<p>Pressure mounted from railway employees of different zones that the PL Bonus should be announced and paid in cash to enable them to make purchases for celebrating Dussehra. It is needless to mention that Puja days (Navratra) will commence from 25th Sept 2014 onwards hence there is need to arrange payment in cash.</p>
<p>NFIR, therefore, requests to kindly arrange to issue suitable instructions for payment of P.L. Bonus in cash as a special case.</p>

<p>(ii) NFIR’s letter No.1/3/Pt.1 dated 25.10.2013</p>
<p>Kindly refer to the Agenda item No. 8/2014 for PNM/NFIR meeting on the above subject wherein contention was that employees are being asked to submit affidavits and fulfil other unnecessary formalities for withdrawal from Provident Fund.</p>
<p>Information had been called for from all Zonal Railways regarding procedure being followed in different Railways while sanctioning withdrawals from Provident Fund few marriage purpose. Almost all Railways are following the simple procedure on withdrawals from Provident Fund by its employees except some Railways where self declaration duly witnessed by two railway employees is required. None of the Railways have asked its employees to submit affidavit in connection with withdrawal from Provident Fund.</p>
<p>It is therefore requested to indicate the specific Railway which is insisting on submission of affidavits etc. for withdrawal from Provident Fund, so that they are suitably advised.</p>

<p>NFIRs delegation has called on you on 28th July, 2014 and handed over memorandum for taking appropriate action.<br />
NFIR now requests to kindly arrange to convey the dates on which Federation’s representatives can meet the Pay Commission to explain the case of railway employees of various categories. In this Connection, we suggest as follows :-<br />
a) Inter-action meetings may be fixed giving us reasonable advance intimation to enable us to reschedule our other programmes.<br />
b) Meeting/hearing may be fixed department wise to facilitate us to meet the Pay Commission along with the representatives of the concerned departmental category.<br />
c) In the Railways there are eight major departments with hundreds of categories. Eight different dates for explaining our case may kindly be considered.<br />
d) Inter-action meetings may also be convened for explaining the case of miscellaneous and isolated categories.<br />
e) We request that a separate date and time be provided to facilitate the Federation to explain uniqueness of railways as well unique nature of duties of railway employees in general.<br />
We request you to kindly consider giving dates for us during September and October 2014. keeping in mind the holidays during these months. We shall be grateful to the Pay Commission, if the tentative dates are conveyed to enable to us to select and respond.</p>

<p>The Gerieral Secretaries of Affiliated Unions of NFIR,<br />

Sub: <strong>Applicability of Old Pension Scheme to substitutes who attained temporary status prior to 01/01 12004 and regularised after 01/01/2004 – clarification.</strong></p>
<p>Ref: (i) GS/NFIR’s letters No.II/16 dated 9th October 2012. 04/10/2013 &amp; 31/03/2014<br />
(ii) GS/NFIR’s letter No. II/16 dated 4/10/2013 addressed to Secretary, Ministry of Finance, New Delhi and copy endorsed to the AM/Staff, Railway Board.<br />
(iii) NFIR’s PNM item No. 15/2011.<br />
In continuation to the above cited references, the Federation desires to convey that the Ministry of Finance has since given clearance. (as informed by the E.D/FE. Railway Board, during discussions) for applying liberalized pension scheme to those substitutes who attained temporary status prior to 01/01/2004 but, however, got regular absorption subsequent to 01/01/2004 with continuous service.<br />
With this clarification of MoF, those substitutes who attained temporary status prior to 01/01/2004 and later on absorbed as regular staff will get covered under the Old Pension Scheme i.e. Liberalized Pension Scheme. Railway Board is processing the case for issuing orders. This is NFIR/PNM item being pursued by Federation since the year 2011.<br />
Concerned Staff may be advised accordingly.</p>

<div>While enclosing copy of Federation’s letter No. 1/5(A) dated 27/09/2013, NFIR desires to bring to your kind notice, the following facts for consideration.</div>
<div></div>
<div>2. In the Standing Committee meeting held under the chairmanship of the Secretary DoP&amp;T, on 7th May 2014, the agenda item pertaining to merger of D.A. with pay was discussed by the JCM/Staff Side representatives. There has, however, been no positive response from the Official Side on the issue probably the VII CPC has started working on the terms of reference.</div>
<div></div>
<div>3. Now that the D.A. has become 100% of pay w.e.f. 01/01/2014 and another instalment of D.A. @ 6% of pay is likely to be granted by the Government w.e.f. 01/07/2014 as per the figures of Consumer Price Index, continuing D.A., without merger, is highly unjustified. In the past i.e. during the year 2004, the Government of India had merged 50% DA with pay for all purposes. Similar decision has, unfortunately, not been taken by the previous Government.</div>
<div></div>
<div>4. Seventh Central Pay Commission has already sent communications to JCM constituent organisations etc.. to submit Memorandums. At this juncture, it would be proper to convey to the Chairman, 7th CPC to consider the JCM (Staff Side) demand for merger of DA with pay with retrospective effect and send interim report to the Government for consideration.</div>

<div>NFIR, therefore, requests you to kindly consider our request and see that the Government makes reference to 7th CPC to consider DA merger with pay and to send its interim report to the Government for favourable consideration.</div>

<div>In terms of instructions contained in Board’s letter of even number dated 22.7.2004, Group ‘C&#8217; employees with 03/05 years of non-fortuitous service in the grade the minimum of which is Rs.5000/- and in higher Group ‘C’ grades (Vth CPC) are eligible for being considered for appearing in the 70%S election/30% LDCE held for promotion to Group ‘B’ posts in the major departments having ‘Organized Services’s including Accounts Department. Consequent upon implementation of the pay scales recommended by the VI Pay Commission, these instructions have since been modified (except for Accounts Department) vide Board’s letter of even number dated 29.03.2010.</div>
<div></div>
<div>2. Now, the matter regarding eligibility conditions for appearing in the Selection/LDCE for promotion to Group &#8216;B’ posts in the Accounts Department, has been considered by the Board and it has been decided that:</div>
<div></div>
<div>i) For Group ‘B’ selections (70% quota), Group ‘C’ employees of Accounts Department working in Pay Band PB-2 (Rs.9300-34.800) with Grade Pay of Rs.4200 and above with 3 years of non-fortuitous service in the grade (including non-fortuitous service rendered in the corresponding pre-revised grades) in the Accounts Department and who have qualified the Appendix-3 IREM Examination will be eligible.</div>
<div></div>
<div>ii) For Group ‘B’ selections (30% LDCE quota), Group ’C’ employees of Accounts Department working in Pay Band PB-2 (Rs.9300-34800) with Grade Pay of Rs.4200 and above with 5 years of non-fortuitous service in the grade (including non-fortuitous service rendered in the corresponding pre-revised grades) in Accounts Department and who have qualified the Appendix &#8211; 3 IREM Examination will be eligible.</div>
<div></div>
<div>iii) In the integrated seniority of Group ‘C’ employees eligible for Group &#8216;B’ selections (70% quota), employees in Pay Band PB-2 (Rs.9300-34800) with Grade Pay of Rs.4800 will be placed above those in Pay Band PB-2 (Rs.9300-34800) with Grade Pay of Rs. 4200. In either category, the relative seniority of employees coming from different streams will be determined with reference to length of non-fortuitous service in the Scale of PB-2 + 4800 or PB-2 + 4200, as the case may be.</div>

<p>NFIR has been writing to the Government of India (including Prime Minister, Finance Minister etc) for merger of 50% DA with pay through its letters dated 10/01/2013, 05/08/2013, 27/09/2013. Also in its 27th National Convention held at Visakhapatnam from 10th  to 12th December, 2013, the Federation had passed a resolution demanding merger of 50% DA with Pay and grant of interim relief to employees of Central Government including Railway employees.</p>
<p>NFIR feels happy to convey that the Central Government has conceded the demand of the employees raised by the Federation.</p>
<p>Union Cabinet is likely to consider the issues to day for taking final decision. Federation will advise decision when taken by the Government. <em><strong>Federation expects that there may be Good News for all Central Government employees very soon.</strong></em></p>

<div>Ref: (i) Railway Board&#8217;s letter No.PC-V/2009/ACP/2 dated 13/12/2012.</div>
<div>(ii) NFIR’s letter No.IV/MACPS/09/Pt.6 dated 20/01/2013.</div>
<div>(iii) Railway Board’s letter No. PC-V/2011/M/4/NFIR dated 05/03/2013.</div>
<div>(iv) Railway Board’s letter No.PC-V/2009/ACP/7/SCR dated 05/03/2013.</div>
<div></div>
<div>NFIR vide its letter dated 30/01/2013 had invited attention of the Railway Board (MS) to clarification issued by the Railway Board vide letter dated 13/12/2012 and illogically upheld further vide letter dated 05/03/2013. In its letter dated 30/01/2013, while explaining rule position in detail, Federation had demanded meeting at the level of Railway Board (MS) considering its wider implications and the inappropriate stand taken by the Railway Board, besides keeping in abeyance the implementation of instructions dated 13/12/2012.</div>
<div></div>
<div>Unfortunately, Railway Board did not take any action despite Railway Board (MS) verbal assurance. The wrong stand taken by the Railway Board on the issue has resulted into affecting undue recoveries from the salaries of staff on some Zonal Railways creating deep sense of resentment among them who are now feeling aggrieved and agitated.</div>
<div></div>
<div>2. In this connection, NFIR wishes to invite once again the kind attention of the Railway Board (MS) that the clarification dated 13/12/2012 allows financial upgradation under MACPS under promotional /cadre hierarchy whereas the MACP Scheme permits granting financial upgradation in Grade Pay hierarchy and is admissible upto GP Rs. 12000/- in PB-4.</div>
<div></div>
<div>This proves the contention of the Federation that the said clarification is grossly erroneous as the same is against the policy guidelines on MACPS and may not withstand judicial scrutiny.</div>
<div></div>
<div>3. Apart from above. NFIR wishes to bring to the notice of Railway Board (MS) following additional facts for kind information and necessary action:-</div>
<div></div>
<div>That the Ministry of Health &amp; Family Welfare, Nirman Bhawan, New Delhi vide O.M. No.Z2901171/2012-N dated 11th April 2013, which is the nodal ministry in sofar as para-medical stall are concerned has permifted financial upgradation in PB-3 with GP Rs.6600/- to the nursing staff pursuant to the judicial scrutiny of the issue at the level of Supreme Court.</div>
<div></div>
<div>That the Federation is shocked to know from many Zonal Railways that based on Railway Board’s clarification issued on 13/12/2012 recoveries from all similarly placed stall, including para-medical stall has since begun and the staff are being put to totally disadvantageous position.</div>
<div></div>
<div>4. Federation further wishes to clarify that the O.M. dated 11th April 2013, should be implemented mutatis-mutandis in favour of railway employees who are similarly situated as any action contrary to the said O.M. will be contempt the orders of Apex Court.</div>
<div></div>
<div>NFIR. therefore, requests the Railway Board (MS) to immediately withdraw the clarification issued under letter dated 13/12/2012, as requested earlier and issue suitable instructions to all General Managers etc.. not to affect recoveries. Federation is, however, ready to discuss the issue at the level of Railway Board (MS). Federation may be kept advised of the action taken.</div>

<p>Sub: <strong>Productivity Linked Bonus to the Railwaymen for the year 2012-13.</strong></p>
<p>Durga Pooja is the biggest festival of the Eastern part of the country. Durga Puja and Festive Season are approaching very last, and every time we have seen eleventh hour trouble creating lots of frustration and chaos among the Railwaymen. There is rumour in the corridors that, this year Productivity Linked Bonus may be reduced inspite of untiring efforts made by the Railwaymen in increased productivity.</p>
<p>AIRF has achieved PLB for the Railwaymen after lots of struggles and sacrifices. In this connection, it is worth-mentioning that PLB is a bilateral agreement arrived at between the Organized Labour and Ministry of Railways, any tinkering with PLB Formula or any deviation from the inputs will definitely create confrontation</p>
<p>Since AIRF is maintaining very good harmonious industrial relations over the Indian Railways, we hope, nothing will be done to harm the industrial peace.</p>
<p>As per our calculation, Railwaymen must get increased PLB for the year 2012-13 in comparison to last year, since productivity has increased. In case Railway Board think it, otherwise the matter may be discussed, but no means that payment of PLB should be delayed, which may cause serious industrial relation.</p>
<p>Please treat the matter as Most Urgent and arrange the payment of PLB as per formula, already decided.</p>
