<strong>Sub: Holding of National Convention of the National Council (JCM)(Staff Side)</strong></p>
<p>As you are aware, the Staff Side, JCM National Council had, as desired by the 7th CPC,<strong> submitted a separate memorandum on Interim Relief and Merger of DA, copy of which had also been sent to the Finance Ministry. During the Informal Discussions the Staff Side had with the Pay Commission, they had assured us to take up the issue with the Government seeking amendment to the Terms of Reference to enable them to act upon our memorandum.</strong><br />
We have received reply from the Finance Ministry, which is indicative of a refusal of both the demands. The NDA Government has adopted the same plea made by the UPA II Government to reject our demands. The 7th CPC have so far not communicated to us, the decision they have taken on our memorandum.</p>
<p>From the steps so far taken by the BJP Government, it is unambiguous that they would be pursuing the neo-liberal economic policies with much more intensity than even the UPA Government. Having got a clear majority in the Parliament, they would be able to push through necessary legislations to pursue reforms. The outsourcing of Railway functions, privatization of Defence manufacturing Units, increased FDI inflow in various core sectors of economy, dismantling of the administrative price mechanism, de-nationalization efforts in the Banking, Insurance and Coal Sectors and above all the adherence to New Contributory Pension Scheme are some of the bold anti worker steps taken by the new Government.</p>
<p>The matter of fact approach and urgency which was visible in the initial days of the 7th CPC appears to have vanished. It is a matter of pride for all of us that we could submit our final memorandum on common issues to the Commission within the stipulated time frame. We are also happy to note that almost all service organizations of Central Government employees have endorsed our formulations on the wage structure and other service benefits. It is also a fact that all these organizations have submitted their memoranda on department-specific issues before 31st July, 2014. Despite having received such large number of memoranda, the 7thCPC has so far not commenced taking oral evidence giving an indubitable impression that the Commission might not be able to submit its report within the stipulated time of 18 months.</p>
<p>All these issues came up for the consideration of the members of the Staff side when they met a few days back. The unanimous opinion was to pursue the issues through organizational methods. Accordingly, it was decided to hold a National Convention, eliciting the participation of the representatives of all Service organizations participating in the JCM to discuss the emerging situation and decide upon future course of action. Incidentally, we must mention that the JCM conceived as a negotiating forum has been made ineffective by the Government over the years by not convening its meetings periodically.</p>
<p>The National Convention will be held at MPCU Shah Auditorium, Sree Gurjarathi Samaj, Raj Niwas Road, Civil Lines(Opposite Civil Lines Metro Station), Delhi, on 11th December, 2014. The Convention will commence at 12 Noon and will be concluded by 4.00 PM. 740 delegates will participate in the convention, of which 370 shall be Railwaymen(AIRF and NFIR), 150 will be Defence Civilian employees (AIDEF and INDWF) and the rest 220 will be represented by other Central Government employees (Confederation of Central Government employees and workers). The participating organizations will issue separate circular letter indicating the number of delegates of each Branch/Unit, Divisions/Zones, Circles/States, and affiliates may deploy to the Convention.</p>
<p>The Staff side will meet again to finalize the draft declaration to be placed before the Convention for discussion and adoption. The date and venue of the meeting will be intimated in due course.</p>

<p>Dear Comrades,</p>
<p>We send herewith copy of the letter from the Secretary, Staff Side, JCM intimating of the decision taken by the Staff Side to hold a National Convention at New Delhi on 11th December, 2014. We have already placed the said letter in our website. The decision is the outcome of the efforts the Confederation representatives in the Staff Side of the National council and must be considered a step in the justify direction in pursuance of the Charter of demands, especially the important issues like<strong> wage revision, interim relief, merger of DA, scrapping of the new Pension scheme, privatization, outsourcing</strong> etc. As indicated in the letter of the Staff side Secretary, the staff side is likely to meet in the second fortnight of November, 2014 to finalize the draft declaration and the programme of action. We shall place the draft declaration on our website as and when the same is finalized.</p>
<p>Confederation is entitled to deploy 220 delegates to participate in the convention. We have decided to invite the Confederation of Central Government officers organizations also to participate in the convention. The quota of delegation for the major affiliates and State Committees are indicated in the table given below. All other affiliates and State Committee may deploy three delegates (each) to participate in the convention. The Convention is being held at MPCU Shah Auditorium, Sree Gurjarathi Samaj, Raj Niwas Road, Civil Lines(Opposite Civil Lines Metro Station), Delhi, The Convention will commence at 12 Noon and will be concluded by 4.00 PM on 11th December, 2014.</p>
<p>The timings have been so arranged to enable the comrades to reach in the morning of 11th and if necessary to return on the same day. The delegates are requested to make their own arrangements for stay etc,if they wish to be at Delhi earlier or later of the day of the convention. The venue is well connected by Metro Line and from the Civil Lines Station, it is walkable distance only. Kindly ensure that the tickets for onward and return journey for the participating delegates are booked well in advance.</p>

										<content:encoded><![CDATA[<p><strong>Confederation publishes the resolution adopted at the National Convention of Central Government employees</strong></p>
<p><strong>RESOLUTION</strong> adopted at the National Convention of Central Government employees on 4th April, 2014 at Nagpur.</p>
<p>1. The National Secretariat of the Confederation places on record its appreciation over the massive and magnificent participation of the largest number of our members in the 48 hour strike on 12th and 13th Feb. 2014. It was a great manifestation of the confidence the members had reposed in the organization and their determination to win the demands through struggles. The reports, the Confederation CHQ received both from the affiliates and the State Committee indicate the massive participation of the employees in the strike action throughout the county. In some of the affiliates, the participation had been cent percent. This must embolden the Confederation to pursue the issue with determination and organize further action programmes to ensure that the demands are got settled.</p>
<p>2. The Secretariat has noted that the Government had pretended to ignore the massive action of the employees. There had been no response from them so far. In the wake of the strike action, it announced the composition of the 7th CPC disregarding the united demand raised by the Staff side of the JCM National Council for the inclusion of a labour representative. The Government also chose not to convene the meeting the staff side to discuss the draft terms of reference submitted. It did not make any <strong>announcement on the question of merger of DA, Interim Relief, and inclusion of GDA</strong> within the ambit of the Commission and rejected the demand for making the recommendation of the Commission effective from 1.1.2014.</p>
<p>3. On every issue, which is included in the 15 point Charter of demands, the Govt. continued with its nugatory attitude. In the last session of the Parliament, they ensured that the PFRDA bill becomes an Act despite the strongest objection and resistance of the employees by eliciting and receiving the support and patronage of the dominant opposition party, the BJP. Even on an issue like compassionate appointments, no positive response emerged. The period witnessed increased outsourcing of governmental functions. Almost a third of the workforce is presently casual and contract workers with abysmally poor wages taking advantage of the acute unemployment situation in the country. There had been no settlement of any issue raised by the Staff Side in the National Council JCM. <strong>The JCM scheme has been made ineffective as not a single meeting of the Council was held in the last three years</strong> and even the decision taken at the National Anomaly Committee was thwarted through political intervention.</p>
<p>4. The plight of the three lakh Gramin Dak Sevaks of the Postal Department is highly deplorable. They constitute almost half of the Postal work force. But for them, the functioning of the Postal system will come to a grinding halt. Their service conditions are presently worse off than even a causal/daily rated worker. Despite the Supreme Court’s decisions that they are holders of Civil Post and consequently are entitled to the benefits and privileges of a civil servant, there had been no improvement in their service conditions worth mentioning. In spite of repeated presentation of their case both inside and outside the Parliament by people from all walks of life irrespective of party affiliation, the Government had been silent to the pleading for bringing them within the ambit of the Pay Commissions. <strong>Confederation is duty bound and determined to change the situation and to bring them within the purview of the 7th CPC.</strong></p>
<p>5. During its five year tenure the UPA II was in power, it intensified the neo-liberal reforms; phased out all welfare measures; accentuated the unemployment situation; divested the PSUs; allowed unbridled entry of Foreign capital to subjugate the Indian people; ruined the indigenous industry; destroyed the livelihood of the farmers and agricultural labourers; allowed the prices of all essential food items to soar; privatised education and health care services; ensured that each of its decision was to favour the rich; granted huge tax concessions to the corporate; indulged in large scale corruption; squandered away the national wealth; siphoned off the poor man’s earning into the hands of a few rich in the country; sided with the entrepreneurs in all labour disputes; took each and every political decision to sub-serve the interest of the imperialist powers especially the USA. The pursuance of the neo liberal policies at the behest of the advanced capitalist countries drove the majority of Indian population to be below the poverty levels. In the comity of nations, India became the poorest and the last ranking in all fields. <strong>Indian youth were driven to be beggars at the doors of transnational corporations and developed countries.</strong></p>
<p>6. Those who were responsible in driving our country men to unprecedented deprivation have to now seek mandate, for their tenure is to end shortly. No different is the approach of the major opposition party, BJP. There is nothing to choose from these two political dispensations. They were hand in glove together to demolish the sovereignty of the country; pauperisation of the people and supported every legislation to intensify the neo liberal exploitation of the common man. They supported to the hilt the corporate houses. But for the support extended by the BJP, the PFRDA bill would never have been made into a law. The Act now provides for the extension of the new contributory pension scheme to those who were recruited prior to 1.1.2004 and the existing pensioners. Despite the refusal of the Government to accept their suggestion to guarantee minimum pension, the BJP unashamedly supported the Bill, for they were the proponents of the neo liberal economic policies. They supported this Government to increase the FDI and FII in all sectors of economy and announced that they would intensify the reform process if elected to power. The conglomeration of Corporates in the country has now appointed the leader of that party to be the next CEO to run the country. They have no use for the discredited UPA howsoever subservient it could be. They know in a democratic system demagogy can play a vital role. They are certain that BJP and its allies if elected to power will be much more pliant and compliant.</p>
<p>7. The Corporate controlled media has created an illusion to the effect that there exists a consensus across the political spectrum in the country that the neo liberal policies will spur economic growth and the only point to be clinched in the forthcoming election is as to which political combination, whether the UPA led by Rahul Gandhi or the NDA of Narendra Modi is more efficient in pursuing the IMF dictated economic policies vigorously. Economic growth is not akin to development. In the initial years of the introduction of the LPG, no doubt, the economy grew phenomenally, but the large majority of Indian people suffered. It permanently halted the bringing up of an egalitarian society. It only enlarged the scope for maximisation of profit of the corporate giants; opened up larger and bigger avenues for corruption at the top of administration, whereby the ruling party and its leaders could amass wealth. The scams unearthed by the Comptroller and Auditor General of India during the last five years of UPA II Rule speak volumes of the cancerous growth of corruption in our country. The 2G spectrum involving Rs. 1.76 lakh crores, the Coalgate of the dimension of Rs. 1.86 lakh crores, the corruption involved in the commonwealth games, the Rs. 40,000 cr deal in the Delhi Airport Privatisation scheme, The KG Basin related Gas price deal with Reliance, topping with Rs 48 lakh crores are a few that surfaced during this period.</p>
<p>8. As part of the economic policy, concerted and continuous efforts were made to the job killing process in all sectors, through contractorisation, casualisation, outsourcing, privatisation etc. Contract workers now constitute 80% of the total work force in the private sector. After the implementation of the 6th CPC recommendations about 35% of the workforce in the Governmental sector is either contract or casual workers. <strong>They are paid quarter of or even less the wages of the regular workers.</strong></p>
<p>9. This election is not only to decide who should govern this country but more so to determine for whom the governance is. UPA having been totally discredited in the eyes of the common man has no chance whatsoever. NDA must not have a chance once again for it is bound to pursue the neo liberal policies more vigorously than even the UPA. That is the one and only reason why the Indian corporate houses and the corporate controlled media solidly back the BJP and the BJP led NDA. The Political combination outside the NDA and UPA has a predominant presence in the 15th Lok Sabha. They are capable of being the largest segment in the 16th Lok Sabha too.</p>
<p>10. It is in this background that the workers must assess the political situation. In the forthcoming electoral battle, every worker must discharge his salutary responsibility. Since the present state of affairs is the product of the neo- liberal policies and since both the UPA and the NDA are the proponents of those policies, one must have clear vision and exercise the franchise effectively to ensure that a pro-worker, pro-people combination of parties is in governance. In the forthcoming election to the 16th Lok Sabha, the Central Government employees must become a vehicle for change in the interest of the common people; rise above the divisive ideologies and misleading propaganda; identify their friends especially in the Left parties; and ensure the success of those who stood with them and fought for the cause of the workers and common people.</p>
<p>11. The Secretariat came to the inescapable conclusion that the settlement of the demands in the charter will only be possible through intensification of the struggles. It recognised the need for larger unity. It will strive for bringing about such a united platform for joint action. The inevitability of an indefinite strike action has to be emphasised. The Confederation and its affiliates must prepare its members for such an eventual and unavoidable action, if the proposed 7th CPC is to really revise the wages. It is needed to ensure the withdrawal of the pernicious contributory pension scheme. It only will ensure that there are no casual or contract system of employment in Government service. The Government employees must be bestowed with democratic rights and above all must enjoy the facility for collective bargaining and right to strike. The Gramin Dak Sevak system is a colonial legacy and no civilised country must endure such brutal exploitation. All is possible through united and sustained action. The Confederation has proved beyond any iota of doubt that it has built up an organisation capable of carrying out such an action.</p>
<p>12. To ensure that the Indian people have food security, the farmers are not driven to commit suicide, the workers do have decent job environment and emoluments, the prices of essential commodities do not soar, there is universal public distribution of essential food articles; India has an independent foreign policy, this great Nation is not enslaved by western imperial powers once again, all communities and people of different faiths are allowed to live in peace and harmony; no communal violence erupts; all able bodied people have jobs and livelihood, there must be a Government which exist for the sake of the poor inhabitants of this country. Central Government employees must take an active role in the ensuing General election and strive with their best to bring about such a Government.</p>
<p>13. This convention calls upon every worker of the Confederation to fan out and reach out to the rank and file of its membership, explain the stupendous task ahead; to work in consonance with the understanding depicted in this resolution and ensure that they become instruments for a great political change in our country.</p>
<p>14. The Convention authorises the National Secretariat to review the political situation emerging after the election and take appropriate decision to mobilise the rank and file of the workers for an eventual industrial action to seek settlement of the 15 point charter of demands.</p>

<strong>CENTRAL TRADE UNIONS HELD NATIONAL WORKERS CONVENTION AT NEW DELHI ON 06TH AUGUST 2013</strong></p>
<p>A massive National convention of all Central Trade Unions, Central and State Government Employees &amp;; Teachers Federations and Public Sector employees Unions etc was held at Mavlankar Hall New Delhi on 6th August 2013. The convention was addressed by the leaders of <strong>BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF</strong>. Presidium consisted of the leaders of all the above Central Trade Unions. The resolution adopted by the National convention called upon the workers to organize following.</p>
<p>1. Demonstration/Rallies/Satyagraha at all state capitals with respective statewide mobilization on 25th September 2013</p>
<p>2. Massive Demonstration before Parliament with main mobilization from neighbouring states on 12th December, 2013</p>
<p>3. On the same day of Demonstration before Parliament (12th December 2013), District-level Demonstrations at all District Headquarters all over the country.</p>
<p>4.  Sectoral programme of joint actions for effectively opposing Restructuring, Outsourcing etc. and on sector-specific issues/demands and against Divestment of shares in Pubic Sector Enterprises.</p>
<p>5.  Exclusive Joint Action Programmes on the demand of Minimum Wage and Contract Workers related other demands.</p>

<div align="justify">This National Convention of Workers held on <strong>4th September, 2012 at Talkatora Stadium. New Delhi</strong>, participated by workers representatives from all over India from all sectors, expresses its deep concern and anguish at the total non-response of the Govt. to address the burning Issues of the working people viz containing price-rise, universalisation of social security rights for unorganized sector workers, ensuring proper minimum wages, mass scale contractorisation, rampant violation of labour laws and onslaught on trade union rights etc., despite consistent persuasion by all in united platform of the entire trade union movement in the country through various forms of countrywide programmes and agitations in a democratic manner since last three years. Such non-response of Govt. to the all-in-united activities and persuasion by trade unions is nothing but an affront on the democratic rights and aspirations of the working people of the country, which the trade union movement cannot accept lying down.</div>
<div align="justify">
<a name="more"></a></div>
<div align="justify">While condemning the government for Its inaction and total indifference towards the miserable plights of the working people who keep the wheel of the economy moving, this National Convention strongly opposes the move of the Govt. to curtail budgeted allocations for pro-people employment and welfare schemes like NREGA and ICDS meant for rural populace and women and child care respectively. The Govt. is hell bent upon carrying the financial reforms by amending the bank and insurance laws to allow entry of MNCs and Corporates in these vital sectors and also pushing through the privatization process in phases through disinvestment of shares in blue chip PSUs In the core and strategic sectors of the economy. The Govt. is gifting natural and mineral resources of the country to corporates and MNCs paving the way for their loot.</div>
<div align="justify">Labour law violations are on increase, corporates have been given tree hand to suppress democratic trade union rights including the basic right of forming a trade union and increase in deployment of contract labour on jobs of regular nature. Many millions of workers employed to run several central govt. schemes, like ICDS, ASHA, mid-day-meal, sarva-silksha etc are being denied even the statutory minimum wages and associated rights. The state administration has become subservient to MNCs, and Corporates. The recent unfortunate incident in Maruti Suzuki Plant in Manesar and its aftermath including arrest of 150 workers and dismissal of over 500 workers is a glaring instance of corporate govt. nexus.</div>
<div align="justify"></div>
<div align="justify">It appears the govt. is bent upon continuing the same anti people economic policy even seeking to enact legislations that run contrary to the interest of working people and their social security rights besides generating a severe recessionary impact on the national economy. The growth of economy is as low as 5.2 and index of industrial production declining to less than 1 percent with unemployment situation aggravating severely.</div>
<div align="justify"></div>
<div align="justify">The Convention expresses its deep concern at the refusal of the Central Govt. to respond to the just demands of the united platform of trade unions on which the country had witnessed, as never before, a massive general strike on 28th February 2012.</div>
<div align="justify"></div>
<div align="justify">This Convention while taking note of the precarious economic situation of the country, steep rise in the price of essential goods and commodities and all out attack on trade union aid social security rights and rampant labour law violations decides to further intensify the joint struggles, that were being carried out lot last three years on the following demands.</div>
<div align="justify"></div>
<div align="justify">While reiterating the live point demands formulated jointly by the Central Trade Unions and Federations for 1) concrete measures to contain price rise, 2) concrete measures for employment generation, 3) strict enforcement of labour laws, 4) universal social security cover for organized and unorganized workers and creation of National Social Security Fund and 5) stoppage of disinvestment in Central and State PSUs/ Undertakings, the National Convention demands immediate action by the Govt. of India to ensure :-</div>
<ul>
<li>No Contractorisation of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry/establishment</li>
<li>Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs.10,000/- linked with cost price Index.</li>
<li>Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.</li>
<li>Assured Pension for all</li>
<li>Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions Nos. 87 and 98.</li>
</ul>
<p>The National Convention adopts the following action programme to press for once again the above burning issues facing the working people:</p>
<p>Programme:</p>
<ol>
<li>Stated / district / sector level Joint Conventions during September, October and November 2012</li>
<li>Satyagraha /Jail Bharo / Court Arrest on 18th / I9th December2012 in all the states through out the country</li>
<li>March to Parliament on 20th December2012 (mobilization by the unions from the states adjoining Delhi)</li>
<li>Countrywide Two Days General Strike on 20th and 21st February 2013.</li>
</ol>
<p>The National Convention appeals to the working people of the country and their unions/federations irrespective of affiliations to respond in a massive way the call for countrywide united struggle and participate enmasse in the action programmes formulated by this all-in united platform of workers and employees to press for these vital demands embracing all sections of the toiling class.</p>
