<p>The Central Record Keeping Agencies (CRAs) appointed by PFRDA develop system level functionalities as per the evolving needs of NPS/APY stakeholders.</p>



<ol class="wp-block-list" start="2">
<li>CRAs have the responsibility to develop new functionalities or utilities, establish new processes, offer multiple models of interface for the uploading offices in order to provide maximum flexibility in terms of operation for the benefit of the subscribers as an ongoing exercise to fulfil their obligations which ultimately benefit the Subscribers.</li>



<li>The list of functionalities that have been developed and made available by CRAs during Quarter II of the current FY 2022-23 is attached herewith for benefit of subscribers and other stakeholders (Annexure I, II and III).</li>



<li>The circular is placed in the intermediary section of CRA on PFRDA website for the information of all NPS/APY stake holders.</li>

<p>(a) the main objective of National Pension Scheme;</p>



<p>(b) the age prescribed for availing the benefit of said scheme;</p>



<p>(c) whether all citizens of the country can avail benefit of the scheme or limited retired employees can avail the benefit of the scheme and if so, the details thereof; and</p>



<p>(d) whether this scheme has also been implemented in States and if so, the details of the services provided in Gujarat State so far?</p>



<h3 class="has-text-align-center wp-block-heading"><strong>ANSWER</strong></h3>



<p>The Minister of State (Finance)</p>



<p>(a) The National Pension System (NPS) was introduced by the Government of India to replace the defined benefit pension system. NPS was made mandatory for all new recruits to the Central Government service from 1st January 2004, (except the armed forces in the first stage) and has also been rolled out for all citizens with effect from 1st May 2009, on a voluntary basis. The Government had made a conscious move to shift from the defined benefit, pay-as-you-go pension scheme to defined contribution pension scheme, NPS, due to rising and unsustainable pension bills. The transition aimed at freeing the limited resources of the Government for more productive and socio-economic sectoral development.</p>



<p>(b) NPS is open for subscription to all citizens of India, resident as well as non-resident, aged between 18- 65 years. A person after retiring at the age of 60 years can also join NPS and contribute till the age of 65 years.</p>



<p>(c) All citizens of the country, resident as well as non resident, aged between 18-65 years can subscribe to NPS, and can avail the following benefits under NPS:</p>



<ul class="wp-block-list"><li>i. Contribution up to Rs. 1.50 lakhs made to the NPS Tier-I account are eligible for tax deduction under Section 80CCD (1) and Section 80CCE of the Income Tax Act, 1961. An additional tax rebate of Rs.50000/- is also allowed for contributions made to NPS Tier-I under Section 80CCD (1B) of the Income Tax Act, 1961. The contribution made by an employer to the Tier 1 account of an employee (up to 14% of the salary for Central Government and up to 10% of the salary in case of other employers) is also tax-exempt under Section 80CCD (2) of the Income Tax Act, 1961 subject to a maximum of Rs. 7.50 lakhs under Section 17(2) (vii) of the Income Tax Act, 1961.</li><li>ii. Deduction under Section 80C for the contribution made to Tier II NPS account by Central Government employees for a fixed period of not less than three years, is allowed.</li><li>iii. In accordance with Section 10(12A) of the Income Tax Act, 1961, the entire 60% amount withdrawn as a lump sum is tax-free.</li><li>iv. Partial withdrawal of up to 25% of the subscriber’s own contributions before attaining the age of superannuation is allowed, subject to certain conditions.</li><li>v. Transparency and portability are ensured through online access of the pension account by the NPS subscribers, across all geographical locations, and portability of employments.</li></ul>



<p>(d) As of now all State Governments (except West Bengal) have notified NPS for their employees. Further, as reported by the Central Recordkeeping Agency (CRA), a total of 2,38,599 subscribers from the State Government of Gujarat have joined NPS as on 27.02.2021 and the total Assets Under Management (AUM) for the State Government of Gujarat are Rs.14,152.36 cr.</p>

<p><strong>Conference on Implementation of National Pension System by State Governments</strong></p>



<p>A conference on implementation of National Pension System by State Governments was organized by PFRDA on 10th Sept 2018 at IHC, New Delhi. The prime objective was to provide a forum to all State Governments, where the progress in the implementation of NPS with respect to compliance of timelines in various NPS related activities could be brought to the fore and a way forward could be provided. Higher officials from all State Governments attended the conference.</p>

<p>Dr. Badri Singh Bhandari, Whole Time Member (Economics) in his opening address informed the state government officials about the features and benefits of NPS and various initiatives undertaken by PFRDA. He emphasised the use of online generation of PRAN, dashboard facility for effective monitoring of nodal officers and timely submission of subscriber registration forms and regular remittance of subscriber contribution. He reiterated about the issuance of guidelines by State Governments regarding procedure and timelines to be followed by State Governments for registration of new employees, upload of SCFs and remittance of the NPS contributions. He also touched upon the need of resolving pending grievances and withdrawals on priority by the nodal officers.</p>



<p>Sh. Ajay Narayan Jha, Secretary, Dept of Expenditure, Govt. of India in his address stated that the need of contributory system of pension arose due to the twin objectives to ensure fiscal prudence and secure old age income security in the country. Fiscally strong States are important for progress and development as the pension liabilities of the government has been increasing in terms of proportion of GDP. He advised participating State Governments to monitor the performance of NPS implementation with respect to timely completion of NPS related activities at nodal office level.</p>

<p>Chairman, PFRDA, Sh. Hemant G. Contractor, emphasized on the need for the government officials to be aware of the determinants of pension. NPS, being a contributory and market driven scheme, is different from the earlier pension system in the government, which was a formula based PAYG (Pay As You Go) scheme. In NPS, pension is dependent on various factors, such as the contribution amount, period of contribution, regularity in remittances, returns on investment, withdrawals, deferment options and choice of annuity. He urged the State governments to adopt online PRAN generation Module (OPGM) and to ensure effective implementation and monitoring of NPS. He also urged State Governments to ensure extending choices similar to those available to non-government subscribers and also to frame Rules for the guidance of government staff handling NPS in the States.</p>



<p>Quite a few presentations were made by various stakeholders under NPS for the benefit of the participants. As on 31st August, 2018, 28 States have implemented NPS and there are 32.51 Lakh subscribers with asset under management of Rs 1,16,227.49 Cr.</p>

<p style="text-align:center">Ministry of Labour &amp; Employment<br /> <strong>Prime Minister launches National Pension Scheme for Traders and Self Employed Persons</strong></p>



<p style="text-align:right">12 SEP 2019</p>



<p>The Prime Minister of India, Shri Narendra Modi launched at Ranchi today, the National Pension Scheme for Traders and Self Employed Persons, a pension scheme for the Vyaparis (shopkeepers /retail traders and self-employed persons) with annual turnover not exceeding Rs 1.5 crore. The Governor of Jharkhand Smt. Draupadi Murmu, Chief Minister of Jharkhand Shri Raghubar Das, Minister of Tribal Affairs Shri Arjun Munda, Minister of State  for Labour &amp; Employment (I/C) Shri Santosh Kumar Gangwar and other dignitaries were also present on the occasion.  With this nation-wide launch, the facility for enrollment under the scheme has been made available to the prospective beneficiaries through 3.50 lakh Common Service Center (CSCs) across the country. In addition people can also self-enroll by visiting the portal <a rel="noreferrer noopener" aria-label="maandhan.in/vyapari (opens in a new tab)" href="https://www.maandhan.in/vyapari" target="_blank">maandhan.in/vyapari</a>. The eligible Vyaparis can visit their nearest CSCs and get enrolled under the scheme. At the time of enrollment, the beneficiary is required to have an Aadhaar card and a saving bank/ Jan-dhan Account passbook only. He/ She should be within 18 to 40 years of age group. GSTIN is required only for those with turnover above Rs. 40 lakhs. The enrolment under the scheme is free of cost for the beneficiaries. The enrolment is based upon self-certification.</p>



<p>Government has approved National Pension Scheme for Traders and Self Employed Persons in acknowledgement of notable contribution of Vyaparis (shopkeepers/ retail traders and self-employed persons). It is a voluntary and contributory pension scheme for entry age of 18 to 40 years with a provision for minimum assured pension of Rs 3,000/- monthly on attaining the age of 60 years. The beneficiary should not be income tax payer and also not a member of EPFO/ ESIC/ NPS (Govt.)/ PM-SYM. The Central Government shall give 50 % share of the monthly contribution and remaining 50% contribution shall be made by the beneficiary. The monthly contribution is kept low to make it affordable. For example, a beneficiary is required to contribute as little as Rs.100/- per month at a median entry age of 29 years. </p>



<p>This pension scheme is one of the top priorities of Prime Minister Narendra Modi’s Government in its second term. According to the Ministry’s 100-day plan, this scheme will target enrolling 25 lakh subscribers in 2019-20 and 2 crore subscribers by 2023-2024. <p><strong>Subject: Proposed Protest by Government Employees from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (NPS) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</strong></p>



<p>It has been brought to the notice of the Government that a forum by the nomenclature of National Joint Council of Action (NJCA) has decided to organize protest from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (<a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener" aria-label="NPS (opens in a new tab)">NPS</a>) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission</p>



<p>The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest.</p>



<p>There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgements that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1/(S)/2008 Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).</p>



<p>All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>



<p>In case employees go on protest anytime during the period 15.03.2019 to 30.03.2019, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty during the period of said protest, i.e. from 15.03.2019 to 30.03.2019.</p>

<p>F. No. 1/3/2016-PR &#8211; In partial modification of para 1(i) of Ministry of Finance’s Gazette Notification No. 5/7/2003-ECB-PR dated 22nd December, 2003, based on the Government’s decision on 6th December, 2018 on the recommendations of a Committee set up to suggest measures for streamlining the implementation of National Pension System (NPS), the Central Government makes the following amendments in the said notification, namely :-</p>



<p>(1) In para 1(i) of the said notification, for the words “The monthly contribution would be 10 percent of the salary and DA to be paid by the employee and matched by the Central Government”, the words “The monthly contribution would be 10 percent of the Basic Pay plus Dearness Allowance (DA) to be paid by the employee and 14 percent of the Basic Pay plus DA by the Central Government” shall be substituted.</p>



<p>(2) The following provisions shall be inserted after para 1(v) of the said notification, namely:-</p>



<p>CHOICE OF PENSION FUND AND INVESTMENT PATTERN IN TIER-I OF NPS AS UNDER:</p>



<p>(vi) Choice of Pension Fund: As in the case of subscribers in the private sector, the Government subscribers may also be allowed to choose any one of the pension funds including Private sector pension funds. They could change their option once in a year. However, the current provision of combination of the Public-Sector Pension Funds will be available as the default option for both existing as well as new Government subscribers.</p>



<p>(vii) Choice of Investment pattern: The following options for investment choices may be offered to Government employees : </p>



<ul class="wp-block-list"><li>The existing scheme in which funds are allocated by the PFRDA among the three Public Sector Undertaking fund managers based on their past performance in accordance with the guidelines of PFRDA for Government employees may continue as default scheme for both existing and new subscribers.</li><li>Government employees who prefer a fixed return with minimum amount of risk may be given an option to invest 100% of the funds in Government securities (Scheme G).</li><li>Government employees who prefer higher returns may be given the options of the following two Life Cycle based schemes.</li></ul>



<p>(A) Conservative Life Cycle Fund with maximum exposure to equity capped at 25% &#8211; LC-25.</p>



<p>(B) Moderate Life Cycle Fund with maximum exposure to equity capped at 50% &#8211; LC-50.</p>



<p>(viii) Implementation of choices to the legacy corpus: Transfer of a huge legacy corpus of more than Rs. 1 lakh crore in respect of the Government sector subscribers from the existing Pension Fund Managers is likely to impact the market. It may be practically difficult for the PFRDA to allow Government subscribers to change the Pension Funds or investment pattern in respect of the accumulated corpus, in one go. Therefore, for the present, change in the Pension Funds or investment pattern may be allowed in respect of incremental flows only.</p>



<p>(ix) Transfer of legacy corpus in a reasonable time frame: PFRDA may draw up a scheme for transfer of accumulated corpus as per new choices of Government subscribers in a reasonable time frame of say five years. Once PFRDA draws up this scheme, change in the Pension Funds or investment pattern may be allowed in respect of the accumulated corpus in accordance with that scheme.</p>



<p>4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I-SEC. 1] COMPENSATION FOR NON-DEPOSIT OR DELAYED DEPOSIT OF CONTRIBUTIONS DURING 2004-2012:</p>



<p>(x) In all cases, where the NPS contributions were deducted from the salary of the Government employee but the amount was not remitted to CRA system or was remitted late, the amount may be credited to the NPS account of the employee along with interest for the period from the date on which<br />
the deductions were made till the date the amount was credited to the NPS account of the employee, as per the rates applicable to GPF from time to time, compounded annually.</p>



<p>(xi) In all cases where the NPS contributions were not deducted from the salary of the Government employee for any period during 2004-2012, the employee may be given an option to deposit the amount of employee contribution now. In case he opts to deposit the contributions now, the amount may be deposited in one lump sum or in monthly installments. The amount of installment may be deducted from the salary of the Government employee and deposited in his NPS account. The same may qualify for tax concessions under the Income Tax Act as applicable to the mandatory contributions of the employee.</p>



<p>(xii) In all cases where the Government contributions were not remitted to CRA system or were remitted late (irrespective whether the employee contributions were deducted or not), the amount of Government contributions may be credited to the NPS account of the employee along with interest for the period from the date on which the Government contributions were due till the date the amount is actually credited to the NPS account of the employee, as per the rates applicable to GPF from time to time. Instructions to this effect may be issued by the Department of Expenditure/ Controller General of Accounts. All such cases of delay may be resolved within a period of three months.</p>



<p>The above provisions shall come into force with effect from 1st April, 2019.</p>

It has been brought to the notice of the Government that a forum by the nomenclature of  National Joint Council of Action (NJCA) has decided to organize Dharna/Demonstrations in front of Jantar Mantar, New Delhi and all across the country on 13th March, 20 19 in order to  protest against New Pension Scheme (<a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener" aria-label="NPS (opens in a new tab)">NPS</a>).</p>



<p>2. The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. 										<content:encoded><![CDATA[<p><strong>National Pension Scheme: Good News for central government employees! Government contribution to NPS to rise to 14% of basic salary</strong></p>
<p>In a bonanza for government employees, the Cabinet Thursday raised the government&#8217;s contribution to National Pension Scheme (NPS) to 14 per cent of basic salary from the current 10 per cent, sources said. Minimum employee contribution will, however, remain at 10 per cent. The Cabinet also approved tax incentives under 80C of the Income Tax Act for employees’ contribution to the extent of 10 per cent, they added. Presently, the government and employees contribute 10 per cent of basic salary each to NPS.</p>
<p>While the minimum employee contribution remains at 10 per cent, the government contribution has been increased from 10 per cent to 14 per cent. The Cabinet, headed by Prime Minister Narendra Modi, also allowed government employees to commute 60 per cent of the fund accumulated at the time of retirement, up from 40 per cent at present. Also, employees will have the option to invest in either fixed income instruments or equities, sources said.</p>
<p>As per the Cabinet decision, if the employee decides not to commute any portion of the accumulated fund in NPS at the time of retirement and transfers 100 per cent to annuity scheme, then his pension would be more than 50 per cent of his last drawn pay, sources said. The government did not announce the decision in view of the ensuing polls in Rajasthan Friday. While the government is yet to decide on the date of notification of the new scheme, sources said such changes usually come into effect from the beginning of a financing year, meaning April 1, 2019. This formula for changes in the NPS was worked out by the Finance Ministry based on the recommendation of a government-appointed committee.</p>

<p>Shri Ajay Dutt called the attention of the Government towards &#8220;<b>Abolishing National Pension System (NPS) and reinstate the old Pension System in the interest of lakhs of Government Servants</b>&#8220;.</p>
<p>Sh. Arvind Kejriwal, Hon&#8217;ble Chief Minister made a brief statement.</p>
<p>The following Resolution moved by Sh. Ajay Dutt was put to vote and adopted by voice-vote :</p>
<p>&#8220;<b>The Legislative Assembly of NCT of Delhi, having its sitting on 26 November 2018 :</b></p>
<p>Taking note of the negative consequences of the anti-employee National Pension System (NPS) that is imposed on the Government Servants by the then NDA Government in 2004 and sustained by the UPA-I, UPA-II and NDA-II Governments,</p>
<p><b>Given the fact that, unlike the old pension scheme, the NPS :</b></p>
<ul>
<li>does not give any guarantee to the employees either for assured returns on investments or for minimum pension.</li>
<li>does not provide for family pension or social security,</li>
<li>does not provide for loan facility when in dire need,</li>
<li>does not provide for annual increments and hike in DA,</li>
<li>does not allow the employees to withdraw enough money from their own pension fund to meet the medical emergencies,</li>
<li>leaves the employees at the mercy of volatile markets and the forces that have notoriously been manipulating the markets,</li>
<li>imposes draconian restrictions on withdrawals from pension fund,</li>
<li>allows the insurance companies to exploit employees by way of forcing them to buy annuity for a minimum of ten years even after retirement, and</li>
<li>runs contrary to the spirit of welfare state as enshrined in the Constitution,</li>
</ul>
<p>Given the fact that the pro-people and welfare oriented Government of NCT of Delhi is strongly in favour of restoring the rights and privileges of its employees by way of replacing the NPS with the time tested old pension scheme,</p>
<p>Resolves to urge upon the Government of India to scrap the NPS with immediate effect and bring at once all the Government Servants working under the Government of NCT of Delhi under the old pension scheme and restore to them all the benefits of the old pension scheme wherein the fair and legitimate pensions’ benefits are disbursed through the Consolidated Fund of India, so that the dedicated work force of the Government of NCT of Delhi and their families will be able to lead their lives with sense of security and dignity, and</p>
<p>Further resolves to urge upon the Government of India to restore t he old pension scheme in place of NPS or the benefit of all the Government Servants working under the Government of India and also to actively encourage other States to follow this true welfare measure&#8221;</p>

										<content:encoded><![CDATA[<h3 style="text-align: center;"><strong>Defined Contribution Pension Scheme (National Pension System)</strong><br />
<strong>(Salient Features)</strong></h3>
<hr />
<ul>
<li>The National Pension System works on defined contribution basis and will have two tiers &#8211; Tier-I and II. Contribution to Tier-I is mandatory for all Government servants joining Government service on or after 1-1-2004 (except the armed forces in the first stage), whereas Tier-II will be optional and at the discretion of Government servants.</li>
<li>In Tier-I, a Government servant will have to make a contribution of 10% of his basic pay plus DA, which will be deducted from his salary bill every month by the PAO concerned. The Government will make an equal matching contribution. However, there will be no contribution from the Government in respect of individuals who are not Government employees.</li>
<li>Tier-I contributions (and the investment returns) will be kept in a limited partial withdrawable Pension Tier-I Account. Tier-II contributions will be kept in a separate account that will be withdrawable at the option of the Government servant. Government will not make any contribution to Tier-II account.</li>
<li>The existing provisions of Defined Benefit Pension and GPF would not be available to the new recruits in the central Government service, i.e. to the Government servants joining Government service on or after 1-1-2004. However, retirement gratuity and death gratuity would be extended to the central government employees covered under NPS on the same terms and conditions as applicable under CCS(Pension) Rules, 1972.</li>
<li>In order to implement the Scheme, there will be a Central Record Keeping Agency (CRA) and several Pension Fund Managers (PFM) to offer three categories of Schemes to Government servants, viz., options A,B and C based on the ratio of investment in fixed income instruments and equities. The participating entities (PFMs and CRA) would give out easily understable information about past performance, so that the individual would be able to make informed choices about which scheme to choose.</li>
<li>An independent Pension Fund Regulatory and Development Authority (PFRDA) will regulate and develop the NPS.</li>
<li>A Government servant can exit at or after the age of 60 years from the Tier-I of the Scheme. At exit, it would be mandatory for him to invest 40 per cent of pension wealth to purchase an annuity (from an IRDA-regulated Life Insurance Company) which will provide for annuity for the lifetime of the employee and his dependent parents/spouse. He would receive a lump-sum of the remaining pension wealth which he would be free to utilize in any manner. In the case of Government servants who leave the Scheme before attaining the age of 60, the mandatory annuitization would be 80% of the pension wealth.</li>
<li>Provisionally, central government employees covered under NPS has option to choose benefits under old pension scheme or NPS in the event of their death or discharge from service on invalidation.</li>

<p>NPS.1 <strong>The  CCS(P)  Rules are applicable to govt. servants appointed on  or  before </strong><strong>31.12.2003. Are the employees who joined pensionable establishments  of  Govt. of India after 31/12/2003 eligible for any benefits under these rules?</strong></p>
<p>In  accordance with DoP&amp;PW O.M. No.  38/41/06 &#8211; P&amp;PW(A) dated 5.5.2009 such  employees  who  joined  after  31/12/2003  and/or  their families may be given the benefit of disability pension  or  family  pension  provisionally  till  the finalization of rules under the National Pension System   (NPS) on death/injury.<br />
Further,  the  benefit of Retirement Gratuity and Death Gratuity have  been extended to the Central Government civil employees covered under NPS in the  same  terms  and conditions  as applicable under CCS Pension Rules, 1972 vide this OM no. 7/5/2012 &#8211; P&amp;PW(F)/B dated 26/08/2017.</p>
<p>NPS.2 <strong>What are the guidelines/orders in regard to settlement of dues of the </strong><strong>deceased Government employees covered under NPS?</strong><br />
As per the Department of Pension &amp; PW O.M. No.38/41/06 &#8211; P&amp;PW(A) dated 5.5.2009 (available on website) the benefits under the CCS(Pension) Rules has  been  provisionally  extended to the families of deceased employees covered under NPS. Family Pension/gratuity in terms of O.M. dated 5.5.2009 shall  be  payable  to  the  family of the deceased employee if the deceased  employee was  covered  under  NPS  and fulfils the conditions. These payments are provisional and  will  be  adjusted  as  per the final provisions. As per Para 7 of the O.M., the accumulations in pension wealth of deceased employee under NPS  will not be paid during the period provisional benefits under the aforementioned O.M. are payable. The Head of Office will prepare the pension papers as per provisions of the relevant rules and proceed as per the procedure for making the provisional payments to  eligible  Government  servants families explained in Ministry  of  Finance O.M. No.1(7)/DCPS(NPS)/2009/TA/221 dated 2.7.2009 read with corrigendum dated 29.9.2009.</p>
