Please find enclosed a copy of PCDA(WC) Chandigarh letter No. Pay/II/ Tech/94 dated 23.06.2023, which is self explanatory.

It 1s therefore requested that practice followed/ adopted as regards payment of Night Duty Allowance to Station Officers (erstwhile FED ‘B’) may be intimated at the earliest for onward submission of the same to PCDA(WC) Chandigarh.

Further, a list of designation/category/level of employees, who were made eligible by the MoD for receipt of Night Duty Allowance under your audit jurisdiction, may be obtained and provided to this office for further necessary action please.

Subject : Clarification regarding admissibility of Night Duty Allowance to FED re-designated to Station Officer.

Night Duty Allowance was admissible to the Fire Fighting staff as per list of categories identified for grant of NDA in accordance to the MoD OM dated 15.03.1990 (copy enclosed). It is pertinent to mention here that among the list of staff identified FED ‘B’ Fire Supervisors have been re-designated to the post of Station Officer with a revised pay level Gand GP 2800 / –

Further, as per DoPT OM No. A-27016/02/ 2017-Estt (AL) dated 13.07.2020. the ceiling of Basic Pay for entitlement of NDA has been upgraded to Rs.43600/- per month.

Since, the list of categories has not been revised w.r.t admissibility of NDA to the Fire Fighting Staff who have been re-designated to the post of Station Officer, it is difficult to conclude whether Station Officer is eligible to get NDA or not.

In view of the above, your views and practice followed in r/o grant of Night Duty Allowance to fire fighting staff ( FED ‘B’) re-designated to Station Officer may please be furnished to this office within 15 days for our better appreciation and enabling this office for further necessary action on the subject matter.

Please refer to Board’s letter of even number dated 29.09.2020 (RBE No. 83/2020) whereby para 2 of Board’s letter of even number dated 08.03.2018 (RBE No. 36/2018) has been modified duly incorporating a clause of ceiling of basic pay of Rs. 43600/- for entitlement of Night Duty Allowance as per the instructions of DoP&T.

2. After issue of Board’s instructions dt. 29.09.2020, the demand of the Federations/Associations has been received to remove the basic pay ceiling limit for entitlement of Night Duty Allowance. The matter has been examined in consultation with DoP&T and MoF(DoE) and it has been decided as under:

• NDA may be granted to all eligible non-gazetted employees of Ministry of Railways upto Pay Level – 7 (including those who are granted the benefit of MACP in Pay Level – 8). However, maximum Basic Pay for working out hourly rate of NDA shall remain Rs. 43600/- i.e. the prescribed ceiling fixed vide Board’s letter of even number dt. 29.09.2020.
• Other terms and conditions to grant NDA shall remain unchanged.

3. The above instructions would be effective provisionally w.e.f. 04.07.2022 i.e. from the date of issue of approval by Ministry of Finance on the subject.

4. Further, the matter is being referred separately to Ministry of Finance/Department of Expenditure for clarification reg. date of effect of the decision and reg. the issue of recovery of NDA.

5. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

The undersigned is directed to refer the issue regarding restoration of Night Duty Allowance to all categories of Railway employees. It is stated that this Ministry has already taken up this issue and forwarded matter to MoF/DoE for concurrence vide Board’s OM dated dt. 09.09.2021 and reminder dt. 23.11.2021.

DoE has forwarded copy of OM dt. 16.12.2021 addressed to DoPT. Also informed that a reference to DoPT on this issue has been made and reply from DoP&T is awaited.

In light of position provided by DoE, this Ministry has requested to DoP&T vide Board’s OM dt. 04.01.2022 for early resolution of the matter. However, reply From DOP&T & DOE is still waited.

With due regards, it is submitted that this federation has been demanding for removal of the artificial ceiling of Rs. 43600/- for eligibility for Night Duty Allowance in Defence Installations which has been imposed vide DoPT OM dated 13.07.2020. This issue has been raised in the Additional Mechanism meeting of MoD as well as various JCM-lll Level Councils.

This issue was discussed in the National Council (JCM) meeting held under the Chairmanship of Cabinet Secretary on 26.06.2021 as Agenda Point No. 5.22 Item No. NC-48/19/21 and after prolonged discussion the Chairman asked the Secretary (P) and Secretary (Exp.) to resolve the issue expeditiously.

Later, it was also discussed in National Council (JCM) meeting held under the Chairmanship of Secretary (P) on 30.07.2021 as Agenda No. 4.2 Item No. NC-47/31/19-Litigation cases on service matter wherein AS (E), DoPT stated that the guidelines issued by DoPT on the subject matter are not for the industrial employees working under the MoD. Hence, MoD has to take a conscious decision in the matter.

Therefore, you are requested to issue necessary instructions/clarifications to remove this artificial ceiling of Rs. 43600/- for defence civilians for eligibility of Night Duty Allowance so that all the eligible employees may get their legitimate monetary benefits without further delay.

Sub: Recovery of Night Duty Allowance (NDA) from Railway employees who have become ineligible to get NDA after issue of Board’s letter dated 29.09.2020 (RBE No. 83/2020).

Please refer Board’s letter of even number dated 08.03.2018 (RBE No. 36/2018) whereby the revised rates of NDA for 7th CPC period effective from 01.07.2017 were conveyed to zonal Railways. Subsequent to issue of DoP&T’s OM dated 13.07.2020 on Night Duty Allowance, further instructions issued vide Board’s letter dated 29.09.2020 (RBE No. 83/2020) prescribing Rs.43600 as ceiling of Basic Pay for entitlement of NDA. Federations have represented against the decision of ceiling-limit of pay and demanded for its review. While considering Federations’ demand Board have decided to refer the matter to DoP&T for clarification and, in the interim, recovery of NDA from Railway employees who have become ineligible for the same after issue of Board’s letter dated 29.09.2020 (RBE No. 83/2020) be deferred until further orders.

7th CPC Night Duty Allowance – Payment of (NDA) pursuant to the recommendations of 7th Central Pay Commission

Railways are accordingly, advised to defer recovery against NDA until further orders.

Responding to Railway Board’s reply vide letter No. E(P&A)II-2017/HW-1 dated June 2020 to the GS/NFIR, Federation vide its letter dated 27/07/2020, requested the Railway Board to provide a copy of the proposal sent to Department of Expenditure (DoE) for taking further action at Government’s level. It is however observed that copy has not been made available till now, while the Railway Board vide RBE No. 83/2020 dated 29/09/2020 since issued instructions revising the rates of Night Duty Allowance (NDA), fixing unjustified pay ceiling at Rs. 43,600/-per month for entitlement of Night Duty Allowance to be applicable with effect from 01/07/2017. The said decision of the Railway Ministry prescribing pay ceiling of Rs. 43,600/- per month has resulted in deprival of Night Duty Allowance to large number of Railway employees, therefore unacceptable to the Federation in view of the following:-

• All Group ‘C’ Railway employees (working in GP 1800 to 4600, PB-1 & 2) are eligible to receive Night Duty Allowance (NDA) as could be verified vide Board’s letters dated 09/06/2016, 14/12/2016, 17/11/2017 & 08/03/2018. These provisions are also applicable to the Group ‘C’ Railway employees in GP 4600 and also those who got financial upgradation under MACPS in GP 4800 & 5400 respectively.
• It is relevant to note that since 6th CPC pay of the Railway employees has been fixed in 7th CPC pay levels applying multiplication factor of 2.57, similar criteria should have been applied for fixing rates of Night Duty Allowance without imposing any ceiling limit.
• With the issuance of Railway Board’s instructions vide dated 29/09/2020, prescribing pay ceiling of Rs. 43,600/-, the Railway employees working even in GP 1900, 2000, 2400/Pay Level 2, 3, 4 and above have been deprived of Night Duty Allowance, although they ‘continued to perform night duty for smooth running of train services at all times.
• The decision of Railway Board vide letter dated 29-09-2020 prescribing pay ceiling of Rs.43,600/- p.m w.e.f. July 1, 2017 would also cause financial hardship to the staff who have already been paid Night Duty Allowance at the rates prevailed till date as it may lead to recovery of the NDA already paid. This situation may lead to resentment and agony among Group ‘C’ employees of all pay levels. The Railway Ministry should take initiative and place the case before DoP&T, highlighting the uniqueness and complex working to review and allow Railway to sort out the matter in consultation with the Federations.

2. Federation also desires to re-iterate again that the issue relating to grant of Night Duty Allowance to Railway Employees w.e.f. 01-07-2016 and 01-01-2017 consequent to increase in the Dearness Allowance rates from 125% to 132% raised vide NFIR’s PNM Agenda Item No.35/2018 and discussed already has not yet been resolved, therefore the same needs to be addressed now.

NFIR, therefore, once again requests to Railway Board to kindly review and see that all the points relating to grant of Night Duty Allowance to Railway employees mentioned above and also in PNM Agenda No.15/2018 are addressed and the correspondence exchanged with the DoE be also made available to the Federation. An early action in the matter is solicited.

2. The matter has been reviewed based on the orders received from DoPT, the nodal Deptt. of Govt. on NDA. The President is pleased to decide that the hourly rate of NDA shall be equal to {(Basic Pay + Dearness Allowance)/200} which would be admissible to eligible categories of non-gazetted Railway Servants classified under Chapter XIV of the Railway Act, 1989 read with the Railway Servants (Hours of Work and Period of Rest) Rules, 2005 for work put in during the period from 22:00 hrs to 06:00 hrs. The ceiling of basic pay for entitlement of Night Duty Allowance shall be Rs.43600 per month. The rate should be worked out separately for each employee. The present formulation of weightage of 10 minutes for every hour of duty performed between the hours of 22:00 and 06:00 would continue.

3. The grant of NDA shall be subject to furnishing of a certificate by the supervisor concerned that Night Duty is essential.

4. These instructions will be applicable w.e.f. 01.07.2017.

5. This issues with the concurrence of the Finance Directorate of Ministry of Railways.

Subject: Implementation of Government decision on 7th CPC’s recommendations on Night Duty Allowance (NDA).

Consequent upon the decision taken by the Government on the recommendations made by the 7th Central Pay Commission on the subject of Night Duty Allowance, the following instructions are being issued in supersession of this Department’s O.M.s No. 12012/4/86-Estt. (Allowances ) dated 04.10.1989 and OM No.15020/2/92- Estt .(Allowances) dated 05 .05 .1994

• Wherever the working hours have been arrived at after taking into account the night weightage factor, no further compensation may be admissible.
• Night Duty will be defined as duty performed between 22:00 hours and 6:00 hours
• A uniform weightage of 10 minutes shall be given for every hour of night duty performed.
• The ceiling of basic pay for entitlement of Night Duty Allowance shall be Rs. 43600/- per month.
• The hourly rate of NDA equal to [(BP+DA)/200] will be paid and the basic pay and DA for the calculation of NDA rates shall be the basic pay and DA prevalent as per 7th CPC.
• This formulation will extend to all employees across all Ministries/ Departments who were already in receipt of NDA.
• The amount of NDA will be worked out separately for each employee depending upon the basic pay the concerned employee is drawing on the date of performing the night duty. The existing practice for giving same rate of NDA to all employees with a particular Grade Pay should be discontinued.
• A certificate should be given by the supervisor concerned that Night Duty is essential.

2. The above instructions will be applicable with effect from 1st July 2017

Sub: Payment of Night Duty Allowance at revised rates to Civilian Employees working in the establishments under the MoD.

Several references have been received from sub-offices regarding whether NDA will be calculated on the basis of Pay of 6th CPC or on 7th CPC. The matter has been referred to HQrs office.

In this context, please find enclosed a copy of HQrs office letter No. AT/Army-BR/A/Civ /2366/NDA/Vol-1 dated 19.05.2020 regarding payment of Night Duty Allowance at revised rates to Civilian Employees working in the establishments under the MoD for guidance and further necessary action in the matter.

HQrs office cited under reference states that “in absence of revised order on the subject post-implementation of 7th CPC, it seems appropriate to admit NDA claims on the basis of extend orders on the subject until any revised orders received.”

Accordingly competent authority has decided that Night Duty Allowance claims should be admitted in audit on the basis of basic pay of the individual as per 6th CPC i.e pay of an individual as on 31.12.2015.

Further, it is requested to advice unit authorities to take up the matter with MoD through their administrative channel for obtaining clarification on this subject as instructed by the HQrs office.

Ref: PCDA (WC)’s letter No. Pay/II/ Tech/CG dated 17.03.2020

Night Duty Allowance was recommended vide para 8.17.71-77 of 7th CPC report and accepted by Govt. of India vide Resolution No. 11-1/2016-IC dated 6th July, 2017. However, no orders, that might have been issued by Ministry of Finance for implementation of the same, have been received through MoD till date in this regard.

In the absence of revised order on the subject post-implementation of 7th CPC, it seems appropriate to admit NDA claims on the basis of extant orders on the subject until any revised orders are received. Also, unit authorities can be advised to take up the matter with MoD through their administrative channel for obtaining clarification on this subject.
