquote>
<p>6. Since, the Government has decided not to revise the rates of OTA, the rates as prescribed in this Department&#8217;s OM dated 19th March, 1991 for Office Staff, Staff Car Drivers and Operative Staff will continue to operate subject to their fulfillment of the above conditions.</p>
<p>7. All the existing instructions, except to the extent superseded by this O.M., will continue to remain in force.</p>
<p>8. These instructions will be applicable with effect from 01 July, 2017.</p>
<p>9. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these instructions are being issued after consultation with the Comptroller &amp; Auditor General of India.</p>

<p>Ref: Board&#8217;s letter of even No. dated 28-11-2017 (RBE No. 175/2017)</p>
<p>Pursuant to the recommendations of the Seventh Central Pay Commission, the rates of OTA have been revised w.e.f. 01-7-2017 vide Board&#8217;s letter of even number dated 28-11-2017 (RBE No.175/2017). The issue of revising the date of effect of OTA w.e.f. 01-01-2016 had been under consideration and it has been decided that the basic pay and DA element for the purpose of OTA may be antedated to 01-01-2016 and other elements constituting emoluments for the purpose of OTA viz. HRA and Transport allowance etc. shall be taken into account at revised rates w.e.f. 01-7-2017 as per the 7th CPC recommendations.</p>
<p>2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Subject: <strong>Payment of overtime Allowance (OTA) in the revised pay to the employees of Defence Industrial Establishments governed by the Factories Act, 1948</strong>.</p>
<p>Consequent upon revision of pay structure as per VII CPC recommendations, the matter regarding payment of OTA, as per revised pay, to the employees of the Defence Industrial Establishments under the Factories Act, 1948 has been considered in consultation with the Ministry of Labour &amp; Employment, Ministry of Finance and Ministry of Law &amp; Justice.</p>
<p>2. It has been decided that the Overtime Allowance shall be paid to the employees of the Defence Industrial Establishment governed by the Factories Act, 1948 on the basis of revised wages with effect from the date the wages have been revised i.e. 1.1.2016. The OTA on the basis of revised wages is subject to the conditions stipulated in this Ministry&#8217;s OM No. 14(1)/97/D(Civ-11) dated 1st July 1998.</p>
<p>3. It is further added/clarified that those categories of &#8220;workers&#8221; who come within the scope of Section 64 of the Factories Act and whose basic pay exceed the wage limit, as specified in sub-section (6) of Section (1) of the Payment of Wages Act, 1936, are entitled for payment of OTA in terms of MoD OM No. 14(2)/76/D(Civ-II) dated 25.06.1983 on the basis of wage limit notionally determined. Accordingly, OTA will be paid to them on the basis of wage limit notionally determined on the basis of old pay scales until the new wage limit is defined by the Ministry of Labour &amp; Employment based on the consumer expenditure survey published by NSSO. Thereafter, the OTA will be paid to them on the basis of new wage limit notionally determined, if the basic pay exceeds the new wage limit.</p>
<p>The other conditions as laid down in this Ministry&#8217;s letter No. 14(1)/97/D(Civ-II) dated 1st July. 1998 shall remain unchanged</p>
<p>4. This issues with the concurrence of MoD(Finance/AG/PB) vide their Dy No. 1 04/AG/PB dated 15.02.2018 and after consultation with Ministry of Labour &amp; Employment vide their ID No. Z-16025/09/2017-ISH-II dated 13.11.2017</p>
