<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (iii) NFIR’s letter No. I/11/Pt. II dated 11/02/2019.</p>



<p>&nbsp;
 Federation vide its communications dated 07/09/2018 &amp; 11/02/2019 
brought to the notice of Railway Board a specific case of wrong fixation
 of pay in favour of Shri Satyendra Kumar Lal, Chief Typist, DLW, 
Varanasi. Along with its communication, Federation also provided a chart
 highlighting the pay fixation done (Drawn) by the DLW/Varanasi 
vis-à-vis the pay due to be fixed in pursuance of Board’s instructions 
contained in RBE No. 40/2012 and requested that suitable instructions be
 issued to the GM/DLW, as also to other Zonal Railways etc., for proper 
implementation of Board’s orders (RBE No. 40/2012). Federation is 
disappointed to note that though period of over one year has passed, no 
action has been taken in the matter, while the employee continues to 
draw less salary.</p>



<p>NFIR, therefore, once again requests the <strong>Railway Board</strong>
 to connect Federation’s letters dated 07/09/2018 and 11/02/2019 and 
issue suitable clarification to the Zones etc in general and 
DLW/Varanasi in particular to ensure correct implementation of the 
instructions contained in RBE No. 40/2012 so as to avoid financial loss 
to employees on their pay fixation in 7th CPC Pay Matrix.</p>



<p>A copy of the instructions issued may be endorsed to the Federation.</p>

<p>Ref: Railway Board’s letter No.F(E)III/2008/PN1/l2 dated 04/02/2019</p>



<p>Kind attention of Railway Board is invited to the instructions issued vide Board’s letter dated 04/02/2019 relating to revision of pension of pre-2006 pensioners/family pensioners w.e.f.01/01/2006 who had retired from Railway service while in 5th CPC scale of Rs.6500-10500 duly enclosing Department of pension and pensioners’ Welfare (DoP&amp;PW’s) O.M.No.38/33/12-P&amp;PW(A) dated 4th January, 2019 stating that these instructions shall apply mutatis mutandis on Railways also.</p>



<p>ln this connection, NFIR desires to state that the pensioners who had retired from Railway service in 5th CPC pay scale Rs.6500-10500 and family pensioners continued to be aggrieved over DoP&amp;PW O.M. dated 4th January, 2019 and Railway Board’s letter dated 04/02/2019 as mentioned below:-</p>



<p>Vide Dop&amp;PW’s O.M. dated 4th January, 2019, an example has been mentioned which allows revision of only minimum Pension/Family Pension to Rs.8345/5007 respectively.</p>



<p>The O.M. does not cover the cases of Pensioners/Family Pensioners who had drawn higher pay at various stages upto maximum of Rs. 10500 in 5th CPC Pay Scale Rs.6500-10500.</p>



<p>The V CPC pay scale of Rs. 6500-10500, although initially treated as equivalent to GP 4200 (PB-2), subsequently the Government had granted replacement Grade Pay 4600 (PB-2) w.e.f.01/01/2006. Therefore, last pay drawn by the pre-2006 retired Railway employees in the Pay Scale should have been the criteria for revising the pension/family pension duly calculating notional Pay in GP 4600 (PB-2)</p>



<p>The O.M. dated 04/01/2019 needs to be modified suitably for covering all cases of pre-2006 pensioners/family pensioners as proposed below:-</p>



<p>Last pay drawn in pay scale Rs. 6500-10500 at the time of retirement/death to be calculated notionally in 6th CPC in PB-2 + GP 4600, and Pension/Family Pension re-fixed based on i.e. 50% / 30% of such notional pay respectively. These pensioners/family pensioners are to be paid arrears accrued from 01/01/2016, similar to all other pre-2006 pensioners/family pensioners as per RBE No.l7/2019 dated 04/02/2019.</p>



<p>Separate concordance table needs to be prepared and circulated on the basis of pay drawn by the pensioners/Family pensioners in V CPC Pay Scale of Rs.6500-10500 vis-a-vis GP 4600 in PB-2. Based on para 4.2 of Railway Board’s circular dated 04/09/2008 new revised concordance table say 25A is to be prepared/introduced to cover all cases.</p>



<p>While undertaking revision of pension/family pension cases as per RBE No. 17/2019 dated 04/02/2019, Zonal Railways have been facing difficulties as the revision in GP 4600/- under 6th/7th CPC has not been systemized under ARPAN. In absence of proper concordance table for notional pay fixation of pensioners/family pensioners, as on 01/01/2006, the Zonal Railways etc., have also been facing difficulty in undertaking revision of pension/family pension. It is also suggested that the concordance table No.26 available with Board’s letter dated 11/07/2018 for GP 4600 (corresponding 5th CPC Scale Rs. 7450-11500) may be made applicable in the instant case of pension/family pension revision. Federation cites Western Railway’s reference to Railway Board vide letter No. Pen/05372/E789/ARPAN/PRE-2016 dared 18/02/2019 seeking guidelines.</p>



<p>Federation requests the Railway Board to take note of genuineness of the case for highlighting to DoP&amp;PW / MoF to review and render justice to these pensioners/family pensioners of pre-2006 era. A new concordance table 25-A needs to be created/incorporated for the V CPC pay scale Rs. 6500-10500 vis-a-vis GP 4600 (PB-2).</p>



<p>NFIR, therefore, requests the Railway Board to approach DoP&amp;PW/MoF for getting the O.M, dated 04th January, 2019 modified with a view to revise pension to those pensioners who were in puy scale Rs. 6500-10500 (V CPC) and drew higher pay at various stages upto Rs. 10500 and above (including stagnarion increment) to ensure equal treatment with other pensioners. A.copy of the proposal sent to the DoP&amp;PW may be endorsed to the Federation for follow up action.</p>

<p>In the recently held Meeting, All India Railwaymen’s Federation has pointed out (PNM Item no.30/ 2011) that the pensioners are facing difficulties with regard to grant of Fixed Medical Allowance despite several letters from Board emphasizing to ensure strict compliance of the instructions issued vide letter cited under reference, the latest being dated 27.10.2016 (RBA No. 80/2016).</p>
<p>It is ,.therefore, requested that the prevailing status on your Railway may be reviewed and pensioners’ grievance in this regard may be redressed.</p>

Sub: <strong>Revision of percentage distribution of posts in Technicians category implementation of agreement &#8211; reg.</strong></p>
<p>On the Charter of Demands of the Federation, informal and formal meetings were held by the Railway Board, chaired by CRB, on 21st &amp; 22nd July 2016 at Rail Bhavan, New Delhi.</p>
<p>On 22nd July 2016, the demand relating to merger of Technicians Grade-II (GP 2400/-) with Technician Grade-I (GP 2800/-) was discussed by the Board with the Federations. Consequently, it was agreed that the percentage distribution of Technicians category shall be revised as indicated below w.e.f. 01/09/2016, while merger issue will be processed separately.</p>

<p>In this connection, NFIR brings to the notice of Railway Board that in the wake of orders issued by the Railway Board for implementation of 7th CPC Pay Matrices and grant of option for switching over to revised pay, a number of representations being received at this, urging for implementation of the agreement to enable the employees to take a decision for exercising option for revised pay matrix. While the Federation is aware that the proposal is already under process, it may kindly be appreciated that expeditious action is required to be taken for issuing orders which would facilitate staff to exercise option for7th CPC Pay Matrix.</p>
<p>NFIR, therefore, requests the Railway Board (MS &amp; FC) to kindly see that orders are issued at the earliest revising the percentages as above with effect from September 1, 2016.</p>

<p>Sub: <strong>Amendment to payment of Bonus Act, 1965-Revision of wage calculation limit from Rs. 3500/- p.m. to Rs. 7000/- p.m. with effect from 01/04/2014- payment of P.L. Bonus to Railway employees at revised rate of Rs. 7000/- p.m.-reg.</strong></p>
<p>Ref: Railway Board’s reply vide No. E(P&amp;A)II-2014/PLB-8 dated 16/02/2016 to GS/NFIR.</p>
<p>While thanking the Railway Ministry for its prompt reply to NFIR under reference No. E(P&amp;A)II-2014/PLB-8 dated 16/02/2016, the Federation re-iterates the following facts for taking appropriate steps by the Government.</p>
<blockquote><p>(i) The chronological developments since decades need to be taken into account for processing the case for payment of PL Bonus to the Railway employees at the revised wage calculation ceiling limit i.e. Rs. 7000/- p.m. w.e.f. 01/04/2014.</p>
<p>(ii) When the Bonus Act was amended, raising the wage calculation ceiling from Rs. 750 to 1600, the Railway employees were paid PL Bonus at the revised wage calculation ceiling limit. Subsequently, when the Bonus Act was amended, revising the wage calculation limit from Rs. 1600/- to Rs. 2500/-, the said rate was adopted by the Railway Ministry and PL Bonus paid to the Railway employees at the revised rates.</p>
<p>(iii) When the wage calculation ceiling was again revised to Rs. 3500/- w.e.f. 1st April 2006, the Federation took up the issue and explained the merits of the case for adopting the rate of Rs. 3500/- w.e.f. 01/04/2006 for ensuring payment of PL Bonus. The Railway Ministry had processed the case and obtained Union Cabinet’s approval and issued orders vide letter No. E(P&amp;A)II-2008/PLB-10 dated 03/10/2008, duly revising the wage calculation ceiling to Rs. 3500/- with retrospective effect i.e, from 01/04/2006, consequently, PLB arrears for the year 2006-07 were paid to the Railway employees in October 2008.</p></blockquote>
<p>From the above facts, it could be seen that the payment of P.L. Bonus has been ensured commensurating with the revision of wage calculation ceiling limit made through amendments to Bonus Act, 1965 without any deviation. Similarly when the wage calculation ceiling limit has been raised to Rs. 7000/- p.m., the Railway Employees are entitled for payment of P.L. Bonus at revised rates for the year 2014-15.</p>
<p>NFIR, therefore, requests the Hon’ble Railway Minister to kindly arrange to process the case on top priority for obtaining the approval of the Union Cabinet for making payment of PL Bonus arrears pertaining to the year 2014-15 to the Railway employees at the earliest.</p>

<p><strong>Further to above, Federation furnishes below yet another category viz., Shorff cadre (Cash &amp; Pay Department – Receipt side) in which case the ACP Scheme was more advantageous than the MACP Scheme introduced by the Railway Board vide Board’s letter No.PC-V/2009/ACP/2 dated 10-06-2009, w.e.f. 01-09-2008.</strong></p>

<p><strong></strong><strong>Note: * The above comparison clearly establishes the fact that under ACP Scheme the staff got financial up-gradation in Pay Scale Rs.5000-8000/GP 4200/- on completion of 24 years of service whereas under MACP Scheme, the staff gets GP 2800/- (replacement Grade Pay) on completion of three decades and they cannot dream of reaching GP 4200 (PB-2) under MACPS.</strong></p>

<p>Kind attention is invited to the announcement made by the Government of India, Ministry of Labour and Employment on 1st September 2015, conveyed through press Information Bureau, extract of item no.2 the subject reproduced below:-</p>
<div style="border-left: solid 3px #C00000; margin: 0; padding: 15px;">For the purpose of bonus, the wage eligibility limit and calculation ceiling would be appropriately revised. It is proposed to revise the wage eligibility limit from Rs.10,000 to Rs.21,000 and calculation ceiling from Rs.3500 to Rs.7,000 or the minimum wage notified by the appropriate Government for that category of employment, whichever is higher, with the proposed revision of the minimum wages, the average<br />
calculation ceiling would be about Rs.10,000.</div>
<p>In the light of the Government’s announcement as mentioned above.<br />
NFIR requests the Hon’ble MR to kindly arrange to take action for<br />
removal of calculation ceiling for the purpose of payment of productivity Linked Bonus (PLB) to Railway employees. Incidentally it is mentioned that in the past, as and when the Government had revised the calculation ceiling, the Ministry of Railways have accordingly paid P.L. Bonus to employees.</p>

Sub: <strong>Disadvantages caused due to Bio-toilets introduced in the passenger coaches of Indian Railways reg.</strong></p>
<p><strong> </strong></p>
<p>The concept of bio-toilets in passenger carrying coaches was given shape by the Railway Ministry some time in the year 2011 when in a few coaches of’ passenger carrying mail/express trains, the bio-toilets were first introduced. NFIR understands that the Railway Ministry plans to fit bio-toilets in all passenger coaches by 2021.</p>
<p>&nbsp;</p>
<p><strong>Federation has been receiving number of complaints from the C&amp;W Staff on malfunctioning vis-a-vis disadvantages of the bio-toilets.</strong> In this connection, NFIR having gone into the complaints received from the C&amp;W Staff, noticed the following problems which may cause serious health hazards to staff.</p>
<p>&nbsp;</p>
<p>The bio-toilet system is very sensitive. It has more than 100% chances of choking even with a bit of ‘Pan Gulka’ spitted in the toilets by the passengers knowing or unknowingly if not flushed properly by the passenger in the moving or stationary trains. Choking in these toilets also takes place due to throwing of Napkins, Cigarette buds, Gutka Pouch, Ladies pads, Plastic Water Boltles or their covers, liquor boltles and garbage of food stuff by the passengers resulting toilet pans and leading to public complaints. This situation has been causing tremendous pressure on staff for no fault of theirs.</p>
<p>&nbsp;</p>
<p>The ball-valve provided which should function to drain out the waste to the ground by operating a connected pedal, never works due to faulty design. It is also reported that designs differ from one manufacturer to another, causing problems in procurement of spares.</p>
<p>&nbsp;</p>
<p>The RDSO designed simplified standard mechanism to operate the ball valve be not compatible with old designs.</p>
<p>&nbsp;</p>
<p>It has been further complained that improper trials of revised versions/modifications before implementation has been the real problem in procurement of spares and has been creating confusion among the Supervisors and Staff in the course maintenance.</p>
<p>&nbsp;</p>
<p>The C&amp;W Supervisors and staff working in pit lines have been facing lot of inconvenience during under gear maintenance, examing brake beam, brake block hanger, brake shoe assermbly, brake blocks, Safety wire rope &amp; their pins, bogies frames and also facing serious inconvenience in piston stroke brake cylinder which faces tank of quite a big size and leaves narrow gap.</p>
<p>&nbsp;</p>
<p>Bio-toilets required inspection &amp; maintenance to ensure working of Ball-Valve &amp; its operation linked with p-trap and Hose Connector, mounted and fitted in the narrow gap of the top surface of the tank and trough floor of the coach. C&amp;W Engineers and Staff have been put to lot of difficulties during maintenance and have been subjected to more physical mental stress in day-to-day working. While working are being compelled to inhale foul smells emanating from the choked tanks containing human waste and have started acquiring diseases.</p>
<p>&nbsp;</p>
<p><strong>The process of draining out or the choked tanks generates unbearable filthy smell creating inconvenience to other technical staff working on other under gears and at times diverts their attention and Compels to ignore the necessary safety repairs due to bad work environment.</strong></p>
<p><strong> </strong></p>
<p>At present we have this system only on 10% of the coaches, causing serious problems. ‘The height of the problems can be measured when 100% coaches will have this system and will it be possible for staff to function? The C&amp;W Supervisors and Staff are reported to have become like human scavengers. It is worth-mentioning that the <strong>Government of India had banned scavenging in the year 1993 consequent to the directions given by the Apex Court through various judgements.</strong></p>
<p><strong> </strong></p>
<p>Federation has further been given to understand that as per Railway Board’s guidelines effluent test is required to be conducted to over 5% population of each type of coaches at an interval of 3 months and is to be conducted by the expert laboratory Staff. Unfortunately, the Railway Authorities, instead of using Lab Staff for the said purpose, have been pestering C&amp;W Staff to collect effluent from Bio-Tanks for conducting test in some Depots like Gwalior, despite the fact that this job is not related to C&amp;W staff.</p>
<p>&nbsp;</p>
<p>Federation notes with disappointment that the ‘Bio-toilet’ system introduced on the I.R. is claimed to be environment friendly but it is not so. particularly for the C&amp;W Supervisors &amp; Technical Staff of Mechanical Department.</p>
<p>&nbsp;</p>
<p>NFIR, therefore. requests the Railway Board (MM) to kindly see that thorough review is conducted before proceeding further for introducing Bio-toilets in coaches.</p>

<p>During the Holy month of Ramzan, the time of Iftar coincides with setting of the sun, which takes place quite early.</p>
<p>It has, therefore, been decided that those Muslim Railway employees who observe fast and are required to tavel a long distance to their residence for Iftar, may be allowed to leave office early wherever feasible.</p>
