Dear Sir,
We invite your kind reference to the representations made by the staff side both in writing and orally during discussions bilaterally and otherwise on innumerable occasions over the need to convene the National Council meeting of the JCM, which met last about 9 years back.

Since there had been no meeting of the National Council the directive issued by the Department of personnel to various Ministries of the Government of India to convene the Departmental Council meeting had also not been dwindled. We regret to write that inspite of our persistent persuasion you have unfortunately no found time for holding the meeting.

There had been no reason whatever for such inordinate delay in convening the meeting. This apart, the periodicity with which the National Standing committee used to meet has also been dwindled. The National Anomaly Committee set up in the wake of the 6th CPC is still to finalise its business.

The Staff Side, which met on 8th February, 2019 at New Delhi, has come to the inescapable conclusion that it must tread the path of struggle to get the negotiating forum revived we are therefore, constrained to take recourse to agitational programmes and have decided that all the Staff Side members of the National Council will sit on dharna on 28th March, 2019 at New Delhi.

We hope you will take note of the growing. discontent in the matter and take corrective steps to revive the JCM and to convene the meetings immediately.

The NJCA met today and took note of the inordinate delay in honouring the commitment made by the Government on 30th June, 2016 in respect of Minimum Wage, Fitment Formula, Scrapping the New Contributory Pension Scheme, Option No.1 to Pensioners, Outsourcing, Regularization of Contract/Casual Workers, JCM revival etc.

At the end of the deliberations it was decided to adopt a resolution and forward the same to the Government.

Copies of the Resolution and letter to the Cabinet Secretary are enclosed herewith, which are self-explanatory.

The NJCA will again meet on 18.08.2018 to finalize the future course of action in the matter of Indefinite Strike which was deferred on 06.07.2016.

The NJCA of the organizations, participating in the JCM, met today and adopted the enclosed resolution.

The NJCA was extremely unhappy to nole that the government did not honour its commitment made to the leaders of the organizations when they metlhe Hon’ble Home Minister and Finance Minister in the presence of the then Railway Ministers on 30.06.2016 on the basis of which the Indefinite Strike which was to commence on 11 .07.2016 was deferred.

The reply 10 a question asked by Shri Neeraj Shekhar in the Upper House of the Parliamcnl(Rajya Sabha) given by Hon’ble Minister of State for Finance, Shri P. Radha Krishnan, on 06.03.201 B Minister, which is reproduced below, has further angered the Central Government employees.

“Question of Shri Neeraj Shekhar(1170)

(a) Whether Government Is actively contemplating to increase minimum pay from Rs.18,000/· to Rs.21,000/· and filment factor from 2.57 to 3, in view of resentment among the Central Government employees over historically lowest increase in pay by 7th Central Pay Commission (CPC);
(b) If so, the details thereof and the date from which it would be implemented; and
(c) If not, the reasons for the callous attitude of Government towards Government Employees?”

ANSWER
MINISTER OF STATE FOR FINANCE (SHRI P RADHAKRISHNAN )

“(a),(b)&(c ) – The minimum Pay of Rs .18,000/- p.m. and filment factor of 2.57 are based on the specific recommendations of the 7th Central Pay Commission in the light of the relevant factors taken into account by it. Therefore, no change therein is at present under consideration”.

The NJCA has decided to meet again on 18.08.2018 10 consider the response, if any, from the government to this letter and to the enclosed resolution.

In case of the continuing negative attitude of the government, the NJCA will be left with no other alternative but to revive the decision of Indefinite Strike action, which was deferred on 06.07.2016 on the basis of the assurance given by the Group of Ministers on 30.06.2016.

RESOLUTION

The National JCA, which met today(03.07.20 18) at New Delhi as per the notice issued by the Convenor, after deliberations, came to the painful conclusion that the government had been unfortunately indulging in chicanery for the past two years by not honouring their commitment made to the NJCA leaders on 30.06.2016. The NJCA which was formed to pursue the demands and issues of the Central Government Employees especially those emanating from the recommendations made by the 7th CPC in the matter of Wage Revision, New Pension Scheme etc. had deferred the Indefinite Strike action, which was to commence from 11 .07.2016, on the solemn announcement held out by the Group of Ministers, consisting of the Hon’ble Home Minister, Finance Minister and the then Railway Ministers. The Govt had categorically stated that they should set up a High Power Committee to look into the matters concerning the upward revision of Minimum Wage Fitment Formula etc. with a direction to submit its report within four months. The NJCA had made reasoned submissions as to the fallacy of the computation of Minimum Wage made by the 7th CPC.

The meeting further noted that the report of the committee, set-up by the Government under the Chairmanship of the Secretary, Pension, to look into the grievances of the employees and officers over the newly introduced Contributory Pension Scheme in place of the existing Defined Benefit Pension Scheme, has been kepi pending by the Government without taking any action whatsoever, thereby denying the benefit of Defined Benefit Of Pension to the employees recruited on or after 1.1 .2004.

The meeting also noted that, rejection of Option No.1, recommended by the 7th CPC, to the Pensioners on the specious ground that the said recommendation was not feasible to be implemented, was nothing but denial of legitimate parity between the past and present Pensioners.

The meeting noted with deep concern and anguish that the government has virtually closed down the doors of negotiation by not convening the meeting of the National council JCM lor the past 8 years.

The meeting in the above circumstances and given the totally nugatory attitude of the government has decided to revive the Indefinite Strike action, which was deferred on 30.06.2016, immediately and call upon the Central Government employees to prepare themselves for an otherwise inevitable show down. The meeting noted that the government had been dillydallying the issue for the past two years. The meeting desired that the government must immediately address the follollling issues and bring about negotiated settlement thereof without any further delay.

a) Upward Revision of Minimum Wage and Fitm ent Formula
b) Scrapping the New Contributory Pension Scheme.
c) Allow Option No.1 as one of the Pension Fitment Formula.

The meeting has directed the Convenor to bring to the notice of the Cabinet Secretary and through him the government lhe resentment and discontent of the employees and await their response up to 07.08.2018 and put into operation the deciSion to revive the decision of Indefinite Strike action immediately, thereafter, in case no negotiated settlement is brought about on the various demands included In the Charter of Demands .

NJCA had led a relentless campaign to seek upgradation of minimum salary to Rs 26,000, instead of Rs 18,000 proposed by 7th Central Pay Commission.

New Delhi, Jan 4: National Joint Council of Action (NJCA) convenor Shiv Gopal Mishra once again lashed out at Centre for not paying heed to the demands of aggrieved central government employees. Mishra, who also heads the All India Railwaymen’s Federation (AIRF), claimed that he is personally pained since the government has ignored the genuine demands raised on behalf of employee unions. Mishra listed two of the most genuine demands which he wanted Centre to fulfill: Upscaling of minimum salary to Rs 26,000 and enabling Old Pension System for employees hired on and after 1st January, 2014.
“In the recommendations of the 7th CPC both the demands were ignored,” Mishra said in his statement issued for AIRF. He further added, “held meetings with the Cabinet Secretary, Secretary(DoP&T), Secretary (Exp.) etc. of the Government of India, to extract maximum benefits for all of you, but up till now nothing fruitful has emerged,” he added.
Centre had constituted a High Level Committee headed by Finance Secretary Ashok Lavasa to look into the anomalies raised following the implementation of 7th Pay Commission. The allowances of government employees, along with arrears would only be cleared after the committee submits is report. The allowances are likely to be rolled out following the Union Budget.
The report of 7th Pay Commission was notified by Union Government in July. Although the salaries have been hiked using 2.57 fitment factor. However, the hike in allowances were put on hold as employee unions had raised objections. The 7th Pay Commission report submitted by Justice (retd) AK Mathur subsumed 37 and abolished 51 out of the incumbent 196 allowances.
Apart from the National Council (Staff Side), Confederation of Central Government Employees & Workers have launched a campaign against Centre, seeking fulfillment of 21-point-charter of demands. They have called for a nationwide strike on February 15.

Committee of Secretaries will hold their second meeting regarding the resolution of anomalies in the implementation of 7th Pay Commission. The meeting is scheduled on September 1.

The leading employee union, National Joint Council of Action, headed by Shiv Gopal Mishra, has been invited in the meeting. Aggrieved central government employees pin their hope in the outcome of the meeting. However, many among them have turned increasingly pessimistic, after reports floated earlier in the week stating that the government would not be increasing the minimum salary which has been fixed as Rs 18,000.

Shiv Gopal Mishra is expected to pitch the demands of the government employees before the high-powered committee. As of now, it is not clear whether government would pitch for a compromise with the union. However, the committee members are scheduled to hear the grievances of the employees as raised by the Unions.

One of the foremost demands raised by NJAC is that the government should use 3.68 fitment factor, instead of 2.57 in calculating the minimum salary, as well as the hike in allowances. The minimum salary of government employees as per 6th Pay Commission was Rs 7,000. This was increased by the Justice AK Mathur led panel to Rs 18,000, using the 2.57 fitment factor. If the 3.68 fitment factor would be applied, the entry-level pay would be hiked to Rs 26,000.

The 7th Pay Commission report prepared by Justice (Retd) AK Mathur had suggested the abolition of 51 out of the 194 existing allowances. A total of 27 allowances were subsumed.

Apart from the civilian employees, the armed forces have also marked their objection as the pay panel has refrained from incorporating their demand related to the creation of a uniform pay matrix.

The Defence Pay Matrix has only 24 pay levels, on the other hand, their bureaucratic counterparts enjoy 40 pay levels. Due to this, the armed forces personnel receive less opportunity of salary hikes. Their income gets stagnated at certain points, and even after retirement, they end up drawing Rs 20,000 less as pension, as compared to their civilian counterpart. Similarly, the demand to include Tier-II employees among beneficiaries in the technical allowance has not been paid heed.

The all-important meeting scheduled by the government comes a day before the pan-India strike called by several employee unions across organized sectors against the recommendations of the 7th pay commission.

On the call of the National Joint Council of Action(NJCA), on hopeless recommendations of VII CPC, scrapping of National Pension System (NPS) and other long pending genuine demands of the Central Government Employees, covering lakhs and lakhs of Railwaymen, Defence (Civilian) personnel, Postal employees, working in different Central Government offices throughout the country, unitedly not only participated and contributed regularly in agitational programmes of different stages of struggle but also succeeded to reflect such an environment in the entire length and breadth of the country well before the date of commencement of nationwide “Indefinite Strike” from 11th July, 2016; that compelled the Government of India to think better than Rs.18,000 as Minimum Wage, change in the Fitment Formula and many other important heartburning aspects, like National Pension System (NPS) and to handover all such issues to the committees with a commitment to consider the same within a timeframe of four months. Considering positive attitude of the senior ministers of the Government of India, the National Joint Council of Action (NJCA) had decided to give another four months time to the government.

I am fully aware that, our Central Government Employees and the youth with full sincerity and dedication had unitedly created an unprecedented environment throughout the country, enlightening all the fellowmen about our demands in support of “Indefinite Strike” continuously, for which they deserve to be thanked a lot.

Earlier too I had drawn your attention and warned to be aware of such elements who will confuse and mislead you by various baseless arguments and try to weaken and derail our united struggle.

I know that, such negative thinking persons neither would have participated in the strike nor moved shoulder to shoulder in the movement of struggle. Negative thoughts not only weaken the individual, but also malign mental attitude of the others. Certain such persons, pouring in forcefully their polluted views on others, only try to break the broader unity of the movement. After all, it is not a new phenomena, such elements were found in all the strikes of the past. But nowadays; propaganda scenario has changed. Earlier, social media – WhatsApp, Facebook etc. were not available, so, such elements were launching propanganda campaign in the Canteens, Pan shops etc. In the present era, instead of using social media, WhatsApp, Facebook etc, in positive way for uniting co-workers, such elements unsuccessfully attempt to break the unity with their contaminated thought, reflecting the fellowmen that they are the only genius and ever alert and real friends of them, but such individuals always deceived and show their back at the climax of the struggle.

I had earlier mentioned; to be very careful of such vindictive personalities who have destructive thought during the struggle, meant to secure their own rights. It is waste to have even least hope of any contribution in any struggle from such individuals who during agitation/strike try to side-away themselves by all means.

For complete preparation of strong background in any movement, struggle/strike, role of an individual unit, branch, division, zonal and national level, strong change can never be devaluated, and such an strong united movement at all levels leaders ultimately encourages to give a clarion call of struggle at the national level. National leadership has to take care of all even-odd circumstances, lead his attitude, patience and safety of their force. Deep contemplation yields of the movement for him to cause execution to implement various strategies and timelines for the fulfillment of the objective of the obligation to go beyond such a positive approach rather than criticism for decisions on the subtleties of the churning the movement extended to the middle of your peers and get validness struggling peace succeeds

I have full faith that, all the Central Government Employees were ready, already even today and will remain ready with the time slot to fight for their rights.

I again remind my colleagues to be aware and give befitting reply to those having negative thinking, and a strong movement only can go ahead.

Sub:- Observance of All India protest day on 19th November 2015

Dear Comrade,
All of you may recall that the NJCA in its meeting held on 30th September 2015 in Delhi after considering the delay in submission of the report of the 7th CPC as also broadly taking stock the speculating and detail deliberations, unanimously decided to defer the proposed Indefinite General Strike of the Central Government Employees till next Budget Session and symmetrically it was also resolve to observe 19th November 2015 as Joint Nation wise protest day to all the country to press upon the Government of India to resolve the long pending legitimate demands of all the Government Employees.

All of you are therefore accordingly requested to take all necessary steps to jointly observe protest day on 19th November 2015. As per decision taken by the NJCA in the said meeting the member of the NJCA shall stage one day Dharna at Jantar Mantar in New Delhi on the said day.

Charter of Demands

1. Effect wage revision of Central Government employees from 1.12014 accepting the memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA. Ensure submission of the 7th CPC report with the stipulated time frame of 18 months; include Grameen Dak Sewaks within the ambit of the 7th CPC. Settle all anomalies of the 6th CPC.
2. No privatisation, PPP or FDI in Railways and Defence Establishments and no corporatisation of postal services;
3. No Ban on recruitment/creation of post.
4. Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.
5. No outsourcing; contractorisation, privatization of governmental functions; withdraw the proposed move to close down the Printing Presses; the publication, form store and stationery departments and Medical Stores Depots; regularise the existing daily rated/casual and contract workers and absorption of trained apprentices;
6. Revive the JCM functioning at all levels as an effective negotiating forum for settlement of the demands of the CGEs.
7. Remove the arbitrary ceiling on compassionate appointments.
8. No labour reforms which are inimical to the interest of the workers.
9. Remove the Bonus ceiling;
10. Ensure five promotions in the service career.

Report of the protest may be forwarded to this office accordingly.
