<p>Subject: <strong>Payment of Productivity Linked Bonus to Civilian Employees of Defence Production Establishments for the year 2017-18.</strong></p>
<p>Madam Sir,</p>
<p>I am directed to refer to this Ministry&#8217;s letter No.48(4)/98/D(B&amp;C) dated 27 July, 2000 on the above subject and to convey the sanction of the President to payment of Productivity Linked Bonus for the year 2017-18 equivalent to 40 days wages to the eligible employees in Defence Production Establishments as mentioned therein with an overall ceiling of wages of Rs.7000/- per month. PLB is to be calculated taking average number of days per month as 30.4 days.</p>
<p>02. The casual labour who has worked for at least 240 days, in each year, for 03 years or more, will be eligible for this PLB payment. The amount will be paid on a notional monthly wages or Rs.1200/-. In case where the actual emoluments fall below Rs.1200/- per month, the amount will be calculated on actual monthly emoluments. All payments under these orders will be rounded off to the nearest rupee.</p>
<p>03.The above sanction is subject to the following condition:-</p>
<p>(a) OFB will submit a monthly status report on the progress achieved to review the formula for calculation of PLB which otherwise would have been reviewed after three years from implementation ie from the accounting year 1999-2000.</p>
<p>(b) GMs of each of the respective factories should submit the Certificate regarding standard man-hour for jobs whenever there is a change in production processes or when new labour saving machines are introduced, incorporating the following details :-</p>
<blockquote><p>(i) Standard Man Hours before the installation of CNC Machines.</p>
<p>(ii) Standard Man Hours after the installation of CNC Machines.</p>
<p>(iii) Difference between the above two leading to savings in Standard Man Hours.</p></blockquote>
<p>In the event of more than one CNC Machine being installed on two different occasions each time figures are to be updated for additional subsequent addition of CNC Machine.</p>
<p>04. The expenditure will be debited to Major Head 2079 of the Defence Service Estimates (Ordnance Factories) and to the respective Heads to which the pay and allowances of employees of allied establishment: are debited.</p>
<p>05. This issues with the concurrence of Ministry of Finance and MoD (Finance Division) vide their Dy. No. 361 dated 15/10/2018.</p>

<p>Ministry of Finance, Department of Expenditure vide ID No. 2(2)12007/E-li (B) dated 19.02.2007 have informed MoD that the MoD should checkup the matter with the State Government/Local Authorities to confirm whether Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak are two different cities or both are one and the same. It was further clarified that if it happen to be the same city then HRA / CCA is already admissible at Hyderabad rates being part of Hyderabad (UA). Accordingly, Ministry of Defence after consulting the State Government Authorities have issued instructions vide ID No. 6(6)/2005 D (Civ.) dated 16.05.2007 clarifying Yeddumailaram (Medak) and Eddumailaram (Census Town). Medak are one and the same city and accordingly they are eligible for HRA / CCA as applicable to Hyderabad (UA).</p>
<p>&nbsp;</p>
<p>Ministry of Finance vide its ID No. 2(2)/2007-E-li(B) dated 01.12.2014 have advised Ministry of Defence that payment of HRA at Hyderabad rates to the employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak may be stopped with immediate effect. Accordingly, Ministry of Defence have issued instructions to Ordnance Factory Board to immediately reduce the rate of HRA to the above employees from existing 30% to 10%.</p>
<p>&nbsp;</p>
<p>In this regard it is stated that Eddumailaram (Census Town) was declared / treated as Urban (i.e. Census Town) at 2001 Census vide Government of India, Ministry of Home Affairs, Director of Census Operation Letter No. 4646/Census CeIl/2001 dated 12.08.2002 (copy enclosed for ready reference) Moreover, as per the publication of Government of Andhra Pradesh regarding concept of Urban Agglomeration defined in Chapter 1 of introduction, concepts and definitions, jurisdictional changes, Rural – Urban Frame Andhra Pradesh in Para 1.3.7 it is clearly mentioned that the Medak District falls within the Urban Agglomeration of Hyderabad (UA).</p>
<p>&nbsp;</p>
<p>In view of the above Department of Expenditure is requested to re-examine the whole issue in terms of the supporting documents stated in the Preceding Para and arrange to issue instructions to continue 30% HRA for the Defence Civilian Employees of Ordnance Factory Yeddumailaram (Medak) and Eddumailaram (Census Town), Medak, This issue may please be considered seriously and urgently since the Defence Production Unit is facing serious industrial unrest owing to stoppage of HRA at par with Hyderabad (UA) rates.</p>

<p>UNIFORMITY Citing ‘equal pay for equal work’ principle, Delhi High Court tells Centre to grant pay parity to ordnance factory employees</p>
<p>Employees at Ordnance Factories (OF) – who have been contesting their omission from the benefits of the sixth pay commission for over seven years have finally more than one reason to rejoice.</p>

<p>Reining in the principle of ‘equal pay for equal work’ at public offices, the Delhi High Court has directed the Centre to grant pay parity to employees in the OF with that of identically ranked official in the Central Secretariat Service (CSS) and Central Secretariat Stenographer’s Service (CSSS).</p>
<p>The direction will be applied retrospectively from 2006 — when the sixth CPC was implemented. Not only this, the HC order will come in handy for the employees of the OF when the seventh central pay commission is implemented.</p>
<p>The HC order came in response to a petition filed by Ordnance Factory Employees Association challenging the decision of the finance ministry declining their request for the assistants working in the OF Board to be given same pay scale as was given to similarly placed officials in CSS, CSSS, Ar my Headquarters, UPSC and other services.</p>
<p>The starting point of discrimination against the employees of the OF Board came soon before the acceptance of recommendation of the sixth CPC when a pay upgradation of employees of CSS and CSSS was made in September 2006.</p>
<p>While the OFs and Armed Forces Head Quarters (AFHQs) — both non-secretariat organization — were excluded from the pay upgradation, the latter took the matter to the Central Administrative Tribunal (CAT) and got an order in its favour.</p>
<p>In the case of OF Board, the central government took the view that since it was a nonattached office working outside the Secretariat, there cannot be parity of pay scales. The OF Board was denied benefit of upgradation and the replacement scales given by the sixth CPC. The CAT, too, took a similar stand and denied any relief to the OF Board.</p>
<p>The matter finally reached the Delhi HC last year and after over a year of deliberation a bench of Justice S Ravindra Bhat and Justice Vipin Sanghi termed the discrimination meted out to the OF Board as “over-classification.”</p>
<p>The HC said the discrimination was illogical and artificial. It also took note that the cadre structure of CSS and CSSS is identical to that of the OF. In all the above organisations, the cadre of upper divisional clerks (UDCs) is filled by the feeder of the cadre of the lower divisional clerks (LDCs).</p>
<p>The cadre of assistants on the OF Board is filled by promotion from the feeder cadre of UDCs with at least five years of experience on regular basis.</p>
<p>“The OF Board was treated historically as equals to CSS/CSSS employees and enjoyed equal pay and all benefits flowing from equal pay,” the high court noted adding, “This was based on the previous four instances of determinations by successive pay commissions that they performed equal work.”</p>

<div><strong>Brief on Preliminary meeting with 7th CPC held on 21st Aug-2014 in New Delhi .</strong></div>
<p>The meeting was held in the office of 7th CPC in New Delhi at 12.25 to 13.25 Hrs. and it was chaired by chairman/7th CPC. Members of the commission and directors were also present. All office bearers of NE were invited for meeting of office bearers in New Delhi and to attend the meeting with CPC.</p>
<p>The following office bearers of IOFGOA could reach New Delhi and attended the meeting.</p>
<p>1. Shri B.K. Singh as President<br />
2. Shri S.B. Chaubey as General Secretary<br />
3. Shri N.K. Tripathi as Jt. General Secretary<br />
4. Shri R.C. Pandey (Rep-West Zone)in place of Shri Philips Mathew V/President.<br />
5. Shri Y.Raj Shekhar Reddy(Rep-South Zone)<br />
6. Shri D.M. Lonare as rep. Central Zone<br />
7. Shri KapilDev Sharma as Member Secretary to the Subcommittee made to draft proposal for 7th CPC.</p>
<p>Remaining office bearers either could not attend the meeting or they were not kept in delegation due to the restrictions in numbers. Shri B. Indra Reddy(BS-OF Medak ) was present in Delhi and he was allowed in meeting on request.</p>
<p>Importance of the Indian Ordnance Factories &amp; its Group-B (G/NG) cadre , roles and responsibilities of the organisation as well as the cadre, need of corrective actions by 7th CPC, grievances of the cadre, expectations of the cadre from 7th CPC an the demands were very well explained before the commission by our delegation team. It’s a matter of satisfaction that our proposal was heard nicely followed by the required interaction by the members and chairman of the commission.</p>
<p>We also requested commission to have a visit to any of the Ordnance Factories like OFAJ, OFK OFBAD etc which are having simple, complex and unique- all type of functions to verify the statements of IOFGOA submitted to commission in the memorandum and explained in the meeting regarding the importance of the organisation and cadre as well as to have a true perception about the Indian Ordnance Factories its employees and products along with the hardship being faced during day to day work. The Chairman of the commission assured to visit any of the ordnance factories like OFBAD or OFAJ and to ask OFB also to submit their memorandum for all cadres to the commission.</p>
<blockquote><p><em><strong>    We observed that the commission was positive and serious towards the issues raised by us and considerate towards our grievances/demands. The commission also assured to grant an other meeting for presentation after having interaction with OFB and visit to a Ordnance Factory.</strong></em></p></blockquote>

<ul>
<li>IOFGOA represents Group-B Gazetted Officers-Junior Work Managers (JWMs) , PS &amp; Sr. PS Cadres and Promotee Group-A Officers-Assistant Works Managers of Indian Ordnance Factories under OFB.</li>
<li>Ordnance Factories are not profit making organization but the fourth arm of Indian defence. These are meant to serve Armed Forces &amp; Paramilitary forces by providing broad ranging critical to simple defence products &amp; services, which needs a highest level of dedication &amp; integrity in its employees. It should not be treated as general industrial set-up.</li>
<li>JWM is the 1st managerial and administrative level (not supervisory cadre) in Indian Ordnance Factories. Sometimes it is mistaken by some authorities as supervisory cadre. 7th CPC may please treat JWMs as Managerial and administrative cadre. This cadre implements all the policies/directives of Govt/MOD/OFB at the ground of work i.e. shop Floor. This is the cadre which has maximum technical skill &amp; experience in the organization which contributes in transformation of resources into output through Technocratic, Managerial &amp; Administrative efficiency. It should be given due care by 7th CPC because it has been ignored by 5th &amp; 6th CPC.</li>
<li>Minimum recruitment qualification of JWM/Tech is Degree in Engg./ PG in Engg./ M.Sc. in Physics or Chemistry or relevant subject or equivalent and for JWM/Non-Tech is Graduate degree in engineering, technical, humanities, science, commerce &amp; law.</li>
<li>The next Promotional Post for JWM is Asst Works Manager (AWM) IOFS Cadre.</li>
<li>Recruitment to the post of JWM is done through promotion from Chargeman, LDCE &amp; DR through UPSC.</li>
<li>Minimum recruitment qualification of the feeder cadre Chargeman/Tech is three years Engg. Diploma/ B.Sc. with Physics, Chemistry &amp; Mathematics. For Chargeman/Non-Tech it is degree from recognized University.</li>
<li>Sanctioned strength of AWM is 375 out of which only 188 is available for promotion from JWMs against sanction strength of JWM – 7694 &amp; remaining 187 for DR. JWMs are stagnated after getting only one promotion from the post of Chargeman.</li>
<li>JWM cadre needs to be strengthened for “Indigenisation of Defence Procurement”.</li>
<li>Corrective actions &amp; special care is required by 7th CPC against the anomalies created by 5th CPC &amp; 6th CPC as stated in chapter (4.0). i.e. that is related to MACP, Annual Increment, Fitment Table, Fixation, Pension Commutation, Un-harmonic distribution of Pay Scales, Entry Pay for DR, Unequal Multiplication-Factor, Distortion in Parity in Pay Scales amongst equivalent Cadres, Distortion in Quarters entitlement Criteria etc.</li>
<li>There is a need for maintaining inter-departmental Horizontal &amp; Vertical Harmony in Central Govt Posts, Pay Scales &amp; Promotional prospect as available for Group-‘A’ Organized Services at present.</li>
<li>The number of total Pay Scales should be reduced from 19 to 15, as proposed in Chapter (6.15).</li>
<li>6th CPC Grade Pay &amp; Pay Band should not be taken as exclusive basis for new pay determination.</li>
<li>Grade Pay system should be abolished and open-ended pay scales should be evolved as per Chapter (6.14.1).</li>
<li>Recommendation of 7th CPC should be implemented from 01/01/2014, as DA was 100% on that day.   The feeder grade of JWM i.e. Chargeman (pre-revised Grade Pay Rs. 4200, PB-II) should be upgraded to pre revised Grade Pay 4800 PB-II, before deriving new Pay Scale.</li>
<li>JWM (pre revised Grade Pay Rs 4600, PB-II) should be rationalized (from its pay scale in 4th CPC) &amp; be upgraded to the pre revised Grade Pay 5400 (PB-III), before deriving new Pay Scale in 7th CPC.</li>
<li>The next higher post above JWM which is AWM (pre revised Grade Pay Rs 5400 PB-III) should be upgraded &amp; merged with the post of WM (pre revised Grade Pay Rs 6600 PB-III), before deriving new Pay Scale.</li>
<li>PS &amp; Sr. PS Cadre of Ordnance should be treated at par with counter parts in Ministries and OFB while deriving new pay scale.</li>
<li>Higher emoluments for Higher Posts including all allowances (Piece Work Profit &amp; Overtime Allowance) should be provided to maintain the hierarchical status. JWM of Ordnance factories are getting letter emoluments as compare to Chargeman &amp; Industrial Employees.</li>
<li>Principles of determination of Pay Structure as per chapter number (6.1).</li>
<li>The minimum pay scale should be 27,000 as on 01/01/2014 &amp; maximum salary should be 284000 with ratio of (1) : (10.5) and the difference between minimum &amp; maximum salary should be harmonically distributed amongst all the cadre falling in between , as proposed in chapter (6.17).</li>
<li>Annual increment should be 5% with provision of option i.e. 1st January &amp; 1st July.</li>
<li>Minimum Promotional benefit should be 10% of Basic Pay.</li>
<li>Time Bound Promotion system should be introduced for all cadres. Each cadre should get at least Six Promotions failing which financial upgradation.</li>
<li>Proposal for either “Scraping-off” or “Desired Improvement” in new Pension Scheme as per Chapter (7.0).</li>
<li>Regarding retirement gratuity, the number of service years should be 42 in place of 33, month salary should be granted for each completed year &amp; ceiling should be removed.</li>
<li>Parity in Pension/Family Pension between pre &amp; post CPC retirees should be maintained.</li>
<li>Provision of Every year LTC &amp; one international LTC to the countries wherever Air India Flights are operating Otherwise Foreign travel under LTC upto SAARC (South Asian Association for Regional Cooperation) Countries, which includes India, Bhutan, Sri Lanka, Maldives, Nepal, Pakistan and Bangladesh.</li>
<li>Provision of Bonus for all Central Govt employees.</li>
<li>Provision of Grievances Settlement Machinery for Gazetted Officer otherwise representation in JCM forum should be made.</li>
<li>Factory allowance for employees working in Govt Production units like Ordnance Factories where 6 days per week working exists, in place of 5 days working in a week for other Central Govt. Departments.</li>
<li>Allowance on acquiring Higher Qualification.</li>
<li>Risk allowance for JWM working in identified Hazardous Operations/Area, where industrial employees are getting Risk Allowances.</li>
<li>Special working allowance for working in factories located under Naxalite Area.</li>
<li>Hard Station working allowance for working in Remote Area.</li>
<li>Children Education Allowance upto PG level.</li>
<li>Remaining allowances are per chapter (6.32).</li>
<li>Other Miscellaneous Suggestions as per chapter (8.0).</li>

<p>Reference: Your Office letter No. Pay/Tech-I/LTC dated 25.11.2013.</p>
<p>The matter has been examined in the light of extant rules on the above subject and the facts brought out under your letter cited above.</p>
<p>2. In this regard, attention is invited to GoI, M.F. O.M. No. 21011/13/89- E.II(B), dated 20.12.89 also reproduced under Rule 5 of FRSR Part IV DA , DR and HRA Rules which clearly stipulates that – “the phrase ‘same station’ includes all places which are treated contiguous to the qualified city/town in terms of paras 3(b)(ii) and Para 3(b)(iii) and those places which are included in the Urban Agglomeration of a qualified city”.</p>

<p>Respected Sir,<br />
With due regards, your attention is invited to S.R.O. 13(E) Dated 04.05.1989 / S.R.O.-191 dated 28.11.1994 / S.R.O.-66 dated 27.05.2003 “Indian Ordnance Factories Group C Supervisory and Non-Gazetted Cadre (Recruitment and Conditions of Service) Rules” which stipulates that the post of Chargeman (Tech) will be filled up by-</p>
<blockquote><p>(a) 25% by direct recruitment after adjustment of surplus and transfer,<br />
(b) 25% by Limited Departmental Examination and<br />
(c) 50% by promotion from panel prepared by relevant DPC for each category<br />
and on failure of recruitment by promotion, by transfer failing which by direct recruitment {as mentioned in Point No. 2 of Annexure to OFB Letter No. 01/CR/A/I/Vol.II/658, dated 21.02.2011}.</p></blockquote>
<p>It further stipulates that the post of Chargeman will be filled up by Promotion from Draughtsman or equivalent in scale of Rs.1200-2040 with 3 years service and by promotion from Highly Skilled Grade-I with 3 years of regular service failing which from Highly Skilled Grade-II with 6 years regular service in respectively category.</p>
<p>The above Recruitment Rule (SRO) nowhere says that the post of Chargeman will be filled by promotion from Master Craftsman.</p>
<p>It is to be noted that the post of Master Craftsman was created in pursuance of the recommendations of the 3rd Central Pay Commission made in Chapter 19 of Volume I of its Report, vide MOD letter No. 1(2)/80/D(Civ-I), dated 21.09.1982 in the pay scale of Rs. (425 – 640) at par with the Chargeman. Para 2(iv) of the letter stipulates that the incumbents selected for the post of Master Craftsman will forego their normal promotion to the supervisory grade; i.e., Chargeman.</p>
<p>The pay scale of Master Craftsman &amp; Chargeman was revised to Rs. (1400 – 2300) as per 4th CPC but the 5th  CPC revised the pay scale of Master Craftsman to Rs. (4500 – 7000) whereas Chargeman was revised &amp; upgraded to Rs. (5000 – 8000) w.e.f. 01.01.1996.</p>
<p>Subsequently, Restructuring of Cadre of Artisan Staff in Defence Establishments in modification of recommendations of the 5th CPC has been introduced vide MOD letter No.11(1)/2002/D(Civ-I), dated 20.05.2003 which states that the post of Master Craftsman shall not be part of the hierarchy and the placement in this grade will not be treated as promotion for Highly Skilled Grade either under normal promotion rules or under ACP Scheme. Para 4(iv) of the letter states that<span style="text-decoration: underline;"> the post of Master Craftsman (Rs. 4500 – 7000) shall continue to be considered as Highly Skilled grade for the purpose of promotion to the grade of Chargeman-II (Rs. 5000 – 8000).</span></p>
<p><strong>It is worth to mention here that Hon’ble Supreme Court of India has already decided that the administrative instructions cannot be issued in contravention of the statutory rules {C&amp;AG of India vs. Mohan Lal Mehrotra, 1991 Lab IC (SC) 2328, para 22} and that there can be no dispute with the proposition that a rule framed under the Proviso to Art. 309 of the Constitution cannot be modified by an executive order {State of Maharashtra &amp; Anr vs Chandrakant Anant Kulkarni &amp; Ors: 1981 AIR 1990, 1982 SCR (1) 665}</strong></p>
<p>The Supreme Court has held in the case of “Sant Ram Sharma vs State Of Rajasthan &amp; Anr : 1967 AIR 1910, 1968 SCR (1) 111” as under:-</p>
<blockquote><p>    “It is true that Government cannot amend or supersede statutory rules by administrative instructions, but if the rules are silent on any particular point Government can fill up the gaps and supplement the rules and issue instructions not inconsistent with the rules already framed.”</p></blockquote>
<p>Contrary to above, vide letter cited under reference MOD has communicated that the idea of exclusion of the post of Master Craftsman (MCM) from further promotions in the hierarchy (Chargeman in the same Grade Pay) has not found favour with the Defence Finance.</p>
<p>We are surprised to construe from above that Defence Finance may promote any person on any post which may be against the provisions of relevant Recruitment Rules (SRO) made under the proviso of Article 309 of the Constitution of India.</p>
<p>Here, we would like to draw your attention to Para 3.1 of Govt. of India, DoP&amp;T O.M. No. 22011/5/86-Estt.(D), dated 10th April, 1989 issued as consolidated instructions on Departmental Promotion Committee, which stipulates as under:-</p>
<blockquote><p>   “ ….. A vacancy shall be filled in accordance with the recruitment rules in force on the date of vacancy, unless rules made subsequently have been expressly given retrospective effect. Since amendments to the recruitment rules normally have only prospective application, the existing vacancies should be filled as per the recruitment rules in force. Holding of DPC meetings need not be delayed or postponed on the ground that recruitment rules for a post are being reviewed/amended.”</p></blockquote>
<p>It is worth to mention here that Para 2 of Annexure &#8211; I of DOP&amp;T O.M. No. 35034/3/2008-Estt. (D), dated 19.05.2009 of MACPS provides that the MACPS envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay as given in Section I, Part – A of the first schedule of the CCS (RP) Rules, 2008 and which is as under;</p>
<p><span style="color: #800000;">Grade Pay Rs. 1800/- Grade Pay Rs. 4200/-</span><br />
<span style="color: #800000;">Grade Pay Rs. 1900/- Grade Pay Rs. 4600/- </span><br />
<span style="color: #800000;">Grade Pay Rs. 2000/- Grade Pay Rs. 4800/- </span><br />
<span style="color: #800000;">Grade Pay Rs. 2400/- Grade Pay Rs. 5400/- </span><br />
<span style="color: #800000;">Grade Pay Rs. 2800/- Grade Pay and so on</span></p>
<p>Hence, a person who is drawing grade pay of Rs. 4200 due to 02 promotions/ACPs and completes 30 years regular service on or after 01.09.2008 will be granted financial upgradation under 03rd MACPS in grade pay of Rs. 4600/-.</p>
<p>Therefore, you are requested to review the referred clarifications and withdraw the same without further delay and clarify that since the post of MCM was not in hierarchy of artisan staff cadre upto 31.12.2005, the Highly Skilled worker/MCM who were already drawing the pay scale of Rs. (5000 – 8000) under ACP Scheme may be considered for further financial upgradations in the next Grade Pay (Rs. 4600) in the hierarchy of Grade Pays.</p>

<p>Sub:- <strong>Authorisation of Earned Leave in respect of Industrial Employees (IEs) Of Ord. Fys and Ord. Equip. Fys.<br />
</strong><br />
Ministry of Defence vide ID No.8/1R108/D(Fy.II) dated 25/09/20,13 has clarified that the Industrial Workers employed in Ordnance factories are entitled for 30 days Earned Leave (Annual Leave) with wages. With the issuance of the clarification the provisions contained in DOP&amp;T OM dated 20-07-1998 has become equally applicable to Industrial Employees, opted to be governed under Factories Act for Earned Leave purpose by virtue of the provisions contained in Section 78 of the Factories Act, 1948. Further, on specific queries, the Ministry confirmed that the clarification should be given effect from 20-07-1998.</p>
<p><em>In view of the above following instructions are issued for immediate implementation:</em></p>
<blockquote><p>1) Entitlement of 30 days Earned .Leave for each completed year of service may be extended to IEs who are guided under Factories Act invoking provisions of Section 78 of Factories Act.</p>
<p>2) The benefit of calculation of leave wages as per Section 80 of the Factories Act may be extended only to those piece workers who already opted to be guided under Factories Act for EL purpose on or before 31/10/2005. No fresh option in this regard is acceptable.</p>
<p>3) Crediting of 30 days EL for those IEs, as specified in Para 2, may be made w.e.f. 20/07/1998 subject to maximum accumulation of 120 days upto 06/11/2006 and 300 days thereafter.</p>
<p>4) Calculation of leave wages of such Industrial employees, as mentioned in Para 2 and debiting of availed leave in their leave account is to be made taking into account .intervening Sunday g &amp; Holidays as inclusive of availed leave. Hence, instead of the existing formula of P/(N-S), their leave wages may be calculated as per regular establishment i.e. taking into account the formula of P/N where &#8216;P&#8217; means the Basic Pay and piece work profit actually earned in the month immediately preceding the leave. If holidays fall during the currency of the availed Earned Leave, &#8216;Holiday Pay&#8217; should not be allowed separately.</p></blockquote>

<p><span style="color: #993366;"><strong>1.What is New Pension Scheme ?</strong></span></p>
<p>A new defined contribution pension system in place of existing defined benefit system, applicable for fresh entrants to Central Government Service from 01-01-2004.</p>
<p><span style="color: #993366;"><strong>2. When it is started &amp; for whom ?</strong></span></p>
<p>The system is mandatory for all new recruits to the Central Government Service from 01-01-2004 except the Armed Forces.</p>
<p><span style="color: #993366;"><strong>3.What is the quantum of the Contribution ?</strong></span></p>
<p>The monthly contribution to be deducted amounts to 10% of the Basic Pay, Grade Pay and DA to be paid by the employee &amp; matched by the Central Government.</p>
<p><span style="color: #993366;"><strong>4.What will be the amount of Government Contribution?</strong></span></p>
<p>It is equal to the individual’s subscription.</p>
<p><span style="color: #993366;"><strong>5.Is there any maximum limit of the subscription for an individual?</strong></span></p>
<p>The maximum limit is 10%.</p>
<p><span style="color: #993366;"><strong>6.When does the NPS subscription start?</strong></span></p>
<p>Recoveries towards Tier-I contribution start from the salary of the month following the month in which the Government Servant has joined the service. Therefore, no recovery is to be effected for the month of joining.</p>
<p><span style="color: #993366;"><strong>7.Whether GPF will be available to the subscribers of the NPS ?</strong></span></p>
<p>The existing provisions of defined benefit pension &amp; GPF would not be available to the new recruits in the Central Government service covered under NPS.</p>
<p><span style="color: #993366;"><strong>8.How many Tiers are there in the NPS ?</strong></span></p>
<p>There are two Tiers in the NPS. Tier-I is compulsory &amp; Tier-II is voluntary. Tier-II is a withdrawable account at subscriber’s option. The employee would be free to withdraw part or all of the Tier-II of his money any time. Government will not make any contribution to Tier-II account.</p>
<p><span style="color: #993366;"><strong>9.When can the subscriber of NPS exit from the system ?</strong></span></p>
<p>Individual can exit at the date of Superannuation i.e. at the age of 60 years.</p>
<p><strong>10.What amount will be paid to the subscriber of the NPS at the time of retirement?</strong></p>
<p>At exit, the individual would be mandatorily required to invest 40% of the pension wealth to purchase an annuity and balance pension wealth will be paid to him. Individual would have the flexibility to leave the pension system prior to age 60. However, in this case, the mandatory annuitization would be 80% of the pension wealth.</p>
<p><span style="color: #993366;"><strong>11.What is the Architecture of the New Pension Scheme ?</strong></span></p>
<p>In order to implement the scheme there is a Central Record Keeping Agency (National Securities Depository Limited) &amp; several Pension Fund Managers. At this stage there are three PFMs viz. SBI Pension Funds Pvt.Ltd., UTI Retirement Solutions Ltd. &amp; LIC Pension Fund Ltd.</p>
<p>An independent Pension Fund Regulatory &amp; Development Authority (PFRDA) is to regulate and develop the pension market.</p>
<p><span style="color: #993366;"><strong>12.How &amp; when an employee can contribute to Tier-II of the Scheme ?</strong></span></p>
<p>An individual can open a Tier-II account with a Nationalized Bank and the contribution will be deposited to the Bank by the subscriber concerned. As Government will not make any contribution to Tier-II account no recoveries will be made from the salaries of the employees on this account.</p>
<p><span style="color: #993366;"><strong>13.How an employee be a member of the NPS ?</strong></span></p>
<p>Immediately on joining Government service, the Government servant will be required to provide particulars such as his name, designation, scale of pay, date of birth etc. in the prescribed form viz. S-I form prescribed by the NSDL, Mumbai, and submitted to his DDO. The S-I form shall be submitted by the DDO to his Pay &amp; Accounts Officer. The PAO will forward the S-I form to the NSDL, Mumbai. On receipt of the form, NSDL will allot 12 digit PRAN (Permanent Retirement Account Number) to the subscribers and a PRAN kit will also be forwarded to the subscribers by the NSDL.</p>
<p><span style="color: #993366;"><strong>14.How will the subscription recovered from the subscribers be remitted to the concerned authorities ?</strong></span></p>
<p>The subscription of the NPS subscribers will be recovered from his regular pay by the PAO concerned. The PAO will upload the NPS data to the NPSCAN of NSDL &amp; a cheque of the same amount will be remitted to the Trustee Bank appointed by the PFRDA viz. Bank of India after the data has been uploaded to the NPSCAN.</p>
<p><span style="color: #993366;"><strong>15.What is the investment plan of the NPS ?</strong></span></p>
<p>The contribution towards pension will be invested in the default Schemes termed as ‘Scheme I’ of various Pension Fund Managers (SBI Pension Funds Pvt. Ltd., UTI Retirement Solutions Ltd. &amp; LIC Pension Fund Ltd.) presently in the proportion of 33%, 32% &amp; 35%, respectively. Each PFM will invest 85% of the contributions received by it in fixed income instruments and 15% in equity &amp; equity related instruments.</p>
<p><span style="color: #993366;"><strong>16.Whether the individual is entitled for leave encashment after retirement ?</strong></span></p>
<p>The benefit of encashment of leave salary is not a part of the retirement benefits admissible under Central Civil Services (Pension) Rules, 1972. It is payable in terms of CCS (Leave) Rules which will continue to be applicable to the Government Employees who join the Government Service on or after 01-01-2004. Therefore, the benefit of encashment of leave salary payable to the Government Employees/ to their families on account of retirement/death will be admissible.</p>
<p><span style="color: #993366;"><strong>17.What happens if an employee gets transferred during the month ? Which office will make deduction of contributions ?</strong></span></p>
<p>As in the case of other recoveries, the recovery of contributions towards NPS for the full month (both individual &amp; Government) will be made by the office who will draw salary for the maximum period.</p>
<p><span style="color: #993366;"><strong>18.Who will pay additional relief on death/disability of Government Servants covered by NPS ?</strong></span></p>
<p>Additional relief on death/disability of Defence Civilians Personnel covered by the New Defined Contribution System (NPS) will be dealt with by PCDA (P) Allahabad.</p>
<p><span style="color: #993366;"><strong>19.What is the procedure for recovery of NPS contribution in the case of EOL/HPL ?</strong></span></p>
<p>The subscription of the employee and the Government would be restricted proportionately to the leave salary in case of HPL cases.</p>
<p>In case of EOL since no salary is drawn during this period, no contribution either from employee or from Government would be payable.</p>
<p><span style="color: #993366;"><strong>20.What is the procedure for recovery of NPS contribution in the case of Suspension cases?</strong></span></p>
<p>Every subscriber shall subscribe monthly to the NPS when on duty or Foreign Service but not during a period of Suspension.</p>
<p>On exoneration or otherwise, the amount of subscription shall be the emoluments to which he was entitled on the first day after his return to duty.</p>
<p>If a subscriber elect to pay arrears of subscriptions in respect of a period of suspension, the emoluments or portion of emoluments which may be allowed for that period on re-instatement, shall deemed to be emoluments drawn on duty.</p>
<p><span style="color: #993366;"><strong>21.What is the Time Line of regular upload and Fund Transfer ?</strong></span></p>
<p>The responsibility for timely remittance to the Trustee Bank is that of the PAO in respect of all the subscribers under his domain. After pre-audit of pay bill the PAO should upload the subscriber contribution details on NPSCAN and obtain the transaction ID by the 25th of each month.</p>
<p>If the remittance is through RTGS/NEFT then it may be ensured that the NPS contributions (Govt. &amp; Employees) should be credited to the account of the Trustee Bank by the PAO on the last working day of each month for that salary month. If the remittance is through a cheque payable to the Trustee Bank, then the same should be delivered to the local branch of the Trustee Bank by the PAO by the 26th of each month marked NPB for the last working day of the month.</p>
