Sub: <strong>Recovery of excess amount paid to pre-1996 retirees.</strong></p>
<p>I am directed to refer to your letter No.AIRF/44(29) ated 03.02.2014 on the above subject.</p>
<p>2. In this regard it is slated that clarificatory instructions dated 02.02.2010 &amp; 18.03.2010 were issued to all the Zonal Railways for correction of the error committed by some of the Zonal Railways while revising pension/family pension of such of the pre-1996 retirees of the 4th CPC scale of pay of Rs.1400-2300 w.e.f. 01.01.1996/01.01.2006. The Zonal Railways were advised that the corresponding scale in 5th CPC and Pay Band and Grade Pay in 6th CPC to the 4th CPC scale of pay of Rs.1400-2300 is Rs. 4500-7000 and PB-1+ GP 2800 respectively.</p>
<p>3. When the corrective action was taken by Zonal Railways, some of the pensioners approached different CAT benches praying for restoration of their incorrect pension/family pension and for stoppage of recovery. In almost all the cases, the Hon’ble CAT has upheld the action of the Zonal Railways for correct revision of pension/family pension. On recovery aspect, in few cases, CATs have observed that since there was no misrepresentation on the part of the railway servants, no recovery be made.</p>
<p>4. In three of such cases, the Railway has filed writ petition against the order of the CAT challenging the stoppage of recovery ordered by CATs, which are still pending before High Courts. As such, any decision in regard to recovery or otherwise can only be taken after the judgment in The said cases are pronounced.</p>

<div>The undersigned is directed to convey the approval of the Union Cabinet for doubling the existing rate of payment of HPCA / PCA to all eligible Group &#8216;C&#8217; and &#8216;D&#8217; employees working in Hospitals, Dispensaries and Organizations in the Central Government from the period w.e.f. 1.9.2008. The amount of HPCA/PCA would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. This is subject to the following terms and conditions :-</div>

<div>(i) HPCA/PCA may be admissible in case the individual proceeds on leave/training for less than one calender month.</div>
<div></div>
<div>(ii) HPCA / PCA may not be admissible in case the individual proceeds on leave/training for more than one calender month.</div>
<div></div>
<div>(iii) HPCA / PCA should not be admissible in case of unauthorized leave.</div>
<div></div>
<div>This issues with the approval of Department of Personnel and training vide their D.O. No.21012/01/2010-Estt.(AL) dated 18th October, 2012 and U.O. of even number dated 11th December, 2012.</div>

<div>References have been received from Zonal Railways seeking clarification regarding grant of benefits under MACPS in respect of the employees qualifying through LDCE/GDCE. The matter has been examined in consultation with Department of Personnel &amp; Training (DoP&amp;T), the nodal department of Government on MACPS and it has been decided as under:</div>

<div>(i) If the relevant RRs provide for filling up of vacancies in a grade by Direct Recruitment, induction of an employee to that grade through LDCE/GDCE may be treated as Direct Recruitment for the purpose of grant of financial upgradation under MACPS. In such cases past service rendered in a lower pay scale/Grade Pay shall NOT be counted for the purpose of MACP Scheme.</div>

<div>(ii) if the relevant RRs prescribe a <strong><span style="text-decoration: underline;">promotion Quota</span></strong> to be filled on the basis of LDCE/GDCE, such appointment would be treated as promotion for the purpose of benefit under the MACPS and in such cases, past regular service shall also be counted for further benefits, if any, under the MACP Scheme.</div>

<div>The Ministry of Railways has approved the following full/partial cancellation/diversion of trains during fog. There will be no booking for these trains during likely fog period from 1st January 2013, which ever is earlier, to 17th February 2013. Hover, the Ministry of Railways has directed Zonal Railways to keep a close watch on the field situation and in case there is no fog, booking for the trains, which are proposed to be cancelled, will be started with a three day notice with a condition that the train may be cancelled in case there is fog.</div>

The cancellation etc. of trains is being announced in advance so that travellers can plan their alternative journeys accordingly and are put to minimum inconvenience.</p>

<p>Several Instructions have been issued from time to time on the subject of recognition of reputed professional Institutions/Societies (both national and International) and on the procedures, terms and conditions governing such re-imbursement with an objective to encourage Railway personnel take membership and avail of re-imbursement to the tune of 90% of membership fee.</p>
<p>2. The question of having a self-contained booklet on the subject which provides for the relevant guidelines in a summarized form and providing therewith interpretations of the intricate instructions/orders pertaining to the subject was under consideration for quite some time. A booklet as Standards of operating Procedure (SOP) in bilingual form has been prepared on the subject and is enclosed which may facilitate smooth implementation of the policies on the<br />
subject.</p>
<p>3. The booklet must not be used as a substitution to the original instructions but to be used only as guidelines/hand out.</p>
<p>4. Wide publicity may be given at all relevant levels.</p>
<p>5. This issues with the concurrence of Finance Directorate of the Ministry of Railways.</p>

<p>Sub: <strong>Cashless Service for RELHS Card Holder to take treatment in Recognized Private Hospitals in emergency.</strong></p>
<p>In an endeavour to alleviate the problems faced by the Sr. Citizens in getting treatment in emergency, a cashless service for RELHS card holders to take treatment in recognized private hospitals of National Capital Region was introduced by Northern Railway vide Board’s letter of even no. dated 29.02.2008 as a Pilot Project. The scheme was subsequently extended by one year each on two occasions i.e. up to 20.08.2011 vide Board’s letters of even no. dated 13.11.2009 and 27.01.2011.</p>
<p>The issue of extension of the scheme or otherwise was under consideration in the Ministry of Railways for sometime. The Competent Authority in the Ministry of Railways after careful consideration in the matter, has decided to extend the facility till further orders for RELHS beneficiaries to take care of their health care needs in an acute emergency. This scheme will now be available in all Metros, State Capitals and Zonal Headquarters of the Indian Railways. Detailed guidelines on the subject attached.</p>

<p><strong>CASHLESS SERVICES FOR RELHS CARD HOLDERS TO TAKE TREATMENT IN RECOGNIZED PRIVATE HOSPITALS IN EMERGENCY</strong></p>
<p>Terms &amp; Conditions of the Scheme</p>
<p>i. The scheme is to be implemented in all the Metros, State Capitals and Zonal Headquarters.</p>
<p>ii. Zonal Railways shall enter into an ‘MOU’ with already empanelled hospitals under their jurisdiction for the scheme. Further, if there are not enough recognized multi-specialty hospitals, zonal Railways shall recognize CGHS empanelled hospitals on CGHS approved rates and/or other hospitals as per extant policy and enter into an ‘MOU’ for the Smart Card Scheme.</p>
<p>iii. Smart Card should provide necessary demographic data and other relevant information on a standardized format.</p>
<p>iv. Zonal Railways shall award the job of issuing the Smart Card to a suitable services provider on most competitive rates, through open bidding.</p>
<p>v. It shall be the responsibility of the hospital to inform the authorized medical attendant regarding emergency within 24 hours. In case an admission is found to be of non-emergency nature, the treating hospital shall refer the patient to authorized medical attendant in next 24 hours.</p>
<p>vi. The scheme shall be implemented with the existing man power of Zonal Railways.</p>
<p>vii. Issuance of Smart Card is made mandatory to RELHS beneficiaries residing in the regions mentioned in (i) above and cost of the card as decided upon may also be included in the contribution towards joining RELHS at the time of retirement.</p>
<p>viii. The following conditions, shall qualify as emergencies.</p>
<p>• Acute cardiac conditions/syndromes.</p>
<p>• Vascular catastrophes, Cerbo-vascular accidents.</p>
<p>• Acute respiratory emergencies.</p>
<p>• Acute abdomen including acute obstctrical.gynccological emergencies.</p>
<p>• Life threatening injuries.</p>
<p>• Acute poisioninig and snake bite.</p>
<p>• Acute endocrine emergencies.</p>
<p>• Heat stroke and cold injuries of a life threatening nature.</p>
<p>• Acute renal failure.</p>
<p>• Severe infections leading to life threatening situations.</p>
<p>• Any other condition in which delay could result in loss of life or limb.</p>

<p>The organised labour requested in the JCM meeting for provision of rest rooms facility at wayside stations for the staff belonging to safety/operational categories and for the staff attending to the failures at outstations &amp; remote places.</p>
<p>The issue was examined and it is advised that Zonal Railways may identify stations where resting facilities are to be provided in consultation with the federations. This may be done especially for remote &amp; wayside stations where frequency of passenger carrying trains is less and road transportation facility is infrequent.</p>
<p>This may be considered in the phased manner and all other possibilities may be explored to resolve this issue”. The action taken may be advised to Board.</p>

<p>Sub:- <strong>Grant of arrear of stagnation increment, consequent to the implementation of 6th CPC — reg.</strong></p>
<p>During the period when recommendations of 5th Central Pay Commission were in vogue i.e. prior to implementation of the recommendations of 6th Central Pay Commission, there were employees, who had reached the maximum of the scale of pay and (5th CPC) were in receipt of stagnation increment, after an interval of two years.</p>
<p>Fixation of pay of such employees as per recommendations of 6th cpc was done based on pay drawn by them on 31.02.2005 and they were given increment from 1st July, 2006. The pay structure of 6th CPC was given effect from 01.01.2006. However, such of the stagnated employees were not extended the under noted benefits:-</p>
<p>“Those employees should have been extended the benefit of their normal increment during Feb to June 2006 as if they were not stagnating during the same period. They may also be considered accordingly for re-fixation of pay and payment of consequent arrears.”</p>
<p>The above demand of the employees assumes more significance because of the fact that such employees had been stagnating for longer durations in the same scale of pay without any promotion, and really deserved the financial benefits. Since number of such employees is not going to be too large, NFIR therefore, requests the DOPT to issue instructions for granting the benefit mentioned above. Action taken in the matter may be advised to the Federation.</p>
