OFFICE MEMORANDUM

Sub: Fixation of pay in the Revised Pay Structure, 2016 on promotion as Accounts Officer consequent to grant of NFU to Assistant Account Officers (CCAS).

The references have been received in this office seeking clarification whether the AAOs who have been granted NFU in the Pay Level 9 in terms of this office O.M. No, A-60015/1/2018/ MF, CGA(A)/ NGE/7th CPC/238 dated 4th July, 2018, are eligible for benefit of fixation of pay on promotion as Accounts Officer, The matter was taken up with the Department of Expenditure, Ministry of Finance accordingly.

The Department of Expenditure vide, I.D. No, 02-01/2018-E,IIIA dated 09.09.2019 has viewed that the benefit of fixation of pay under Rule 13 at CCS (Revised Pay) Rules 2016, if availed at the time of NFU, the same should be offset at the time of promotion in the same level in order to avoid double fixation benefits. As such the AAOs (CCAS) who have been granted NFU in Pay Level 9 and availed benefit of fixation of pay under Rule 13 of
the CCS (RP) Rules 2016, are not eligible for grant of same benefit on promotion as Account Officer in the same Level i.e. Pay Level 9.

All respective accounting units of Ministries/ Departments concerned are advised to revival such cases in the light of clarification as mentioned in Para 2 above.

Media Reports Maligning GoI over NFFU/NFU to Armed Forces

Certain section of media is attempting to generate motivated controversy on the NFFU/NFU for Armed Forces while the case is still subjudice in the Apex Court. The targeting of Govt officials ascribing false statements to them with an intent to pressurise them is highly condemnable. In case of complicated policies with long term and wider consequences, there may be times when agreement is not easy to build not only between two parties but also within a party, such cases are debated for merit in judicial Courts as per the law of the land. This process must not be attempted to be highjacked by publically targeting the reputation of individuals discharging their duties as the authorised representatives of one side, GoI in this case. In the instant case, the recourse to judicial review was taken as per the existing policies and at the decision of the GoI. Certain facts have been twisted and misrepresented in media with the purpose of misleading uniformed community and the general public. One, the Central Pay Commission has been incorrectly quoted to have recommended NFFU/ NFU for the Armed Forces. Two, there has been no attempt to malign the uniformed community or quote them as staying in ‘palatial houses’ as the hardships faced by military fraternity are well known and deeply respected by everyone including those in the Govt. The counsel of GoI has only read out the recommendations of the 7th CPC as the argument of the case in the Apex Court. Three, the originators of smearing campaign have not spared even a uniformed veteran representing GoI in judicial matters but who has no connection with the instant case. Four, the delay is not at the behest of the Govt but because of the Apex Court asking the Govt to serve the notices to remaining petitioners so that they can also be heard.

MoD requests all to allow the legal procedure in the Apex Court to complete. It is reiterated that Govt stands by its uniformed fraternity and is custodian of its high morale and operational effectiveness.

The seventh pay commission whose provisions are going to be implemented from October 1 after a long wait has not satisfied Army personnel especially veterans who feel that the status of the defence forces “has taken a big dip” especially in comparison to paramilitary forces and bureaucrats. The commission’s recommendations which were initially rejected by all three chiefs of the tri-services have only been accepted after the ministry of defence (MoD) gave its assurance of sorting out the various anomalies.

Sources said that defence minister Manohar Parrikar spoke to the service chiefs following which they decided to heed his advice on implementation of the pay commission. The commission’s implementation had been halted on September 9 when the three chiefs had written to the MoD about the apparent anomalies.

Among the major anomalies pointed out by the services are non functional upgrade (NFU), NFU pay fixation, military service pay (MSP), and common pay matrix for civilian and military services and allowances. Grant of NFU, a long standing demand of the forces, is for officers who are denied promotions due to the lack of vacancies in the steeply-pyramidal structure of the armed forces so that they do not lose out on pay grades, as their batch mates are promoted. “IFS and IPS officers, as also those from organized Group A civil services, now get NFU after the 6th pay commission like IAS officers. But the armed forces have been kept out of it,” said a senior serving officer. “This adversely impacts the morale of serving military officers. It also creates command, control and functional problems because even organizations that work closely with the military like DRDO, Border Roads Organisation, Military Engineer Services and the like get NFU,” he added.

Another demand is the placement of all Lt-Generals in the HAG+ (higher administrative grade) pay-scale like directors-general of police. “As of now, only 33% of Lt-Gens are in the HAG+ scale. The status of all Lt-Gens with that of DGPs must be restored,” the officer added.

Minister of State for Home Affairs Shri Kiren Rijiju said in the Parliament as in a written reply to a question on 23.12.2015 about the Para Military Forces as given below…

Question : Whether Government is aware of a judgement passed by Delhi High Court observing that Centre must consider all para-military forces-CRPF, BSF, ITBP, CISF and SSB as organized services to extend them not just financial benefits but better promotional and deputation avenues in Government, including Non-functional Financial Upgradation (NFU) from 2006 in terms of the Sixth Pay Commission.

Answer : The Hon’ble High Court of Delhi has given a judgement on 03.09.2015 to grant the benefit of Non Functional Upgradation (NFU) as recommended by the 6th Central Pay Commission to Group ‘A’ officers of Central Armed Police Forces (CAPFs). However, the same has been challenged by filing Special Leave Petition (SLP) before the Hon’ble Supreme Court of India, which is sub-judice.
