<p>In exercise of the powers conferred by the Central Government Vide Notification No. S.0.190(E) dated 19th January, 20 17 of the Ministry of Labour &amp; Employment, the undersigned hereby revise the rates of Variable <strong><a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener">Dearness Allowance</a></strong> on the basis of the average consumer price index number for the preceding period of six month ending on 30.06.2020 reaching 329.16 from 324 (Base 2001-100) and thereby resulting in an increase of 5.16 points for <strong>Industrial workers</strong> and direct that this order shall come into force w.e.f. 01.10.2020.</p>



<p>RATES OF V.D.A.FOR EMPLOYEES EMPLOYED IN <strong>“Employment of Sweeping and Cleaning excluding activities prohibited under the Employment</strong> <strong>of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993″.</strong></p>

<p>The VDA has been rounded off to the next higher rupee as per the decision of the Minimum Wages Advisory Board.</p>

<p>The classification of workers under different categories will be same as in Part­-I of the notification, whereas classification of cities will be same as in the Part-II of the notification dated 19th January, 2017. The present classification of cities into areas A, B &amp; C is enclosed at Annexure I for ready reference.</p>

<p>Sir,</p>



<p>As reported in media, several states are changing/ suspending labour laws to the inconvenience of the workforce of the Nation and hence we write this for your kind intervention so that humanity is not crucified at the alter of business.</p>



<p>As you are aware, the International Labour Organisation has passed the “Hours of Work (Industry) Convention 1919” and the same has been ratified by India in 1921 thus making it obligatory on the part of India to honour its commitments to <strong>restrict hours of work to not more than 8 (eight) hours per day or maximum 48 hours per week.</strong></p>

<p>However, taking advantage of the fact that the subject is covered under the “concurrent list”, several State Governments are arbitrarily changing the law to increase the working hour per day to 12 hours and some state governments are also proposing to suspending all labour law for 1000 days, all these in the name of encouraging /attracting Industries in their respective states.</p>



<p>The <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> Pandemic is unprecedented and to cope up with the situation patience and compassion is needed, particularly when India is a welfare state and a democracy.</p>



<p>It may be appreciated that in any industry, there are 5 elements of a cost of product viz: Direct Labour, Direct Material, Direct Expenses, Factory Overheads, and, Distribution &amp; Selling and Administrative overheads. The cost of labour is hardly 10 percent of the total cost of product and in spite of this it is the labour which has become an epicenter of discrimination.</p>



<p>As is evident from various press reports, the workforce in the unorganized sector, which comprises 90% of the workforce of this country are virtually left at the mercy of circumstances with the implementation agencies being a total failure in ensuring even the statutory minimum wages. Thus, under such circumstances, any changes and/ or suspension of Labour laws will result in devastation of humanity per se.</p>



<p>Under the compulsion of competition, it appears the State governments have categorized labour as a “commodity” and are blatantly misusing their powers to browbeat this important element of human race.</p>



<p>The prevailing circumstances compel us to remind that the Principles of ILO as expressed in its preamble to the founding documents states that “Labour is not a commodity, people should not be treated as inanimate commodities…. People who work for a living should be treated as human beings and accorded dignity and respect.”</p>



<p>In view of the seriousness of the issue, we urge the central government to play a proactive role and ensure that States stop taking advantage of the “concurrent” list scenario and change and/or suspend operation of labour laws. Necessary directives/advisories may be issued by the Centre immediately.</p>

<p>In exercise of the powers conferred by Central Government vide Notification No. S.O. 188(E) dated 19th January, 2017 of the Ministry of Labour and Employment the undersigned, hereby revise the rates of Variable Dearness Allowance on the basis of the average consumer price index number for the preceding period of six months ending on 31.12.2018 reaching 301.33 from 288.33 (base 2001 = 100) and thereby resulting in an increase of 13 points for Industrial Workers as under. This order shall come into force w.e.f. 01.04.2019 :-</p>

<p>Therefore the minimum rates of wages showing the basic rates and Variable Dearness Allowance payable w.e.f. 01 04 2019 will be as under :-</p>

<p>The VDA has been rounded off to the next higher ru pee as per the decision of the Minimum Wages Central Advisory Board.</p>



<p>The classification of workers under different categories will be same as in Part­ I of the notification, whereas classification of cities will be same as in the Part-II of the notification dated l9th January, 2017. The present classification of cities into areas A, 8 &amp; C is enclosed at Annexure I for ready reference.</p>

<p style="text-align:center">New Delhi, the 29th January, 2019 </p>



<p><strong>G.S.R. 56 (E)</strong>.- Whereas a draft of certain rules further to amend the Minimum Wages (Central) Rules, 1950, among other rules, were published as required by sub-section (1) of section 30 of the Minimum Wages Act, 1948 (11 of 1948), in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i) vide notification of the Government of  India in the Ministry of  Labour and Employment number  G.S.R.  413(E),dated the 23rd April, 2018, inviting objections and suggestions from all persons likely to be affected thereby, within  a  period  of  three  months,  from  the  date  on  which  copies  of  Official Gazette containing the said notification were made available to the public;</p>



<p>And whereas copies of the said Official Gazette were made available to the general public on the 23rdApril, 2018; </p>



<p>And whereas the objections and suggestions received on the said draft rules from the public have been considered by the Central Government;</p>



<p>Now,  therefore,  in  exercise  of  the  powers  conferred  by  section  30  of  the  said  Act,  the  Central Government hereby makes the following rules further to amend the Minimum Wages (Central) Rules, 1950, namely:-</p>



<ol class="wp-block-list"><li>(1) These rules may be called the Minimum Wages (Central) Amendment Rules, 2019. <br /> (2) They shall come into force on the date of their publication in the Official Gazette.</li><li>In the Minimum Wages (Central) Rules, 1950,- </li></ol>



<p>(a) in rule 21, for sub-rule (4A), the following sub-rule shall be substituted, namely:- </p>



<p>(4A)  Every  employer  shall,  on  or before  the  1st  day  of  February  in  each  year,  upload  unified  annual return  in  Form  III  on  the  web  portal  of  the  Central  Government  in  the  Ministry  of  Labour  and Employment giving information as to the particulars specified in respect of the preceding year:</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>Provided that during inspection, the inspector may require the production of accounts, books, registers and other documents maintained in electronic form or otherwise.</p></blockquote>



<p><em>Explanation</em>.-  For the purposes of this sub-rule, the expression “electronic form”  shall  have the same meaning as assigned to it in clause (r) of section 2 of the Information Technology Act,  2000 (21 of 2000).’; </p>



<p>(b) in Form III, for the word,  figures, brackets and letter “Rule 21(4A)(1)”,  the word, figures, brackets and letter “Rule 21(4A)” shall be substituted. </p>

<p><strong>Note</strong>:  The Minimum Wages (Central) Rules, 1950 was published in the Gazette of  India vide  notification number  S.R.O. 776, dated the 14th October, 1950 and lastly amended vide notification number G.S.R. 182(E) dated the 12th March, 2015.</p>

<p>(a) whether it is a fact that Parliamentary Committee on Home Affairs has shown its displeasure over duty allowances of Home Guards in various States and Union Territories, which is less than minimum wages;</p>
<p>(b) the guidelines of Supreme Court in respect of duty allowances of Home Guards and the reasons for not implementing them in Union Territories till now; and</p>
<p>(c) whether Government would again take up the issue of implementing it in those States where it has not been implemented?<br />
ANSWER</p>

<p>(a) to (c): The Department Related Parliamentary Standing Committee on Home Affairs in its 201st Report has shown its displeasure over the non-implementation of Hon&#8217;ble Supreme Court Order regarding payment of duty allowances to the Home Guards by the States.</p>
<p>The Hon&#8217;ble Supreme Court in the Civil Appeal No. 2759 of 2015, vide order dated March 11, 2015, directed that the State Government should pay Home Guards at such rates, total of which 30 days ( a month) come to minimum of pay to which the police personnel of States are entitled. It is expected that the State Government shall pass appropriate orders in terms of aforesaid observation on an early date.</p>
<p>Home Guards is a State/UT subject. Pay and allowances of Home Guards are governed by the Home Guards Acts and Rules of the respective States/UTs. Directorate General (Fire Services, Civil Defence and Home Guards), Ministry of Home Affairs vide letters dated 4th June 2015, 16th September 2016, 6th March, 2017, 24th April, 2017 and 11th April, 2018 have requested all the States/UTs to implement the aforementioned decision of the Hon&#8217;ble Supreme Court. Further, the Ministry of Home Affairs vide letters dated 4th May, 2018 and 18th July, 2018 has also requested the States/UTs to implement the same.</p>

<h1 style="text-align: center;">Fixing minimum wages for domestic work</h1>
<p style="text-align: right;">07 MAR 2018</p>
<p>Many of the State Governments like Rajasthan, Kerala, Punjab, Tamilnadu and Tripura have included domestic workers in the schedule of the Minimum Wages Act and the domestic worker are therefore entitled to file cases before the concerned authorities in case of any grievance in this regard. The registration of the placement agencies is a State subject. An advisory has been issued to all the State Government requesting them to take steps for formulation of a policy at their own level for regulating these placement agencies. Moreover, meetings have been held on 6/12/2017 &amp; 12/2/2018 at Shillong and Kolkata respectively where representatives of the Ministry of Labour and Employment, ILO, representatives of the State Governments and other stakeholders had participated to discuss the matter.</p>
<p>This information was given by Shri Santosh Kumar Gangwar, Union Minister of State (I/C) for Labour and Employment in written reply to a question in Rajya Sabha today.</p>

<p>Ref: Board&#8217;s letter of even number dated 20.10.2015</p>
<p>Payment of minimum wages to workers employed on Railways under the various provisions of the Contract Labour (R&amp;A) Act, 1970 has become a pivotal issue in the present economic scenario. A meeting in this regard was held by Chief Labour Commissioner (Centre) on 15.11.2017 wherein the following issues, inter alia, were discussed:</p>
<blockquote><p>(i) Whether new rates of minimum wages w.e.f. 01.04.2017 are being paid to the contract workers;</p>
<p>(ii) Mode of payment to contract workers through bank/cheque/cash;</p>
<p>(iii) Whether provident fund is deducted from the payment made to the contract workers and the same is credited to that PF account;</p>
<p>(iv) Whether medical facilities from ESI are made available to contract workers;</p>
<p>(v) Issue of slips towards payment made to contract worker to bring out transparency in the system.</p></blockquote>
<p>2. Since the factual report is to be submitted to Ministry of Labour &amp; Employment within 15 days, the Railways are requested to provide the information at the earliest at Fax No. 011 &#8211; 23070939.</p>

										<content:encoded><![CDATA[<p><strong>Minimum Wages to Labourers </strong></p>
<p>The Minister of State (I/C) for Youth Affairs and Sports Shri Vijay Goel said in the Lok Sabha today that the minimum wages to the labourers working under the Department of Sports &amp; Youth Affairs of Union Territory (UT) of Lakshadweep has been given as per the rates of daily wages fixed by the Directorate of Labour and Enforcement, UT of Lakshadweep, Kavarati Island. The details are as under:</p>
<p><strong>High Skilled Labourers  &#8211; Rs. 275/- + Variable DA (per day); and</strong></p>
<p><strong>Casual Labourers &#8211; Rs. 200/- + Variable DA (per day).  </strong></p>
<p>In a written reply he gave the details of funds allocated and released for this purpose during the last three years and the current year:-</p>
