<p>Dear Sir,</p>



<p>The Staff Side of the NC-JCM has submitted innumerable representations to your office and also to the office of Secretary DOPT on the various issues agitating the minds of the Central Government Employees and Pensioners. You will appreciate that is the Central Government Employees who kept the Government machinery cunning during the entire COVID-19 LockDown period. Many Central Government Employees because of their exposure to the risk of COVID-19 virus while performing their duty succumbed &amp; death. Their families are suffering since Government has not paid any compensation to them after losing the sole breadwinner. Even the DA / DR being paid to them to compensate for the price rise has been frozen for 18 months without any reason. In this situation the NJCA has decided to observe 1/2/2021 (day of presentation of Central Budget 2021) as CALL ATTENTION DAY BY <a href="https://centralgovernmentnews.com/central-government-employees-news-latest-update/" target="_blank" rel="noreferrer noopener">CENTRAL GOVERNMENT EMPLOYEES</a> by holding demonstration throughout of the county in front of the all the Central Government Establishments / Units / Branches in support of the following major and outstanding demands :</p>



<p class="has-text-align-center"><strong>Demands Of Central Government Employees</strong></p>



<p>1. Withdraw the decision to corporatize Railway Production Units, 41 Ordnance Factories, GOCO Model in Army Base Workshops and stop Privatization and Outsourcing of permanent and perennial jobs</p>



<p>2. Immediate release of three installments of DA / DR due to the Central Government Employees and Pensioners from 1/1/2020, 1/7/2020 and 1/1/2021.</p>



<p>3. Implementation of the assurances given by the Group of Ministers on <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong> demands including minimum pay end fitment factor etc.</p>



<p>4. Settle all the 7 CPC Anomalies pointed out by the Staff Side of NC &#8211; JCM including the extension of one more option to switch over to 7 CPC, restoration of certain allowances and advances, and grant of two increments while on promotion/ MACP, etc.</p>



<p>5. Withdrawal of NPS and restoration of the Guaranteed defined Pension under CCS (Pension) Rules 1973.</p>



<p>6. Withdrawal of FR 56(j) which is being misused as a measure of punishment.</p>



<p>7. Issue Government Orders on all the demands agreed in the meeting of the Standing Committee of NC JCM and in the 47th Meeting of the NC-JCM</p>



<p>8. Settle the demands of the Staff Side with regard to regularization of the absence of the employees during <a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">COVID-I9</a> pandemic and Lockdown Period due to non-availability of Public Transport and home quarantine etc.</p>



<p>9. Payment of compensation to the Central Government employees who died due to COVID-19 Virus infection.</p>



<p>10. Ensure 100% Compassionate Appointment to the wards of the deceased Central Government Employees and those who are medically invalidated from service</p>



<p>11. Implement the following Supreme Court Judgments for the similarly placed employees:-<br />(iii) Grant of Notional Increment to these employees who retired/ retiring on. 31st January / 30th of June.<br />(iv) Implementation of <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACP Scheme </a>w.e.f. 1/1/2006</p>



<p>12. Payment of Night Duty Allowance to the employees detailed on Nightshift duty without any basic pay ceiling limit</p>



<p>13. Reimbursement of the Actual Amount charged by the CGHS empanelled Hospitals for the treatment of COVID-19 infection</p>

<p>Sub: <strong>Meeting of the NJCA to discuss and decide course of action to fight against privatization / corporatization and anti-labour policies of the Government of India</strong></p>



<p>As you are aware that; danger of privatization/ corporatization/ outsourcing, in Railways, Ordnance Factories and other Departments/ Organizations of the Government of India, is looming large. The government is moving in full-swing in the direction of privatization/ corporatization of the Railway Production Units and Defence Factories as also closure of the Railway Printing Presses in spite of assurance given by the Railway Board(Ministry of Railways) that nothing would be done without consulting the organized labour.</p>



<p>No doubt, all the Unions / Federations are fighting and agitating this issue at the grassroots level, but now, time has come to take a united movement to face the challenge. It has, therefore, become incumbent on us that, we should keep ourselves prepare to halt government’s efforts of privatization / corporatization of the Railways Production Units and Ordnance Factories.</p>



<p>To discuss and decide future course of action to fight against privatization/ corporatization / outsourcing policy of the Government of India, a meeting of the NJCA will be held on 25th July, 2019 in JCM Office, 13-C, Ferozshah Road, New Delhi, from 16:00 hrs.</p>

<p>Subject: <strong>Proposed Nationwide Dharna/Demonstration by National Joint Council of India (NJCA) on 13th March, 2019 against National Pension Scheme (NPS) &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</strong></p>



<p>1. It has been brought to the notice of the Government that a forum by the nomenclature of  National Joint Council of Action (NJCA) has decided to organize Dharna/Demonstrations in front of Jantar Mantar, New Delhi and all across the country on 13th March, 20 19 in order to  protest against New Pension Scheme (<a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener" aria-label="NPS (opens in a new tab)">NPS</a>).</p>



<p>2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(1) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgements that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and  that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department&#8217;s O.M. No.33012/ 1/(s)/2008- Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A). </p>



<p>3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the wi lIing employees are allowed hindrance free entry into the office premises. </p>



<p>4. In case employees go on Dharna/demonstration, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty on the day of Dharna/demonstration, i.e., 13.03.2019.</p>

minimum wage and fitment formula.</p>



<p>They pointed out the honourable home 
minister that on all previous occasions, the Government had revised the 
minimum wage recommended by the respective pay Commission after 
negotiation with the Staff Side JCM. The growing concern of the Central 
and state Government employees manifested in large scale mobilisation of
 the newly recruited employees over the new contributory Pension scheme 
was also brought to his notice.</p>



<p>The employees and officers who are 
recruited in Central Government service after 1.01.2004 are extremely 
agitated over the meagre amount of annuity they are entitled to receive 
even after paying huge amount of subscription to the scheme devoid of 
cost indexation. Family pension protection ect. The delegation also 
brought to the notice of the honourable Minister that the number of 
employees and officers who are presently covered by the new scheme has 
crossed over 50% of the total strength and the demand for bringing back 
the old Pension scheme has gained momentum. It unfortunate</p>



<p>that the Government did not heed even to
 the modest suggestion made by the Staff Side before the pension 
committee to the effect to guarantee a minimum amount of annuity to 
those who are covered under the new scheme. The delegation also stated 
that they are constrained to belive of a concerted effort on the part of
 the Government to kill the negotiating forum JCM as repeated pleading 
made to revive the joint consultative Machinery has not been responded.</p>



<p>They pointed out that the National 
Council of the JCM met about 9 years back and the meetings of the 
Standing committee and national Anomaly Committee has been few and far 
between . Since no meetings are convened at the apex level, the 
departmental Councils had also become defunct, they added. In other 
words, they said that there has been virtually no interaction worth the 
name between the Government and the employees organisation , which has 
proliferated the litigation and in most of the cases, the Government has
 lost out in the Courts. They also pointed out that the official side 
had been taking extremely nugatory attitude and had not been acting upon
 even on the verdicts of the Supreme Court.</p>



<p>The Honourable Home Minister gave a patient hearing and recalled the<br /> interaction he had with the Staff side earlier, when an assurance to  revisit the quantum of minimum wage and fitment formula had been held  out . He assured the delegation that he would cause a discussion of the matter with the Honourable Prime Minister.</p>



<p>The National JCA met later at the Staff 
side office when Com. M.S. Raja and Com. Giriraj Singh joined the 
meeting. The issues were discussed at length, especially taking into 
account the ensuing general Election in the country. The meeting finally
 decided to organise the following programme of actions.</p>



<p><strong>13th March 2019</strong></p>



<p>A massive demonstration cum dharna will 
be organised under the auspices of the National JCA to highlight and 
focus the demand for the withdrawal of the new Pension scheme and 
restoration of the old Pension scheme for Central Government employees. 
The National JCA will simultaneously write to all Political parties to 
make their stand clear on the issue of the New Pension scheme in their 
respective manifesto. The National JCA will spcarhead a campaign amount 
the employees for the acceptances of the demand by the political 
parties. The dharna will be at jantar Mantar and the same will be 
participated by the employees working in and around Delhi besides the 
NJCA leaders. On the same day, similar dharna and demonstrations will be
 held in front of all Central Government offices throughout the country.
 The employees will also be requested to wear black badges projecting 
the demand for the withdrawal of the NPS.</p>



<p><strong>28th MARCH 2019</strong></p>



<p>A protest day long dharna will be 
organised at jantar Mantar on 28.03.2019, in which all the National 
council members will take part. A huge demonstration will also be 
organised on the same day in front of the dharna venue in which the 
employees working in and around Delhi will take part. The dharna will 
highlight the need to revive the JCM forum and thus constant and 
continuous inter action between the Government and the employees. It 
will also focus the intolerable attitude of the official side even in 
issuing orders, where the supreme Court has given the verdict in favour 
of the employees. The Cabinet Secretary will be informed of this 
decision well in advance.</p>



<p>Copy of the letter addressed to the 
Cabinet Secretary is enclosed. All participating organisations are 
requested to make the programme a grand success. The NJCA will meet 
again on 28.03.2019 to discuss of the future course of action to be 
mounted in the days to come.</p>

<p>Dear Sir,<br />
We invite your kind reference to the representations made by the staff 
side both in writing and orally during discussions bilaterally and 
otherwise on innumerable occasions over the need to convene the National
 Council meeting of the JCM, which met last about 9 years back.</p>



<p>Since there had been no meeting of the 
National Council the directive issued by the Department of personnel to 
various Ministries of the Government of India to convene the 
Departmental Council meeting had also not been dwindled. We regret to 
write that inspite of our persistent persuasion you have unfortunately 
no found time for holding the meeting.</p>



<p>There had been no reason whatever for 
such inordinate delay in convening the meeting. This apart, the 
periodicity with which the National Standing committee used to meet has 
also been dwindled. The National Anomaly Committee set up in the wake of
 the 6th CPC is still to finalise its business.</p>



<p>The Staff Side, which met on 8th 
February, 2019 at New Delhi, has come to the inescapable conclusion that
 it must tread the path of struggle to get the negotiating forum revived
 we are therefore, constrained to take recourse to agitational 
programmes and have decided that all the Staff Side members of the 
National Council will sit on dharna on 28th March, 2019 at New Delhi.</p>



<p>We hope you will take note of the 
growing. discontent in the matter and take corrective steps to revive 
the JCM and to convene the meetings immediately.</p>

<p>Subject: <strong>All India Protest Day for 19th September, 2018 &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</strong></p>
<p>It has been brought to the notice of the Government that National Joint Council of Action (NJCA), New Delhi has decided to observe &#8220;All India Protest Day&#8221; on <strong>19th September, 2018</strong> in support of the following issues:</p>
<blockquote><p><strong>i. Upward Revision of Minimum Wage and Fitment Formula,</strong><br />
<strong>ii. Scrapping of the New Contributory Pension Scheme; and</strong><br />
<strong>iii. Allow Option No. 1 as one of the Pension Fitment Formula.</strong></p></blockquote>
<p>2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike including mass casual leave, go slow or any action that abet any form of strike in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike. There is no statutory provision empowering the employees to go on strike. The Supreme Court has also ruled in several judgments that going on a strike is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with the law. Any employee going on strike in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1/(s)/2008-Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).</p>
<p>3. All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed protest, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>
<p>4. In case employees go on protest, all Divisional Heads are requested to forward report indicating the number and details of employees, who are absent from duty on the day of protest, i.e., 19.09.2018.</p>

<p>Sub: <strong>Resolution No. NJCA/2018 dated 18/08/2018 against Government’s Failure to fulfill its assurances &#8211; Reg.</strong></p>
<p>A copy of Resolution dated 18/08/2018 passed by NJCA is enclosed.</p>
<p>As decided by NJCA in its meeting held on 18/08/2018 at New Delhi, the affiliates are directed to hold mass rallies/demonstrations etc., protesting against Government failure to implement its assurances on revision of minimum wage, improvement of fitment formula and abolition of National Pension System (NPS). Other pending issues related to railway employees may also be highlighted during protest actions. Affiliates may take note that “September 2018” should be treated as PROTEST MONTH by organizing different forms of protest actions at all levels i.e. Depots, Establishments, Workshops, Major Stations etc.,</p>
<p>&#8220;<strong>All India Protest Day</strong>&#8221; should be observed on 19th September 2018 and on the said date the affiliates should mobilize employees in large number along with those of Central Government Employees Organizations and hold massive rallies / demonstrations. The members of INDWF and FNPO should also be made part of agitation wherever possible.</p>
<p>A report on protest actions conducted by the affiliates may be sent to the Federation promptly.</p>

										<content:encoded><![CDATA[<p><strong>NJCA DECIDES TO OBSERVE “ALL INDIA DEMANDS DAY” ON 19th SEPTEMBER 2018</strong></p>
<p>Dear Comrades,</p>
<p>NJCA has given a call to observe 19th September 2018, the 50th Anniversary day of 1968 strike of Central Govt. employees, as ALL INDIA DEMANDS DAY protesting against the betrayal of BJP &#8211; led NDA Government and demanding immediate settlement of the following three demands. NJCA has also resolved and informed the Cabinet Secretary its decision to revive the deferred indefinite strike of Central Govt employees, in case The Govt refuses to settle the demands.</p>
<p><em><strong>Demands :-</strong></em><br />
<strong>1) Upward revision of Minimum Wage and Fitment Formula</strong><br />
<strong>2) Scrapping the New Contributory Pension Scheme.</strong><br />
<strong>3) Allow Option-1 as one of the Pension Fitment Formula.</strong></p>
<p>Confederation National Secretariat calls upon all affiliated Organizations and State / District level C-O-Cs to observe “Demands Day” on 19th September 2018 (if possible, jointly with Railway &amp; Defence Federations) through out the country by holding protest demonstrations and rallies at all centres and also in front of all offices.</p>
