<p>Ref.: This office Letter No.NC-JCM-2024/8″ CPC dt.03.06.2024.</p>



<p>Dear Sir,<br />On behalf of the Staff Side Members of National Council JCM and the entire Central Government Employees and Pensioners I wish you a very happy and prosperous New Year 2025 in advance. It is now 09 years after the implementation of the 7 CPC recommendations and the next Wage revision and Pension revision is due from 01.01.2026, since the wages of the Central Government Employees and Pension of the Central Government Pensioners are revised once in 10 years. This periodicity is maintained from the implementation of 4th CPC, i.e., from 01.01.1986. This office vide letter referred above have requested your good self (Copy enclosed for ready reference) that the Government may constitute the 8th Central Pay Commission immediately. It is now more than 06 months after we submitted our request. So far we have not received any positive response from the Government.</p>



<p>Sir, you will appreciate that the 7th Central Pay Commission was constituted well in advance ie., on 28.02.2014, almost 02 years before the implementation date of 01.01.2016. However, just 01 year only is left for the next wage / pension revision. The Pay Commissions used to take almost 02 years period for Submitting their final report to the Government and the Government takes 03 to 06 months for considering and implementing its recommendations. In this back drop I feel there is no justification in further delaying the matter. Hence it is once again requested that you may kindly take up the matter with the Hon’ble Prime Minister and Finance Minister for immediate constitution of the 8th CPC.</p>

<h4 class="wp-block-heading">5.15 Item No.NC-48/9/21: Grant of Compassionate Allowance to the widows of Employees dismissed/removed from service. (D/ o P&amp;PW).</h4>



<p>Explaining the issue, Secretary, D/ o P&amp;PW, explained that the CCS(Pension) Rules, 1972 provide for payment of Compassionate Allowance to employees dismissed or removed, if the case deserves special consideration. Cases in which the widows of employees, dismissed and removed, have applied for Compassionate Allowance which has not been considered on the ground that there is no such provision in Rule 41 of CCS(Pension) Rules, 1972. Compassionate Allowance may be sanctioned to widows of the dismissed and removed employees on humanitarian grounds, in cases where such an employee has rendered more than 10 years qualifying service before dismissal/ removal. He also stated that an amendment in CCS (Pension) Rules is under consideration, wherein it is proposed that Disciplinary Authority may examine every case, and make a decision regarding grant of Compassionate Allowance, within three months after the date of issue of the order imposing the penalty of dismissal or removal from service. A provision in the Rules to also consider past cases (which were not considered earlier) within a period of 3 months from the date of notification of the revised Rules is also under consideration.</p>



<p>Shri C. Sri Kumar, member, Staff Side, specifically mentioned the cases of those deceased employees, whose applications remain undecided, and whose widows may be considered for a grant of Family Pension.</p>



<p><strong>Decision: The chairman directed D/ o P&amp;PW to take a decision in the matter at the earliest, and then the item may be treated as closed.</strong></p>





<p>(i) A Government servant who is dismissed or removed from service shall forfeit his pension and gratuity:</p>



<p>Provided that the authority competent to dismiss or remove him from service may, if the case is deserving of special consideration, sanction a compassionate allowance not exceeding two-thirds of pension or gratuity or both which would have been admissible to him if he had retired on compensation pension.</p>



<p>(ii) A compassionate allowance sanctioned under the proviso to sub-rule (i) shall not be less than Rs. 9,000/- p.m.</p>

<h3 class="wp-block-heading">Sub: Brief of the meeting held today with the Cabinet Secretary (Government of India)</h3>



<p>Met today with the Cabinet Secretary (Government of India) and handed him over a copy of our letter dated 16th January 2021, expressing our anguish over the freezing of Dearness Allowance/ Dearness Relief payable to the Central Government Employees and Pensioners/ Family Pensioners. I also demanded for payment of Dearness Allowance/ Dearness Relief with arrears since 01.01.2020.</p>



<h2 class="has-text-align-center wp-block-heading"><strong><a href="https://centralgovernmentnews.com/expected-da-2021/" target="_blank" rel="noreferrer noopener">Expected DA 2021</a></strong></h2>



<p>During the course of the discussion, the Cabinet Secretary said that the country was passing through an unprecedented situation, that is why, Government had to take such an action, but he further said that there should not be any doubt that freezing of Dearness Allowance/ Dearness Relief will continue even after 30th June 2021.</p>



<p>I also asked him that, no action has been taken in our letter dated 11th January 2021 (Reg. the undue delay in settling the issues discussed in the meeting of the Standing Committing of NC/JCM and 47th meeting of the NC/JCM). He immediately called Addi. Secretary(Esstt.), DoP&amp;T, and asked her to organize all the meetings due as well as to get implemented the issues agreed in the meetings of the NC/JCM referred to above.</p>

										<content:encoded><![CDATA[<p>Agenda item No. 1 for the meeting of the National Anomaly committee sent to NC JCM by Confederation vide No. Ref: Confdn/JCM NC/Anomaly/2016-19 Dated &#8211; 03.07.2017</p>
<p><strong>Item &#8211; I &#8211; ANOMALY IN INCREMENT RATE</strong></p>
<p>As per clause(C) of the terms of reference of the National Anomaly Committee &#8211; where the official side and the staff side are of the opinion that any recommendations is in contravention of the principle or the policy enunciated by the Seventh Central Pay Commission itself without the commission assigning any reason &#8211; it constitutes an anomaly.</p>
<p>Regarding annual increment the recommendations of seventh CPC are as follows:</p>
<p><strong>(i) 7th CPC Report &#8211; Highlights of Recommendations &#8211;</strong></p>
<p>SL &#8211; 7 &#8211; Annual Increment &#8211; The rate of annual increment is being retained at 3 percent.</p>
<p><strong>(ii) 7th CPC Report &#8211; Forword</strong></p>
<p>Para 1.19 &#8211; The prevailing rate of increment is considered quite satisfactory and has been retained.</p>
<p><strong>(iii) 7th CPC Report &#8211; Chapter 4.1 -Principles of Pay determination</strong></p>
<p>Para- 4.1.17 &#8211; The various stages within a pay level moves upwards at the rate of 3 percent per annum.</p>
<p><strong>(iv) 7th CPC Report &#8211; Chapter 5.1 &#8211; Pay Structure (Civilian Employees) </strong></p>
<p>Para 5.1.38 &#8211; Annual Increment</p>
<p><strong>&#8220;The rate of annual increment is being retained at 3 percent&#8221;</strong></p>
<p>Para 5.1.21 &#8211; The Vertical range of each level denotes pay progress within that level. That indicates steps of annual financial progression of 3 percentage within each level.</p>
<p>Contrary to the above principle laid down by the 7th CPC, the actual increment rate in the Pay levels of the Pay matrix are less than 3% as illustrated in the Table below: &#8211;</p>
<p><strong>ILLUSTRATION-I &#8211; LOSS IN INCREMENT </strong></p>

<p><strong>ILLUSTRATION &#8211; 2</strong></p>
<p>In Level &#8211; 2, Cell &#8211; 2, the pay is shown as 20500. After giving one increment of 3% it should be 21115/- but the next cell is only 21000 (Level-2, Cell-3). Next stage should be 21115+633=21748 but the next cell is only 21700 (Level-2 Cell-4).</p>
<p>In Level &#8211; 6, Cell 14 should be 50500 + 1515 = 52015 whereas it is given only 52000.</p>
<p>From the above it can be safely concluded that</p>
<blockquote><p>(i) Recommendation of the Pay Commission regarding increment rate is in contravention of the principle or policy enunciated by the 7th Pay Commission, Hence it constitutes an anomaly.</p>
<p>(ii) In many stages, eventhough the increment is shown as 3%, it is rounded off to the next below amount causing financial loss to the employees.</p>
<p>(iii) In the sixth CPC, while calculating increment, if the last digit is (one) or above, it used to be rounded off to next 10 (Ten). So in this Pay Matrix also if the amount is 10 (Ten) and above, it should be rounded off to the next above 100 (hundred).</p>
<p>(iv) Even if the difference may look small (in percentage) it will also have long term impact on the employees promotion inviting heavy financial loss. The following illustration will reveal it.</p></blockquote>

<p>1. Pay Level &#8211; 6</p>
<p>2. Cell (Stage) in the Pay Level &#8211; 8</p>
<p>3. Basic Pay in the Revised Scale &#8211; 44900</p>
<p>4. Actual Pay after adding 3% annual increment &#8211; 46247</p>
<p>5. Basic Pay fixed as per the Pay Matrix &#8211; 46200</p>
<p>6. Loss of amount to the employee in the increment &#8211; 47</p>
<p>7. Pay on promotion to next Level if fixed as per serial 4 above &#8211; 49000</p>
<p>8. Pay on promotion to the next level, if fixed as per serial &#8211; 5 above &#8211; 47600</p>
<p>9. Loss per month on promotion &#8211; 1400</p>
<p>Thus, for a loss of Rs.47/- only in the Annual increment, the employee will suffer a recurring loss of Rs.1400/- per month during his/her promotion to the next level and this loss will have cumulative effect on rest of the period of the service career with financial loss on Dearness Allowance (DA) and further promotions and also Pensionery benefits.</p>
<p>The above anomalies are to be rectified.</p>

<p>Sources said that the Allowance Committee Meeting has finalized a proposal on HRA. It will be finalized in the Meeting held on 25th October 2016. It is said that the proposed Meeting under the Chairmanship of DOPT Secretary (P) with the Secretary Staff Side, NC (JCM) is to firm up the view on various allowances pertaining to Department of Personnel &amp; Training.</p>
<p>&nbsp;</p>
<p>This Meeting is conducted as per the decision of Allowance Committee Meeting held on 1-9-2016. The meeting to finalize the allowances pertaining to DOPT has been scheduled to be held on 25th October 2016.</p>
<p>The Reliable Sources said that the Official Side are in the view of increasing HRA by 1 Stage to reach 30% , 20% and 10% .</p>
<p>&nbsp;</p>
<p>The pay Commission recommended HRA at the rates initially from 24%, 16%, and 8 % and whenever DA reaches 50% it will be increased to 27%, 18% and 9% and Finally after DA reaches 100% the HRA will be revised to 30% , 20% and 10% for X,Y and Z cities respectively.</p>
<p>&nbsp;</p>
<p>The NCJCM has demanded in its Memorandum submitted to the 7th Pay Commission that 60%, 40% and 20% HRA to be recommended for X,Y and Z cities.</p>
<p>&nbsp;</p>
<p>The Pay Commission totally ignored this demand and recommended reduction of rates from Sixth CPC. Since it is Co related with DA , it will be increased after two stages to 30%, 20% and 10% after DA reaches 50% and 100%.</p>
<p>&nbsp;</p>
<p>The sources said that now it is proposed to start the <strong>HRA rates initially from 27%, 18% and 9%</strong> and after DA reaches 50% the House Rent Allowance will be revised to 30%, 20% and 10% for X,Y and Z cities respectively.</p>

<p>The statistics reveals that there are 88% of total strength of Government servants are in Group ‘C’ Category.</p>

<p>Obviously those who are representing these 88% at the Forums which are constituted to negotiate with concerned Departments and Government about their issues are capable of weighing the advantages and disadvantages of recommendations of 7th central pay commission.</p>

<p>The Staff Associations and Workers federations are the one who are representing Group C and Group B at various levels of negotiating forums know the plights and facts of government servants more than anybody. They in fact never utter a word of praise on 7th CPC recommendations since the day the report was submitted to the Finance Minister.</p>
</div>
<div></div>
<div>
<p>National Council JCM and Confederation described it as Retrograde recommendations, unexpected and un acceptable. They declared that all the central government employees are upset and dis satisfied since many of their demands were not considered by 7th pay commission.</p>
</div>
<div></div>

<p><b>1. Pay Scales and allowances are arrived by multiplying 2.57, just 14.29 % increase over existing pay and Allowances after DA neutralization.</b></p>
<p><b> 2. The rate of HRA has been abruptly reduced,</b></p>
<p><b> 3. Payment of CCL has been reduced for second 365 days.</b></p>
<p><b> 4. Same confusion in MACP continues,</b></p>
<p><b> 5. Uncertainty in Pension benefit in NPS continues.</b></p>
<p><b> 6. Existing Pension provisions are left un touched. None of the proposals submitted by Pensioners Associations are not considered.</b></p>
<p><b> 7. Minimum Pay is very much less; Maximum Pay is lavishly higher. [Minimum Rs.18000 – Maximum Rs.275000]</b></p>
<p><b> 8. Gap between Minimum and Maximum Pay is not reduced, but unfortunately increased. [In sixth CPC it is 1:12 , 7th CPC Recommends 1:14]</b></p>
<p><b> 9. All the Pay commission reduced the number of pay scales but 7th Pay commission maintained the existing pay scales,</b></p>
<p><b> 10. 55 Allowances are abolished, No new allowances are introduced,</b></p>
<p><b> 11. Same 3% increment continues, NCJCM demand for Two Increment Days 1st January and 1st July is not considered</b></p>
<p><b> 12. No considerable benefit on Promotion,</b></p>
<p><b> 13. Interest free advances including LTC advance are abolished,</b></p>
<p><b> 14. Except the introduction of New Pay Matrix, nothing new in the recommendations of 7th Pay commission</b></p>
<p><b> 15. Again uniform Multiplication factor was not applied for arriving Entry Pay for various Grades.</b></p>

<p>Low value for Lower Grades high value for higher Grades. Again the disparity in arriving Entry Pay is maintained by 7th CPC also.</p>

<p>What sixth CPC had recommended in some cases, what Government has suggested in some issues, what the Department has told, that has been just followed by the 7th Pay commission.</p>

<p>So the Central government employees are expecting the Government to pay attention to the concerns of Govt servants in respect of some recommendations of 7th pay commission which need to be addressed to boost the morale of the Central Govt staffs.</p>

<p>The constituents of NCJCM already formed National Joint Council of Action (NJCA) to invite the attention of Central Government through agitation Programmes to settle their demands. Now they modified their charter of demands to include the issues regarding 7th Pay Commission recommendation and cautioned that unless it is not settled before March 2016, they will be going for indefinite Strike.</p>

<p><em>Confederation of Central Government Employees JCM (NC) Staff Side has represented to Cabinet Secretary that the 7th CPC proposed 14% increase in Basic Pay is meagre compared to any other CPCs and wants to convene a meeting to discuss the charter of demands given below during Feb 2016 otherwise JCM (NC) Staff Side may have to go for indefinite Strike from 1st March 2016.</em></p>
<p>JCM (NC) Staff Side letter to Cabinet Secretary on the meagre increase of 14% of the 7th CPC recommendation – Calls for negotiation and if fails Indefinite Strike from March 2016</p>
<p>Confederation of Central Government Employees has represented that 7th CPC has recommended very less increase in pay compared to other CPCs in the past.  Confederation Looks for further negotiation during February 2016 and if it fails it has planned for indefinite Strike from March 2016.</p>

<p>Subject:- <strong>7th CPC recommendations and Charter of Demands – Reg.</strong></p>
<p>We send herewith our suggestions and demands on the recommendation made by the 7th CPC. As indicated when the undersigned met you on 20th November 2015 the central government employees are extremely agitated over the totally retrograde recommendations of the Commission.</p>
<p>The meagre increase of 14% recommended by the 7th CPC is the lowest ever any pay Commission has made. It was the similar recommendation, we would request you to recall, made by the 2nd CPC that triggered a confrontation of an unprecedented nature, leading to a strike action which lasted for five days in the year 1960. In the background of the fact that the 5th and 6th CPC recommendations had resulted in the wage rise of 31% and 54% respectively, the anger, anguish and frustration of the employees are the natural outcome. Unless the minimum wage is re-determined with all consequential benefits, the discontent will not be capable of being addressed effectively.</p>
<p>It is, therefore, necessary that a meeting of the members of the Standing Committee of JCM NC is convened under your chairmanship immediately to discuss the issues we have incorporated in the enclosed charter. Settlement through bilateral negotiation has become the urgent need and requirement.</p>
<p>I have been directed by the meeting of the NJCA held on 8th December 2015 to convey to you the disappointment and resentment of the employees over the recommendations of the 7th CPC. We expect a bilateral negotiated settlement of the issues without delay from the Government. We request you that a mutually agreeable settlement on the issues are brought about latest by the first week of February 2016. I have been asked by the meeting to inform you that the entire Central Govt Employees under the auspices of National JCA will be constrained to go indefinite strike in the first week of March 2016 if the desired settlement through bilateral discussions is not brought about by the first week of February 2016. To facilitate an early resolution of the issues, we expect the government to set up a Committee of Group of Ministers to negotiate with the NJCA immediately.</p>
<p>We earnestly hope that the Government will effectively intervene and bring about a satisfactory settlement much before the first week of February 2016 and avoid an otherwise inevitable confrontation.</p>

<p>Today I met the Chairman, VII CPC, Justice Shri Ashok Kumar Mathur, and expressed our anguish against retrograde recommendations of VII CPC, particularly reg. Minimum Wage, reduction in HRA and CCL, non-redressal of NPS, abolition of various allowances, examination of MACP benefit, etc. etc.</p>
<p>Tough he had given argument, but I told him about the anguish of all the constituents of the JCM(Staff Side), who feel that they have been betrayed by the VII CPC.</p>
<p>Comrades! I have also met the Cabinet Secretary, Shri P.K. Sinha, in the afternoon and handed him over a copy of the attached letter and requested him to convene meeting of the NC/JCM at an earliest as well as to intervene in the matters raised by the JCA in case of report of VII CPC at an earliest. The Cabinet Secretary has promised that he would try to fix the meeting at an earliest and also look into the points raised by the NC/JCM(Staff Side) for VII CPC.</p>

<p>It has come to our notice that, @0.01% of the AUM on daily accrual basis is proposed to be imposed on the NPS Subscribers.</p>
<p>In this connection, it is worth-mentioning that, in the past, it was assured to the Central Government Employees that, no Administrative Charge/Fee would be imposed on any of the Government employees.</p>
<p><strong>Orders to this effect, if so issued, should immediately be withdrawn.</strong></p>
