<p>Sub: <strong>Resumption of duty by Loco Running Staff after availing periodic rest or leave &#8211; Booking of Running Staff &#8211; reg.</strong></p>



<p>Kind attention of Railway Board is invited to the opening address delivered by the Federation (outside agenda) during NFIR&#8217;s PNM meeting held with the Railway Board on 25th/ 26th ApriI, 2019 wherein attention was drawn to one of the recommendation of the Task Force on Safety, which submitted its report to the Railway Board on 10th January, 2017. Federation stated that five very Senior Railway Officers (as members) under the Chairmanship of General Manager, N.C. Railway have recommended (Para 24.6.5) that the Running Staff e.g. Loco Pilots etc., who join duty after availing periodic rest or after leave should mandatorily take rest of six hours in the Running Room before being booked on Running duties for a train. An extract of Para 24.6.5 of the report of the Task Force Safety is reproduced below:-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>&#8220;Loco Pilots coming to duty after availing a periodic rest or after a leave should be made to take a mandatory rest of 6 hours in the running room before being booked for a train.&#8221;</strong></p></blockquote>



<p>Federation further stated in the PNM meeting that unfortunately above recommendations of the Task Force are not being followed perhaps in absence of the instructions from Railway Board and the Running Staff are being booked invariably on the Divisions of Zonal Railways to work first train immediately on resumption from rest/leave. </p>



<p>NFIR, therefore, requests the Railway Board to issue suitable instructions to the Zonal Railways clearly stating that the Running Staff coming on duty after availing periodic rest or leave should be allowed to take 06 hours mandatory rest before booking to work a train. A copy of instructions issued may be endorsed to the Federation.</p>

(iii) Railway Board&#8217;s letter No.E(P&amp;A)II-2017/BDA-1 dated 14-09-2018 (RBE No.138/2018)</p>
<p>Pursuant to NFIR&#8217;s reference vide letter dated 11-04-2018 relating to admissibility of payment of Breakdown Allowance to the staff working in GP 2000/Level-3 of 7th CPC who were left erroneously in Board’s order dated 30th August,2017 (RBE No.106/2017), Railway Board vide letter dated 14-09-2018 (RBE No.138/2018) have issued clarification for grant of Breakdown Allowance to the Technicians Grade-III though drawing pay in higher pay level under MACPS at the rates prescribed for the post held by the employee. Federation however noticed that the said instructions are not in conformity with the Federation’s demand to grant Breakdown Allowance to the Staff working in GP 2000/Level-3 at the pay received in the same Grade Pay/Pay Level.</p>
<p>In this connection, Federation desires to state that the Breakdown Allowance is treated as Compensatory Allowance and is attached to the extra-ordinary duties performed by such staff. The Board&#8217;s clarification dated 14-09-2018 limiting the payment of Breakdown Allowance to the post held by the staff i.e. substantive pay in GP 1900, is unjustified and needs to be corrected suitably to render justice to the staff of Technical Categories.</p>
<p>NFIR, therefore, urges the Railway Board to consider the above points and issue amendment to the clarification to letter dated 14-09-2018 soon duly endorsing copy to the Federation.</p>

<p>Ref: Federations Joint letters No.II/IB dated 09/05/2016 &amp; I5/05/20I7 to CRB.</p>
<p>Federations have repeatedly been inviting kind attention of the Railway Board at all levels including at the level of Hon&#8217;ble MR, CRB to the DC/JCM item No.27/2006, urging decision for absorption of staff working in the Quasi Administrative Office/Units against erstwhile Group &#8216;D&#8217; vacancies since long.</p>
<p>The subject was also discussed by NFIR and AIRF in full Board meetings held on 07/02/2014, 01/10/2015 and 04/02/2016. Federations are deeply disappointed that though years passed, the issue is still pending unresolved. The Federations Joint communications to the Railway Board Chairman vide letters dated 09/05/2016 and 15/05/2017 have unfortunately not yielded positive result.</p>
<p>The Federations have re-iterated through joint letter dated 09/05/201, the justification for restoration of the earlier policy formulated in the year 1973 &amp; 1977 to facilitate regular absorption of staff working in Quasi Administrative Offices/Units. The Federations had sent another letter dated 15/05/2017 requesting to arrange a meeting at the level of Hon&#8217;ble MR and CRB, unfortunately no meeting has been convened as yet. Federations desire to state that 12 valid points were conveyed to the Railway Board on the legal opinion tendered by the Learned ASG relating in this particular case, but however there has been no positive response yet. Federations once again enclose a copy of 12 points for consideration at the level of Railway Ministry which we feel are sufficient to keep the policy alive. The subject was also highlighted by the Federations during. Standing Committee Meetings held between the Federations and the Railway Board (MS, DG/P etc.) on 7th Feb, 2018, 4th April, 2018 without any positive result which is unfortunate</p>
<p>The Federations also reiterate that the decision of Railway Board vide dated 10/06/1997 was arbitrary as the same was issued without consultations with us which amounts to breach of agreement reached with the Federations during previous periods.</p>
<p>We therefore requests the CRB again to kindly intervene and see that a meeting takes place at your level early to settle this long pending issue besides other issues where agreements have been reached but not implemented so far. Alternatively we suggest a special meeting with Hon&#8217;ble Railway Minister early.</p>

(iv) NFIR&#8217;s PNM Agenda Item No.18 sent to Railway Board on 26/06/2018.</p>
<p>Federation desires to invite kind attention of Railway Board to the letter dated 26/12/2017 wherein instructions have been issued for revision of flat rate of license fee (Standard Rent) for residential accommodation in Railways with retrospective effect i.e. 01/07/2010, 01/07/2013, and 01/07/2016. Federation expresses its anguish over non-appreciation of ground reality highlighted by the Federation vide its letter dated 12/03/2018 for taking remedial action and instead, sent reply vide letter dated 09/05/2018 that the revision in the flat rate of license fee is based on the pattern of Ministry of Housing and Urban Affairs. Due to this negative approach, the Federation was compelled to raise the issue vide PNM Agenda Item No. 18 (sent to Railway Board on 26/06/2018), but unfortunately, instructions have not been modified yet.</p>
<p>Besides above, the Federation desires to convey to the Railway Board that the reports are received from the NFIR affiliated Unions that though outstanding dues towards office rent, electricity, telephone and water charges have already been cleared by the affiliates, the Divisional Administrations have raised bills for payment arrears towards rentals of office accommodation from 01/07/2010 to 30/06/2013, 01/07/2013 to 30/06/2016 and 01/07/2016 to 31/03/2018. While the Board&#8217;s instructions dated 26/12/2017 are unjustified, the action of Railway Administration, demanding payment of arrears on account of Office rent of the accommodations in possession of the affiliated Unions is totally wrong.</p>
<p>As the subject has already been taken up by the Federation in the PNM fora at Board&#8217;s level, it is urged that the instructions dated26/12/2017 be kept in abeyance or withdrawn.</p>

<p>Please refer to NFIR&#8217;s representation dated 23.07.2018 addressed to Hon&#8217;ble MR requesting intervention of Hon&#8217;ble for obtaining approval of Ministry of Finance (MoF) for upgradation GP-4600 to GP-4800.</p>
<p>2. With respect to above, it is stated that Railway Board have been making persistent efforts with various levels for obtaining approval of proposal sent MoF vide Board&#8217;s OM dated 08.02.2017 proposing revision of pay structure of Sr.Supervisors in Group &#8216;C&#8217; of all departments (other than Account Department) to upgrade 75% of such Supervisor posts from Level-7 (erstwhile GP-4600) to Level-8 (erstwhile GP &#8211; 4800) and to bring parity in the pay scales of Group 13 Officers Accounts/Non-Accounts department.</p>
<p>3. It has already been intimated to NFIR through ATS on PNM-NFIR Item Nos. 3 &amp; 10/2018 that a D.O. letter dated 20.04.2017 was sent from Hon&#8217;ble MR to Hon&#8217;ble FM for expediting approval on above proposal. Thereafter, a reminder dated 15.05.2018 from EDPC-­II to JS(Pers)/MoF was also sent in this connection. Recently, a D.O. letter dated 13.07.2018 (Annex-I) from Board (CRB) to Finance Secretary has also been sent requesting them to expedite approval on Board&#8217;s proposal dated 08.02.2017.</p>

<p>Ref: Railway Board&#8217;s RBE No.147/2017 letter No.E(W)2017/ED-2/3 dated 12/10/2017.</p>
<p>Pursuant to Government decision on the recommendation of 7th Central Pay Commission, the DoP&amp;T vide No.A-27012/02/2017-Estt.(AL) dated 16/08//2017 had issued instructions revising the amount for reimbursement of Children Education Allowance and Hostel Subsidy. The Railway Board vide RBE No.147/2017 dated l2th Oct, 2017 has issued corresponding instructions to the General Managers for ensuring payment of Children Education Allowance &amp; Hostel Subsidy at revised rates from 01/07/2017.</p>
<p>On Zonal Railways, the staff are facing much inconvenience on account of non-issuance of proper proforma/format for preferring claims, consequently the reimbursement is delayed and claims continued to remain pending due to queries being raised at different levels. It is further learnt that the Eastern Railway, South Eastern Railway and Central Railway have issued proforma/format which are however not common. Other Zonal Railways have not at all issued proforma for preferring the claims. It has however been found that the Eastern Railway Administration has not only circulated format, but also issued JPO.</p>
<p>NFIR is of the view that it would be necessary to bring reimbursement to avoid delay as well staff grievances.</p>
<p>NFIR therefore requests the Railway Board to arrange to issue proper format to enable the employees to prefer claims without hassles together with certificate from the Heads of the Institutions. Such uniform format will be advantageous to the Railway Administration as well to staff who are entitled for reimbursement of Children Education allowance/Hostel Subsidy.</p>

<p>At the outset, NFIR thanks the Railway Ministry for granting exemption from 5 years minimum service condition to consider the request transfers in the following situations vide Railway Board&#8217;s letter dated 10/02/2016.</p>
<p>(a) Transfers sought on mutual exchange basis,</p>
<p>(b) Transfers sought on spouse ground,</p>
<p>(c) Railway servants who are care-givers to a disabled child and</p>
<p>(d) Physically handicapped Railway servants.</p>
<p>The Federation brings to your kind notice that the Defence Forces Personnel after having served for safeguarding the Nation&#8217;s Borders for decades, have retired and thereafter they are being recruited through Railway Recruitment Boards/Railway Recruitment Cells in the Railways. These Personnel during their service in the Defence Forces were far away from their families for decades. After recruitment in Railwals also, they are away from their family members and children due to their postings at different places. Consequently, they are facing lot of hardships in managing two establishments. Their case therefore, deserves to be considered by<br />
relaxing 5 years minimum service condition, so that they can seek transfer nearer to their place of residence and can peacefully perform their duties while leading family life.</p>

<p>Sub: <b>Claims regarding payment of Travelling Allowance to the Staff promoted under cadre restructuring w.e.f. 0l/11/2013- case of North Western Railway-reg.</b></p>
<p>Ref: (i) GM(P)AJ.W. Rly&#8217;s letterNo.600E/Bills/HQ/NWREU/7/2015 dated 25/01/2016.<br />
(ii) NFIR&#8217;s letter No. I/5(F) dated 01/03/2016.</p>
<p>(iii) Railway Board&#8217;s letter No. F(E)I/2016/AL-28/17 dated 22/04/2016.</p>
<p>On going through the reply sent by the Board vide letter dated 22/04/2016, Federation is disappointed to note that the issue raised by NFIR vide its letter dated 01/03/2016, has not been gone into thoroughly with reference to the rules on the subject lPara1202 of IREM Vol. I and Para 1602 (2) of IREC Vol. II] and the stipulations mentioned in the footnote where following provision has been made in case of late authorization/drawal of increments by the employees from retrospective effect.</p>
<blockquote class="tr_bq"><p>&#8220;<b>Note: </b>In the case of late authorization/drawal of increments with retrospective effect, other than where increments were withheld or where the increments take an officer above the stage &#8216; of efficiency bar, there is no objection to the supplementary claims relating to Travelling Allowance, if any being admitted, on the basis of the enhanced pay including the increments.&#8221;</p></blockquote>
<p>These stipulations however have not been taken into account by the Board while sending negative reply to the Federation.</p>
<p>Incidentally, Federation desires to mention that the issue was raised by the General Secretary, NFIR in the PNM meeting held on 19th/20th May 2016 outside the agenda. It is also worth-mentioning that the benefit of cadre restructuring to be given effect from 0l/1112013 was actually granted after lot of delay due to various administrative reasons, therefore claims of staff for payment of Travelling Allowance at the enhanced rates effective from 01/11/2013 need to be considered as provided under the rules.</p>
<p>NFIR, therefore, requests the Railway Board to kindly review and issue suitable instructions to all Zones etc., on the subject. A copy of instructions issued may be endorsed to the Federation.</p>
