<h3 class="wp-block-heading">Sub: Clarification regarding grant of National Holiday Allowance (NHA) to those non-gazetted employees who are getting higher pay level under MACPS.</h3>



<p>Ref: Board’s letter No. E(P&amp;A)I-2021/ HL-1 dated 04.02.2022 (RBE No. 14/2022).</p>



<p>Attention is invited to Railway Board’s instructions referred above clarifying that NHA would be admissible to those eligible non-gazetted employees who are getting higher pay level beyond level-8 under MACPS, at the rates prescribed for the substantive post held by them.</p>



<p>2. The issue regarding date of effect of Board’s letter dated 04.02.2022 has been examined in Board’s Office. It is stated that Board’s instructions dated 04.02.2022 would be effective from 04.02.2022 onwards.</p>



<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>



<p>4. This disposes of South Central Railway’s letter No. P[R]/55/ NHA/III dated 02.08.2022.</p>

<h3 class="wp-block-heading">Sub: Payment of National Holiday Allowance (NHA) to the Group ‘C’ non- gazetted Railway employees who are getting higher pay level beyond Level-8 under MACPS &#8211; reg.</h3>



<p>Ref: GS/SCRE Sangh’s letter No. SCRES/ GM/Personnel &amp; Genl/Vol Dated 16.02 2022</p>



<p>With reference to GS/SCRE Sangh’s letters cited above, it 1s advised that the matter has been referred to Railway Board for clarification whether to grant NHA to the eligible staff (who are in higher pay level beyond Level-8 under MACPS) w.e.f 01.07.2017 or from the date of issue of Board’s letter dt 04 02.2022 through which the staff working in higher pay level beyond Level-8 under MACPS are made eligible for NHA, for taking further necessary action.</p>



<p>In turn, Railway Board vide their letter No. E(P&amp;A)I-2021/ HL-1-Part(1) dt 27.02.2023 have advised that, the issue is under examination in Board’s office in consultation with Finance Directorate of Railway Board. As and when a decision is taken, necessary instructions would be issued accordingly (copy enclosed)</p>

<h3 class="wp-block-heading" id="sub-clarification-regarding-grant-of-national-holiday-allowance-nha-to-those-non-gazetted-employees-who-are-getting-higher-pay-level-under-macps">Sub: Clarification regarding grant of National Holiday Allowance (NHA) to those non-gazetted employees who are getting higher pay level under MACPS.</h3>



<p>Ref.: Board’s letter No. E(P&amp;A)I-2017/HL-1 dated 30.08.2017.</p>



<p>In context of Board’s letter cited above, references have been received in Board’s office from some of the Zonal Railways, seeking clarifications regarding entitlement of National Holiday Allowance (NHA) to those non-gazetted employees who are getting higher pay level beyond level-8 under MACPS. This issue has also been raised in PNM Forum by AIRF as item No. 11/2018 and by NFIR as item No. 11/2018.</p>



<p>2. The matter has been examined in Board’s Office. MACPS provides for grant of financial upgradation to employees on personal basis and the concerned employees continue to discharge the duties and responsibilities of their substantive post. In view of this, it is clarified that National Holiday Allowance (NHA) may be granted to those eligible non-gazetted employees who are getting higher pay level beyond level-8 under MACPS, at the rates prescribed for the substantive post held by them.</p>



<p>3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>



<p>4. This disposes of NWR’s letter No. 600-3/faeu/vai/ vaserqairse/19/2020 dated 23/03/2021.</p>

<p>Federation invites kind attention of the Railway Board to their letter dated 3010812017, quoted under reference, wherein instructions have been for payment of National Holiday Allowance to the non-gazetted staff in Level-l to Level-8 of 7th CPC Pay Matrix. Federation however points out that the said instructions do not cover those non-gazetted Railway employees working in Level-9 and above (erstwhile GP 5400).</p>
<p>&nbsp;</p>
<p>In this connection, Federation desires to mention that large number of non-gazetted Railway employees have been working in Level-9 and above, but have now been deprived payment of National Holiday Allowance as a result of issuance of Board’s instructions dated 30/0812017. Incidentally, Federation desires to mention that these staff (Level 9 and 10) are fully covered for payment of National Holiday Allowance as they fulfill the conditions laid down vide Board’s policy instructions contained in letter No. E(P&amp;A)I-97/HL/2 dated 1810211998, therefore exclusion of these staff for payment of National Holiday Allowance is not justified.</p>
<p>&nbsp;</p>
<p>NFIR, therefore, requests the Railway Board to issue amendment to the Board’s instructions dated 30th August, 201,7 duly covering the non-gazetted staff working in Level-9 and above for payment of National Holiday Allowance. A copy of revised instructions issued may be endorsed to the Federation.</p>

<p>4.The other terms and conditions as contained in Board’s letter No. E(P&amp;A)I-97/HL/2 dated 18.02.1998 for grant of this allowance shall remain unchanged.</p>

The undersigned is direct to refer to your letter No. I/5(g)/Part V dated 03.07.2015 on the above demand cited subject and to state that VII CPC is examining the issue in respect of rate of NHA along with rates of other allowances. As such, it is perhaps not an appropriate time to consider any kind of revision or deviation from the existing rates NHA. In the circumstances the final report/recommendations of VII CPC may be awaited. The PNM Item No. 5/2013 may be closed.</p>

<p>While discussing NFlR’s PNM item No. 5/2013 in the PNM meeting, the Official Side stated that the Federation’s reply dated 12/12/2014 has been examined by the Board, but however, it has been found that the demand of the Federation to compute NHA by taking into account DA in addition to Basic Pay and Grade Pay and at one and halftime the normal rate prevalent till 1968 is not feasible of acceptance.</p>
<p>In this connection. Federation desires to state that the view taken by the Railway Board is not acceptable to NHR as it does not contain justified and valid reasons. The Federation places below following facts which are required to be taken into consideration for giving justified decision.</p>
<p>(a) The decision of the Railway Board is a clear departure from its original decision which was based on the concept that the Railway employees who are not permitted to avail National Holiday in the exigencies of services have to be compensated by payment of additional amount equal 11/2 times of pay (pay in pay band + grade pay) and dearness allowance thereon. The quantum of compensation was clearly laid down which cannot be changed unilaterally by the Railway Board.</p>
<p>(b) The Vth Central Pay Commission though did not favour the continued payment of National Holiday Allowance. had recommended that the staff who are required to be booked on holidays to perform duties. may be paid Over Time Allowance at the prescribed rates.</p>
<p>NFIR therefore requests the Railway Board to review and accept one of the two options mentioned at (a) or (b) above and grant revision of rates. In case there is still reservation on the part of Railway Board. a meeting may be converted for separate discussion.</p>

<p><strong>Sub: – National Holiday Allowance – revision of rate – urged.</strong></p>
<p>Pursuant to the recommendation of the Jagannadha Das Pay Commission contained in para 45 of Chapter XXXV, the Railway Board with the sanction of the President, had decided to compensate the Railway employees by additional payment, when they are called upon to perform duties on National Holidays every year. Instructions to this effect were issued by the Railway Board vide letter No.PC-60/HL-2/1 dated 10th August 1961, fixing following criteria for payment of additional pay:-</p>
<p>“Basic Pay as defined in Rule 2003 (21) (a) (i&amp;ii) R-II and full Dearness Allowance (inclusive of Dearness Pay), Where the pay plus Dearness Allowance falls in between the two slabs, the rate for the next higher slabs shall apply”.</p>
<p>2. The Railway Ministry had also declared some more important days as “National Holidays” later on. In this connection, NFIR wishes to reiterate that initially additional pay was granted, to compensate to those Railway employees who in the exigencies of services are not permitted to avail National Holidays, by additional payment equal to 1 ½ times of the normal rate of pay plus DA thereon. At the same time, NFIR conveys that over the period of time not only the nomenclature but also the basis of National Holiday Allowance has been changed completely by the Railway Board without going into its genesis and has implemented the decision in most negative and unrealistic manner resulting less payment of National Holiday Allowance towards the so called compensation. There is wide variation between the original provision and the amount paid at present as National Holiday Allowance as can be seen from the following illustration:-</p>

3. Incidentally, the Federation desires to mention that the Fifth Central Pay Commission in their recommendations to the Government of India had suggested payment of National Holiday Allowance at the rate of payment of Over Time Allowance.</p>
<p>NFIR, therefore, requests the Chairman, Pay Commission to consider the facts mentioned above and make suitable recommendations to the Government of India for upward revision of the National Holiday Allowance.</p>

<p>The VI CPC in their report had recommended that certain allowances, viz. Children Education Allowance, National Holiday Allowance, Daily Allowance, Washing Allowance, Breakdown Allowance, Special Compensatory Allowance, Cycle Maintenance Allowance, Fixed Conveyance Allowance, Road Mileage Allowance, Special Allowance to various categories of staff etc., should be increased by 25% whenever Dearness Allowance crosses 50%, and this recommendation was duly accepted by the Government of India.<br />
Based on the above recommendation of the VI CPC, these allowances have since been enhanced by 25% w.e.f. 01.01.2011, i.e. from the date, Dearness Allowance having been crossed 50%.</p>
<p>Now, Dearness Allowance has crossed 100% w.e.f. 01.01.2014, there is, therefore, gross justification that the above allowances be further enhanced by additional 25%, as Dearness Allowance has again crossed the value of 50% after enhancement of these allowances w.e.f.01.01.2011.</p>
<p>The Board are, therefore, requested to issue necessary instruction to this effect an early date</p>
