<p>Federation Leaders associated with National Council JCM are keep telling that Allowance Committee might submit its report on 20th February 2017. The CG Staff are already very much upset over the Government’s deliberate attempt to delay the payment of Allowances by constituting many committees. Because the payment of revised Allowances is considered will impact the Governments Exchequers.</p>
<p>Lot of Committees formed and Meetings held after the Notification issued for implementation of 7th CPC Recommendations. But there is no any fruitful outcome from these meetings. No sign of making decisions which satisfy the Central government employees.</p>
<p>Had the Allowance like HRA is paid in revised rates from the date of Notification ie 25th July 2016, it seems more beneficial than waiting for the subcommittee reports. Because if revised allowances are not given retrospective effect, it will be a huge loss for Central Government Servants.</p>
<p>Reports suggests that the Allowance Committee may submit its report on 20th February 2017 and it will be notified with effect from 1st April 2017. Federation sources told that It is unacceptable and we will fight it out until the revised allowances implemented with effect from 1.1.2016</p>

<div>As you may be kindly aware, Joint Consultative Machinery (JCM) Scheme is in operation in Government of India with the object of promoting harmonious relations and of securing the greatest measure of cooperation between the Central Government, in its capacity as employer and the general body of its employees in matters of common concern, and with the object, further, of increasing the efficiency of the public services. The Joint Consultative Machinery (JCM) consists of the Official Side and the Staff Side.</div>

<div>We, as Staff Side, have raised a number of issues with the government, concerning the employees of the Government of India. Two of these issues are agitating the minds of the Government employees and need urgent resolution. These relate to Merger of Dearness Allowance with Pay and removal of the issue relating to Senior Promotee employees drawing less pay than the Junior Direct Recruit employee. Since these issues need decision at the level of Ministry of Finance, I am enclosing brief notes on the same for your kind perusal.</div>

<h3 style="text-align: center;">MERGER OF DA WITH PAY</h3>
<div>The wage revision of the Central Government employees is carried out through the Central Pay Commissions which, considering the magnitude of employees is a time consuming process. The 7 Central Pay Commission (CPC) set up by the Government will require a reasonable time frame to go into the matter judiciously especially because the implementation of 6m CPC recommendations have given rise to large number of issues and cadre related grievances.</div>
<div></div>
<div>During the past, the methodology adopted for compensating the erosion in the real value of wages due to price rise as reflected in high rate of DA to Government employees before the date of the submission of Pay Commission Report and its acceptance by the Government, had always been though the mechanism of merger of a portion of DA with Pay. The merger of DA to partially compensate the erosion in the real wages was first done in pursuance of the Gadgil Committee in the post 2nd Pay Commission period. The 3 CPC had recommended such merger of the DA when it crossed 36%, The Government agreed to merge 60% and later the whole of the DA before the 4°’ CPC was set up. The 501 CPC merged 98% of DA with pay. The 51h CPC had also recommended that the DA must be merged with pay and treated as pay for computing all allowances as and when the percentage of Dearness compensation exceeds 50%. Accordingly even before the setting up of the 6°’ CPC the DA to the extent of 50% was merged with pay.</div>
<div></div>
<div>Presently, the factual position is that as on 1.1.2014, the Dearness compensation is 100% and will exceed the same with effect from 1.7.2014. Since the 7°’ CPC has been set up and one of the issues to be dealt with by the CPC would relate to revision in the existing reference base of price index, it becomes all the more necessary that the Government takes steps to merge at least 50% of DA with pay to compensate the erosion of the real value of wages immediately.</div>
<h3>ISSUE RELATING TO SENIOR PROMOTEE EMPLOYEES DRAWING LESS PAY THAN THE JUNIOR DIRECT RECRUIT EMPLOYEES</h3>
<div>The main issue in this case is that the 6th CPC for the first time recommended specific entry level pay for Direct Recruits (DRs). This resulted in employees who were appointed in service prior to the DRs and also got promoted earlier get less pay as compared to their counterparts recruited directly and who joined after 1.1.2006. It has always been the case that on promotion, the pay of a promoted employee is never fixed at less than the entry level of pay of that post as admissible to a direct recruit.</div>
<div></div>
<div>Consequent upon implementation of the recommendations of the 6th CPC, in respect of pay scales of various categories of staff, there are certain situations where the senior who were promoted before 01.01.2006 are getting lesser pay than their juniors promoted after 01.01.2006, on fixation of their pay w.e.f. 01.01.2006. This, being a serious anomaly, has been raised by us in the National Anomalies Committee for redressal thereof.</div>
<div></div>
<div>The consensus decision in the National Anomaly Committee was that the Staff Side as well as the Official Side agreed that wherever there is a provision of direct recruitment in the Recruitment Rules, pay on promotion would be fixed at the prescribed minimum of the Entry Pay as provided for the Direct Entrants in the Revised Pay Rules, irrespective of the fact whether direct recruitment has actually taken place or not. However to our distress it was later on learnt that the Government went back on this mutually agreed solemn resolution and did not issue any Order in this regard. This being a serious issue has resulted in discontentment prevailing among the seniors who are drawing less pay than is legitimately due to them.</div>
<div></div>
<div>A very simple solution to this issue is that orders may be issued to the effect that the pay on promotion w.e.f. 01.01.2006 would not be fixed less than at the prescribed minimum of the Entry Pay as provided for the Direct Entrants in the Revised Pay Rules, to eliminate this unfairness.</div>

<div></div>
<div>(1) <strong>Lesser standards of evaluation for the JAO and JTO exams. </strong></div>
<div>The Staff Side made a strong appeal to the Management, to review the JAO and JTO exams that had taken place, by adopting lesser standards of evaluation. The vehement, lengthy and detailed arguments of the Staff Side to grant grace marks, were however not accepted by the Management.</div>
<div></div>
<div>As regards taking remedial measures in respect of question papers with discrepancies, it was agreed that the Recruitment Branch will issue a letter to all the CGMs, as has been done in the case of MP and AP circles, for taking necessary remedial action.</div>
<div></div>
<div>(2)<strong> Regular promotion to officiating JTOs. </strong></div>
<div>Management replied that a provision is already made in the New Recruitment Rules for the absorption of all the 1500 officiating JTOs. The RR will soon go for the approval of the Management Committee.</div>
<div></div>
<div>(3) <strong>Eligibility of the Non-Executives to appear Management Trainee exam. </strong></div>
<div>Very serious arguments were placed by the Staff Side for the amendment of the Recruitment Rules of the Management Trainees, so as to make the Non-Executives, with the requisite qualification, eligible to appear the MT exam. But this was not accepted by the Management. Due to the persistent requests made by the Staff Side, Management agreed to review the RR, after one exam is held. It was informed that the notification for holding the MT exam would be issued within 3 months.</div>
<div></div>
<div>(4) <strong>Amendments to JTO(T), JTO(E), JTO(C) and JAO Recruitment Rules.</strong></div>
<div>Management informed that the new RR of JTO(T) is going for the approval of the MC shortly and that the qualifying service has been reduced from 7 years to 5 years. The demand of the Staff Side to reduce it to 4 years was not accepted. Management also informed that the work to frame new RRs of JTO(E), JTO(C) would be taken up shortly.</div>
<div></div>
<div>(5) <strong>Filling up of SC/ST back log vacancies</strong></div>
<div>Management replied that there is no unfilled back log vacancies in Non-Executive posts.</div>
<div></div>
<div>(6) <strong>Regularisation of TSMs and casual labourers appointed on compassionate grounds</strong>.</div>
<div>There was a detailed discussion on this issue. However, Management finally replied that regularization of any TSM or casual labourer could not be done in view of the Hon’ble Supreme Court judgement in the Uma Devi case.</div>
<div></div>
<div>(7) <strong>Revision of stipends of trainees. </strong></div>
<div>Management has already issued order on 07.04.2014, (after this item was submitted for discussion in the National Council) stating that 70% of the minimum pay of the respective pay scale + IDA shall be paid as stipend for TTAs / Sr.TOAs and TMs.</div>
<div></div>
<div>Staff Side demanded that revised stipends should be implemented from 01.01.2007 and arrears should be paid. Management accepted this.</div>
<div></div>
<div>(8)<strong> Fresh Recruitment of Staff. </strong></div>
<div>Staff Side argued about the need for fresh recruitment, since there is acute shortage in cadre like Sr.TOA. Management agreed that fresh recruitment is required, howeverthey told that it should be done for a multi-skilled cadre. Further, they told that this issue would be referred to the consultant.</div>
<div></div>
<div>(9<strong>) Empowerment of women staff in BSNL.</strong></div>
<div>Staff Side argued that the role being played by the women staff, for the growth of BSNL as well as for the society as a whole, should be recognised. It was also pointed out that the women employees, after crossing certain age, are facing specific health problems and thus require a special consideration. In view of the above, the Staff Side demanded the women employees should be granted special leave of one day for every completed one month’s service. However, Management said that it is following the Government Rules in the matter of leave, and whatever is not mentioned in those Rules would not be granted.</div>
<div></div>
<div>(10) <strong>Pay fixation in case of Non-Executives absorbed in BSNL, who had opted for IDA pay scale from the date of promotion after 01.10.2000. </strong></div>
<div>Management said that this issue is being actively persued with the DoT and expressed hope that a favourable order would come soon. The Staff Side demanded that in the meanwhile recovery being made at the field level should be stopped. Management agreed to look into this.</div>
<div></div>
<div>(11) <strong>Provision of Rs.200/- BSNL SIM to all the Non-Executives.</strong></div>
<div>BSNL SIM worth Rs.200/- has already been issued to the Non-Executives working in the outdoor. Staff Side demanded that this facility should be extended to the Non-Executives working in Indoor / offices also. They also demanded that access to other network customers and also to the CUG of Executives should be provided. Management said that this would be looked into.</div>
<div></div>
<div>(12) <strong>Inordinate delay in the finalization of disciplinary cases. </strong></div>
<div>Staff Side pointed out that there is inordinate delay in finalising disciplinary cases, which has also resulted in acute delay in the issuing of Presidential Orders, and demanded prompt action on this count. Management replied that the CVO office has already issued letter to all CGMs to finalise disciplinary cases without further delay.</div>

<div>(13) <strong>Creation of Section Supervisor posts in the circle / administrative offices.</strong></div>
<div>After detailed discussion, Management suggested to hold separate discussion on this issue. Staff Side agreed.</div>

<div>(14)<strong> Independent SSA status for Anantnag and Baramullah. </strong></div>
<div>Staff Side demanded that Anantnag and Baramullah in J&amp;K circle should be granted full SSA status, in view of the fact that TDE and AO are already posted in these places with full administrative and financial powers. Staff Side also pointed out how SSA status has been already granted for smaller districts. Management replied that the proposal to form a separate SSA has come from the CGM J&amp;K, only in respect of Anantnag and that no proposal has come for Baramullah. In respect of Anantnag, Management said that it would be looked into.</div>

<div><strong>(15) Issue of Presidential Orders to TSMs regularized on or after 01.10.2000. </strong></div>
<div>Staff Side pointed out that how POs are not yet issued for a number of TSMs who are regularised on or after 01.10.2000.</div>
<div></div>
<div>Management shared the concern of the Staff Side and told that even 10 days ago a letter had been issued to all the CGMs to forward such cases to the Corporate Office.</div>

<p>Sub: <strong>Upgradation of grade pay of LDC &amp; UDC in the Administrative branch of Government of India Offices.</strong></p>
<p>Respected Sir,</p>
<p>With due respect it is to bring to your kind notice that the undersigned in the capacity as General Secretary of All India Association of Ministerial Staff (Group C) under the Ministry of Statistics &amp; Programme Implementation, had made an appeal to your good office vide letter dated 16/04/2010(Enclosed in Annexure I) wherein it was described how the 6th Pay Commission recommendations disappointed the lakhs of LDC &amp; UDC working in the Central Government Offices. Our contention was that while the 6th Pay Commission has recommended the merger of the various group D posts and upgraded the grade pay from 1400 to 1800, for the LDCs, only a replacement grade pay of Rs. 1900 i.e. just Rs. 100 above the MTS has been granted, even after raising the academic and technical qualification to get selected on the post. Moreover, all the pre-revised pay scales above UDC -from Accountant to Assistant Administrative Officer- have been merged and granted Rs. 4200 &#8211; 4600 grade pay. Thus the basic cadres who are responsible for the smooth functioning of the Central Government offices, especially in the subordinate offices, have ignored/neglected by the Pay Commission as well as the Government.</p>
<p>Considering the gravity of the subject contained in it the aforesaid appeal was forwarded to the Secretary, Department of Personal &amp; Training for action vide PMO ID No. 4/3/2010-PMP4/158890 dated 18/05/2010 (Copy enclosed in annexure II). When any action on the matter has visibly been not taken by the DoPT till 2012, and having aggrieved on the prolonged delay, follow up correspondences have been made as follows</p>
<p>1.  Shri A.H. Lokhande, Jabalpur has sought the action taken report under RTI (copies enclosed in Annexure III (A) &amp; III(B). But both CPIO &amp; appellate authority vide letter No. 20/2/2012-Estt(Pay-1) dated 29Aug 2012 &amp; letter No 20/2/2012-Estt(Pay-1) dated 23rd Oct 2012 respectively have confirmed that the said letter has not received at  DoPT and as such no action taken report can be given(copies enclosed in Annexure IV(A) &amp; IV (B).</p>
<p>2.   Subsequently, the undersigned has obtained a copy of the acknowledgement in confirmation of the receipt of my letter dated 16/04/2010 at DoPT from the PM’s Office. In the light of the said acknowledgement, a letter seeking the copy of the action taken report/Noting drafting under RTI was sent to the CPIO DoPT vide letter dated 09/03/13 (Copy enclosed in Annexure V (A)-V(E).</p>
<p>3.   On 25th April 2013 I have received a letter from CS Section of <a href="http://centralgovernmentnews.com/category/dopt-orders/">DoPT</a> (Annexure VI), which has not given the pointed reply I sought, and as such the same was not convincing. And accordingly an appeal was sent to the appellate authority under RTI act vide letter dated 29/04/2013 for which I have received a letter vide letter No. 20/1/2013-CS-II (B) dated 21st May 2013.(enclosed in Annexure VII (A) &amp; VII(B)  wherein it was informed that “CS-II Division deals only with the LDCs &amp; UDCs of the Central Secretariat Service and as such no records available CS-II Division, there is no proposal to upgrade the grade pay of the LDC &amp; UDC of CSCS Cadre. The application of Shri A.H. Lokhande has not been received in this Division”. Accordingly an order for the disposal of the appeal has been passed.</p>
<p>From the above it is clear that the letter received in the DoPT from the PM’s office has not taken in the records of DoPT where it appears to have been  misplaced which led CPIO and appellate authorities  to state that no such letter is received at DoPT from the PM’s Office. In this respect, even after submitting/providing the proof the acknowledgement of the said letter (obtained from the PM’s Office), DoPT has not bothered to change their version. Moreover, the copies of the applications submitted by Shri A.H. Lokhande have been supplied and even after CS-II division has not changed their version of not receiving any letter from Shri A.H. Lokhande.</p>
<p>Above all, both Shri A.H. Lokhande and myself have sought information regarding the action taken report/noting/drafting in disposal of the letter forwarded to the Secretary, DoPT by the PM’s office vide letter No. 4/3/2010-PMP4/158890 dated 18/05/2010. In reply, the CPIOs and Appellate authorities (pay Division &amp; CS-II Division) have been informing us that the said letter is not received in their section and as such no action is taken.</p>
<p>Sir, the Confederation of Central Government Employees &amp; Workers, All India Railway men’s Federation, National Federation of India Railway men, the Defense Employees Federation and various other Central Government Employees’ Organizations have been writing to the Government to consider the upgradation of the grade pay of the LDC &amp; UDC. Besides, the issue has been put up in the National JCM but the matter could not be discussed as the meeting of the National JCM meeting has not been called so far. Moreover, this item has been placed in the National Anomaly Committee (NAC) but the same has not been taken up for discussion in the NAC so far. It is also bring to your kind notice that all the websites related to the Central Government Employees have actively been discussing the issue as genuine.</p>
<p>Sir, the upgradation of the grade pay of LDC &amp; UDCs is a genuine issue. Cases of all cadres baring the LDC &amp; UDC were considered and favorable decision was taken by the 6th CPC. Similarly, the LDC and the UDC are also deserving  higher grade pays than the present one, to commensurate with the qualifications and assignments attached to these posts after the implementation of the recommendations of the <a href="http://centralgovernmentnews.com/category/6cpc/">6th Pay Commission</a>.</p>
<p>In view of the above, we seek your kind intervention to get a favourable decision in this   regard.</p>

<p><strong>MINUTES OF THE MEETING WITH THE REPRESENTATIVES OF STAFF SIDE, NATIONAL COUNCIL (JCM) ON PENSIONARY MATTERS UNDER THE CHAIRMANSHIP OF SECRETARY (PENSION, AR&amp;PG) ON 28.5.2013 AT LOK NAYAK BHAWAN, NEW DELHI<br />
</strong><br />
Secretary (Pension, AR&amp;PG) chaired a meeting with the representatives of Staff Side, National Council (JCM) on 28.5.2013 to discuss various issues relating to pension and other retirement benefits. The list of participants is at Annexure &#8211; I. Secretary (Pension, AR&amp;PG) welcomed the participants and appreciated the contributions of the pensioners in the overall development of their respective organisation.</p>
<p>2. The meeting started with a discussion on the Action Taken Report on the minutes of the meeting held on 6.11.2012 as per details given below :</p>
<p>(i) Ex-gratia payment to SRPF/CPF beneficiaries who retired other than on superannuation, i.e. voluntary retirement and medical invalidation cases.</p>
<p>Department of Expenditure has given clearance for deletion of clause of &#8216;c&#8217; of para 2 of OM dated 22.3.2004 which prohibits grant of ex-gratia payment to those, who retired from service other than on attaining the prescribed age of superannuation. With this, CPF beneficiaries who have retired voluntarily and on medical grounds after 20 years of service will also be granted ex-gratia. It was decided that this agenda item will be closed after issue of a revised OM by the DOP&amp;PW. Ministry of Railways will also issue similar orders.</p>

<p style="text-align: left;">(ii)<strong> Raising quantum of ex-gratia to CPF retirees on the lines of SRPF</strong>.</p>
<p>The latest status of the case was intimated to the JCM. After the issue of orders by this Department, consequent to the decision of Cabinet the item may be dropped.</p>
<p style="text-align: right;"><span style="text-decoration: underline;">Action : DOP&amp;PW</span></p>
<p style="text-align: right;">
<p style="text-align: left;">(iii) <strong>Abnormal delay in the issue of revised PPO to Pre &#8211; 2006 retirees, pensioners / family pensioners.</strong></p>
<p>(i) It was intimated that the Department had taken the following initiatives like (a) allowing change in date of birth of spouse, (b) use of certain documents as proof of date of birth of spouse, (c) inclusion of present postal address and mobile and telephone number in the life certificate (d) use of e-scroll for extracting information from banks’ database. (e) revision of PPOs even in cases where date of birth/age of spouse is not given in the PPO or this information is not available In the omce records for speedy revision of PPOs.</p>
<p>(ii) As a result, the number of pending revision cases for civil pensioners has come down from 2,54,467 in August, 2012 to 74,000 as on April, 2013 as per information given by the CPAO on the basis of e-scrolls.</p>
<p>(iii) However, amendment in calculation of revised pension, vIde OM dated 28.1.13, has necessitated issue of revised authority in all cases, as indicated in OM dated 13.2.13.</p>
<p>Secretary (Pension, AR&amp;PG) stated that record/information of many pensioners are not available with the Departments, which is hampering further progress and the Pensioners Associations should come forward to help the departments in reaching out to the pensioners/family pensioners. He further stated that Secretaries of various Departments have been requested to review the issue of revision of PPO in the fortnightly/ monthly meetings.</p>
<p>Railways stated that in case of pre 2006 pensioners advertisement has been issued. Matter was taken up with RBI to issue notification to all banks. Out of 10.89 lakh such cases, 5.46 have been issued revised PPOs. Meetings ere generally held at various levels. 30th September, 2013 has been set as the target date for disposal of these cases. The progress is being reviewed every month. It has also been decided to take up the revision of PPOs suo-moto rather than waiting for an application from the pensioner. The said letter is under issue. Secretary (Pension, AR&amp;PG) desired that the same may be issued by 15th June, 2013.Secretary, Pension des,red that necessary chances in systems may be made if that would facilitate the pension sanction and payment processes in the <a href="http://centralgovernmentnews.com/category/railways/">Raliways</a>. The present pension authorisaton is decentralised In the Railways. Secretary, Pension also stated that he will write to the Chairman, Railway Board in this matter.</p>
<p>CGDA, Ministry of Defence intimated that they hope to complete the exercise by 30th September, 2013.</p>

<p>(iv) <strong>Fixation of Revised Pension (1/3rd of commuted portion of pension) in respect of Government servant who had drawn lump sum payment on absorption &#8211; revision by multiplying pre revised 1/3rd pension by a factor of 2.26.<br />
</strong><br />
CAT, Hyderabad Bench, vide its order dated 22.4.2013, has directed, to pass an order for revision of pension of absorbee pensioner’s. The Staff Side was informed that the matter was under examination in consultation with Department of Expenditure.</p>
<p><strong>(V) Commutation of Pension<br />
</strong><br />
(a) <strong>Revision of old / new commutation table and<br />
</strong><br />
(b) <strong>Restoration of commutation period to be reduced from 15 to 12 years.<br />
</strong><br />
It was explained that the matter of revision of old/new commutation table was discussed with Department of Expenditure. It was observed that this issue should be considered by the next pay commission.</p>
<p>JCM intimated that by the new commutation table, the restoration of the commuted portion is completed by 11 years because interest rate is at 8% unlike the old table wherein the restoration period was after 15 years because interest rate was taken at 4.75%. Department of Expenditure stated that issue for this old/new commutation table can be studied only by a specialised body and hence could be looked into by the IRDA. However, these are larger issues for which a holistic view needs tobe taken by a body like the Pay Commission. However, the matter may be referred to Department of Expenditure.</p>
<p>(vi)<strong> Family pension to divorced/Widowed/Unmarried daughter of a Government Servant.</p>
<p>Difficulty faced by them in getting family pension sanctioned.</p>
<p>Life Time Arrear</strong>.<br />
JCM did not raise any specific point in this regard. In fact, it was mentioned by the JCM members that the legal view on the issue of nomination of life time arrear of family pension is that since he/she has not earned the family pension he/she also can not have the right to nominate. As such, the matter may be dropped.</p>
<p>(vii)<strong> Payment of arrears of <a href="AIRF, AIRF Latest News, Department of Pension and Pensioners Welfare, JCM meeting on Pensionary Matters, Minutes of JCM Meeting, National Council JCM, Pensionary Issues, Pensionary Matters, Central Government Employees news">pension</a>/family pension on account of revision of pension/family pension with effect from 1.1.2006.</p>
<p>Specific case of bank In Chandrapur</strong>.</p>
<p>It was informed that the matter was taken up with CPPC, Mumbal (SBI), who informed that the payment to pensioners is being made and there is no such case where pension has not been revised as per <a href="http://centralgovernmentnews.com/category/6cpc/">6th CPC</a>. Hence the matter may be dropped.</p>
<p>(viii) <strong>Payment of Pension to the spouse of pensioners through S.B. account opened jointly with spouse<br />
</strong><br />
&#8211; <strong>Problem in SBI.<br />
</strong><br />
CPAO has informed that necessary instructions in this regard have been issued to all CPPCs with the direction to bring the contents to the notice of all paying branches. CPAO was requested to give a copy to the JCM. It was decided to drop the matter.</p>
<p>3. The representatives of JCM also desired the status of eight agenda items sent by Shri Shiva Gopal Mishra, General Secretary, AIRE which were not included may also be intimated clearly. This may be informed to him separately.</p>
<p>4. After above discussion on Action Taken Report on the minutes of meeting dated 6.11.2012, fresh agenda items were taken for discussion which are as under</p>
<p>(i)<strong> Equitable Gratuity under Rule 50 of Pension Rules. Slabs are too wide leading to disparity.<br />
</strong><br />
Rule 50 of Pension Rus provide the following death gratuity to the family of the deceased Government servant.</p>

<p>The JCM (Staff Side) has stated that the slab given at SI. No. 3 above is not equitable and suggested the following revision</p>

<p>This issue was discussed in the JCM meeting. The present slab of death gratuity was introduced w.e.f. from 1.1.1986 and was introduced as per the recommendations of 4th Central Pay Commission, vide this Department’s OM No. 2/1/1987-PIC-II dated 14.4.1987, This slab has not been revised since 1986. In between, the 5th and 6th Pay Commission had submitted their reports but no revision had been recommended. After discussions, it was decided that the matter may be examined in consultation with Department of Expenditure.<br />
Action: DOP&amp;PW</p>
<p>(ii) Extension of CS (MA) Rules, 1944 to Central Government Pensioners residing in non-CGHS areas.<br />
The Staff Side demanded that as in the case of serving employees, the CS (MA) Rules may be extended to the pensioners also. This would make pensioners in the non CGHS areas entitled for reimbursement of medical expenses. Staff Side also mentioned that Honble Supreme Court has dismissed some SLPs and allowed reimbursement of medical examination of pensioners, in accordance with CS (MA) Rules.</p>
<p>The representative from Ministry of Health informed that the proposal for extension of CS (MA) Rules 1944 to Central Government pensioners was not agreed to in view of huge financial impliations. In regard to the dismissal oF SLP flied by Department against order of courts/tribunals for grant of medical benefits irn individual cases, Ministry of Health has flied a review petition in Supreme Court. It was also informed that Ministry of Health is contemplating Health Insurance Scheme on pan India basis keeping special focus on the non CHGS areas. This Is expected to solve the problems of pensioner’s living in non <a href="http://centralgovernmentnews.com/category/cghs/">CGHS </a>areas. The item was treated as closed.</p>
<p>(iii) Grant of modified parity with reference to the Revised Pay Scale corresponding to pre revised Pay Scale of the post from which an employee had retired — upgraded pay scale Instead of normal replacement scales.</p>
<p>The JCM suggested that upgraded revised pay scales may be notionally extended and used for pension fixation instead of normal replacement scales.</p>
<p>It was informed that after the 5th Pay Commission also modified parity was allowed with reference to replacement pay scales and not with the upgraded pay scales. This decision of Government was also upheld by Supreme Court in its judgement dated 23.11.2006 in the CA No. 3173-3174/2006 &amp; 3188-3190/2006 (K. S. Krishna Swamy Vs. UOI). In the <a href="http://centralgovernmentnews.com/category/6cpc/">6th CPC</a> the same principle has been followed in view of the above. It was informed that it would not be possible to reopen this issue.Therefore, the Ítem may be closed.</p>

<div>Department of Personnel and Training has now published the official minutes of 4th meeting of the National Anomaly Committee held on 5th January, 2012. We have reproduced the full text of the minutes and given below for your ready reference&#8230;</div>

</strong> <strong>Summary Record of Discussions of the 4th meeting of the National Anomaly Committee held on 5.1.2012</strong></div>
<div></div>
<div>The 4th meeting of the National Anomaly Committee was held on 5.1.2012 at 2.30 PM at New Delhi. The meeting was chaired by <strong>Shri R C Misra, Secretary DOP&amp;T</strong>.</div>
<div></div>
<div>The Chairman welcomed all members of Official and Staff Side and expressed the hope that the Committee will be able to resolve the issues through a collaborative process. The Leader of Staff Side in his introductory remarks desired that the issues relating to increasing the frequency of the meetings of the National Council and other fora; increment for those whose date of increment fell between February 2006 to June 2006, benefit of MACP for Loco Drivers should be resolved on a priority basis.</div>

<div><strong>The following agenda items were then discussed.</strong></div>
<div></div>
<div><strong>Items No. 1 to 4 &amp; 5 (iii) &#8211; Anomaly in fixation of pay band in case of merger of pay scales</strong>.</div>
<div>The Staff Side reiterated that since the pre-revised scales 5000-8000 [S9] 5500-9000 [S10]; 6500-9500[S11]; and 6500-10500[ S12] were merged the commencement point of the Pay Band 2 should be at Rs.12090/- based on the minimum of  S12  scale [6500 x 1.86 = 12090] instead of Rs.9300/- computed by multiplying Rs.5000/- by 1.86. The Official Side however insisted that what has been done is in line with the recommendation of the 6th CPC as well as the fitment tables which are also contained in the report itself.</div>
<div><strong>It was decided that this item may be further discussed in the next meeting.</strong></div>
<div></div>
<div><strong>Item No 5 (i) and 34 &amp; 35 &#8211; Reopening of the option for fixation of pay on promotion.</strong></div>
<div>The Staff Side stated that the orders for giving the option up to 31.12.2010 was received late in the lowest formations and therefore, all the employees could not exercise the option, before the stipulated date. A demand for extending this date beyond 31.12.2010 was hence raised.</div>
<div>The Official Side stated that this item already stands closed but if there are still any pending issues in this regard these could be referred on a file to DOPT, which would consider the same and take a decision thereafter in consultation with Department of Expenditure.</div>

<div><strong>Item No. 5 (iii) &#8211; Special Allowance &amp; Qualifying Pay.</strong></div>
<div>The Staff Side pointed out that although the special qualifying pay is treated as an allowance, it is counted as pay for purpose of fixation of pay on promotion to higher post. The result is that senior employees who have been promoted during the period 1.1.2006 to 31.8.2008 get the benefit of pre- revised qualification pay when they have been promoted whereas the junior employees promoted on or after 1.9.2008 have been granted the benefit of double qualification pay and therefore the pay of the seniors is getting fixed at a lower stage as compared to their junior counterparts resulting in an anomaly.</div>
<div><strong>The Official Side agreed to look into this matter</strong>.</div>
<div></div>
<div><strong>Item No.5 (iv) &#8211; Anomaly in fixation of pay between Direct Recruits &amp; Promotees.</strong></div>
<div>The Staff Side pointed out that in terms of FR 22 the pay of no person who is promoted should be fixed below the minimum of the Pay Scale of the higher post and as the system of Pay Bands have been introduced by clubbing several posts, the 6th CPC has devised a formula for fixing the entry pay (which is always the minimum) for fresh recruits. That being the case, the pay of all the promotees should also be fixed not below the said minimum i.e. the entry pay of the fresh recruit for each grade pay.</div>
<div>The Official Side explained that in such cases if an anomaly arises then the stepping up of the pay of the promotees is allowed subject to fulfilment of certain conditions. However, if certain difficulties persist in this regard, they could be referred to DoPT for consideration.</div>
<div>The Staff Side however insisted that all the conditionalities imposed while stepping up pay may be withdrawn and that the pay of all the promotees may be fixed at the entry level of that post as in the case of the direct recruit. This should be permissible in those posts where there is an element of direct recruitment in that post irrespective of any new recruit having joined the post or not The Official Side agreed to reconsider the points raised by the Staff Side.<br />
<strong>It was decided that the matter shall be discussed in the next meeting.</strong></div>
<div></div>
<div><strong>Item No (v) &#8211; Date of Next Increment.</strong></div>
<div>The Staff Side urged for grant of one increment in pre revised pay scale on 1.1.2006 as a onetime measure in respect of all those employees whose next increment fell between 1.2.2006 to 30.6.2006 and then re-fixing them in the revised pay band so as to grant next increment on 1.7.2006. The Official Side requested that the Staff Side should confirm that their request for grant of an increment in the pre-revised scale would not have repercussions on any other category and not lead to any further demands. The Staff Side confirmed that this was only a one-time measure and would not result in either raising of other demands or have repercussions on any other category of employees.</div>
<div>The Official Side stated that they will consider this issue positively.</div>
<div><em>(Necessary Orders have since been issued by DoExpdr dt 19.03.2012)</em></div>
<div></div>
<div><strong>Item No 5 (vii) &#8211; Temporary Status Casual Labourers</strong>.</div>
<div>The Staff Side pointed out that as per the Scheme of Temporary Status, these employees have been granted the pre-revised minimum of Rs.2550-3200 applicable to the lowest post with the benefit of annual increment etc. Therefore in so far as the pay scale is concerned they are being treated as regular employees. However, they should be granted the Grade Pay of Rs.1800 and fixed at Pay Band I with effect from 1.1.2006 if they are already matriculates and if they do not meet this basic qualification they should be given the training and then fixed at Pay Band I with grade pay of Rs.1800</div>
<div>w.e.f. 1.1.2006. The Official Side noted this demand and assured consideration of the same.</div>

<div></div>
<div><strong>Item No.11 &#8211; Grant of Revised Allowance w.e.f. 1.1.2006.</strong></div>
<div>The demand of the Staff Side was that allowances formed part of wages and thus should be revised with effect from the same date from which the revised pay scales have been implemented i.e. 01.01.2006. The Official Side stated that the allowances, other than Dearness Allowance (DA), have been revised w.e.f. 01.09.2008 on the basis of specific recommendations of the 6th CPC. It was also mentioned that even in regard to 5th CPC recommendations similar practice was followed. Therefore, there was no anomaly as such.</div>
<div></div>
<div><strong>Item No 12 &amp; 13 &#8211; Transport Allowance.</strong></div>
<div>The Staff Side pointed out that the calculations desired by the Official Side are already available under item no. 13. It was pointed out that Transport Allowance at the rate of Rs. 3200 granted to those in PB-3 of grade pay Rs•5400/-  and above is 2.9 times of their pre-revised TA+CCA which was Rsatoo. The Transport Allowance in respect of Grade Pay of Rs.46o0/- and 4200/- has been revised to Rs.1600/- which is only 2.28 times of the pre- revised TA+CCA amounting to Rs.700/-.</p>
<p>The Staff Side demanded that the raise granted in respect of grade pay of Rs.4600/- and Rs 4200/- should also be 2.9.times of Rs.700/- which would work out to Rs.20307-. The Official Side stated that this is a new demand and cannot be treated as an anomaly. The Staff Side then stated that this item would be taken up in the National Council</p></div>
<div></div>
<div><strong>Item No.14 &#8211; Revision of the existing allowance which are to be replaced by new schemes.</strong></div>
<div>Reference was made to minutes of the 3rd meeting of National Anomaly Committee held on 15th February  2011 where under item No 14 it was stated that if within six months the new schemes are not finalized and introduced, the rates of the allowance like Risk Allowance &amp; Patient Care Allowance would be doubled. The Official Side agreed to take a decision in this matter within a month&#8217;s time.</div>
<div></div>
<div><strong>Item No.15, 16, 17 &#8211; Parity in pension.</strong></div>
<div>The contention of the Staff Side was that the pension of the pre-2006 retirees is fixed in terms of different set of rules as compared to those who retired on and after 1.1.2006 which results in pension at a lower rate for pre- 2006 retirees as compared to those who are in identical pay scale and at the same stage of pay but retiring on or after 1.1.2006. Reference was made by them to the 6th CPC recommendations which stated that pension will be subject to the provision that revised pension, in no case, shall be lower than 50% of the sum of the minimum pay in the pay band and the grade pay thereon corresponding to the pre-revised pay scale from which the pensioner had retired. This recommendation was accepted by the Government vide para.  4.2 of O.M.No.38/37/08-P&amp;PW (A) dated 1.9.2008 which reads as follows:</p>
<p><strong><em>&#8220;The fixation of pension will be subject to the provision that the revised pension, in no case, shall be lower than fifty percent of the minimum of the pay in the pay band plus the grade pay corresponding to the pre-revised pay scale from which the pensioner had retired. In the case of HAG+ and above scales, this will be fifty percent of the minimum of the revised pay scale.&#8221;</em></strong></div>
<div>The Government of India vide their OM. No.38/37/08 P&amp;PW (A) Pt I dated 3.10.2008 and OM F No. 38/37/08-P&amp; PW (A) dated 11.2.2009 clarified that the pension calculated at 50% of the minimum of the Pay in the pay band plus grade pay would be calculated at the minimum of the pay in the pay band (irrespective of the pre-revised scale of pay) plus the grade pay corresponding to the pre-revised pay scale. The Staff Side contended that by qualifying the term &#8221; minimum pay in the pay band&#8221; by the clause &#8220;irrespective of prerevised scale of pay&#8221; the 50% of pay in the pay band has been brought down to the minimum of the lowest pay scale in the pay band. In other words minimum pay in the Pay Band of PB 1 has been fixed at Rs.5200/- in respect of all the pay scales of that Pay Band. In PB  2, such a minimum has been fixed at Rs.9300/- in respect of pay scales of that Pay Band.</div>
<div>The Staff Side pointed out that the clarificatory OM dated 3.10.2008 and dated 11.02.2009 have been quashed and set aside in the latest judgment of full Bench of Principal Bench of Central Administrative Tribunal on these issues. The Official Side stated that the Judgment was under consideration and decision would be taken soon.</div>
<div></div>
<div><strong>Item No. 24, 25, 26 &#8211; Commutation of pension.</strong></div>
<div>The Staff Side demanded that option of commutation is given when a person retires and that the commutation should be allowed in terms of pension fixed at that time on the basis of pre-revised pay etc on the day following the date of retirement in terms of the Table then in force. In view of this if as a result of revision of pay the issue of additional amount of commutation arose, the commutation-table which was applicable on date of retirement needs to be adopted. The New Commutation-Table which has come into force on or after 1.9.2008 cannot be made applicable to determine</div>
<div>additional commutation value since the new Table was not in existence on the date of retirement.</div>
<div>The Official Side stated that for commutation purposes New Commutation-Table will have to be applied and this was based on the recommendations of the 6th CPC. Therefore, this cannot be construed as an anomaly.</div>
<div><strong>The Official Side deferred this item for the next meeting.</strong></div>
<div></div>
<div><strong>Modified Assured Career Progression Scheme</strong></div>
<div></div>
<div>It was demanded by Staff Side that the stage of Rs.2000/- and Rs.4600/- in Grade Pay hierarchy may be ignored for the purpose of MACP. Official Side stated that in the Joint Committee on MACP it was decided that there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. The Official Side had since written to the Ministries of Railways, Defence, Urban Development, Home and the Department of Posts to elicit information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme and the Staff Side was also requested to collect and forward such information to the Department of Personnel &amp; Training for further necessary action.</p>
<p>The Official Side pointed out that though DoPT had written to the concerned Ministries, no Ministry/Department other than Ministry of Urban Development had responded. Ministry of Defence representative stated that they have since sent the cases of specific problems on MACP. The Leader of Staff Side raised the issue relating to Loco Pilots/Drivers in Ministry of Railways. These employees are in the same grade pay and thus they are not getting any benefit of MACP.</p></div>
<div><strong>The Official Side assured that such cases could be specifically looked into and where seniors were getting less pay than juniors after availing of benefit of ACPS/MACPS, stepping up of pay could be considered.</strong></div>

<div><strong>Miscellaneous</strong></div>
<div>Following issues which were not part of the Agenda of the 4th meeting of the NAC were also raised by some of the Staff Side members.</div>
<div></div>
<div>a) Reference was made to minutes of the 3rd meeting of National Anomaly Committee held on 15th February  2011  where, under item No 28, relating to Grant of grade pay of Rs.5400 in PB-2 for Assn. Accounts/Audit Officers, it was decided that since this matter pertains to Group B employees who are not covered under the JCM Scheme, the item did not fall within the purview of the NAC. However, it was decided that Joint Secretary (Pers.), Department of Expenditure and Joint Secretary (Estt.), Department of Personnel &amp; Training will discuss this issue with the members of the Staff Side This was noted by the Official Side.</div>

<div>b) The issue relating to doubling of Daily Allowance on Tour was also raised; and the Staff Side insisted that rates of daily allowance may be doubled if the present system of reimbursement on the basis of actual expenditure on conveyance, boarding and lodging etc. are not suitable / practicable in the case of employees who go on tour to places where there are no hotels / restaurants and the Auto drivers do not issue the receipts. It was pointed out that this was not an Item under discussion in the Agenda.</div>

<div>c) The issue of Child Care Leave to female civilian industrial employees in defence establishments was also raised and the Staff Side mentioned that this benefit has been given from  20.10.2011  even though it should be given from 1.9.2008 as in the case of female civilian government employees. The Official Side pointed out that reference from Ministry of Defence in this case was not on record.</div>
<div><strong><em>On account of time constraint, this meeting of the NAC was adjourned thereafter with the decision that another such meeting will be held shortly to discuss the remaining items</em></strong>.</div>

We have already placed a gist of discussions and decision of the 4th National anomaly Committee meeting held today on agenda items that came up for consideration. &nbsp;The Staff Side of the National Council met on 16th. &nbsp;The issue of the non functioning of the JCM at the Departmental level and the ineffectiveness of the council meetings wherever it meets were the subject matter of serious discussions at the Staff Side. &nbsp;The last meeting of the National Council was held in 2010. &nbsp;The non acceptance of the arbitration awards, the inordinate delay in taking final view of items introduced as agenda by the official side and the non issuance of orders on agreed items, the refusal to record disagreement and refusal to refer the issue to arbitration etc. were raised by the members of the Staff Side. &nbsp;It was therefore, decided that this issue should be taken up seriously by the leader and Secretary in their initial remark at the NAC meeting and should elicit concrete response from the official side.</div>

Accordingly the Leader, Com. Raghaviah and Com. Umraomal Purohit, Leader and Secretary, Staff Side in their opening remakrs made a strong presentation of this issue and conveyed the growing resentment of the employees. &nbsp;Both the Secretary General and President supplemented this presentation with further information and conveyed to the official side that while the non functioning of the Departmental Councils were restricted to a few Ministries in the past, as at present, it has been spread to almost all Ministries barring Railways, Defence and to a small extent to the Postal Department.</div>

The Chairman, while responding to this complaint said that he would elicit the information &nbsp;from all Ministries/Departments as to when the last meeting of the Council was held, whether the Anomaly Committee had been constituted and if so what was the stage at which its deliberations are and monitor its functioning effectively and take up the grievance expressed by the staff in this regard with the highest authority in the Government to ensure that the machinery is brought to effective functioning system.</div>
