<p>Dear Comrades,<br />It is highly shocking that the recognition of NFPE &amp; AIPEU Group-C has been withdrawn by Postal Administration on the basis of false, fake, fabricated and concocted complaint of one unrecognized organization i.e. BPEF (Bhartiya Postal Employees Federation) affiliated to Bhartiya Mazdoor Sangh (BMS)<br />which is labour wing of RSS and BJP. The allegations are very much frivolous that the both organizations have done political funding to CPI (M), CITU and Farmers movement.</p>



<p><br />NFPE &amp; P-III Union are major constituents of Confederation. In one National Executive Committee Meeting of Confederation. The decision was taken to extend solidarity and Co-operation to the Farmers movement who<br />were fighting for the cause of every one to save the agriculture sector. On this earth, nobody can survive without food which Farmers produce and the same was totally non-political movement and so many farmers and agriculture workers union were participating in the same. After a period of more than one<br />year Prime-Minister himself apologized and withdrawn all three farmers bills.</p>



<p><br />Confederation collected some amount from its constituent organizations and handed over to one our fraternal organization of Farmers and agriculture workers. No amount was given by NFPE &amp; P-III union directly to Farmers<br />Movement. Other allegations are totally false. No funding was done to CPI(M) in any way by NFPE and P-III and no where it is mentioned in any account of NFPE and P-III whether it is believable the such a meagre amount transferred to CPI(M) may be political funding to a National Political Party.</p>



<p><br />Third allegation is to transfer money to C.I.T.U. that is also wrong. Confederation is affiliate of World Federation of Trade Union (WFTU) and every year affiliation fee is given to WFTU. NFPE explained that this amount was given to WFTU as affiliation fee from Confederation not by NFPE. So many organizations affiliated to WFTU are remitting affiliation fee and FNPO and BPEF both remit affiliation fee or levy to INTUC &amp; BMS respectively.</p>



<p><br />As this is a politically motivated action to grow and develop the BPEF unions in Department of Post which have not been able to gain membership more than 5% since after its formation in 1978 and could not get recognition under CCS (RSA) Rules-1993 after several rounds of verification since 1993.<br />So with the help of their political AKAS they want to destroy NFPE which is a militant organization and have been fighting for the cause of Postal Workers since its formation.<br /></p>



<p>There is a planned move of Corporatization and privatization of Postal Department through India Post Payment Bank. Against this move NFPE conducted a glorious strike on 10th August-2022. Being annoyed with the strike<br />and other agitational programmes being conducted by NFPE, this conspiracy has been hatched. Previously also some other attacks were unleashed on Postal Department and NFPE and the same were challenged, protested and halted by NFPE.</p>



<p><br />We as Confederation of Central Government Employees and Workers, stand like a rock behind NFPE and declare all kind of solidarity, co-operation and support to NFPE in this period and condemn highly undemocratic, illegal and arbitrary action of Postal Administration.</p>



<p><br />We appeal to all constituent organizations and state C-O-Cs to conduct lunch hour demonstrations in front of all big offices of Central Government on 2nd May-2023 declaring BLACK DAY and all employees should BEAR BLACK BADGE for whole day on 2nd May-2023.</p>



<p><br />The following resolution may also be sent to Prime-Minister, Communication Minister and Secretary Posts after holding demonstration.<br />“<strong><em>Restore the recognition and Trade Union Facilities to NFPE &amp; P-III</em></strong>”.<br /></p>



<p>NFPE has faced so many challenges in past and has won every time and this time also it will win and overcome the crisis.</p>

<p>Whereas allegations of funding Political Party were leveled against National Federation of Postal Employees (NFPE) and its trade union wing from the Union Account as well as funding of Farmer&#8217;s agitation (Kisan Movement) from the Accounts of All India Postal Employees Union Group &#8220;C&#8221;.</p>



<p>2.And whereas it was instructed vide this office letter of even no. dated 18.07.2022 to submit explanation on the allegations of aforesaid funding to political Party and Farmer&#8217;s agitation (Kisan Movement). Funding the farmers movement through Confederation of Central Govt. Employees was categorically admitted vide letter dated 24.08.2022 of NFPE.</p>



<p>3. And Whereas vide this office letter of even number dated 10.10.2022 it was directed to explain as to whether various amounts were paid to CPI(M), CITU and Farmers Solidarity Funds through online transfer and cheque payments from AIPEU Group &#8220;C&#8221; account. The response submitted vide letter dated 14.10.2022 was not found satisfactory and it was again instructed vide this office letter dated 13.12.2022 to submit detailed explanations and necessary clarifications.</p>



<p>4. And Whereas instead of explaining your position supported by due evidence, earlier submissions were merely reiterated. It was observed that NFPE and Association donated some amount to Confederation of Central Government Employee and workers to provide help to farmers&#8217; movement as well as Rs. 4,935/- to CPI(M) and Rs. 50,000/- to CITU. The act of political donations was in contravention of Rule 5(b), Rule 5(h) and Rule 6(c) of CCS(RSA) Rules, 1993.</p>



<p>5. And Whereas in order to give a final opportunity to explain the position and in order to meet natural justice, you were addressed vide communication of even number dated 16.03.2023 to show cause as to why the recognition of your Association (AIPEU Gr. &#8216;C&#8217;) as well as Federation (NFPE) concerned should not be withdrawn as per provisions contained in Rule 8 of the CCS (RSA) Rules, 1993. The due date for submission of explanation was extended up to 31.03.2023 vide this office letter of even number dated 23.03.2023, on the request of Federation.</p>



<p>6.And Whereas Secretary General, NFPE &amp; General Secretary, AIPEU, Gr &#8216;C&#8217; has submitted an explanation vide their letter No. PF/NFPE/ Misc dated 29.03.2023 inter-alia contending the following: &#8211;</p>



<p>6.1 It has been contended that he was elected as the General Secretary of AIPEU Gr &#8220;C&#8221; during third week of April, 2022 and as the Secretary General of NFPE during the first week of November, 2022. The alleged transactions had not taken place after taking over the above offices by him. He was not at all acquainted with the daily functioning of the AIPEU Gr-C (CHQ) and the Federation when the alleged transactions might have taken place. Upon consulting the audited accounts of both these organizations which were passed in last All India Conference and Federal Council, he had found no reflections of the alleged transactions in the accounts, except funding the Confederation which was not an organizational decision or collective act of the organization.</p>



<p>6.2 In so far as donation made to the Confederation of Central Govt Employees &amp; Workers to provide help to farmers&#8217; movement, it has been submitted that Federation is an affiliate of the Confederation and contributes to the fund as quota. of the Confederation each year. It was a usual contribution that has been made to the Confederation and accordingly noted in the account of NFPE. Later on, the Confederation has intimated that the fund was utilized for the aid of the farmers. Thus, the utilization of the collected fund was a decision of the Confederation and was not under the control of our Federation.</p>



<p>6.3 As far as donation of Rs. 4935/- (Rupees four thousand nine hundred thirty- five only) to CPI(M) is concerned, it has been stated that these transactions were made without the knowledge of federation online on 05.01.2021, being the cost of some books purchased. During that time, COVID protocol was in force and that is why the price of the books was paid online. The receipt of the purchased books is available with the purchaser. This transaction was not an organizational decision or an act of the organization. Had there been a decision on this score, there would surely be a note on record and all the then office bearers would have known. It was a personal purchase made by the office assistant engaged at union office and the union bank account was utilized temporarily for making a digital payment. The said amount was adjusted while paying salary to the concerned office assistant.</p>



<p>6.4 It has been pleaded that the Federation has a glory of contributing on many occasions for the cause of humanity i.e., flood, earthquakes, storms that had put our nation and citizens under grief and need. Clause 4(e) of the constitution of NFPE (Aims and Objects) obligates to work for the interest of the Nation. It is not known as to how the aid to the farmers are objectionable to the length of withdrawing recognition of the largest Federation in the department. As such, there is no violation of CCS (RSA) Rules 1993.</p>



<p>6.5 It has been pleaded that the earlier replies were lacking various factual details due to unavailability of earlier General Secretary of AIPEU Group-C and Secretary General of NFPE. It has been requested to treat the earlier replies as withdrawn ab initio.</p>



<p>7. The contentions were examined with the available records and were not found tenable on the following grounds:</p>



<p>7.1 The plea of the present incumbent that he had no knowledge of the transactions taken place during the incumbency of successor holds no grounds and are his mere afterthought, as he could easily have referred the records of Federation before submitting replies to the Department. In the Income and expenditure account of the All India Postal Employees Union Group-C Association for the year ending 31st March, 2021, it had clearly been mentioned that an amount of Rs. 30,000/- was contributed to confederation for farmer&#8217;s movement. Moreover, NFPE vide their letter No. PF/NFPE/Misc dated 24.08.2022 (para c) has already admitted funding to the Farmer&#8217;s Movement through Confederation- &#8220;NFPE and its constituents donated some amount to Confederation of Central Govt. Employees and workers to provide help to farmers movements which was totally non- political movement and this is tradition among various trade unions to extend solidarity to each other when any trade union or working-class union is conducting any agitation or movement. &#8220;</p>



<p>Their audit statement also proves that they were fully aware of the utilization of the money given by them to the Confederation and it was clearly an organizational decision of AIPEU Group &#8216;C&#8217;</p>



<p>7.2 The submission of the Association that the transaction of Rs. 4935/- was a personal transaction which was erroneously paid from the Association&#8217;s account holds no legs to stand and are mere after thoughts. The association has not provided any evidence in this regard since how a personal transaction can be made from the account of Association. Further, in case any transaction is made from the account of Association/Federation it will be considered as collective decision of Federation/ Association in respect of application of fund. Further, as per copy of bank transaction it was evident that Bank transaction of Rs. 50,000/- from the account of the Association to the account of CITU.</p>



<p>7.3 Rule 5(b) of the CCS (RSA) Rules, 1993 inter-alia stipulates that, &#8220;the Service Association has been formed primarily with the objective of promoting the common service interest of its members&#8221;. Further Rule 5(h) the CCS (RSA) Rules, 1993 stipulates that &#8220;the funds of the Service Association consist exclusively of subscriptions from members and grants, if any, made by the Government, and are applied only for the furtherance of the objects of the Service Associations. Rule 6(c) of the CCS (RSA) Rules, 1993 states that &#8220;the Service Association shall not maintain any political fund or lend itself to the propagation of the views of any political party or a member of such party&#8221;. As such, aforesaid donations clearly violate the aforesaid mentioned acts are in contravention of Rule 5(b), Rule 5(h) and Rule 6(c) of CCS (RSA) Rules, 1993.</p>

<p>7.4 The request to treat earlier replies as withdrawn ab-initio on the ground of due to unavailability of earlier General Secretary of AIPEU Group- C &amp; Secretary General of NFPE cannot be accepted. The present incumbent was required to refer the requisite documents / records before submitting replies to the Department.</p>



<p>The above contentions were duly examined vis a vis facts and records on place and it has been observed that the Federation/Association has failed to comply with the conditions set out in the CCS (RSA) Rules, 1993 hereunder:</p>

<p>In the orders issued in Covid-19 guidelines the officials above 50 years of age and pregnant women were allowed to avail commuted leave without Medical Certificate due to <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">Covid -19</a></strong> pandemic.</p>



<p>The same may kindly be extended further till the Covid-19 Crisis is over as there is no loss to the Department by giving this facility to the elderly officials and pregnant women officials.</p>

<p>Sir,</p>



<p>It is a matter of pleasure that the vaccination programme against Covid-19 has been launched by the Government of India. In first phase it is to be provided to the front line workers.</p>



<p>Our Department of Post was also declared essential service and our Postal Employees have rendered their services in various ways including delivery of medicines and other item related to treatment during <strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> crisis and lockdown period. Our Postal Staff including GDS have provided services of remitting money on the door step of public through A.E.P.S During service in pandemic crisis period so many of our officials got infected with Corona virus and so many have lost their lives.</p>



<p>Still there is threat to the <a href="https://centralgovernmentnews.com/category/postal-department/" target="_blank" rel="noreferrer noopener">Postal Employees </a>while rendering various services.</p>



<p>It is therefore requested to kindly cause necessary efforts at your level to convince Govt. of India, Health Ministry to provide Corona Vaccine to Postal Employees on priority basis treating them as front line workers.</p>

<p>I am directed to refer to your letter No.SG/AIAIASP/03/2018 on the above mentioned subject and to inform that the issue of granting NFSG in pre­ revised GP Rs. 5400/- in PB-2 corresponding to Level 9 to Asstt. Superintendent Posts on completion of four years of service in the pre-revised GP Rs. 4800/- (Level 8 in Pay Matrix) has been examined with following observations:- </p>



<p>i. The NFSG Scale is given to AAOs in P&amp;T Accounts vide MoF OM No. 25-2/2017- IC/E.III (A) dated 18.06.2018 as per recommendations of 7th CPC in Para 11.12.140 of the report whereas there is no such recommendation for ASP cadre. Moreover, AAOs in P&amp;T Accounts are having all India Transfer Liability and on contrast, the ASP is a Circle level cadre. Further, ASPs are enjoying Rule 38 transfer from one Circle to other whereas there is no such provision for AAOs. As such, the plea for granting NSFG to ASP cadre in line of AAO cadre as mentioned in the representation is not tenable.</p>



<p>ii. There is different time span in promoting IPs to ASPs in Circles as ASP is a Circle level cadre. In some Circles IPs get promotion in ASPs cadre immediately after completion of minimum qualifying years of service in IP cadre viz 3 years (now 5 years) whereas in some Circles IPs are waiting their hierarchical promotion in ASP cadre even after regular service of 10-13 years in the cadre. The NSFG Scale would not only make a huge disparity in pay among ASPs who are originally entered in IP cadre on the basis of same examination and are borne on the same IP gradation list.</p>



<p>Therefore, the proposal to grant NSFG to Asstt. Superintendent Posts on completion of four years of service cannot be recommended.</p>

<p>I am directed to convey the observation of competent authority made during a recent review meeting of Loss &amp; Fraud cases held in Directorate on 27.03.2019. In some of the fraud cases committed in the past the modus operandi adopted was premature closure of RD/MIS/TO accounts without the knowledge of the depositors by making payment to agents or by crediting the amount to fake POSB accounts. Therefore, the competent authority has desired that premature closure of RD/TD/MIS and others scheme may be allowed only if depositors are personally present. You are therefore requested to issue necessary instructions to all concerned to ensure this.</p>

<p>Your kind attention is invited towards Directorate letter no. as referred above under which orders have been issued to make delivery of the letters under Pradhan Mantri Jan AarogyaYojna (PMJAY) on Sunday.</p>
<p>In this connection we want to bring to your kind notice that now a days it has become the order of the day that on each and every Sunday officials are being engaged in various works like delivery of some important letters, some melas to achieve targets in various schemes, various meetings on new and premium schemes and other schemes of the Department. The officials of Department of Posts are now deprived from their basic right of availing weekly off.</p>
<p>Now the delivery of PMJAY letters has been entrusted to the staff which is very much causing troubles and sufferings to the employees.</p>
<p>It is also worth mentioning here that no off or any type of compensation is granted to the officials attending duty on Sunday and holiday. This shows apathetic attitude of the officers of Department.</p>
<p>Already Postal Employees are suffering a lot after implementation of CBS, CSI, IPPB, RICT, Aadhar, Passport, PNOP and other schemes.</p>
<p>It is therefore requested to kindly cause suitable instruction to all not to deprive the employees to avail their weekly offs and this practice should be ended.</p>

<p style="text-align: center;"><span style="text-decoration: underline;"><em><strong>IMPORTANCE OF JANUARY 2019 TWO DAYS STRIKE</strong></em></span></p>
<p>National Convention of Workers organized by Central Trade Unions (except BMS), independent Federations and Associations viz; Central Government and State Govt. Employees, Banks, Insurance, Defence production employees etc, held at Mavlankar Hall, New Delhi on 28th September 2018, has decided to conduct two days nationwide strike on 8th&amp; 9th January 2019. Earlier, Confederation of Central Govt. Employees &amp; Workers, in its National Convention held at Hyderabad on 10th June 2018, has decided to go for one day&#8217;s nationwide strike on 15th November 2018, demanding settlement of 10 points Charter of demands of Central Govt. Employees, Pensioners, Gramin DakSevaks and casual/contract workers. In the changed circumstances, Confederation has decided to postpone the 15th November 2018 one day strike and to join the two days strike on 8th and 9thJanuary 2019 announced by the National Convention of Workers. There is no change in the 10 points charter of demands of Confederation adopted in the Hyderabad National Convention.</p>
<p>The declaration adopted in the National Convention of Workers held on 28th September 2018 has stated as follows:</p>
<p>“Government is dragging its feet on wage negotiations of public sector in bipartite settlement and 7th Central Pay Commission anomalies of Central Government employees. Four sub committees were formed by the Government to address several issues raised by Central Government employees (NJCA) such as scrapping of New Pension Scheme (NPS) review of Minimum wage and fitment formula, restoration of allowances and allowing option-I as one of the pension benefit formula. But nothing has been done.</p>
<p>The Central Government Employees organisations including the Defence and Railways have been planning united action against the betrayal of the Government and asserting their genuine demands including scrapping of New Pension Scheme. This National Convention extends full support to their struggle and upholds all their demands.&#8221;</p>
<p>Thus, the entire Trade unions (other than BMS) has taken serious view of the negative attitude of the Central Government towards the demands of Central Government employees and Pensioners and extended full solidarity and support to our struggle.</p>
<p>Unrest among the New Pension Scheme (NPS) employees is rising day by day. Those NPS employees who retired from service, in 2015 to 2018, after completing ten years&#8217; service are getting a paltry sum of Rs.1000 to 3000 only as monthly annuity pension. How can a pensioner and his family live with such a megre amount as pension. This is equal to &#8220;No Pension&#8221;, Under the Old Pension Scheme (OPS) an employee who completed minimum ten yearsservice is eligible for 50% of last pay drawn as minimum pension.</p>
<p>Regarding increase in Minimum Pay and Fitment formula, the assurance was given to the NJCA leaders by none other than the Hon&#8217;bleHome Minister and Finance Minister on 30.06.2016. Two years are over but nothing happened. Government has replied in Parliament that, at present, there is no proposal for increasing Minimum Pay and Fitment formula. Thus the entire Central Govt. Employees are betrayed. Regarding Pensioners, the one and the only favourable recommendation of the 7th CPC i.e. Option-I, stands rejected by Government.</p>
<p>Three lakhs GraminDakSevaks of the Postal department conducted a heroic strike for sixteen days and finally Govt. was compelled to accept their demands.But while issuing orders, eventhough new pay scale recommended by the Kamalesh Chandra Committee is implemented, regarding arrears the Committee&#8217;s recommendation was rejected and modified by Govt. Some important recommendations like Children Education Allowance, Time bound three financial upgradations etc. are still pending. Regarding revision of wages of Casual Labourers, orders issued by Postal Directorate is yet to be implemented in some Circles and Divisions and their demand for regularisation is not considered favourably by Govt.</p>
<p>The situation in the country is deteriorating day by day. National economy including value of Indian currency, suffered serious setback due to pro-corporate, anti-labour and anti-people neo-liberal policies pursued by the Central Government, grievously impacting the livelihood of the working people and farmers.</p>
<p>The situation due to steep rise in petrol and diesel prices with cascading effect on increase in prices of all daily life utility items, especially food items, is resulting in torturous impact on common masses. The unemployment situation is getting aggravated with employment generation practically turned negative even in most labour-oriented sectors. The agricultural sector and farmers are in deep distress. The after-effects of demonitisation and faulty GST Continue to adversely impacting the deep crisis set in the fast-paced neo-liberal economic policies of the Government. Lack of job opportunities on the one hand and continued job losses, retrenchments, illegal closures on the other hand are imposing miserable condition on the ordinary families for their food, education of children and medical care of the sick and elderly, Aggressive move to sell the shares of the Public Sector undertakings and onslaught of privatization through various routes like outsourcing, PPP etc. is going on in full swing. The demand for universal social security with guaranteed pension has fallen on deaf ears.</p>
<p>Central Govt. not only refused to respond to the just and genuine demands of the organized agitation of working class, but has been continuing its aggression against the hard-won labourrights of the workers, employees and Trade Unions. It is in this background the entire working class of our country has decided to fight back the onslaught of the Govt. against the working class and peasants.</p>
<p>National Federation of Postal Employees (NFPE) has been in the forefront of the struggle against the neo-liberal policies of the Govt. especially against the negative attitude of the Govt. towards the Central Govt. Employees demands including Postal employees.</p>
<p>On January 8th&amp; 9th, about 18 to 20 crores organized and unorganized workers will go on two days strike. NFPE HQ calls upon the entirety of Postal and RMS employees including GraminDakSevaks and Casual, Part-time, Contingent employees to join the strike en-mass. It is a struggle for our survival.</p>
