<p>(a) whether Government has received representations from various Unions/ Associations of Central Government Employees from all across the country to discontinue the New Pension Scheme (NPS) and implement the Old Pension Scheme (OPS);</p>



<p>(b) if so, the action taken by Government to meet their demands;</p>



<p>(c) whether Government is considering to revert to the Old Pension Scheme (OPS); and</p>



<p>(d) if so, the details thereof and if not, the reasons therefor?</p>



<h3 class="wp-block-heading">ANSWER</h3>



<p>MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)</p>



<p>(a) to (d): Representations have been received from time to time offering inputs on different aspects of National Pension System.</p>



<p>The National Pension System (NPS) was introduced for Central Government employees vide Ministry of Finance (Department of Economic Affairs) Notification No. 5/7/2003-ECB &amp; PR dated 22.12.2003 for all new recruits joining the Central Government service (except armed forces) from 01.01.2004.</p>



<p>On introduction of the National Pension System, the Central Civil Services (Pension) Rules, 1972 were amended. Accordingly, the benefits of old pension scheme under the Central Civil Services (Pension) Rules, 1972 are not admissible to the Central Government civil employees appointed on or after 01.01.2004, under the amended rules.</p>



<p>Government of India has taken many steps for streamlining of <a href="https://centralgovernmentnews.com/category/nps/">NPS</a> for Central Government employees and to protect the interest of the subscribers. These include enhancement of Government’s contribution from the earlier 10% of Pay plus DA to 14% of Pay plus DA, freedom of choice of selection of Pension Funds and pattern of investment to subscribers, payment of compensation for non-deposit or delayed deposit of NPS contributions for any period during 2004-2012, tax exemption under Section 80C of the Income Tax Act, 1961 and increase in tax exemption limit for lump sum withdrawal on exit from earlier 40% to 60% of the amount due, making the entire withdrawal exempt from income tax, framing of Central Civil Services (Implementation of National Pension System) Rules, 2021 and setting up of an oversight mechanism in Ministries/Departments for implementation of NPS</p>

<p>A meeting of NJCA along with constituent organizations of National Council JCM and other organizations of Central/State Government Employees, Autonomus bodies and Teachers Organization was held at AIRF Office, New Delhi on 07.01.2023 to discuss and decide a serious agitational programme for scrapping of NPS and restoration of OPS.</p>



<p>After a detailed discussion it was decided to hold One National Convention at New Delhi on 21.01.2023 at Pyare Lal Auditorium, ITO New Delhi in which the final programme of action and resolution will be passed.</p>



<p>Before that on 12th January 2023, it was decided to organize public awareness programme by holding Gate Meeting at all offices and wide publicity through Main Media and Social Media.</p>



<p>All Confederation Office Bearers, Chief Executives of Constituent Organizations and General Secretaries of State COCs are requested to organize 12th January 2023 programme and take part in National Convention alongwith some office bearers.</p>

<p><strong>Subject: Coverage under Central Civil Services (Pension) Rules, in place of National Pension System, of those Central Government employees who were recruited against the posts/vacancies advertised /notified for recruitment, on or before 22.12.2003.</strong></p>



<p>The undersigned is directed to say that consequent on introduction of National Pension System (NPS) vide Ministry of Finance (Department of Economic Affairs) Notification No. 5/7/2003-ECB &amp; PR dated 22.12.2003, all Government servants appointed on or after 01.01.2004 to the posts in the Central Government service (except armed forces) are mandatorily covered under the said scheme. The Central Civil Services (Pension) Rules, 1972 and other connected rules were also amended vide Notification dated 30.12.2003 and, after the said amendment, those rules are not applicable to the Government servants appointed to Government service after 31.12.2003.</p>



<p>2. Subsequently, Department of Pension and Pensioners’ Welfare in consultation with the Department of Personnel &amp; Training, Department of Expenditure and Department of Legal Affairs in the light of the various representations/references and decisions of Hon’ble Courts, issued instructions vide OM No. 57/04/2019-P&amp;PW(B) dated 17.02.2020 giving one time option to Central Government employees who were declared successful for recruitment in the results declared on or before 31.12.2003 against vacancies which occurred before 01.01.2004 and were covered under the National Pension System on joining service on or after 01.01.2004, to be covered under the CCS(Pension) Rules, 1972 ( now 2021). There was fixed time schedule for different activities under the aforesaid OM dated 17.02.2020.</p>



<p>3. Representations have been received in this Department from the Government servants appointed on or after 01.01.2004 requesting for extending the benefit of the pension scheme under Central Civil Services (Pension) Rules, 1972 (now 2021) on the ground that their appointment was made against the posts/vacancies advertised/notified for recruitment prior to notification for National Pension System, referring to court judgments of various Hon’ble High Courts and Hon’ble Central Administrative Tribunals allowing such benefits to applicants.</p>



<p>4. The matter has been examined in consultation with the Department of Financial Services, Department of Personnel &amp; Training, Department of Expenditure and Department of Legal Affairs in the light of the various representations/references and decisions of the Courts in this regard. It has now been decided that, in all cases where the Central Government civil employee has been appointed against a post or vacancy which was advertised/notified for recruitment/appointment, prior to the date of notification for National Pension System i.e. 22.12.2003 and is covered under the National Pension System on joining service on or after 01.01.2004, may be given a one-time option to be covered under the CCS(Pension) Rules, 1972 (now 2021). This option may be exercised by the concerned Government servants latest by 31.08.2023.</p>



<p>5. Those Government servants who are eligible to exercise option in accordance with para-4 above, but who do not exercise this option by the stipulated date, shall continue to be covered by the National Pension System.</p>



<p>6. The option once exercised shall be final.</p>



<p>7.&nbsp;<strong>The matter regarding coverage under the CCS (Pension) Rules, 1972 (now 2021), based on the option exercised by the Government servant, shall be placed before the Appointing Authority of the posts for which such option is being exercised for consideration, in accordance with these instructions. In case the Government servant fulfills the conditions for coverage under the CCS (Pension) Rules, 1972 (now 2021), in accordance with these instructions, necessary order in this regard shall be issued latest by 31st October, 2023. The NPS account of such Government servants shall, consequently, be closed w.e.f. 31st December, 2023.</strong></p>



<p>8. The Government servants who exercise option to switch over to the pension scheme under CCS (Pension) Rules, 1972 (now 2021), shall be required to subscribe to the General Provident Fund (GPF). Regarding accountal of the corpus in the NPS account of the Government servant, Controller General of Accounts (CGA) has furnished the following clarification vide letter No. 1(7)(2)/2010/cla./TA III/390 dated 14.11.2019 &amp; I.D. Note No. TA-3-6/3/2020-TA-III/cs-4308/450 dated 23.12.2022:</p>



<ul class="wp-block-list">
<li>i. Adjustment of Employees’ contribution in Accounts: Amount may be credited to individual’s GPF account and the account may be recasted permitting up-to-date interest (Authority-FR-16 &amp;Rule 11 of GPF Rules).</li>



<li>ii. Adjustment of Government contribution under NPS in Accounts: To be accounted for as (-) Dr. to object head 70 – Deduct Recoveries under Major Head 2071 – Pension and other Retirement benefit – Minor Head 91 1- Deduct Recoveries of over payment (GAR 35 and para 3.10 of List of Major and Minor Heads of Accounts).</li>



<li>iii. Adjustment of increased value of subscription on account of appreciation of investments – May be accounted for by crediting the amount to Govt. account under M.H. 0071- Contribution towards Pension and Other Retirements Benefits 800-Other Receipts (Note under the above Head in LMMHA).</li>
</ul>



<p>9. All Ministries/Departments are requested to give wide publicity to these orders without fail. The cases of those Government servants who fulfill the conditions mentioned in this O.M. and who exercise option to switch over to the pension scheme under CCS (Pension) Rules, 1972 (now 2021) may be settled by the administrative Ministries/Departments in accordance with these orders.</p>



<p>10. This issues in consultation with Ministry of Finance, Department of Expenditure vide ID Note No. 1(7)/EV/2019 dated 05.12.2022 &amp; 07.02.2023 and in consultation with Controller General of Accounts vide their I.D. Note No. TA-3-6/3/2020-TA-III/cs-4308/450 dated 23.12.2022.</p>



<p>11. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders are issued in consultation with Comptroller and Auditor General of India, as mandated under Article 148(5) of the Constitution of India.</p>

<p>(a) whether many States have restarted Old Pension Scheme (OPS) to their respective Government employees and if so, the details thereof;</p>



<p>(b) whether many States have raised demand to the Government to return National Pension Scheme (NPS) money to start OPS;</p>



<p>(c) if so, the details thereof and the reaction of the Government thereto;</p>



<p>(d) the decision taken or being taken by the Government to return NPS money to those States who have started OPS;</p>



<p>(e) whether the Government proposes to return to OPS in near future; and</p>



<p>(f) if so, the details thereof?</p>



<h3 class="wp-block-heading">ANSWER</h3>



<p>THE MINISTER OF STATE IN THE MINISTRY OF FINANCE (DR. BHAGWAT KARAD)</p>



<p>(a) to (f) The State Governments of Rajasthan, Chhattisgarh, and Jharkhand have informed the Central Government/Pension Fund Regulatory and Development Authority (PFRDA) about their decision to restart Old Pension Scheme (OPS) for their State Government employees.</p>



<p>The State Government of Punjab on 18.11.2022 has issued notification regarding implementation of OPS to the government employees who are presently being covered under the National Pension System (NPS).</p>



<p>The State Governments of Rajasthan, Chhattisgarh, and Jharkhand, have sent proposals to the Central Government/PFRDA to return the accumulated corpus of subscribers under NPS to respective State Governments. No such proposal has been received from the State Government of Punjab.</p>



<p>In response to the proposals of the State Governments of Rajasthan Chhattisgarh, and Jharkhand, PFRDA has informed the respective State Governments that there is no provision under Pension Fund Regulatory and Development Authority Act, 2013 read along with PFRDA (Exits and Withdrawals under the National Pension System) Regulations, 2015, and other relevant Regulations, as amended from time to time, vide which the funds, which are already deposited both in the form of Government contribution and Employees’ contribution towards NPS, along with accruals, can be refunded and deposited back to the State Government.</p>



<p class="has-text-align-center has-white-color has-vivid-cyan-blue-background-color has-text-color has-background"><strong>There is no proposal under consideration of Government of India for restoration of old pension scheme.</strong></p>

<h4 class="wp-block-heading">Subject: Options under Central Civil Services (Implementation of National Pension System) Rules, 2021 to avail benefits under old pension scheme on death of Government servant covered under National Pension System during service or his discharge from service on account of invalidation or disablement -reg.</h4>



<p>The undersigned is directed to say that Department of Pension and Pensioners’ Welfare has notified the Central Civil Services (Implementation of National Pension System) Rules, 2021 to govern service related matters of Central Government civil employees covered under National Pension System. Rule 10 of these rules deals with option to be exercised by every Central Government employee covered under National Pension System for availing benefits under National Pension System or old pension scheme in the event of death of Government servant during service or his discharge on the ground of invalidation or disablement.</p>



<p>2. In accordance with rule 10 of the Central Civil Services (Implementation of National Pension System) Rules, 2021, every Government servant covered under the National Pension System shall, at the time of joining Government service, exercise an option in Form-1 for availing benefits under the National Pension System or under the Central Civil Service (Pension) Rules or the Central Civil Service (Extraordinary Pension) Rules in the event of his death or boarding out on account of disablement or retirement on invalidation. Government servants, who arc already in Government service and are covered by the National Pension System, shall also exercise such option.</p>



<p>3. The option shall be exercised to the Head of Office who will accept the same after verifying all the facts submitted therein and place it in the service book. A copy of the option shall be forwarded by the Head of Office to the Central Recordkeeping Agency through the Drawing and Disbursing Officer and the Pay and Accounts Officer for their record. The Pay and Accounts Officer shall also make suitable entry in the online system indicating the details regarding the option exercised by the Government servant.</p>



<p>4. Every Government servant shall, along with the option in Form 1, also submit details of family in Form 2 to the Head of Office. The Head of Office shall, on receipt of the Form 2, acknowledge receipt of the Fo1m 2 and all further communications received from the Government servant in this behalf, countersign it indicating the date of receipt and get it pasted on the service book of the Government servant concerned. The Head of Office on receipt of communication from the Government servant regarding any change in the size of family shall also incorporate such a change in Form 2.</p>



<p>5. The option exercised may be revised at any number of times by the Subscriber before his retirement by making a fresh option intimating his revised option to the Head of Office. On receipt of the revised option, the Head of Office and the Pay and Accounts Officer shall take further action as mentioned above.</p>



<p>6. A Subscriber who is discharged on invalidation or disability shall be given an opportunity to submit a fresh option at the time of such discharge. Where such Subscriber does not exercise a fresh option or is not in a position to exercise fresh option at the time of discharge, the option already exercised by the Subscriber shall become operative. Where no option was exercised by the Subscriber and the Subscriber is not ina position to exercise an option at the time of discharge, his case will be regulated in accordance with para 9 below.</p>



<p>7 In the case of death of a Subscriber while in service, the last option exercised by the deceased Subscriber before his death shall be treated as final and the family shall have no right to revise the option.</p>



<p>8. Where a Subscriber who did not exercise an option and dies before completion of service of fifteen years or within three years of the notification of Central Civil Services (Implementation of National Pension System) Rules, 2021, his family will be granted family pension in accordance with the provisions of the Central Civil Services (Pension) Rules or the Central Civil Services (Extraordinary Pension) Rules, as the case may be, as a default option.</p>



<p>9. Where a Subscriber is discharged from Government service on invalidation or disability before completion of service of fifteen years or within three years of the notification of these rules without exercising an option, and is also not in a position to exercise an option at the time of discharge, he will be granted invalid pens ion or disability pension in accordance with the provisions of the Central Civil Services (Pension) Rules or the Central Civil Services (Extraordinary Pension) Rules as the case may be, as default option;</p>



<p>10. In all other cases, where no option was exercised by the Subscriber, the claim of the Subscriber on discharge from the service and that of the family on death of the Subscriber, shall be regulated in accordance with the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under National Pension System) Regulations, 2015, as default option .</p>



<p>11. In cases where the option exercised by the deceased Subscriber or the default option for benefit under the Central Civil Services (Pension) Rules or the Central Civil Services (Extraordinary Pension) Rules becomes infructuous on account of non¬ availability of an eligible member of the family for grant of family pension under the Central Civil Services (Pension) Rules or the Central Civil Services (Extraordinary Pension) Rules, such option would be deemed to have become invalid and the benefits admissible under the National Pension System shall be granted to the legal heir(s) of the employee in accordance with the Pension Fund Regulatory and Development Authority (Exits and Withdrawals under National Pension System) Regulations, 2015.</p>



<p>12. Copy of Form 1 and Form 2 are also enclosed.</p>



<p>13. All Ministries/Departments are requested that the above provisions regarding option to be exercised under Central Civil Services (Implementation of National Pension System ) Rules, 2021 may be brought to the notice of the Government employees covered under NPS, Head of Offices and personnel dealing .with the NPS matters in the Ministry/ Department and attached /subordinate offices thereunder, for strict implementation.</p>

<p>Dear Comrades,</p>



<p>Confederation of Central Government Employees and Workers and All India State Government Employees Federation have decided to Conduct Joint Struggle and agitational programmes against anti employees and anti working class policies of Govt. of India on Common Charter of Demands related to both Central and State Govt. Employees.</p>



<p><strong>Joint Meeting of Confederation and AISGEF</strong></p>



<p>A Joint meeting of Confederation and AISGEF was held at AISGEF Head Quarter at Faridabad on 6th September 2022. From Confederation side, Corns. R. N. Parashar, Secretary General, Tapas Bose, Working President, Giriraj Singh, Vice President, Ajay Tiwari &amp; Aniruddh Singh Rawat (ITEF) and Parminder Pal Singh (NFPE) took part in the meeting.</p>



<p>From AISGEF Corns. A. Sree Kumar, Secretary General, Subhash Lamba, President, Shashikant Rai, Kamlesh Mishra and Punit Kumar Tripathi took part in the meeting.</p>



<p>Meeting was presided over jointly by Corns. Subhash Lamba, President AISGEF and Tapas Bose, Working President, Confederation. Com. R. N. Parashar explained the core issues and stressed the need of joint struggle to put pressure on govt. for settlement of the demands. Com. A. Sree Kumar also elaborately spoken on the issues and endorsed the proposal of Joint struggle on Common Charter of Demands.</p>



<p>All leaders participated in the discussion and endorsed the need of joint struggle on common demands.</p>



<p>After detailed discussion, it was decided to put forth the following issues before the Govt. of India / Concerned authorities for immediate settlement.</p>



<ol class="wp-block-list"><li><strong>Scrap NPS and Roll back to OPS.</strong></li><li><strong>Regularize all contractual / out sourced / daily waged Fill up all the vacancies in Central/State Government / PSUs urgently.</strong></li><li><strong>Stop privatisation and corporatisation of PSUs.</strong></li><li><strong>Constitute the 8th Central Pay Commission.</strong></li><li><strong>Release all DA/DR including Confiscated arrears.</strong></li><li><strong>Remove all riders and restrictions on Compassionate employment.</strong></li><li><strong>Ensure democratic trade union rights.</strong></li></ol>

<p>If the issues are left unnoticed by the concerned authorities even beyond 30th October 2022, the concerned struggle will be organized jointly.</p>

<p><strong>Quota for participation in National Convention at Talkatora Statdium &#8211; New Delhi</strong></p>



<p><strong>The following quota is allotted to the constituents of Confederation.</strong></p>



<p>NFPE – 1000, ITEF – 300, Audit – 200, Other Organizations – 50 each. All COCs – 100 each</p>



<p>All Chief executives of the concerned organisations should issue circulars and distribute quota to each circle and unit and ensure participation.</p>



<p><strong>World Federation of Trade Unions &#8211; TUI &amp; PS &#8211; Directive Committee meeting in India</strong></p>



<p>The Directive Committee meeting of WFTU &#8211; TUI &amp; PS is scheduled to Be held at Hotel Rajhans, Surajkund, Faridabad (Haryana) on 9th &amp; 10th November 2022.</p>



<p>About 20 members from Foreign Countries will participate in meeting.</p>



<p>From India Com. A. Sreekumar, Secretary General, AISGEF (Dy. Secretary General &#8211; WFTU &#8211; TUS &amp; PS), R. N. Parashar, Secretary General, Confederation (Directive Committee Member) and one comrade from state employees Confederation will take part in the meeting.</p>



<p>Detail information will be given later.</p>



<p><strong>Financial Position</strong></p>



<p>Financial Position of Confederation is very poor. Two above mentioned programme will incur heavy expenditure and Confederation has to give it’s share. We have requested several times to remit due quota to confederation only very few constituent organization’s and state COCs have remitted quota in the last three years. All constituents and state COCs are requested to remit due quota as early as possible by cheque / DD or by Direct Deposit in below mentioned Bank account.</p>

<p>Will the Minister of Law and Justice be pleased to state:</p>



<p>(a) whether Department of Pension and Pensioners’ Welfare had sought comments of Department of Legal Affairs (DLA) again vide Note dated 24/03/2022, regarding issuing general orders for exclusion of central government employees from the purview of NPS and to cover them under OPS whose advertisements for recruitments were issued on or before 31/12/2003 in view of various judgments of Apex Court;</p>



<p>(b) 1f so, whether DLA has furnished its final comments in response to above in the month of May, 2022;</p>



<p>(c) 1f so, full details of comments furnished along with the date thereof; and</p>



<p>(d) 1f not, reasons for delay?</p>

<p>MINISTER OF LAW AND JUSTICE<br />(SHRI KIREN RIJTJU)</p>



<p>(a) &amp;(d): Yes Sir, the Department of Pension and Pensioners’ Welfare (DoP&amp;PW) made a reference dated 24/03/2022 to the Department of Legal Affairs (DLA) seeking advice regarding the inclusion of central government employees under Old Pension Scheme on the basis of the date of advertisement being on or before 31/12/2003 of the posts against which they were appointed and whether it would be legally feasible for the DoP&amp;PW to issue executive instructions in this regard.</p>



<p>The issue was examined in the Department of Legal Affairs in the light of the comments given by the Department of Financial Services in the matter and vide note dated 06/05/2022, it was opined that the proposal of the administrative Department is a matter of policy of the administrative Department/ Ministry. Further, the notification dated 22/12/2003 is silent about the date which would determine the applicability of NPS &#8211; the date of joining or the date of Notification/ Advertisement. Also, on the basis of judgments in various court cases, DoP&amp;PW has allowed one-time option to opt for OPS/NPS for employees whose selection for appointment were finalized before 01/01/2004 but joined Government service on or after 01/01/2004 due to administrative lapse in their recruitment process. Therefore, an administrative decision to issue executive instructions providing for coverage of Government servants under OPS who were appointed to Central Government service on or after 01/01/2004 on the basis of advertisement/ notification of vacancies issued prior to 01/01/2004 1s in order.</p>

<p>(a) whether the Central and State Government employees are opposing the New Pension Scheme;<br />(b) if so, the details thereof;<br />(c) whether the Government proposes restore the Old Pension Scheme keeping in view the benefits of the said scheme in interest of employees;<br />(d) if so, the reasons thereof; and<br />(e) if not, the reasons therefor?</p>

<p>(a) to (e) Representations have been received from time to time which include the request for restoration of Old Pension Scheme. There is no proposal under consideration of Government of India for restoration of old pension scheme in respect of Central Government employees recruited on or after 01.01.2004. The National Pension System (NPS) was introduced by the Government of India to replace the defined benefit pension system by defined contribution pension scheme in order to provide old age income security in a fiscally sustainable manner and to channelize the small savings into productive sectors of the economy through prudential investments.</p>
