<h3 class="wp-block-heading">Subject: Review of Modified Flexible Complementing Scheme (MFCS) &#8211; reg.</h3>



<p>The undersigned is directed to refer to this <strong>Department OM of even number dated 16.4.2020</strong> (copy enclosed) followed by <strong>reminder dated 06.07.2020</strong> on the above-mentioned subject conveying therein the following recommendations made by Committee of Secretaries (CoS), in its meeting held on 20th February 2020, while considering the proposal of review of Modified Flexible Complementing Scheme (MFCS):</p>



<ul class="wp-block-list"><li>Ministries/ Departments may carefully rework the Output Indicators so as to simplify and streamline them. Qualitative dimensions may also be captured so that excellence of a Scientist is brought out and only the deserving Scientists get promoted.</li><li>Ministries/ Departments may ensure that all promotions under MFCS are held timely so that the issue of granting retrospective promotion does not arise.</li><li>Number of posts required at HAG/ HAG+ level may be worked out individually at the Ministry/ Department level looking at the organizational structure and their specific requirements. Cadre review exercise may accordingly be undertaken.</li></ul>



<p>2. A response in this regard is still awaited. It is, therefore, requested that Action Taken Report on the recommendations made by CoS, may kindly be provided to this Department at the earliest.</p>

<p>The undersigned is directed to refer to Central Civil Services (Classification, Control &amp; Appeal) Rules, 1965 [CCS(CCA) Rules, 1965] and Central Civil Services (Pension) Rules, 1972 [CCS(Pension) Rules, 1972] and the instructions issued under these Rules wherein certain time-limes have been prescribed for various activities/ events/ procedures relating to procedures under the said Rules. For instance, in the said Rules/instructions, time limits have been prescribed for the following : –</p>



<ul class="wp-block-list"><li>Review of order of suspension before its expiry date <strong>[Rule 10(6) of CCS(CCA) Rules,1965]</strong></li><li>Submission of written statement of defence on the charge-sheet by the charged officer <strong>[Sub Rule 4 in Rule 14 of CCS (CCA) Rules, 1965]</strong></li><li>issuance of charge-sheet once a decision is taken by the Disciplinary Authority to initiate Disciplinary proceedings. [DoP&amp;T’s O.M. No. 425/04/2012-AVD-N(A) dated 29.11.2012],</li><li>completion of Inquiry and submission of report by the Inquiring Authority <strong>[Sub rule (24) in Rule 14 of CCS (CCA) Rules, 1965]</strong></li><li>disciplinary proceedings initiated against a Pensioner shall not be in respect of an event which took place four years before such initiation.<strong>[Rule 9 of CCS(Pension) Rules, 1972]</strong></li><li>Acceptance of notice of VRS under<strong> Rule 48A of CCS(Pension) Rules, 1972</strong> (The list is only illustrative and not exhaustive)</li></ul>



<p>2. Consequent upon the outbreak of <a rel="noreferrer noopener" aria-label="COVID-19 (opens in a new tab)" href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank">COVID-19</a>, and considering the unprecedented situation of the Lockdown w.e.f. 24th March 2020, it may not be feasible to adhere to the timelines prescribed in the said Rules and to the instructions issued under the Rules. It has accordingly been decided not to count the period of the Lockdown for the purposes of adherence to the prescribed timelines, including those listed above. For example, if the due date for completing a process/ work/ event at the start of the Lockdown falls after 20 days, then the due date will get postponed by the number of Lockdown days and the same number (20) of days will be available to complete the work after the Lockdown is lifted.</p>



<p>3. However, after the Lockdown is lifted, if the time left to complete the task is less than 15 days, then the processes may be allowed to be completed <strong>within 15 days.</strong></p>



<p>In addition, timelines may have been prescribed for receipt of applications for direct recruitment, deputation, etc. Where the last date of receipt of application for direct recruitment, deputation etc. falls within the period of the Lockdown, the last date shall be extended by the number of days of the Lockdown. Similarly, the time limits prescribed in the CCS (Conduct) Rules, 1964, for various purposes shall also be extended by the number of days of the Lockdown.</p>



<p>These instructions are applicable only in such cases where there is an intervening Lockdown period and it will not be applicable otherwise.</p>

<p>The undersigned is directed to say that this Department vide OM dated No. 21011/01/2009-Estt. (A) (Pt.II) dated 23.07.2009 as prescribed time schedule for recording and completion of <strong><a href="https://centralgovernmentnews.com/tag/APAR/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">APAR</a></strong>.</p>

In the light of situation arising out of spread of Novel Coronavirus (<strong><a href="https://centralgovernmentnews.com/tag/Covid-19/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">COVID-19</a></strong>), it has been decided with the approval of competent authority to revise the time schedule for some of the activities relating to recording of APAR. <p>The undersigned is directed to state that the leave sanctioning authorities were advised vide O.M. of even number dated 17th March, 2020 to sanction leave who wish to self-quarantine, as a preventive measure. In this regard, in relaxation of Central Civil Services <strong><a href="https://centralgovernmentnews.com/category/ccs/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">CCS</a></strong> (Leave) Rules, 1972, it has now been decided with the approval of competent authority to grant Commuted Leave without production of medical certificate to those officials who are above 50 years of age and have underlying conditions i.e. Diabetes, Respiratory problems, Renal diseases and other life-threatening illness, for a period upto 4th April, 2020, so as to avoid unnecessary burden on the health care system.</p>

<p>Sub:- <strong>Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19)</strong></p>



<p>With a view to contain the spread of Novel Coronavirus (COVID-19) it is imperative that the following precautionary measures are taken by all the Training Institutions: &#8211;</p>



<ul class="wp-block-list"><li>All Training Institutions may review the ongoing training programmes and take appropriate measures to defer / curtail them to the extent possible. It would not be advisable to undertake any new training programme for the time being.</li><li> <strong><a rel="noreferrer noopener" href="https://centralgovernmentnews.com/dopt-preventive-measures-to-be-taken-to-contain-the-spread-of-novel-coronavirus-covid-19/" target="_blank">DoPT Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19) March 17, 2020</a></strong> </li><li>Entry of visitors to training institution may be restricted. If absolutely necessary, such visitors may be admitted after proper screening. Installation of thermal scanner at the entry points of the buildings may be taken up wherever feasible. Hand sanitizers should be mandatorily placed at the entry points and every person-faculty member/ staff member/Visitor entering the premises should compulsorily clean their hands before entering the premises.</li><li>Availability of adequate hand sanitizers and running water/soap in the training institute should be ensured.</li><li> <a rel="noreferrer noopener" href="https://centralgovernmentnews.com/exemption-to-employees-to-mark-biometric-attendance-in-aadhar-based-biometric-attendance-system-aebas/" target="_blank"><strong>Exemption to employees to mark biometric attendance in Aadhar Based Biometric Attendance System (AEBAS) March 6, 2020</strong></a> </li><li>Training / Teaching may be conducted, as far as possible, in a virtual / online mode.</li><li>Adequate distance may be maintained between students in the physical classrooms</li><li>Meetings to the extent possible should be conducted through video conferencing only.</li><li>All non-essential travel may be avoided. Outside visits and excursions, group activities/ screening of movies etc. and physical training activities may be suspended with immediate effect.</li><li>Calling of guest faculty may be avoided.</li><li>All gyms /recreation centres, creches, book clubs etc. inside the premises may be shut down immediately.</li><li>A fully functional medical centre with the presence of qualified doctor(s) and nursing staff may be ensured with proper protocol for treating of staff/ faculty/ trainee with flu like symptoms. SOPs may be developed in consultation with local Public Health Authorities to ensure quick response for testing and isolation/ quarantine of symptomatic patients etc.</li><li>Separate quarantine facility may be created in consultation with local Public Health Authorities.</li><li> <strong><a rel="noreferrer noopener" href="https://centralgovernmentnews.com/latest-dopt-order-preventive-measures-to-contain-the-spread-of-covid19-for-all-central-government-employees/" target="_blank">Latest DoPT Order &#8211; Preventive measures to contain the spread of COVID19 for all Central Government Employees March 19, 2020</a></strong> </li><li>Mess Supervisors should ensure that all the trainees and mess staff wash their hands properly before entry into the Mess and before entry into the kitchen. Messaging outside the mess, its kitchen and the toilets about Dos and Don&#8217;ts&#8217; must be ensured.</li><li>Everything prepared in the mess must be cooked properly and raw salad and uncut fruit avoided for the time being. Linen should be changed frequently. The Trainees may be advised not to share the glass for drinking water and use only their respective water bottles for drinking water. Trainees may be advised not to use outside eateries as a preventive measure.</li><li>Common contact places including class rooms, hostels, mess, guest houses, vehicles/buses etc to be disinfected frequently. Dustbins may be placed in front of all the washrooms. Doorknobs of class rooms, toilets, hostel doors, canteen and all common facilities to be disinfected regularly.</li><li>All faculty members and staff members may be advised to take care of their own health as well as of their friends and family and look out for symptoms such as respiratory problems, fever, discomfort etc. In case anyone feels unwell and shows flu-like symptoms, should inform the Training Coordinator / designated faculty immediately and report to the Medical Centre of the training institutes.</li><li>All staff &amp; faculty at higher risks such as elderly employees, pregnant employees, employees with poor medical conditions and employees suffering from major chronic ailments may be advised to take proper care</li><li>Frequent hand washing with soap, water and alcohol-based hand rub, should be encouraged. Covering of nose and mouth while sneezing and coughing, throwing of used tissues in close bins immediately after use. Keeping a safe distance from persons during interaction, especially with those having flu like symptoms, sneezing in the inner side of the one&#8217;s elbow and not coughing into the palms of one&#8217;s hand, regular check of temperature and respiratory systems, consultation with the doctor in the event of one&#8217;s feeling unwell, wearing of mask and covering of mouth and nose while visiting a doctor and avoidance of social gatherings, must be strongly advised to every faculty member and staff member. Staff &amp; faculty should also be advised not to spit in the public, travel unnecessarily, participate in the large gathering, spending time in the canteens unnecessarily, visit gyms, clubs and crowded places.</li><li>The Health Advisories issued by the Ministry of Health and Family Welfare should be referred to and followed scrupulously.</li><li>Action taken in this regard may be intimated to this Department regularly.  </li></ul>

<p>Sub: <strong>Preventive measures to contain the spread of COVID19.</strong></p>



<p>In continuation of this Department OM of even no. dated 17th March, 2020 (Copy Enclosed), the following further instructions are issued:</p>



<p><strong><a href="https://centralgovernmentnews.com/dopt-preventive-measures-to-be-taken-to-contain-the-spread-of-novel-coronavirus-covid-19/" target="_blank" rel="noreferrer noopener" aria-label="DoPT Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19) (opens in a new tab)">DoPT Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19)</a></strong></p>



<p>(i) Heads of Department (HoDs) may ensure that 50 per cent of Group B and C employees are required to attend office every day, and the remaining 50 per cent staff should be instructed to work from home. All HoDs are advised to draft a weekly roster of duty for Group B and C staff and ask them to attend office on alternate weeks. While deciding the roster for &#8216;the first week, HoDs are advised to include officials who are residing in close proximity to their office or use their own transport to travel to the offices.</p>



<p>(ii) Further, the working hours for all employees who attend office on a particular day should be staggered. It is suggested that three groups of employees may be formed and asked to attend office as per the following timings:-</p>



<p><strong>(a) 9 AM to 5.30 PM<br />(b) 9.30 AM to 6 PM<br />(c) 10 AM to 6.30 PM</strong></p>



<p>(iii) The officials who are working from home on a particular day as per the roster drawn up should be available on telephone and electronic means of communication at all times. They should attend office, if called for any exigency of work.</p>



<p>(iv) Similar instructions may be issued to Attached/Subordinate Offices, Autonomous/Statutory Bodies.</p>

<p>(v) The Department of Financial Services (DFS) and Department of Public Enterprises (DPE) may issue similar instructions regarding Financial Institutions and Public Sector Undertakings.</p>



<p>(vi) These instructions shall not apply to the offices and employees engaged in essential / emergency services and those directly engaged in taking measures to control spread of COVID-19. </p>



<p>(vii) These orders shall be applicable with immediate effect and will remain in force till 4th April, 2020.</p>

<p>Subject: <strong>Preventive measures to be taken to contain the spread of Novel Coronavirus (COVID-19) &#8211; regarding.</strong></p>



<p>In order to contain the spread of Novel Coronavirus (COVID-19), some precautionary measures are required to be taken by all the employees and the Ministries / Departments. In this regard, it has been decided to issue the following advisory for the well-being of Government employees and in public interest.</p>



<p>All the Ministries / Departments are advised to take all necessary measures such as :-</p>



<ul class="wp-block-list"><li>Install thermal scanners at the entry of Government buildings, as feasible. Mandatory placing of hand sanitizers at the entry of Government buildings. Those found having flu-like symptoms may be advised to take proper treatment / quarantine etc.</li><li>Discourage, to the maximum extent, entry of visitors in the office complex. Routine issue of visitors/ temporary passes should be suspended with immediate effect. Only those visitors whom have proper permission of the officer who they want to meet, should be allowed after being properly screened.</li><li>Meetings, as far as feasible, should be done through video conferencing. To minimize or reschedule meetings involving large number of people unless necessary.</li><li>Avoid non-essential official travel. </li><li>Undertake essential correspondence on official email and avoid sending files and documents to other offices, to the extent possible.</li><li>Facilitate delivery and receipt of dak at the entry point itself of the office building, as far as practicable.</li><li>Close all gyms/recreation centres/ creches located in Government buildings.</li><li>Ensure proper cleaning and frequent sanitization of the workplace, particularly of the frequently touched surfaces. </li><li>Ensure regular supply of hand sanitisers, soap and running water in the washrooms.</li><li>All officials may be advised to take care of their own health and look out for respiratory symptoms/fever and, if feeling unwell, should leave the workplace immediately after informing their reporting officers. They should observe home-quarantine as per the guidelines issued by MoH&amp;FW, Government of India available at the following URL: <a rel="noreferrer noopener" aria-label=" (opens in a new tab)" href="https://www.mohfw.gov.in/DraftGuidelinesforhomequarantine.pdf" target="_blank">Draft Guidelines for home quarantine</a></li><li> The leave sanctioning authorities are advised to sanction leave whenever any request is made for self-quarantine as a precautionary measure.</li><li> Advise all employees who are at higher risk i.e. older employees, pregnant employees and employees who have underlying medical conditions, to take extra precautions. The Ministries / Departments may take care not to expose such employees to any front-line work requiring direct contact with the public.</li></ul>

Wash hands even if they are visibly clean.<br /> • To cover your nose and mouth with handkerchief / tissue while sneezing and coughing.<br /> • To throw used tissues into closed bins immediately after use.<br /> • To maintain a safe distance from persons during interaction, especially with those having flu-like symptoms.<br /> • To sneeze in the inner side of your elbow and not to cough into the palms of your hands.<br /> • To take their temperature regularly and check for respiratory symptoms.<br />
 To see a doctor if you feel unwell (fever, difficulty in breathing and 
coughing). While visiting doctor, wear a mask/ cloth to cover your mouth
 and nose.<br /> • For any fever/ flu-like signs/ symptoms, please call 
State helpline number. or the 24&#215;7 helpline number of the Ministry of 
Health &amp; Family Welfare at 011-23978046.</p>

<p>• Shake hands.<br /> • Have a close contact with anyone, if you&#8217;re experiencing cough and fever.<br /> • Touch your eyes, nose and mouth.<br /> • Sneeze or cough into palms of your hands.<br /> • Spit in Public.<br /> • Travel unnecessarily, particularly to any affected region.<br /> • Participate in large gatherings, including sitting in groups at canteens.<br /> • Visit gyms, clubs and crowded places etc.<br /> • Spread rumours or panic. </p>

<ul class="wp-block-list"><li>The post is to be filled up by transfer on deputation (including short term contract) for a period of five years or age of superannuation whichever is earlier.</li><li> Officers from the Central or State Governments, Universities, Central Educational Institutions, Central Autonomous Bodies. Recognised Research Institutions or Public Sector Undertakings.</li><li>Holding analogous post on regular basis in the parent cadre or department or with 3 years service in the grade rendered after appointment thereto on regular basis in the Pay Scale of Rs. 1,23.100 &#8211; 2.15,900 (Level 13) (Pre-Revised Pay Band IV in Scale of pay of Rs. 37400-67000 + Grade Pay of Rs. 8700) or equivalent in the parent cadre or department, and</li><li>Possessing the following Educational qualifications and experience</li></ul>



<h3 class="wp-block-heading">Essential</h3>



<ul class="wp-block-list"><li>Post Graduate degree</li><li>Fifteen years experience in the field of educational administration having the Deputy Secretary pay scale of Rs. 78,800 -2,09,200 (Level 12) (Pre-revised Pay Band of Rs. 15600 to 39, 100 (PB-III) with Grade Pay of Rs. 7,600/- of the Government of India or equivalent above)</li></ul>



<h3 class="wp-block-heading"><strong>Desirable</strong></h3>



<ul class="wp-block-list"><li>Seven years experience in the field of education, educational administration, policy planning, academic work concerning school education including planning, implementation and research in an institution of open and distance learning.</li></ul>



<p><strong>Note. 1</strong> &#8211; Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not exceed five years or till the date of superannuation (60 Years) whichever is earlier.</p>



<p><strong>Note.2</strong> &#8211; The maximum age limit for appointment by deputation including short term contract shall not be exceeding 58 years as on the closing date of the receipt of applications.</p>

<p>The undersigned is directed to say that this Department had vide O.M No 21011/1/2009-Estt.(A)-Part dated 01.02.2012 introduced the scheme of Annual Medical Examination for the Group &#8216;A&#8217; officers of Central Civil Services of age 40 years and above As per the said O.M , the officer concerned is required to attach a summary of the Medical Report with his/her APAR</p>

<p>In view of the situation ariSing out of the spread of Novel Coronavirus (COVID-19), it has been decided with the approval of the competent authority to extend the last date for submission of the summary of Medical Report by Group &#8216;A&#8217; officers of Central Civil Services for the year 2019-2020, upto 30th June, 2020.</p>



<p>3 However. the timelines for recording and compleltion of APAR for the year 2019-2020, as laid down in this Departments OM No 21011/1/2005-Esn(AXpt II) dated 23rd July, 2009. remain unchanged.</p>

<p>Subject: <strong>Proposal to amend Rule 11 of AIS (Conduct)Rules, 1968 by inserting a new-sub Rule 4 &#8211; reg.</strong></p>



<p>Sir / Madam;</p>



<p>I am directed to refer to the subject noted and to state that presently there are no provisions under AIS (Conduct) Rules, 1968 with regard to receipt / retention of gifts from foreign dignitaries by members of AIS being a member of Indian delegation or otherwise. Therefore, it has been decided with the approval of competent authority to insert a new sub-rule (4) under Rule 11 of AIS (Conduct) Rules, 1968.</p>

Accordingly, a draft of the proposed amendments in AIS (Conduct) Rules, 1968 is enclosed herewith with request to furnish your comments / views on the same latest by 31 st March, 2020 positively. Soft copy of the comments / views may also be sent by email at so-ais3@nic.in. If no reply is received within the stipulated time, it will be presumed that State Government has no objection to the proposed amendments.</p>

<h3 class="has-text-align-center wp-block-heading">Proposal to amend AIS (Conduct) Rules 1968</h3>



<figure class="wp-block-table"><table class=""><tbody><tr><td><strong>Existing Rules</strong></td><td><strong>Proposed amendment</strong></td></tr><tr><td>11. <strong>Gifts.</strong><br />11(1) A member of the service may accept gifts from his near relatives or from his personal friends having no official dealings with them, on occasions such as wedding, anniversaries, funerals and religious functions when the making of gifts is in conformity with the prevailing religious and social practice, but he shall make a report to  the Government if the value of such gift exceeds <strong>RS.25, 000/-.</strong><br /><strong>Explanation</strong>&#8211; For the purposes of this rule &#8220;<strong>gift</strong>&#8221; includes free transport, free boarding, free lodging or any other service or pecuniary advantage when provided by a person other than a near relative or personal friend having no official dealings with the member of the Service but does not include a casual meal, casual lift or other social hospitality.</td><td></td></tr><tr><td>11(2) Save as otherwise provided in sub-rule<br />(1), no member of the service shall accept any gift without the sanction of the Government if the value of gift exceeds <strong>Rs.5,000/-</strong></td><td></td></tr><tr><td>11(3) Member of the Service shall avoid accepting lavish hospitality or. frequent hospitality from persons having official dealings with them or from industrial or commercial firms or other or organisations.</td><td></td></tr><tr><td></td><td><span style="text-decoration: underline;">After sub-rule (3) of Rule 11 of AIS (Conduct) Rules, 1968, the following sub-rule (4) shall be inserted:-</span><br /><br />11(4):- Notwithstanding anything contained in sub-rule (1), (2) and (3), a member of Service, being a member of the Indian delegation or otherwise, may receive and retain gifts from foreign dignitaries in accordance with the<br /> provisions of The Foreign Contribution (Acceptance or Retention of Gifts or Presentation) Rules, 2012, as amended from time to time.</td></tr></tbody></table></figure>
