I am directed to refer to Ministry of Personnel, PG & Pensions O.M. No. 4/3/2017-estt (Pay-I) dated 26th Oct 2018 on the above subject. The provisions of the said letter will mutatis-mutandis be applicable to Armed Forces Personnel.

2. This letter issues with concurrence of Defence (Finance) vide their Dy. No. 1(8)/2020-AG/ PA/140 dated 19th November, 2020.

Subject: Coverage under Railway Services (Pension) Rules, 1993, in place of National Pension System, of those Railway employees whose selection for appointment was finalized before 01.01.2004 but who joined Railway service on or after 01.01.2004.

A copy of Department of Pension & Pensioners’ Welfare (DOP&PW’s) O.M. No. 57/04/2019-P&PW(B) dated 171 h February, 2020 is enclosed herewith for compliance and guidance. These instructions shall apply mutatis mutandis on the Railways also. Central Civil Services (Pension) Rules, 1972 correspond to the Railway Services (Pension) Rules, 1993. The Department of Economic Affairs, Ministry of Finance’s Notification No. 5n/2003-ECB &PR dated 22.12.2003, mentioned in the DOP&PW’s O.M. dated 17.02.2020, has been circulated on Railways vide this office’s letter No. F(E)III/2003/PN 1/24 dated 31.12.2003.

Similar to the amendments made in the Central Civil Services (Pension) Rules, 1972 and other connected rules, as mentioned in para 1 of the DOP&PW’s O.M. dated 17.02.2020, the Railway Services (Pension) Rules, 1993 and other connected rules were also amended vide Notification No. F(E)III/ 2003/PN1/38 dated 30.12.2003.

NPS: Additional benefit on death/disability of Government servant covered by NPS

Further, separate instructions with respect to para 9 of the DOP&PW’s O.M. dated 17.02.2020 will be issued by the Accounts Directorate for accountal of the corpus available in the NPS account of the railway servant.

Provisions relating to Reservations

The instructions issued by Government on India under Article 16 (4) and 16 (4A) of the Constitution are, mutatis mutandis, followed by the Public Sector Undertakings (PSUs), Financial Institutions including the Public Sector Banks under the Central Government. Implementation of the reservation provisions are insisted upon as a pre-condition to receive grants-in-aid by the voluntary organizations, autonomous bodies/institutions etc. where:-

• the recipient body employs more than 20 persons on a regular basis and at least 50% of its recurring expenditure is met from grants-in-aid from Central Government; and
• the body is registered society of a cooperative institution and is in receipt of a general purpose annual grants-in-aid of Rs. 2 lakhs and above from the Consolidated Fund of India.

Ministries/Departments have been directed to include suitable clause in the terms and conditions under which voluntary agencies / organizations etc. are given grants-in-aid by the Government for reservation for SCs/ STs/ OBCs in the posts and services under such organisations or agencies. It has further being provided that while sanctioning further grants, the progress made in employing SCs/ STs/ OBCs should be kept in view.

This information was provided by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh in written reply to a question in Lok Sabha today.

These instructions shall apply mutatis mutandis on the Railways also. The Ministry of Finance, Department of Expenditure’s O.M No. 1-6/2016-IC dated 07.09.2016, mentioned in the DOP&PW’s O.M. dated 21.12.2018 , has been adopted on Railways vide this office’s letter No. PC-VII/2016/RSRP/4 dated 22.09.2016 .

Subject: Grant of Advances Seventh Central Pay Commission recommendations – Amendment to rules on House Building Advance (HBA) to Railway servants.

Please refer to this Ministry’s letter of even number dated 05.12.2017 on the above cited subject(vide which, the revised provisions relating to the grant of House Building Advance (HBA) as issued by Ministry of Housing & Urban Affairs (Housing III Section) vide their OM No.1.17011/11(4)/2016-H-III dated 09.11.2017 pursuant to acceptance of 7th CPC recommendations, were mutatis-mutandis made applicable to Railway employees.

2. Ministry of Housing & Urban Affairs vide their OM dated 31.01.2018 (copy enclosed) have now issued clarifications to the fulfillment of extant conditions mentioned in para-2(viii) of their aforesaid OM dated 09.11.2017, which shall be applicable mutatis-mutandis on the Railways.

Subject: Extension of scope of Additional Relief on death/disability of Government Servants covered by the New Defined Contribution Pension System (NPS).

1 am directed to refer to the Department of Pension and Pensioner Welfare’s OM No. 38/41/06.P&PW(A) dated 05th May, 2009 (copy enclosed) regarding “Additional Relief on death/disability of Government Servants covered by the New Defined Contribution Pension System(NPS)”.

2. The applicability of the provisions of the aforesaid OM regarding grant of Additional Relief on death/disability of members of All India Service who have joined Service on or after 01.01.2004 has been considered by this Department and it has been decided to make the provisions of the aforesaid Office Memorandum of Department of Pension and Pensioner Welfare regarding “Additional Relief on death/disability of Government Servants covered by the New Defined Contribution Pension System(NPS)” applicable, mutatis-mutandis, to the All India Service Pensioners/family of All India Service officers who have joined Service on or after
01.01.2004.

Subject: Revision of pension of pre-2006 pensioners of All India Services – delinking the pension from qualifying service of 33 years.

Sir,
I am directed to refer to the above mention subject and to say that in compliance of the judicial pronouncement, the Department of Pension & Pensioners vide its O.M. No. 38/37/08-P&PW(A) dated 06/04/2016 has decided that the pension of pre-2006 pensioners, in no case, shall be lower than 50% of corresponding scale in the fitment table delinking the pension from qualifying service of 33 years and the same is to be revised w.e.f. 0`1.01.2006. The applicability of the provisions of the aforesaid O.M. dated 06/04/2016 to All India Services pensioners of pre-2006 has been considered by this Department and it is decided that provisions of the aforesaid O.M. of Department of Pension & Pensioners Welfare shall be applicable mutatis-mutandis to All India Service pensioners of pre-2006.
