<h2 class="wp-block-heading">Agenda Points for National Council JCM meeting</h2>



<ol class="wp-block-list"><li>Availability of option to switch over to <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a> pay scales after the date of Gazette Notification of CCS (PR) Rules 2016. If an employee gets Promotion/ Financial up-gradation after notification date i.e. 25th July 2016.</li><li>Night Duty Allowance should be paid to authorised category worker in Railway &amp; Defence without ceiling according to 7th CPC Pay Scales.</li><li>Trade union activities should be allowed in Hospitals/ Training Esttd./ Station HQ under Ministry of Defence.</li><li>Important Office Bearers of Registered Trade Unions should be granted the status of <strong>“Protected Workman”</strong> under the provision of the Industrial Dispute Act 1947 and Industrial dispute (Central) rules, 1957.</li><li><strong>“Head of Departments”</strong> should be empowered to decide the <strong>“ Hazardous Operations”</strong> for the purpose of Payment of “Risk allowance” in Min of Defence.</li><li>All the vacant posts in Group ‘B’, ‘C’ and erstwhile Group ‘D’ should be filled up without further delay.</li><li>CGEGIS benefits should be enhanced so that minimum insurance be enhanced to Rs 15 Lakh.</li><li>Medical Cashless facility should be extended to all the serving employees.</li><li>DOP&amp;T should clarify that promotion/up gradation granted under the ACP scheme in the post to those grades which now carry the same grade pay/ level due to merger of pay scale/ up-gradation of posts recommended by the 7th CPC shall be ignored for the purpose of granting up-gradation under MACP.</li><li>Grant of One Increment on the notional basis regarding the calculation of all pensionary benefits to the employees retiring on 30th June and whose DNI is 1st July.</li><li>Cadre review of MTS employees under Min of <a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">defence</a> for providing the opportunity of promotional avenues.</li><li>Govt has decided to Benchmark ‘Very Good’ for the purpose of MACP on the recommendation of 7th CPC. The decision has led to the exploitation of employees. Therefore the decision should be considered for MACP.</li><li>Employees should be given the option to Opt MACP whether from 01-01-2006 or 01-09-2008 whichever is more benefits to them.</li><li>All the employees should be granted the benefits of the old pension scheme viz CCS (pension) rules 1972 if their appointments are based on the vacancies notified prior to 01-01-2004 viz the date of implementations of National Pension System (Earlier Known as New Pension System). It is worth to mention here that various Hon’ble CATs/High Court have delivered Judgements in favour of likewise employees.</li><li>Govt is the largest litigant in this country. To reduce the litigation the benefits under Judgement pronounced in a matter should be extended to all similarly placed employees.</li><li>Correlation of hourly rate of industrial workers (Piece Worker) of OFB based on 7th CPC Pay Scale with the effect of 01/01/2016.</li><li>Scrap New Pension Scheme (NPS) and reintroduce the Old Pension Scheme CCS Pension Rule 1972.</li><li>5% recruitment quota should be enhanced for all dependents of deceased employees of Central Govt. and with the giving, one-time relaxation to all awaited dependents should be provided Job.</li><li>On the matter of Corporatisation of OFB under the working ministry of Defence should be reviewed and after restructuring these ordnance factories kept in the govt. entity.</li><li>The order of Corporatization to railway workshop returned back. The private sector should be kept out from the railway and the operation of the railway should be kept as a government entity so that the interest of economically weak citizens of India could be protected.</li><li>The decision of GOCO model of EME Base Workshop under MOD should be stopped and provide the workload to EME base workshop. Issue necessary orders to provide spare parts timely.</li><li>In various departments under MOD so many workers have been replaced and reverted on the behalf of restructuring, transferred employees are facing troubles in other places. Some institutions have been closed or merged. Therefore necessary action should be taken to stop these activities in DGQA, DRDO, and EME.</li><li>Policy formation for direct recruitment of trained trade Apprentice of Railway &amp; Defence as per the amended provision of section-22 of apprentice act 1961.</li><li>MACP should be provided in a promotional hierarchy instead of the next pay level.</li><li>The Government employee should be permitted to change their Hometown / Permanent Address on two occasions instead of one.</li></ol>

<p>Subject:- <strong>&#8216;Minutes&#8217; of the JCM Meeting held under the Chairmanship of JS (Army) on 09.03.2018 at 4.00 PM on the Notice of the 3 Recognized Federations of Ministry of Defence for holding meeting to discuss issues/demands of Defence Civilian Employees</strong></p>
<p>A copy of the Minutes of the Meeting held under the Chairmanship of JS (Army) on 09.03.2018 on the above subject, is enclosed.</p>
<p>2.All the addressees are requested that the same may be gone through and an immediate action may be initiated in the matter and the Action Taken Report (ATR)/views/comments on all point(s) mentioned against each Section/HQ/Orgns, may be forwarded to D(JCM) Section in the form of a &#8216;self-contained note&#8217; , with the approval of the JS/HOD/HOO concerned.</p>
<p>3.In those cases where action on certain point(s) is/are going on and not yet finalized, the progress arrived at so far may be furnished from time to time to D(JCM) Section till finalization of the case.</p>

<p><strong>Minutes of the Meeting held on 09.03.2018 under the Chairmanship of JS (Army) discuss the issues/demands of the three recognized Federations of Ministry of Defence</strong></p>
<p>A meeting was convened under the Chairmanship of JS (Army) to discuss the issues raised by the Forum consisting of recognized Federations of Trade Unions of Defence Civilian Employees/Workers vide their notice dated 19th February, 2018 for holding ‘Call Attention Strike’ on 15th March, 2018. JS(LS) was also present in the meeting. The list of participants is attached.</p>
<p>At the outset, the representatives of Federations, and members of the Official Side were introduced to the Chairperson. Thereafter, the Agenda Points were taken up for discussion.</p>
<p>Demands:<br />
1. To withdraw the decision to declare 250 items being manufactured by Ordnance Factories as &#8220;Non-Core&#8221;.<br />
2. To not declare 39 items of DEF Group of Factories as Non-Core items.<br />
3. To withdraw the Govt. order to grant uniform Allowance to the soldiers in place of stitched uniforms.</p>
<p>Discussion: The 3 Federation Representatives submitted the following views:</p>
<p>In the interest of the Army and their qualitative requirement of troop comfort items like Army Logo Uniforms, various types of battle dress, parachutes, blankets, boots, tents, jerseys, etc. the 5 OEF Group of Factories should continue to remain with the same product profile and the infrastructure and facilities available should not be dismantled, since these factories are war reserve and huge money is invested in these factories and that should not go as waste/scrap. In the past several times Army has gone to private sector for procurement of these items in the name of cost. However, the experience is that since the private sector has failed in quality and timely supply the Army has again come back to the OEF Group of Factories. Therefore, these factories should not be distributed resulting in its closure in the name of non-core and outsourcing. According to the Federations, all these items are core items only. The Federations are of the view that the past experience of the Army will be repeated and if these established facilities are not readily available when the Army fail in procurement of these items from private sector at that point of time then again re-building those facilities of producing troop comfort items will be very difficult. In spite of all these facts even then if the Government is keen in outsourcing these items, the employees of these factories should not be displaced/transferred. The Government may come with a road map to decide about the future products to be manufactured in these factories then employees may be trained and placed in the same factory without disturbing them in their seniority, future promotion and protection of wages etc. and also for retaining the skill by recruitment of trained apprentices. The Federations also expressed their deep concern about the workload and the future of Small Arms Group of Factories, Vehicle Factory and GIF, Jabalpur and HAPP Trichy. They requested that a positive decision in this regard may be taken by the Government to provide sufficient workload to these factories. They also requested that the indent for the workload of 2018-19 of the OEF Group of Factories may be immediately issued since due to non-receipt of indent, the factories are not able to place supply orders for raw materials. They also requested that the reduced expenditure budget of Rupees more than 3,000 crores may be restored to the Ordnance Factories in the interest of completion of target. The Federations also insisted that the battle field dress like Army Logo Uniforms, Jerseys, etc. should not be included in the Uniform Allowance.</p>
<p>Official Side: Responding to the Federations, JS(LS) mentioned that all of us are proud of achievements of OFB and the aim of the policy is to make the organization lean and effective. The capabilities of the private sector has improved with the progress made in the country. There are issues regarding indents of forces not being fulfilled. The intention of the Government is to concentrate on the core sector. A road map/time frame has been given by the Government for developing vendor base. The road map for redeployment of employees will be given for implementation by the Ordnance Factory Board. The steps initiated are towards improving the future of the Ordnance Factories. He assured that the reduction made in the expenditure budget of approximate Rs. 3000 crores is likely to be restored. Further, he assured that no factory will be closed and no employee will be retrenched. As far as possible, efforts will be made not to dislodge the employees from their existing factories/ place of posting. In case after the stipulated period the Army do not place indent for the existing items, then appropriate training of staff for redeployment would be considered. JS(LS) concluded that new opportunities are opening and needs to be utilized by the Ordnance Factories so that the organization grows and scales new heights. JS(Army) stated that the items which are included in the Uniform Allowance is being examined and will be clarified, and the case is under process for releasing the indents for the next financial year for the allotted workload. JS(LS) also stated that VFJ is loaded with manufacturing of Mine-Protected Vehicle and often the factory is not able to deliver the same (the Federations representatives stated that the same is due to non-availability of raw materials etc). JS (LS) also assured about the future workload of Small Arms Factories.<br />
Demands:-</p>
<p>4. To withdraw the decision to convert Army Base Workshops into GOCO Model.</p>
<p>5. To withdraw the decision to close 4 Depots under the DGOS.</p>
<p>6. To withdraw the decision to close 39 Military Farms.</p>
<p>7. To withdraw the decision to declare 31012 employees surplus.<br />
Discussion: The representatives of the Federations reiterated that the implementation of GOCO Model in the Army Base Workshop, closure of Station Workshops, Depots under DG:OS and Military Farms may be reconsidered by the Government and the decision declaring more than 31,000 employees surplus and the proposed action to displace/transfer them may be reconsidered/withdrawn and those employees should not be disturbed from their place of works. In MES, the E-in-C has taken action for filling up of 17,000 posts through Direct Recruitment and hence there is no surplus in MES and the above posts may be filled up immediately without any delay.<br />
Official Side: JS (Army) assured that no employee will be retrenched and the effect of GOCO Model on employees of Army Base Workshops and the manpower requirement of MES would be considered. As far as possible, all efforts will be made to not dislodge the employees from their existing workshops, depots and MES. In case of redeployment becomes necessary, appropirate training will be given to the employees to retain them in the same unit. As regards the concern of the Federations with regard to the surplus of employees, it will be our endeavour that employees are not subjected to hardships.</p>
<p>Demand: 8 Undue delay in holding the DPC for effecting promotions based on the Cadre Restructuring of various categories of DGQA approved by the Government.<br />
Official Side: JS(LS) assured that the matter will be examined and necessary instructions issued for holding of DPCs and effecting promotions in DGQA.</p>
<p>The other demands of the Federations were not taken up in the meeting and it was assured that regular meeting will be held with the Federations to discuss these issues and the process of implementation of the assurance given would be monitored.</p>
<p>Conclusion: JS (Army) concluded the meeting stating that the views of the Federations will be placed before the higher authorities in the Ministry. He also reiterated the assurance given by JS (LS) that no factory will be closed and no employee will be retrenched. As far as possible, efforts will be made not to dislodge the employees from their existing factories/place of posting. In case after the stipulated period the Army do not place target/indent for those items declared as non-core to the Ordnance Factories then appropriate training for redeployment would be considered. Therefore, he requested the Federations that considering the goodwill of the Government and its commitment towards the welfare of the employees to withdraw the Notice for Call Attention Strike on 15.03.2018. The leaders of the Federations stated that in view of the assurance given, they will deliberate and consider the decision to withdraw the proposed Call Attention Strike on 15.03.2018 after receipt of the Minutes of the Meeting.</p>
<p>The Federations once again reiterated that in the interest of National Security as the country maintains the Armed Forces, the Defence Establishments also should be maintained, strengthened and the interest of civilian employees should also be protected.</p>

<p><strong><em>MINUTES OF THE MEETING OF THE STANDING COMMITTEE HELD BETWEEN THE STAFF-SIDE, NATIONAL COUNCIL (JOINT CONSULTATIVE MACHINERY) AND THE OFFICIAL-SIDE UNDER THE CHAIRMANSHIP OF SECRETARY(P) AT 3.00 P.M. ON 03.05.2017</em></strong></p>
<p>&nbsp;</p>
<p>The meeting of the Standing Committee of the National Council (JCM) was held at 3.00 p.m. on 03.05.2017 under the Chairmanship of Secretary (P) at Room No. 119, North Block, New Delhi. The list of participants is at Annexure.</p>
<p>&nbsp;</p>
<p>2. In his introductory comments, Secretary(Personnel) while welcoming the participants, mentioned that the agenda for the meeting included the action taken statement on the 31 items discussed in the last meeting held on 25.10.2016 and 26 additional items received from the Staff Side.</p>
<p>&nbsp;</p>
<p>3. (i) In his opening remarks, Secretary, Staff-Side thanked the Chairman for convening the meeting and urged that as per the JCM Scheme, the meetings of the National Council should be held on quarterly basis. He also pointed out that the meeting of the National Council under the Chairmanship of Cabinet Secretary has not been held since 2010 which, he emphasized, was against the spirit and the basic principle of the JCM Scheme. This view was seconded by other representatives of the Staff-Side.</p>
<p>&nbsp;</p>
<p>(ii) Secretary (Staff-Side) further requested to know the present position on the basic demands made by the Central Government employees about minimum wages, fitment formula, reversion to the old pension scheme and the report of the Committee of Allowances. He recalled that when a notice for strike was given in 2016, the senior Cabinet Ministers in the Central Government had met the staff side representatives and assured a positive decision on the aforesaid demands. Although that strike was deferred on this assurance, the central govt. employees are still waiting. Consequently, it is getting difficult to make the central government employees understand the reasons for delay in fulfilment of the assurances then given by the Senior Cabinet Ministers.</p>
<p>&nbsp;</p>
<p>(iii) Hence Secretary, Staff-Side requested the Chairman to convey to the Cabinet Secretary and Chairman, National Council (JCM) the duty to meet the Government employees in accordance with the JCM Scheme to avoid an atmosphere of confrontation.</p>
<p>&nbsp;</p>
<p>(iv) He stated that a number of agenda items proposed by the Staff-Side have been deleted and no formal communication has been sent to them on the reasons for deletion. He requested that the views of official side on this may be communicated to them. This sentiment was echoed by other members of the Staff Side. He also mentioned that the senior Cabinet Ministers had issued a statement about constitution of a High Level Committee to look into the aforesaid basic demands made by the Staff Side while giving the strike notice. However, even after more than 10 months, nothing has happened and only one meeting was taken by Additional Secretary in Department of Expenditure.</p>
<p>&nbsp;</p>
<p>(v) On allowances, he informed that there is a lot of uncertainty on whether the allowances would become admissible prospectively or from 01.01.2016 i.e., the date of implementation of 7th Central Pay Commission.</p>
<p>&nbsp;</p>
<p>(vi) The following points were also raised by Leader JCM (Staff-Side):</p>
<blockquote><p>(a) The assurance given by Senior Ministers on 30t h June 2016 on 7th CPC issues-mainly minimum wage and multiplying factor have not been fulfilled. Only one meeting was held by Addl. Secretary (Expenditure) with the Staff side and thereafter nothing is known with regard to progress made even though 10 months passed.<br />
(b) On 7th CPC recommendation for revision of pension on the basis of option the contents of the Committee’s Report are not made available to the JCM (Staff Side). There is need to see that transparency is ensured for preserving healthy industrial relations.<br />
(c) On Allowances, the Leader JCM (Staff Side) expressed disappointment as there has been no positive outcome even after lapse of several months. He requested the Chairman that the JCM (Staff Side) demand to revise the Allowances w.e.f. 01/01/2016 should be considered and Staff Side demand be taken to the level of Cabinet Secretary and the Government.<br />
(d) Although Ministry of finance Resolution dated 25t h July 2016 stipulates that 14.29% hike in the pay of Running Staff in the Railways be ensured, unfortunately, the same has not been complied with. The said hike has not been ensured. He requested the Chairman to kindly take appropriate initiative on the proposal sent by Ministry of Railways which is pending with the Ministry of finance. He also pointed out that the references made by different ministries to the DoP&amp;T/MoF pursuant to the discussions held by the JCM Constituents with the respective Departments/Ministries are pending. He requested that speedy response be ensured by DoP&amp;T/MoF. While concluding, the Leader, JCM (Staff-Side) expressed confidence that the NC/JCM meeting as well Standing Committee meetings will be convened regularly in accordance with the JCM rules for paving way for healthy industrial relations”.</p></blockquote>
<p>(vii) The Staff-Side drew attention to the fact that since 1966 Joint Committees used to be set up for discussing contentious issues which has since stopped. References from the Departments are also remaining unanswered. The members of the Staff Side requested that DOP&amp;T should take a view on all these issues as a number of them have not been settled. The Staff Side also requested that the duration of Standing Committee meetings should be extended so that all issues can be discussed and resolved quickly and the meetings should also be held every quarter.</p>
<p>&nbsp;</p>
<p>(viii) The Staff-Side also pointed out that items of agenda sent by them are to be included, if it is found to be appropriate to be discussed. Since there had been permanent subcommittees under the Chairmanship of Secretary (Health) and (Pension), the agenda items pertaining to those two ministries can be referred to those two sub-committees. The sub-committees are to deliberate and report back to the Standing Committee for a final decision. They wanted the said procedure to be followed as the items sent by the Staff Side to the meeting contained many Pension and Health related issues.</p>
<p>&nbsp;</p>
<p>(ix) Referring to the convening of the Departmental Council, the Staff Side said that the situation has not registered any significant improvement. They also pointed out that in the details provided; no dates of the last meeting held had been indicated. They pleaded that the Department of Personnel has to evolve a mechanism to monitor the functioning of the Departmental council.”</p>
<p>&nbsp;</p>
<p>(x) In view of the ongoing ban on recruitment imposed by the Department of Expenditure, the staff are having to work long hours. This is despite the Task Force, set up by Ministry of Railways on safety-related matters, having suggested that additional staff be mobilized to ensure safety. Even the Hon&#8217;ble Prime Minister in his speeches has stressed the need for safety; but the Ministry of Railways have chosen to ignore.</p>
<p>&nbsp;</p>
<p>(xi) Another point raised was about the instructions issued by the DOP&amp;T following the assurance given to the Hon’ble Supreme Court in a contempt case which was said to have created a situation where the DPCs are not being held and the employees are retiring without getting promotion. It was stated that UPSC is also refusing to accept DPC proposals and insists that clarification from DOP&amp;T may first be obtained. As a result promotions are not taking place and many officers have retired without promotion. The Staff-Side requested that necessary clarifications may be issued by DOP&amp;T urgently so that DPCs can be held in the Departments.</p>
<p>&nbsp;</p>
<p>4. Chairman, in his reply, said that no agenda points had been deleted and, in order to ensure that discussions are complete in a meeting, it was decided in consultation with the Secretary(Staff-Side) to limit the number of agenda points for today’s meeting. He further stated that if the Staff-Side insists that the remaining points which have been left out should also be taken up for discussion, they would need to be circulated to the concerned Departments in advance for their comments. He emphasized that the Government attaches the highest priority to the Staff-Side and the concerns expressed over the assurance given after the strike call would be conveyed to the concerned authority. On the issue of the Allowances Committee’s report not being shared with the Staff Side, the Chairman stated that the sentiment would also be conveyed to Ministry of Finance along with the concerns over pay revision etc.</p>
<p>&nbsp;</p>
<p>5. After these opening remarks the Action-Taken-Note on the minutes of the last meeting held on 25.10.2016 was taken up for discussion.</p>

										<content:encoded><![CDATA[<h3><strong>Minutes of JCM Staff Side Meeting with 7th CPC Implementation Cell held on 19.2.2016</strong></h3>
<h3><strong>Minutes of the Meeting of Joint Secretary (IC) with the Members of the Staff-Side of the Standing Committee (National Council-JCM) held on 19.02.2016</strong></h3>
<p><strong>A Meeting was held under the chairmanship of Joint Secretary (Implementation Cell), Department of Expenditure, Ministry of Finance, with the Members of the StaffSide of the Standing Committee (National Council-JCM) on 19.2.2016 to discuss the issues raised by the National Joint Council of Action (NJCA) {Joint Consultative Machinery (JCM)} in their letter No. NJC/2015/7th CPC dt. 10.12.2015, addressed to the Cabinet Secretary, regarding their Charter of Demands on the recommendations of the 7th Central Pay Commission. The Secretary, Staff-Side of the Standing Committee (National Council- JCM), who is the convener of the NJCA, along with other office bearers attended the meeting. The list of the participants from the Staff-Side is attached at Annexure.</strong></p>
<p><strong>2. Welcoming the members of the Staff-Side, JS(IC) mentioned that the meeting has been convened to enable the Staff-Side to bring out their concerns on the recommendations of the 7th CPC in the light of the Charter of Demands made by them in the aforesaid letter of NJCA so that same could be examined in the Implementation Cell and submitted for consideration of the Empowered Committee of Secretaries. He informed the office bearers that before arriving at a decision, the ECoS would also hold separate discussions with the Staff Side.</strong></p>
<p><strong>2. Commencing the discussions from the Side of the Members of the Staff-Side, Secretary, Staff-Side, Standing Committee (National Council-JCM), explained that they have already placed their Charter of Demands as per the letter of NJCA dated 10.12.2015. He mentioned that the reasons based on which these demands have been made have also been explained therein. He, however, highlighted that the Staff-Side is not at all happy with the recommendations of the 7th CPC and, in fact, no section of the employees is satisfied, as the Commission has recommended a minimal pay increase as compared to the previous Pay Commissions. He mentioned that the Staff-Side does not agree with the minimum pay of Rs. 18000 and the reason as to why the methodology adopted by the 7th CPC to arrive at this figure is not correct has been explained in their letter dated 10.12.2015. He stated that Staff-Side demands enhancement of the minimum pay to Rs. 26000 and the reasons in support of this have been given in their aforesaid letter. He further stated that an amicable and mutually negotiated settlement of these demands is necessary as non-acceptance would further cause resentment in the employees. He informed that Staff-Side has already made their stand clear to go on strike from 11th April, 2016 if their demands are not considered and no amicable settlement happens.</strong></p>
<p><strong>3. Thereafter, the other members of the Staff-Side also expressed their arguments for acceptance of these demands and all of them emphasised that the minimum pay needs to be revised. Consequently, the fitment multiple of 2.57 would also need commensurate change. The leader of the Staff-Side explained that the office bearers who were present in the meeting represent various sections of Central Government employees including railways, defence civilians, postal employees etc., the number of which is around Rs. 32 lakhs.</strong></p>
<p><strong>4. The Staff-Side brought out their concerns on all the 26 demands included in the Charter of Demands and all the points brought out by them in the letter of the NJCA dt. 10.12.2015 were reiterated. However, following issues in support of their demands were highlighted :-</strong></p>
<p><strong>(i) Minimum Pay needs to be revised to Rs. 26000 p.m. and the minimum pay of Rs. 18000 p.m. as recommended by 7th CPC is not acceptable. This would require upward revision in the fitment multiple of 2.57 and change in the Pay Matrix. It was argued that if the 10% of the pay for NPS contribution and the recommended increase in the CGEIS contribution are taken into account, there would be a drop in the take-home salary of the employees at the</strong><br />
<strong>minimum pay of Rs.18000.</strong></p>
<p><strong>(ii) Central Government employees need to be excluded from the National Pension Scheme (NPS), which has been a long pending demand of the StaffSide. The Staff-Side stated that the Pension Fund which has been created under NPS to generate annuity for employees, would not ensure reasonable pension. Rather it is quite likely that it may generate negative returns because of the dismal performance of the financial market to which the fund is</strong><br />
<strong>invested, leaving the employees without any reasonable social security benefit.</strong></p>
<p><strong>(iii) The 7th CPC has recommended abolition of 52 allowances without properly appreciating the justification of these allowances. The example of break-down allowance in case of Railway employees was given, stating that this allowances is given so that the concerned employees take up the necessary follow up action in the case of breakdown on an urgent basis and therefore its withdrawal is not justified in operational interests of Railways.</strong></p>
<p><strong>(iv) The withdrawal of advances, especially LTC, TA, Medical, National Calamity Advance, was not justified. It was argued that these advances are recovered from the employees and, therefore, the same should be retained. (v) In regard to enhancement of contribution under Group Insurance Scheme, it was argued that increase in the contribution from the employees was not justified and if the same is to be raised, the Government should bear the</strong><br />
<strong>insurance premium.</strong></p>
<p><strong>(vi) The post of LDC should be upgraded to UDC and as part of delayering, Grade Pays of Rs. 1900, Rs. 2400 and Rs. 4600 should be abolished and merged with the next higher Grades.</strong></p>
<p><strong>(vii) The rate of increment needs to be raised from 3% to 5% because pay is revised in the Central Government after 10 years. It was mentioned that in the PSUs the pay is revised after 5 years and the rate of increment is also higher.</strong></p>
<p><strong>(viii) Two increments in the feeder post may be granted as promotion benefit.</strong></p>
<p><strong>(ix) Fixed medical allowance for pensioners who are not covered by CGHS and REHS needs to be increased from Rs. 500 p.m. to Rs. 2000 p.m.</strong></p>
<p><strong>(x) The recommendation regarding grant of only 80% of salary for the second year of Child Care Leave need not be accepted and the existing provisions may be retained</strong></p>
<p><strong>(xi) It was also demanded that though the D/o Expenditure has sought the comments of the Ministries/Department on the issues pertaining to them after consulting the Staff Associations, administrative Departments are not inviting the Staff associations for discussions.</strong></p>
<p><strong>5. After detailed explanation by the Staff-Side on all the demands included in the Charter of Demands, JS(IC), while concluding the discussions, assured the Staff-Side that the concerns and demands made by them would be placed before the Empowered Committee of Secretaries for consideration after examining the same in the light of the recommendations of the Commission. He also mentioned that in cases where the comments of the administrative Ministries/ Departments would be necessary, e.g., the case of break-down allowance pertaining to Ministry of Railways, the same would be considered before the issues are placed before the E-CoS. As regards the issue raised that the administrative Departments are not inviting staff associations for discussions, JS(IC) mentioned that the Departments have to formulate the views keeping in view the representations made by the Staff Associations.</strong></p>
<p><strong>6. Thereafter, the meeting ended with thanks to the chair.</strong></p>

										<content:encoded><![CDATA[<div><strong>Brief note on the discussions took place in the 30th meeting of the National Council, held on 23.04.2014 &#8211; BSNL Employees Union</strong></div>
<div></div>
<div>(1) <strong>Lesser standards of evaluation for the JAO and JTO exams. </strong></div>
<div>The Staff Side made a strong appeal to the Management, to review the JAO and JTO exams that had taken place, by adopting lesser standards of evaluation. The vehement, lengthy and detailed arguments of the Staff Side to grant grace marks, were however not accepted by the Management.</div>
<div></div>
<div>As regards taking remedial measures in respect of question papers with discrepancies, it was agreed that the Recruitment Branch will issue a letter to all the CGMs, as has been done in the case of MP and AP circles, for taking necessary remedial action.</div>
<div></div>
<div>(2)<strong> Regular promotion to officiating JTOs. </strong></div>
<div>Management replied that a provision is already made in the New Recruitment Rules for the absorption of all the 1500 officiating JTOs. The RR will soon go for the approval of the Management Committee.</div>
<div></div>
<div>(3) <strong>Eligibility of the Non-Executives to appear Management Trainee exam. </strong></div>
<div>Very serious arguments were placed by the Staff Side for the amendment of the Recruitment Rules of the Management Trainees, so as to make the Non-Executives, with the requisite qualification, eligible to appear the MT exam. But this was not accepted by the Management. Due to the persistent requests made by the Staff Side, Management agreed to review the RR, after one exam is held. It was informed that the notification for holding the MT exam would be issued within 3 months.</div>
<div></div>
<div>(4) <strong>Amendments to JTO(T), JTO(E), JTO(C) and JAO Recruitment Rules.</strong></div>
<div>Management informed that the new RR of JTO(T) is going for the approval of the MC shortly and that the qualifying service has been reduced from 7 years to 5 years. The demand of the Staff Side to reduce it to 4 years was not accepted. Management also informed that the work to frame new RRs of JTO(E), JTO(C) would be taken up shortly.</div>
<div></div>
<div>(5) <strong>Filling up of SC/ST back log vacancies</strong></div>
<div>Management replied that there is no unfilled back log vacancies in Non-Executive posts.</div>
<div></div>
<div>(6) <strong>Regularisation of TSMs and casual labourers appointed on compassionate grounds</strong>.</div>
<div>There was a detailed discussion on this issue. However, Management finally replied that regularization of any TSM or casual labourer could not be done in view of the Hon’ble Supreme Court judgement in the Uma Devi case.</div>
<div></div>
<div>(7) <strong>Revision of stipends of trainees. </strong></div>
<div>Management has already issued order on 07.04.2014, (after this item was submitted for discussion in the National Council) stating that 70% of the minimum pay of the respective pay scale + IDA shall be paid as stipend for TTAs / Sr.TOAs and TMs.</div>
<div></div>
<div>Staff Side demanded that revised stipends should be implemented from 01.01.2007 and arrears should be paid. Management accepted this.</div>
<div></div>
<div>(8)<strong> Fresh Recruitment of Staff. </strong></div>
<div>Staff Side argued about the need for fresh recruitment, since there is acute shortage in cadre like Sr.TOA. Management agreed that fresh recruitment is required, howeverthey told that it should be done for a multi-skilled cadre. Further, they told that this issue would be referred to the consultant.</div>
<div></div>
<div>(9<strong>) Empowerment of women staff in BSNL.</strong></div>
<div>Staff Side argued that the role being played by the women staff, for the growth of BSNL as well as for the society as a whole, should be recognised. It was also pointed out that the women employees, after crossing certain age, are facing specific health problems and thus require a special consideration. In view of the above, the Staff Side demanded the women employees should be granted special leave of one day for every completed one month’s service. However, Management said that it is following the Government Rules in the matter of leave, and whatever is not mentioned in those Rules would not be granted.</div>
<div></div>
<div>(10) <strong>Pay fixation in case of Non-Executives absorbed in BSNL, who had opted for IDA pay scale from the date of promotion after 01.10.2000. </strong></div>
<div>Management said that this issue is being actively persued with the DoT and expressed hope that a favourable order would come soon. The Staff Side demanded that in the meanwhile recovery being made at the field level should be stopped. Management agreed to look into this.</div>
<div></div>
<div>(11) <strong>Provision of Rs.200/- BSNL SIM to all the Non-Executives.</strong></div>
<div>BSNL SIM worth Rs.200/- has already been issued to the Non-Executives working in the outdoor. Staff Side demanded that this facility should be extended to the Non-Executives working in Indoor / offices also. They also demanded that access to other network customers and also to the CUG of Executives should be provided. Management said that this would be looked into.</div>
<div></div>
<div>(12) <strong>Inordinate delay in the finalization of disciplinary cases. </strong></div>
<div>Staff Side pointed out that there is inordinate delay in finalising disciplinary cases, which has also resulted in acute delay in the issuing of Presidential Orders, and demanded prompt action on this count. Management replied that the CVO office has already issued letter to all CGMs to finalise disciplinary cases without further delay.</div>
<div></div>
<div>(13) <strong>Creation of Section Supervisor posts in the circle / administrative offices.</strong></div>
<div>After detailed discussion, Management suggested to hold separate discussion on this issue. Staff Side agreed.</div>
<div></div>
<div>(14)<strong> Independent SSA status for Anantnag and Baramullah. </strong></div>
<div>Staff Side demanded that Anantnag and Baramullah in J&amp;K circle should be granted full SSA status, in view of the fact that TDE and AO are already posted in these places with full administrative and financial powers. Staff Side also pointed out how SSA status has been already granted for smaller districts. Management replied that the proposal to form a separate SSA has come from the CGM J&amp;K, only in respect of Anantnag and that no proposal has come for Baramullah. In respect of Anantnag, Management said that it would be looked into.</div>
<div></div>
<div><strong>(15) Issue of Presidential Orders to TSMs regularized on or after 01.10.2000. </strong></div>
<div>Staff Side pointed out that how POs are not yet issued for a number of TSMs who are regularised on or after 01.10.2000.</div>
<div></div>
<div>Management shared the concern of the Staff Side and told that even 10 days ago a letter had been issued to all the CGMs to forward such cases to the Corporate Office.</div>

<p><strong>PROGRESS ON ISSUES OF JCM III MEETING WITH DGOF</strong></p>

<strong>INDIAN NATIONAL DEFENCE WORKERS FEDERATIONS</strong></p>
<p>JCM III LEVEL COUNCIL MEETING OF BOARD (14th MEETING OF 11th TERM) HELD ON<br />
27th AND 28th NOVEMBER, 2013 AT KOLKATTA.</p>
<p>The following issue were discussed and some of the progresses on the issues are given below for the information of all our affiliated unions.</p>
<p>1. Ex-gratia payment of Rs.10 Iakhs to each family of the employees who lost lives while performing their bonafide duties has been cleared by M of D and sanction was issued by OFB for Rs. 3 crores in respect of 30 families.</p>
<p>2. Necessary clarification was issued by Department of Defence Production on the entitlement of 30 days of Earned leave for Piece workers opted leave under Factories Act but a doubt arised to PC of Fys about the date of effect for which necessary clarification will be obtained from M of D to give effect from July 2008.</p>
<p>3. Departmental Overtime for piece workers was abruptly stopped by OFB from the year 2006 which was not approved by M of D. orders are under issue.</p>
<p>4. For Clerical and Para Medical staff the cadre Review proposals now at OFB level, for Para Medical Staff, OFB finance has cleared and it would be processed further.</p>
<p>5. Cadre Review for Artisan Staff under M of D is to be done which is due. Now Indian Railways have revised the Cadre Review w.e.f. 01.11.2013. It was requested OFB should propose on this line for Ordnance Factory Artisan Staff on receipt of the letters from M of D.</p>
<p>6. The III MACP Rs.4600I- which was granted to MCM and Chargeman was now reviewed by DOP&amp;T and M of D was directed to consider on its own, if the MCM is not the feeder grade to Chargeman. On this basis M of D convened a meeting on 21.11.2013 of Federations and Directors of all Directorates and confirmed that the MCM is not the Feeder grade to Chargeman and only HS Grade I, MCM to Chargeman is only by transfer. Now M of D has submitted the proposal to Defence (Finance) for approval. Therefore, the issue is likely to be settled Hence, it was demanded that PC of A Fys should not affect the reversion of Grade Pay from Rs.4600/- to Rs.4200/- for the serving employees till the orders are issued by M of D. It will be delayed till 31.12.2013.</p>
<p>7. Release of HRA for those who vacated the Quarters and not allotted the quarters has been raised to decide the matter at OFB level.</p>
<p>8. One time relaxation to clerical staff is a permanent demand which was forwarded to M Of D.</p>
<p>9. The following Cadre Review proposals have been submitted to Government through M of D.</p>
<p>MTS, Fire Staff, Canteen Staff, Storekeeping staff, Hindi Typist, Jr Hindi Translators, Teachers, Lab Asst, FED, Durwan, female Searcher etc.</p>
<p>10. Single instructions to all Factones in respect of granting ACP to Durwans will be issued on the basis of promotional hierarchy upto 30.08.2008.</p>
<p>11. All MCMs are now declared as Group B category employees as was demanded in last JCM meeting. They are now entitled to travel by Air on LTC 80 from the nearest Airport to North East Region and J &amp; K. Also their contribution is increased to Rs.60/- towards Central Government Employees Insurance Scheme (CGIES).</p>
<p>12. Further it was demanded that for MCM Promotion, only Departmental Screening committee is held not DPC, therefore, they should be granted promotions twice in a year and not once.</p>
<p>13. Family pensions granted to widow daughters and unmarried daughters on the basis of DOP&amp;T orders.</p>
<p>14. Piece work Co-relation is being processed.</p>
<p>15. It was agreed by PC of A Fys to sanction food bills while on duty to remote areas on self certification basis where registered hotels are not available necessary orders will be issued.</p>
<p>16. Electrical Supervisory Competency test for Chargeman, Theoretical training will be held at OFIL, Ambajhari.</p>
<p>17. Estate Co-ordination committee’s functioning’s will be strengthened to settle the HRA problem.</p>
<p>18. Chairman/OFB agreed to consider and dispose the pending requests of JWMs for transfers.</p>
<p>19. JWM/AWM 76 posts cleared 183 posts proposal sent for promotion 50% promotion to AWM. 50% DR Proposed.</p>
<p>20. Escort duty to which employees is detailed; they will be allowed to compensate the loss of Overtime by giving 75 Hours during the Quarter by which they can recover the loss. 54 Hours ceiling per week should be withdrawn. This has been agreed to consider and to issue necessary instructions to Factories.</p>
<p>21. In order to remove the prevailing stagnation for the Storekeepers and Supervisor NT Stores, a Joint proposal was submitted by the Staff side proposing to grand about 269 posts of Chargeman from Chargeman (T) which will relieve the stagnation. At the same time through Cadre Review, the proposed additional posts will be taken back. The proposal submitted would be agreed to consider by OFB.</p>

All Affiliated Unions of INDWF of Ordnance Factories.</p>
<p>13th Ordinary meeting of OFB JCM III Level council (11th term) held on 6th and 7th June 2013.  Preliminary and review of points were discussed in the meeting held on 06.06.2013 chaired by Sr.DDG/HRD.</p>
<p>The important issues were raised by the Staff side in the meeting and on the issues raised; some of the issues were replied by the official side in the meeting.  In the main meeting to be held on 07.06.2013, Chairman  &amp; DGOF will be presiding the meeting with Board members.</p>
<p>Decisions given by the official side are given below:</p>
<p>1. <strong>DEMANDS RELATED TO PC of A Fys.</strong><br />
Granting of ACP/MACP – I, II and III to Labourers, erstwhile Group ‘D’ and who became Tradesmen later.  They will be considered for ACP I, II and III by ignoring the ACP granted prior to 01.01.2006 and a conscious decision will be taken within 10 days.  The instructions on this issue will be issued to LAOs to grant the financial up gradations as per their eligibility &#8211; minimum Rs.2800 Grade Pay and maximum Rs.4200/- Grade Pay.</p>
<p>2. <strong>Wage package</strong> is now being done centrally at RFI; Ichapore decision will be taken with the approval of PC of Fys to have at HQrs.</p>
<p>3. <strong>Granting of 2 Hours Short leave (with Pay) to IEs</strong> as per M of D orders will be implemented by issuing necessary orders within 10 days or at least before next Pay day by PC of A Fys.</p>
<p>4. The demands for<strong> fixation of Revised pay for HS I w.e.f. 01.01.2006</strong> on the Pre-Revised Pay of Rs.4500-7000 for those who were placed in HS I on account of Re-structuring of Industrial cadre. The issue was agreed to re-examine by PC of A Fys.</p>
<p>5. Retired/Retiring employees drawing<strong> Rs.4600/- Grade Pay on account of  3rd MACP</strong> will be restricted to Rs.4200/- till final decision is received from Ministry of Finance, Dept of Expenditure. If the proposal was agreed, all will be granted Rs.4600/- Grade Pay for 3rd MACP and benefit will be revised.</p>
<p><strong>OF CHANDA</strong>: the issues related to grant of TA/DA, Pay Fixation, Medical bills etc. Delayed and denied by LAOs will be immediately sorted out.</p>
<p><strong>OF BHUSAWAL</strong>: No of references were received from GM, OF Bhusawal on the Accounts related issues which will be sorted out.</p>
<p><strong>HVF, Avadi</strong> : All Accounts related matters will be settled by visiting personally by JCDA and Director/IR to HVF Avadi and will be settled.</p>
<p>Fixation of Initial pay for Fireman Rs.5880 + 1900 instead of Rs.5830 + 1900 will be examined for all Factories</p>
<p>6. <strong>CHILDREN EDUCATION ALLOWANCE</strong>:<br />
Children studying in Ankur Vidyalaya in LKG &amp; UKG at OF Medak are denied CEA, this will be examined and granted the benefit of re-imbursement of expenses as per Government orders on the subject.</p>
<p>7.  <strong>LTC</strong> :<br />
NGOs drawing Rs.4200/- Grade Pay being Group ‘B’ Non-Gazetted are entitled to avail Air Travel from the nearest Airport while on LTC Tour but whereas Industrial Employees drawing Rs.4200/- are denied being Group ‘C’.  This was agreed to re-consider and make Industrial Employees drawing Rs.4200/- as         Group ‘B’ and allow Air Travel from nearest Airport on <a href="http://centralgovernmentnews.com/category/ltc/">LTC</a>.  On being considered as Group ‘B’ for Industrial Employees, they will become eligible to contribute Rs.60/- for CGIES (Group Insurance).</p>
<p>8. <strong>PIECE WORK CO-RELATION ON VI CPC PAY  </strong><br />
<strong>DDG/Admin</strong><br />
A.K.Singh Committee report on incentive scheme submitted during 2003 was not considered as feasible by M of D which was an additional scheme to Piecework.  Due to this the Piece Work revision proposal is pending with M of D.  Federations were agreed to withdraw the A.K.Singh Committee report so that Piece Work revision proposal can be processed and implemented at the earliest.</p>
<p>9. <strong>ORDNANCE FACTORIES RECRUITMENT BOARD</strong><br />
<strong>A/IR – DDG</strong><br />
Upto 2013-14, around 23000 posts have been sanctioned for Recruitment in Ordnance Factories and as per the feedback received around 12000 persons have joined already.  Recruitment process is in various stages for 10,000 to 11,000 posts.  Some Factories not yet advertised vacancies; some of them are under the investigation due to some complaints.  In the recent Head of Departments (HOD) meetings (GMs Conference) this was discussed with Secretary DDP, M of D and Secretary agreed for Centralised Recruitment.  So the Ordnance Factories Recruitment Board will be approved soon to recruit all Group ‘C’ Posts.  For Chargeman DR, NADP Ambajhari will take the responsibility for recruitment.</p>
<p>10. <strong>RECRUITMENT IN NIE CADRE</strong><br />
During 2013-14, 900 posts were sanctioned for recruitment in various factories.  Further sanction is also being considered and will be issued shortly, particularly for CMDs, Stenographers etc for sanction.</p>
<p>11. <strong>Tradesmen SSK on completion of 2 years are to be promoted to Skilled</strong>.<br />
Factories are delaying in conducting Trade Test and effecting <a href="http://centralgovernmentnews.com/category/promotion/">promotions</a>.  It was agreed to the Staff side suggestions to conduct Trade Test before 3 months of completion of 2 years and the promotion will be released on time i.e., on completion of 2 years.</p>
<p>12. <strong>30 Days EL FOR IES WHO HAVE OPTED FOR FACTORIES ACT</strong><br />
<strong>DDG/A/A</strong><br />
After granting 30 days EL to all industrial Employees from November, 2006, the Piece Workers are denied the benefit of availing 30 days EL on the reasons that they have opted leave under Factories Act.  PC of A Fys denied to grant 30 days EL for Piece Workers as the Factories Act restrict EL only upto 18 days.  They said either fresh option is to be allowed or it will remain in the same status.<br />
The reasons because, for Industrial Employees in Ordnance Factories TWO set of leave rules are there<br />
(i)  Under Factories Act<br />
(ii) Departmental Leave Rules<br />
Whereas in Railways only one Rule is applicable to all i.e., Departmental Leave Rules, we have therefore agreed to kill theproblem to agree for retaining/opting for only Departmental leave Rules by which all will get 30 days EL and can accumulate upto 300 days.  Due to this issue, Piece Workers are granted only 18 days and at the time of retirement they are given @ rate of 18 days per year.  We therefore, agreed to switch over to Departmental Leave Rules thereby all will get 30 days EL per annum.  Proposal has been sent to M of D and DOP&amp;T for approval.  Further we will try to get the benefit with retrospectively so that those who have paid less on leave encashment will be granted.  Pensioners will be benefited.</p>
<p>13. DIRECTOR /A/NI<br />
a) The issue of stepping up of Pay between Direct Recruitees and promotees among the Teaching Staff of Ordnance Factories have been raised.  Director/A/NI replied that in respect of PRT, TGT and PGT wherever the promotees are drawing lesser than the Direct Recruitees, will be given Stepping up of Pay as was done in Sr.Staff Nurse, Fireman etc.  This will be considered on receiving the details from the INDWF.</p>
<p>b)  Revival of abolished posts was taken up with <a href="http://centralgovernmentnews.com/category/dopt-orders/">DOP&amp;T</a> but they did not get any reference.  M of D wants matching saving for releasing of Additional Sanction in NIE Cadre proposal is being worked out.</p>
<p><span style="text-decoration: underline;"><strong>NG Group</strong></span></p>
<p>14. On the demand of INDWF, it was agreed by the official side to provide <strong>quota on promotions to CMDs, Data Entry Operators and Tracers to Chargeman (T)</strong>.  91% IEs, 3% DEO, 3% CMDs, 3% Tracer &amp; FED against the 50% promotion Quota.  This will be incorporated in the Draft SRO for obtaining necessary approval.</p>
<p>15. <strong>Seniority of Chargeman &amp; JWM</strong>.  For JWM Seniority list was finalised circulated.  For the Chargeman, there are about 10500 individuals.  To finalise the seniority a task force has been constituted, by July 2013 the list will be finalised after receiving the report.</p>
<p>16. <strong>Promotion for JWM</strong> was finalised, left our seniors will be reviewed by review DPC and orders will be issued.</p>
<p>17. <strong>Cadre Review committee</strong> report will be presented to OF board and after getting Board views, it will be placed to Staff side.</p>
<p>18. For <strong>Chargeman through LDCE</strong>, Degree qualification approved by UGC and for Diploma, AICTE approved will be criteria to decide the level of qualification.</p>
<p>19. For forwarding the application for <strong>outside employment, PH, SC/ST candidates</strong>, it has been agreed and finalised.  For JWMs, OF Board is Appointing Authority.  For others, GMS are made competent to decide.  Draft guidelines are prepared on this.</p>
<p>20. To increase the<strong> strength of JWM (NT), Office Supdt</strong>, a proposal will be taken up with UPSC.</p>
<p>21. For creating <strong>promotional opportunities to Storekeeping Staff</strong>, Cadre Review proposal was submitted to M of D as a long term benefit.  For immediate relief, no further action is made as it does not become feasible to divert the vacancies form other stream.</p>
<p>22. <strong>CMDs, Stenographers</strong>, Direct Recruitment agreed to consider releasing the vacancies.</p>
<p>23. For <strong>Direct Recruitment of Posts</strong>, a comprehensive guideline will be prepared by OF Board and will be distributed to Factories to follow uniformity in respect of advertisement, scrutiny, conducting of Test, level of preparing questions etc.</p>
<p>24. <strong>Durwan</strong> shortage in Factories, M of D agreed to consider increasing the sanction.  But for immediate Relief outsourcing will be done.  For Direct Recruitment, a case file will be submitted to M of D for approval.</p>
<p>25. For <strong>HS I and MCM promotion</strong>, yearly two times, DPC will be conducted and the promotions will be released instead of now conducting yearly once.</p>
<p>26. Group ‘D’ employees and Labourers who were appointed as CMDs, their services will be counted from CMDs for the <strong>purpose of ACP/MACP</strong> treating this as appointment and not as <strong>Fast Track Promotion</strong>.</p>

<p><strong>MINUTES OF THE MEETING WITH THE REPRESENTATIVES OF STAFF SIDE, NATIONAL COUNCIL (JCM) ON PENSIONARY MATTERS UNDER THE CHAIRMANSHIP OF SECRETARY (PENSION, AR&amp;PG) ON 28.5.2013 AT LOK NAYAK BHAWAN, NEW DELHI<br />
</strong><br />
Secretary (Pension, AR&amp;PG) chaired a meeting with the representatives of Staff Side, National Council (JCM) on 28.5.2013 to discuss various issues relating to pension and other retirement benefits. The list of participants is at Annexure &#8211; I. Secretary (Pension, AR&amp;PG) welcomed the participants and appreciated the contributions of the pensioners in the overall development of their respective organisation.</p>
<p>2. The meeting started with a discussion on the Action Taken Report on the minutes of the meeting held on 6.11.2012 as per details given below :</p>
<p>(i) Ex-gratia payment to SRPF/CPF beneficiaries who retired other than on superannuation, i.e. voluntary retirement and medical invalidation cases.</p>
<p>Department of Expenditure has given clearance for deletion of clause of &#8216;c&#8217; of para 2 of OM dated 22.3.2004 which prohibits grant of ex-gratia payment to those, who retired from service other than on attaining the prescribed age of superannuation. With this, CPF beneficiaries who have retired voluntarily and on medical grounds after 20 years of service will also be granted ex-gratia. It was decided that this agenda item will be closed after issue of a revised OM by the DOP&amp;PW. Ministry of Railways will also issue similar orders.</p>

<p style="text-align: left;">(ii)<strong> Raising quantum of ex-gratia to CPF retirees on the lines of SRPF</strong>.</p>
<p>The latest status of the case was intimated to the JCM. After the issue of orders by this Department, consequent to the decision of Cabinet the item may be dropped.</p>
<p style="text-align: right;"><span style="text-decoration: underline;">Action : DOP&amp;PW</span></p>
<p style="text-align: right;">
<p style="text-align: left;">(iii) <strong>Abnormal delay in the issue of revised PPO to Pre &#8211; 2006 retirees, pensioners / family pensioners.</strong></p>
<p>(i) It was intimated that the Department had taken the following initiatives like (a) allowing change in date of birth of spouse, (b) use of certain documents as proof of date of birth of spouse, (c) inclusion of present postal address and mobile and telephone number in the life certificate (d) use of e-scroll for extracting information from banks’ database. (e) revision of PPOs even in cases where date of birth/age of spouse is not given in the PPO or this information is not available In the omce records for speedy revision of PPOs.</p>
<p>(ii) As a result, the number of pending revision cases for civil pensioners has come down from 2,54,467 in August, 2012 to 74,000 as on April, 2013 as per information given by the CPAO on the basis of e-scrolls.</p>
<p>(iii) However, amendment in calculation of revised pension, vIde OM dated 28.1.13, has necessitated issue of revised authority in all cases, as indicated in OM dated 13.2.13.</p>
<p>Secretary (Pension, AR&amp;PG) stated that record/information of many pensioners are not available with the Departments, which is hampering further progress and the Pensioners Associations should come forward to help the departments in reaching out to the pensioners/family pensioners. He further stated that Secretaries of various Departments have been requested to review the issue of revision of PPO in the fortnightly/ monthly meetings.</p>
<p>Railways stated that in case of pre 2006 pensioners advertisement has been issued. Matter was taken up with RBI to issue notification to all banks. Out of 10.89 lakh such cases, 5.46 have been issued revised PPOs. Meetings ere generally held at various levels. 30th September, 2013 has been set as the target date for disposal of these cases. The progress is being reviewed every month. It has also been decided to take up the revision of PPOs suo-moto rather than waiting for an application from the pensioner. The said letter is under issue. Secretary (Pension, AR&amp;PG) desired that the same may be issued by 15th June, 2013.Secretary, Pension des,red that necessary chances in systems may be made if that would facilitate the pension sanction and payment processes in the <a href="http://centralgovernmentnews.com/category/railways/">Raliways</a>. The present pension authorisaton is decentralised In the Railways. Secretary, Pension also stated that he will write to the Chairman, Railway Board in this matter.</p>
<p>CGDA, Ministry of Defence intimated that they hope to complete the exercise by 30th September, 2013.</p>

<p>(iv) <strong>Fixation of Revised Pension (1/3rd of commuted portion of pension) in respect of Government servant who had drawn lump sum payment on absorption &#8211; revision by multiplying pre revised 1/3rd pension by a factor of 2.26.<br />
</strong><br />
CAT, Hyderabad Bench, vide its order dated 22.4.2013, has directed, to pass an order for revision of pension of absorbee pensioner’s. The Staff Side was informed that the matter was under examination in consultation with Department of Expenditure.</p>
<p><strong>(V) Commutation of Pension<br />
</strong><br />
(a) <strong>Revision of old / new commutation table and<br />
</strong><br />
(b) <strong>Restoration of commutation period to be reduced from 15 to 12 years.<br />
</strong><br />
It was explained that the matter of revision of old/new commutation table was discussed with Department of Expenditure. It was observed that this issue should be considered by the next pay commission.</p>
<p>JCM intimated that by the new commutation table, the restoration of the commuted portion is completed by 11 years because interest rate is at 8% unlike the old table wherein the restoration period was after 15 years because interest rate was taken at 4.75%. Department of Expenditure stated that issue for this old/new commutation table can be studied only by a specialised body and hence could be looked into by the IRDA. However, these are larger issues for which a holistic view needs tobe taken by a body like the Pay Commission. However, the matter may be referred to Department of Expenditure.</p>
<p>(vi)<strong> Family pension to divorced/Widowed/Unmarried daughter of a Government Servant.</p>
<p>Difficulty faced by them in getting family pension sanctioned.</p>
<p>Life Time Arrear</strong>.<br />
JCM did not raise any specific point in this regard. In fact, it was mentioned by the JCM members that the legal view on the issue of nomination of life time arrear of family pension is that since he/she has not earned the family pension he/she also can not have the right to nominate. As such, the matter may be dropped.</p>
<p>(vii)<strong> Payment of arrears of <a href="AIRF, AIRF Latest News, Department of Pension and Pensioners Welfare, JCM meeting on Pensionary Matters, Minutes of JCM Meeting, National Council JCM, Pensionary Issues, Pensionary Matters, Central Government Employees news">pension</a>/family pension on account of revision of pension/family pension with effect from 1.1.2006.</p>
<p>Specific case of bank In Chandrapur</strong>.</p>
<p>It was informed that the matter was taken up with CPPC, Mumbal (SBI), who informed that the payment to pensioners is being made and there is no such case where pension has not been revised as per <a href="http://centralgovernmentnews.com/category/6cpc/">6th CPC</a>. Hence the matter may be dropped.</p>
<p>(viii) <strong>Payment of Pension to the spouse of pensioners through S.B. account opened jointly with spouse<br />
</strong><br />
&#8211; <strong>Problem in SBI.<br />
</strong><br />
CPAO has informed that necessary instructions in this regard have been issued to all CPPCs with the direction to bring the contents to the notice of all paying branches. CPAO was requested to give a copy to the JCM. It was decided to drop the matter.</p>
<p>3. The representatives of JCM also desired the status of eight agenda items sent by Shri Shiva Gopal Mishra, General Secretary, AIRE which were not included may also be intimated clearly. This may be informed to him separately.</p>
<p>4. After above discussion on Action Taken Report on the minutes of meeting dated 6.11.2012, fresh agenda items were taken for discussion which are as under</p>
<p>(i)<strong> Equitable Gratuity under Rule 50 of Pension Rules. Slabs are too wide leading to disparity.<br />
</strong><br />
Rule 50 of Pension Rus provide the following death gratuity to the family of the deceased Government servant.</p>

<p>This issue was discussed in the JCM meeting. The present slab of death gratuity was introduced w.e.f. from 1.1.1986 and was introduced as per the recommendations of 4th Central Pay Commission, vide this Department’s OM No. 2/1/1987-PIC-II dated 14.4.1987, This slab has not been revised since 1986. In between, the 5th and 6th Pay Commission had submitted their reports but no revision had been recommended. After discussions, it was decided that the matter may be examined in consultation with Department of Expenditure.<br />
Action: DOP&amp;PW</p>
<p>(ii) Extension of CS (MA) Rules, 1944 to Central Government Pensioners residing in non-CGHS areas.<br />
The Staff Side demanded that as in the case of serving employees, the CS (MA) Rules may be extended to the pensioners also. This would make pensioners in the non CGHS areas entitled for reimbursement of medical expenses. Staff Side also mentioned that Honble Supreme Court has dismissed some SLPs and allowed reimbursement of medical examination of pensioners, in accordance with CS (MA) Rules.</p>
<p>The representative from Ministry of Health informed that the proposal for extension of CS (MA) Rules 1944 to Central Government pensioners was not agreed to in view of huge financial impliations. In regard to the dismissal oF SLP flied by Department against order of courts/tribunals for grant of medical benefits irn individual cases, Ministry of Health has flied a review petition in Supreme Court. It was also informed that Ministry of Health is contemplating Health Insurance Scheme on pan India basis keeping special focus on the non CHGS areas. This Is expected to solve the problems of pensioner’s living in non <a href="http://centralgovernmentnews.com/category/cghs/">CGHS </a>areas. The item was treated as closed.</p>
<p>(iii) Grant of modified parity with reference to the Revised Pay Scale corresponding to pre revised Pay Scale of the post from which an employee had retired — upgraded pay scale Instead of normal replacement scales.</p>
<p>The JCM suggested that upgraded revised pay scales may be notionally extended and used for pension fixation instead of normal replacement scales.</p>
<p>It was informed that after the 5th Pay Commission also modified parity was allowed with reference to replacement pay scales and not with the upgraded pay scales. This decision of Government was also upheld by Supreme Court in its judgement dated 23.11.2006 in the CA No. 3173-3174/2006 &amp; 3188-3190/2006 (K. S. Krishna Swamy Vs. UOI). In the <a href="http://centralgovernmentnews.com/category/6cpc/">6th CPC</a> the same principle has been followed in view of the above. It was informed that it would not be possible to reopen this issue.Therefore, the Ítem may be closed.</p>
