<p>The undersigned is directed to refer to this Department&#8217;s O.M. of even no. dated 20.09.2018 vide which the <a href="https://centralgovernmentnews.com/category/ltc/" target="_blank" rel="noreferrer noopener" aria-label="LTC (opens in a new tab)">LTC</a> scheme allowing Government servants to travel by air to North East Region (NER), Jammu and Kashmir (J&amp;K) and Andaman &amp; Nicobar Islands (A&amp;N) in lieu of Home Town LTC, was extended for a period of two years till 25 September, 2020.</p>

<p>2. Para 2 (iii) of the aforesaid O.M. provides that Fresh Recruits are allowed conversion of one of the three Home Town LTCs in a block of four years, applicable to them. In this regard, as per the extant instructions, fresh recruits to Central Government are allowed <a rel="noreferrer noopener" aria-label="LTC (opens in a new tab)" href="https://centralgovernmentnews.com/category/ltc/" target="_blank">LTC</a> to their home town along with families on three occasions in a block of four years and to any place in India on the fourth occasion. This facility is available to fresh recruits for the first two LTC blocks of four years applicable after joining the Government for the first time. As per the aforesaid O.M., out of these three Home Town LTC, one LTC may be converted by the fresh recruits to travel by air to visit UT of J&amp;K/ UT of Ladakh/ NER/ A&amp;N.</p>

<p>3. In this regard, it has been decided to allow fresh recruits one additional conversion of Home Town LTC to travel by air to any place in Union Territory of Jammu &amp; Kashmir in each block of four years, i.e. in total 4 times in initial 8 years after being eligible for LTC (twice in each block of four years). The travel entitlements and other LTC conditions for this scheme shall be the same as given in DoPT&#8217;s O.M. No. 31011/3/2018- Estt.A-lV dated 20.09.2018 and 20.06.2019.</p>



<p>4. This facility will be valid till 25.09.2020. </p>

<p><strong>Subject: Proposed Protest by Government Employees from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (NPS) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission &#8211; Instructions under CCS (Conduct Rules), 1964 &#8211; Regarding.</strong></p>



<p>It has been brought to the notice of the Government that a forum by the nomenclature of National Joint Council of Action (NJCA) has decided to organize protest from March 15, 2019 to March 30, 2019 to protest against National Pension Scheme (<a href="https://centralgovernmentnews.com/category/nps/" target="_blank" rel="noreferrer noopener" aria-label="NPS (opens in a new tab)">NPS</a>) and to demand hike in Minimum pay and fitment factor under 7th Central Pay Commission</p>



<p>The instructions issued by the Department of Personnel and Training prohibit the Government servants from participating in any form of strike/protest including mass casual leave, go slow etc. or any action that abet any form of strike/protest in violation of Rule 7 of the CCS (Conduct) Rules, 1964. Besides, in accordance with the proviso to Rule 17(I) of the Fundamental Rules, pay and allowances is not admissible to an employee for his absence from duty without any authority. As to the concomitant rights of an Association after it is formed, they cannot be different from the rights which can be claimed by the individual members of which the Association is composed. It follows that the right to form an Association does not include any guaranteed right to strike/protest.</p>



<p>There is no statutory provision empowering the employees to go on strike. The Supreme Court has also agreed in several judgements that going on a strike/performing any sort of protest is a grave misconduct under the Conduct Rules and that misconduct by the Government employees is required to be dealt with in accordance with law. Any employee going on strike/protest in any form would face the consequences which, besides deduction of wages, may also include appropriate disciplinary action. Kind attention of all employees of this Department is also drawn to this Department’s O.M. No.33012/1/(S)/2008 Estt.(B) dated 12.9.2008, on the subject for strict compliance (enclosed as Annexure-A).</p>



<p>All officers are requested that the above instructions may be brought to the notice of the employees working under their control. All officers are also requested not to sanction Casual Leave or any other kind of leave to the officers and employees, if applied for, during the period of proposed Dharna/demonstration, and ensure that the willing employees are allowed hindrance free entry into the office premises.</p>



<p>In case employees go on protest anytime during the period 15.03.2019 to 30.03.2019, all Divisional Heads are requested to forward a report indicating the number and details of employees, who are absent from duty during the period of said protest, i.e. from 15.03.2019 to 30.03.2019.</p>

<p>The progress of writing of APARs of CSS officers was monitored closely and it was observed that a large number of ORUs, Reporting &amp; Reviewing Officers, had not recorded their remarks in the APARs even after the expiry of extended date-lines. All the Ministries/Departments were, therefore, requested vide O.M. dated 29.11.2018 to send ‘alert’ to all the officers for completing action on their part at the earliest and force forward APARs of ORUs, who failed to submit their self-appraisal by 14.12.2018, to next level i.e. Reporting Officer. The ‘SPARROW’ window has been closed on 31.12.2018.</p>



<p>The details of activities completed for writing of APARs on SPARROW for the year 2017-18 are as under:</p>

<p>Attention is invited to the O.M. dated 29.11.2018 followed by Secretary (P)’s D.O. dated 11.12.2018, in terms of which the APARs for 2017-18 pending at ORU level were required to be force forward to next level i.e. Reporting Officer. However, 51 APARs for 2017-18 were closed at ORU level. The concerned Ministries/Departments are requested to elaborate reasons for not force-forwarding these APARs to the next level i.e. Reporting Officer. A list of 51 ORUs whose APARs were not force forwarded is enclosed at Annexure.</p>



<p>Secondly, inspite of clear cut instructions from this Department vide O.M. No.21011/02/2009-Estt(A) dated 16.02.2009, a large number of APARs have been closed at the level of Reporting Officers and Reviewing Authorities. Further, around 286 APARs are pending for Disclosure. It is brought to the notice of all the Ministries/ Departments that the APAR for 2017-18 are now available for viewing to the officer concerned by visiting sparrow-css.eoffice.gov.in-> Dossier-Ny Completed PAR. The officers may be advised to view their APARs for 2017-18 through above link and send representation, if any, to their Ministry/Department, within 15 days from the issue of this O.M. Their representations may be examined as per the extant instructions and outcome of such representations may be intimated to the officer concerned under intimation to this Department.</p>



<p>All the Ministries/ Departments are, therefore, requested to take necessary action as per extant instructions and send a completion report alongwith a printout of APARs for 2017-18 closed on SPARROW web portal for records in this Division.</p>
