Dated: July 3, 2018

Dear Comrades,

Cabinet Secretary,
Government of India,
Rashlrapali Bhawan Annexe,
New Delhi-110001

Dear Sir,

The NJCA of the organizations, participating in the JCM, met today and adopted the enclosed resolution.

The NJCA was extremely unhappy to nole that the government did not honour its commitment made to the leaders of the organizations when they metlhe Hon’ble Home Minister and Finance Minister in the presence of the then Railway Ministers on 30.06.2016 on the basis of which the Indefinite Strike which was to commence on 11 .07.2016 was deferred.

The reply 10 a question asked by Shri Neeraj Shekhar in the Upper House of the Parliamcnl(Rajya Sabha) given by Hon’ble Minister of State for Finance, Shri P. Radha Krishnan, on 06.03.201 B Minister, which is reproduced below, has further angered the Central Government employees.

“Question of Shri Neeraj Shekhar(1170)

(a) Whether Government Is actively contemplating to increase minimum pay from Rs.18,000/· to Rs.21,000/· and filment factor from 2.57 to 3, in view of resentment among the Central Government employees over historically lowest increase in pay by 7th Central Pay Commission (CPC);
(b) If so, the details thereof and the date from which it would be implemented; and
(c) If not, the reasons for the callous attitude of Government towards Government Employees?”

ANSWER
MINISTER OF STATE FOR FINANCE (SHRI P RADHAKRISHNAN )

“(a),(b)&(c ) – The minimum Pay of Rs .18,000/- p.m. and filment factor of 2.57 are based on the specific recommendations of the 7th Central Pay Commission in the light of the relevant factors taken into account by it. Therefore, no change therein is at present under consideration”.

The NJCA has decided to meet again on 18.08.2018 10 consider the response, if any, from the government to this letter and to the enclosed resolution.

In case of the continuing negative attitude of the government, the NJCA will be left with no other alternative but to revive the decision of Indefinite Strike action, which was deferred on 06.07.2016 on the basis of the assurance given by the Group of Ministers on 30.06.2016.

Sincerely yours,
(Shiv. Gopal Mishra)
Convener

Resolution

National Joint Council of Action
4, State Entry Road New Delhi – 110055

RESOLUTION

The National JCA, which met today(03.07.20 18) at New Delhi as per the notice issued by the Convenor, after deliberations, came to the painful conclusion that the government had been unfortunately indulging in chicanery for the past two years by not honouring their commitment made to the NJCA leaders on 30.06.2016. The NJCA which was formed to pursue the demands and issues of the Central Government Employees especially those emanating from the recommendations made by the 7th CPC in the matter of Wage Revision, New Pension Scheme etc. had deferred the Indefinite Strike action, which was to commence from 11 .07.2016, on the solemn announcement held out by the Group of Ministers, consisting of the Hon’ble Home Minister, Finance Minister and the then Railway Ministers. The Govt had categorically stated that they should set up a High Power Committee to look into the matters concerning the upward revision of Minimum Wage Fitment Formula etc. with a direction to submit its report within four months. The NJCA had made reasoned submissions as to the fallacy of the computation of Minimum Wage made by the 7th CPC.

The meeting further noted that the report of the committee, set-up by the Government under the Chairmanship of the Secretary, Pension, to look into the grievances of the employees and officers over the newly introduced Contributory Pension Scheme in place of the existing Defined Benefit Pension Scheme, has been kepi pending by the Government without taking any action whatsoever, thereby denying the benefit of Defined Benefit Of Pension to the employees recruited on or after 1.1 .2004.

The meeting also noted that, rejection of Option No.1, recommended by the 7th CPC, to the Pensioners on the specious ground that the said recommendation was not feasible to be implemented, was nothing but denial of legitimate parity between the past and present Pensioners.

The meeting noted with deep concern and anguish that the government has virtually closed down the doors of negotiation by not convening the meeting of the National council JCM lor the past 8 years.

The meeting in the above circumstances and given the totally nugatory attitude of the government has decided to revive the Indefinite Strike action, which was deferred on 30.06.2016, immediately and call upon the Central Government employees to prepare themselves for an otherwise inevitable show down. The meeting noted that the government had been dillydallying the issue for the past two years. The meeting desired that the government must immediately address the follollling issues and bring about negotiated settlement thereof without any further delay.

a) Upward Revision of Minimum Wage and Fitm ent Formula
b) Scrapping the New Contributory Pension Scheme.
c) Allow Option No.1 as one of the Pension Fitment Formula.

The meeting has directed the Convenor to bring to the notice of the Cabinet Secretary and through him the government lhe resentment and discontent of the employees and await their response up to 07.08.2018 and put into operation the deciSion to revive the decision of Indefinite Strike action immediately, thereafter, in case no negotiated settlement is brought about on the various demands included In the Charter of Demands .

NJCA MEETING – 17th January 2017, NO CONSENSUS ON REVIVAL OF DEFERRED INDEFINITE STRIKE

“No doubt, our strike will have a great impact in settling the demands and also in exposing the powers-that-be who betrayed the cause of 33 lakhs Central Govt Employees and 34 lakhs Pensioners. Somebody should come forward to protest and also, if necessary, to suffer and Confederation is ready for it. Let Confederation lead and others follow.”

NJCA MEETING – 17th January 2017
NJCA MEETING
NO CONSENSUS ON REVIVAL OF DEFERRED INDEFINITE STRIKE

Much awaited meeting of the National Joint Council of Action (NJCA) was held on 17th January 2017 at National Council (JCM) Staff-side office at New Delhi. Leaders of Railways, Defence, Postal and Confederation attended. Detailed discussions were held on the developments that took place after the deferment of the indefinite strike of 11th July 2016 and also on the totally negative attitude of the Government towards the 7th Pay Commission related issues of the Central Government Employees & Pensioners, including increase in Minimum Pay, Fitment formula, Allowances, Pensioner’s Option-I etc.

Unfortunately, there was no consensus regarding revival of the deferred indefinite strike. Hence no decision could be taken. Meeting ended with a decision to meet again after some days. In the meantime NJCA Chairman and Convener may try to meet the Cabinet Ministers who have given the assurances on 30th June 2016 to NJCA leaders.

As there is no immediate possibility for revival of the indefinite strike by NJCA, Confederation National Secretariat has decided to intensify the mobilization campaign and preparation for making the 16th March 2017 one day strike a grand success. All Affiliated Organizations and C-O-Cs are once again requested to make all –out efforts to ensure cent percent participation of employees in the strike. In addition to the campaign programme of National Secretariat members, each affiliated organization and C-O-Cs should chalk out their own separate campaign programme. Please give wide publicity through local print / electronic media and social media like whatsapp, facebook etc.

No doubt, our strike will have a great impact in settling the demands and also in exposing the powers-that-be who betrayed the cause of 33 lakhs Central Govt Employees and 34 lakhs Pensioners.

Somebody should come forward to protest and also, if necessary, to suffer and Confederation is ready for it.

Let Confederation lead and others follow.

NJCA meet today to decide the future course of action on Indefinite Strike

“Since the Leaders of NJCA are meeting today (6th July 2016) at 11:00 hrs., in JCM Office at New Delhi, the expectations are at high to know the recent development in implementation of 7th CPC recommendations and of course about Indefinite Strike also.”

NJCA says No to implementation of 7th CPC, until Govt increase the Minimum Pay and Fitment Factor

The NJCA will be meeting today to decide the future course of action on Indefinite Strike and Government decision on implementation of 7th Pay commission recommendation. The Leaders of NJCA are so discontented with Government’s unilateral decision on implementing 7th Pay Commission.

The Leaders told, “Just Rs.2250 hike recommended in 7th CPC minimum pay has been hyped by Govt and Media as multi folded increase is given to CG Employees in 7th Pay Commission. They obviously tried to create a false public opinion that the CG employees are overpaid. It is totally irrelevant and wrong news being publicized excessively by the Government and Media”.

They further told that arriving Minimum Pay need to be justified by Dr. Akhroyd Formula and 15th ILC norms. But this Rs.18000/- minimum pay recommended by 7th pay Commission is not at par with the Minimum wage to be paid to meet the living standard prescribed by WHO or by Dr. Akhroyd Formula and 15th ILC Principles.

It is said that when NJCA Leaders met the Group of Ministers on 30th June 2016, they actually conveyed their views to GOM to postpone the implementation of 7th Pay Commission until negotiated settlement is arrived at the issue of Minimum Wage and Fitment factor. Because they feel that if recommendations of 7th pay commission are implemented without any increase, it would be difficult to force or convince the Government to revise the Minimum Pay after implementation

It seems that the Central Government Employees and their Federations won’t compromise on this Minimum Wage and Fitment factor issue.

Since the Leaders of NJCA are meeting today (6th July 2016) at 11:00 hrs., in JCM Office at New Delhi, the expectations are at high to know the recent development in implementation of 7th CPC recommendations and of course about Indefinite Strike also.

NJCA – Detailed deliberations on the recommendations of the 7th Central Pay Commission

CONFEDERATION OF CENTRAL GOVT. EMPLOYEES & WORKERS
1st Floor,North Avenue PO Building, New Delhi – 110001 Website:www.confederationonhq.blogspot.com
Email:confederationhq@gmail.com

Date : 27-11-2015

Dear Comrades,

National Secretariat of the Confederation of Central Govt Employees & Workers held on 27-11-15 at New Delhi after detailed deliberations on the recommendations of the 7th Central Pay Commission (CPC) has decided as follows :

1.The National Secretariat has come to the unanimous conclusion that many of the recommendations of the 7th CPC are most retrograde and require to be modified before implementation by the Government, especially the faulty and depressed minimum wage arrived at by the 7th CPC and the fitment formula. Some of the recommendations such as abolition of certain allowances etc., are to be rejected.

2. The National Secretariat is of the firm opinion that a united struggle of entire Central Govt Employees including Railways, Defence and Confederation under the banner of National Joint Council of Action (NJCA) can only compel the Government to modify or reject the retrograde recommendations of the 7th CPC and hence it is decided to further strengthen the unity.

3. The National Secretariat further resolved that the form of the united struggle of NJCA should be an indefinite strike, within a time frame, as Govt is moving fast to implement the recommendations. Negotiation with the Government should precede declaration of indefinite strike and intensive campaign among the employees and mobilization, to create sanction behind the demands.

4. In case the requisite movement is not coming about for any reason, Confederation National Secretariat will meet and chalk out its own independent action.

5. Regarding the sector-wise issues relating to the employees of each department, the affiliated organizations of the Confederation in those departments shall take initiative for uniting all like-minded Federations/Associations/Unions in their department and shall organize agitational programmes on departmental specific demands.

6. The National Secretariat decided to insist that the charter of demands of the NJCA and Confederation should include the demands of Gramin Dak Sevaks, Casual/Contract labourers, filling up of vacancies and scraping the New Contributory Pension Scheme.

7. All affiliated organizations of Confederation are requested to intimate by e-mail to the Confederation CHQ (confederationhq@gmail.com or mkrishnan6854@gmail.com) on the required modifications or additions / deletions in the common recommendations (not department-specific) of the 7th Pay Commission on or before 05-12-2015.

8. Available Secretariat members of the Confederation will meet on 07-12-2015 at New Delhi and finalize the common demands to be included in the charter of demands of NJCA. (NJCA meeting is being held at JCM National Council, Staff-side office on 08-12-2015 to finalize the charter of demands and the further course of action).

9. The National Secretariat congratulated all the Central Govt Employees who made the 27th November 2015 ‘All India Protest Day’ at the call of NJCA, a grand success all over the country by wearing ‘black badges’ and participating in protest demonstrations.

Other Decisions:

1. Next All India Workshop-cum-Trade Union Camp of Confederation will be held at Dehradun (Uttarakhand) before March 2016.

2. The National Secretariat extended full support and solidarity to the proposed agitational programmes of Passport Employees Association including ‘Indefinite hungerfast’.
