<p>The Maternity Benefit Act, 1961 is enforced and implemented by the respective State Governments in all sectors except in the Mines and Circus Industries.  As per the Maternity Benefit (Amendment) Act, 2017, it has been made mandatory for the establishments employing 50 or more employees to provide creche facility, either separately or along with common facilities within a prescribed distance. Time to time, advisories are issued to State Governments for strict enforcement and compliance of the provisions of the Maternity Benefit Act, 1961. Government does not maintain data of defaulters centrally. Implementation of provisions relating to nursing breaks are also enforced by State Governments, except in case of mines and circus.</p>

<p>Subject: <strong>National Minimum Guidelines for setting up and running creches under Maternity Benefit Act, 2017 &#8211; Forwarding of</strong></p>
<p>The undersigned is directed to refer to the subject mentioned above &amp; to say that the Ministry of Labour &amp; Employment has notified the Maternity Benefit (Amendment) Act, 2017 mandating that &#8220;every establishment having fifty or more employees shall have the facility of creche within such distance as may be prescribed, either separately or along with common facilities&#8221;,</p>
<p>2. In this regard, to enable and facilitate the employer for establishing and managing the creche facility, the Ministry of Women &amp; Child Development has formulated the <strong>National Minimum Guidelines for Setting Up and Running Creches under Maternity Benefit Act 2017</strong> (copy enclosed).</p>
<p>3. It is requested to circulate the said guidelines to each and every employer/ institution covered under the Maternity Benefit Act thereby empowering them with the requisite know how to set up modeling the  facilities with adequate provisions. A copy of the said guidelines can also be downloaded from the Ministry&#8217;s website &#8211; <strong>www.wcd.nic.in</strong>.</p>

<p style="text-align: center;"><strong>Government to refund employers for seven weeks of maternity leave given to employees: WCD</strong></p>
<p>The government will give employers the salaries for seven of the 26 weeks of maternity leave for women earning more than Rs 15,000 a month, the Women and Child Development ministry announced on Thursday.</p>
<p>The announcement, which covers the government as well as the private sector, comes in the wake of complaints that many companies were reluctant hire pregnant women after maternity leave was extended from 12 to 26 weeks and some were even firing women employees.</p>
<p>WCD Secretary Rakesh Srivastava said it has been decided to utilise the funds lying in the labour welfare cess to pay the employers.</p>
<p>&#8220;The utilisation of the labour welfare cess lying with the state governments has been very less. After talks with the Labour Ministry it has been decided that the seven of the 26 weeks of maternity leave for all women employees in the private and government sector getting more than Rs 15,000 a month would be paid from that fund,&#8221; Srivastava told reporters here.</p>
<p>The labour welfare cess has been given to state governments to ensure the welfare of workers.</p>
<p>Maternity leave was extended from 12 weeks to 26 weeks last year.</p>
<p>According to Srivastava, there were complaints from women that they were getting fired from their jobs due to the increased duration of maternity leave.</p>
<p>“The government has now decided that out of the 14 extra weeks, half of the amount of salary paid to the pregnant woman would be refunded to the employer from the funds of the labour welfare cess,” he said.</p>
<p>Till March 2017, there was Rs 32,632 crore in the fund. Of this, just Rs 7,500 crore has been utilised, he said.</p>
<p>&#8220;We would be refunding the salary of seven weeks to the employer so women do not face problems upon returning to work,&#8221; he said.</p>
<p>&#8220;The labour minister has agreed to the proposal and we are now carrying it forward. There will soon be a notification from the Labour Ministry with further details,&#8221; he added.</p>

<p><strong>Amendments to the Maternity Benefit Act, 1961</strong></p>
<p>The Union Cabinet, chaired by the Prime Minister Shri Narendra Modi, has given its ex-post facto approval for amendments to the Maternity Benefit Act, 1961 by introducing the Maternity Benefit (Amendment) Bill, 2016 in Parliament.</p>
<p>The maternity benefit Act 1961 protects the employment of women during the time of her maternity and entitles her of a ‘maternity benefit’ – i.e. full paid absence from work – to take care for her child. The act is applicable to all establishments employing 10 or more persons. The amendments will help 1.8 million (approx.) women workforce in organised sector.</p>
<p>The amendments to Maternity Benefit Act, 1961 are as follows:</p>
<p><strong>• Increase Maternity Benefit from 12 weeks to 26 weeks for two surviving children and 12 weeks for more than two children.</strong></p>
<p><strong>• 12 weeks Maternity Benefit to a ‘Commissioning mother’ and ‘Adopting mother’.</strong></p>
<p><strong>• Facilitate’Work from home’. • Mandatory provision of Creche in respect of establishment having 50 or more employees.</strong></p>
<h3><strong>Justification:</strong></h3>
<p><strong>• Maternal care to the Child during early childhood – crucial for growth and development of the child.</strong></p>
<p><strong>• The 44th, 45th and 46th Indian Labour Conference recommended enhancement of Maternity Benefits to 24 weeks.</strong></p>
<p><strong>• Ministry of Women &amp; Child Development proposed to enhance Maternity Benefit to 8 months.</strong></p>
<p><strong>• In Tripartite consultations, all stake holders, in general supported the amendment proposal.</strong></p>

										<content:encoded><![CDATA[<p><em>The Ministry of Labour is expected to amend the Maternity Benefit Act, 1961, which presently entitles women to 12 weeks of maternity benefit whereby employers are liable to pay full wages for the period of leave.</em></p>
<p><strong>Government to Increase Maternity Leave from 12 to 26 weeks</strong> – The International Labour Organisation recommends a minimum standard maternity leave of 14 weeks or more.</p>
<p>The union government is set to increase the maternity leave for women employed in private firms from the existing 12 weeks to 26 weeks.</p>
<p>Women and Child Development Minister Maneka Gandhi Monday said the Ministry of Labour has agreed to increase maternity leave to six-and-a-half months. “We had written to the Labour Ministry asking that the maternity leave be extended taking into account the six months of breastfeeding that is required post childbirth. The Labour Ministry has agreed to increase it to six-and-a-half months,” said Maneka.</p>
<p>The Ministry of Labour is expected to amend the Maternity Benefit Act, 1961, which presently entitles women to 12 weeks of maternity benefit whereby employers are liable to pay full wages for the period of leave.</p>
<p>Officials of the WCD Ministry said they will push for extending the leave to eight months, or 32 weeks, for women employed in both private and government sectors.</p>
<p>But WCD officials said the Labour Ministry has expressed reservations about increasing the maternity leave any further as they perceive that doing so will adversely affect the employability of women.</p>
<p>“The Labour Ministry has decided on six-and-a-half months following meetings with various stakeholders. We, however, feel that eight months of maternity leave — for women in government as well as private sectors — is required. We will move a note to the Cabinet Secretariat in this regard. Six months of exclusive breastfeeding is very important to combat malnutrition, diarrhoea and other diseases in infants and to lower infant mortality rate,” said a WCD official.</p>
<p>The International Labour Organisation recommends a minimum standard maternity leave of 14 weeks or more, though it encourages member states to increase it to at least 18 weeks. At 26 weeks, India is set to join the league of 42 countries where maternity leave exceeds 18 weeks. It, however, falls behind several East European, Central Asian and Scandinavian countries, which have the most generous national legislation for paid maternity leave.</p>
<p>Women employed in government jobs in India get a six-month maternity leave as per the Central Civil Service (Leave) Rules 1972. The last circular in this regard was issued in 2008, when it was increased from four-and-a-half months. If the WCD Ministry’s recommendations to the Cabinet Secretariat are accepted, the Department of Personal &amp; Training will have to issue orders to enhance it to eight months.</p>
<p>Moreover, women government employees are allowed to take childcare leave of up to two years in phases at any point till their child turns 18 years old. The Seventh Pay Commission recently recommended that only the first 365 days of leave should be granted with full pay, while the remaining 365 can be availed at 80 per cent of the salary. But Maneka recently petitioned Finance Minister Arun Jaitley against the proposal, terming it a regressive step at a time when women are trying to become more economically independent.</p>
<p>“Women in India need longer maternity leave in absence of any support in parenting from men. It should not be seen as a deduction in labour hours but as a long-term investment from the future economic point of view. This is in addition to the fact that women need long maternity leave to recuperate and invest in child care,” said Ranjana Kumari, director of the Centre for Social Research.</p>
<p>She added that a recent analysis of the Maternity Benefit Act by CSR for the National Commission of Women showed that discrimination against pregnant women was widely prevalent in the corporate sector in the country.</p>
