<ol class="wp-block-list"><li>We seek your kind intervention to consider and revise the date of implementation of MACPS w.e.f 1.1.2006 (instead of 1-9-2008) as per the recommendations of 110th report on “<strong>Pensioner’s Grievances-Impact of Pension Adalats and Centralized Pensioners Grievance Redress and Monitoring System (CPENGRAMS)</strong>”</li><li>In para 3.35 of 110th report on “Pensioner’s Grievances-Impact of Pension Adalats and Centralized Pensioners Grievance Redress and Monitoring System (CPENGRAMS)” submitted to Parliament on 10th December 2021, it was recommended that, “The Committee feels that DOPPW should pursue the matter of implementation of MACP w.e.f 1st January, 2006 with DoPT as it will give relief to pensioners retiring in the intervening period i.e. from January, 2006 to August, 2008 as all other benefits were given to them from January 2006 as per 6th CPC recommendations”.</li><li>In our earlier memorandum, we have submitted other detailed justifications including that of Judgement given by Hon’ble Supreme Court of India &amp; Hon’ble High Court of Bombay, 6th CPC recommendations for implementation of revised scheme of Pay Bands and Grade Pay as on 01.01.2006 retrospectively and Government’s acceptance of the same, implementation of 6th CPC recommendations on Pay Band, Grade Pay and Dearness Allowance w.e.f.01.01.2006 vide Extraordinary Notification of Resolution No.1/1/2008-I C, dated 29.8.2008, revision of Non Practicing Allowance (NPA) effective from the date an employee drawing pay in the revised scale applicable to him in accordance with the provisions of the Railway Services (Revised Pay) Rules, 2008, i.e. w.e.f. 1.1.2006, etc</li><li><strong>Therefore without diluting the scheme it is requested that MACPS may please be implemented from 1.1.2006 since MACPS is part of pay structure.</strong></li></ol>

<h3 class="wp-block-heading">Subject: Clarification related to grant of financial upgradation under MACP</h3>



<p>This HOrs. had taken up a case with DoP&amp;T seeking clarification on the date from which financial upgradation under MACPS is to be granted in respect of an employee who had been found “Not Fit” by the initial Screening Committee due to not meeting the prescribed benchmark (based on APAR grading) but in subsequent year/ years he was recommended “Fit” by the Screening Committee after meeting the prescribed benchmark.</p>



<p>2. Clarification issued by the DoP&amp;T vide its ID Note No. 1462926/21/CR dated 04.10.2021 is as follows:-</p>



<p>“<em>The matter has been examined. It is clarified that due to the reason of the employee being declared ‘Unfit’ for not meeting the prescribed benchmark (based on APAR grading) by the initial Screening Committee and if the employee is recommended ‘Fit’ by the Screening Committee for subsequent year/years, on his meeting the prescribed benchmark, financial upgradation under <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACPS</a> would be granted to the employee from the date” of meeting of that Screening Committee, which has recommended him ‘Fit’ for grant of MACP. Further, this would have consequential effect of deferment of the subsequent financial Upgradation under MACPS in the extent the previous financial upgradation gets postponed.</em>”</p>

<p>Some doubts/clarification has been raised by Divisions regarding granting of financial up-gradation under MACPs to the category of Section Controllers who have been transferred on own request from other Railway/ Division/ Units with pay protection.</p>

<p>In this situation, promotion to SM from ASM to be ignored because of amendment in Recruitment Rules in SM category circulated vide RBE-26/2020. Again, in terms of RBE-96/2018 Appointment to the post of Section Controller (GP-4200/-) (RS-5500-9000 5th CPC) from the post of Station Master (GP-4200/-) (Rs-5000-8000 5th CPC) is to be treated as lateral shift instead of a promotion.</p>



<p>Therefore, the employee is eligible for 3rd financial up-gradation in GP-4800/-, Level-8 after completion of the 10 years from the re-promotion or 30 years from the date of direct entry grade whichever is earlier. if the concerned employee is still working after 16.02.2018.</p>

<p><strong>Subject:- Clarification on Modified Assured Career Progression (MACP) Scheme reg.</strong></p>



<p>Sir / Madam,</p>



<p>On the above noted subject, this refers to various references seeking clarification on following points of doubt in respect of those employees who were promoted from Inspector Posts (IP) cadre to Asstt. Superintendent of Posts (ASP) cadre in the same Grade Pay Rs. 4600/- (identical pay scale-PB-2nd) during 6th CPC regime:-</p>



<ul class="wp-block-list"><li>i. Whether promotion earned from IP to ASP cadre in the same Grade Pay of Rs. 4600/- (identical pay scale) in 6th CPC regime can be ignored for Modified Assured Career Progression Scheme (MACPS) purpose under the provisions of para-5 of MACP Scheme of 19th May, 2009, consequent upon upgradation of pay scale of Inspector Posts from Grade Pay Rs.4200/- to that of Rs.4600/-.</li><li>ii. Whether the benefits of 3rd financial upgradation under Modified Assured Career Progression Scheme (MACPS) with subsequent benefits in term of para 6.1 of Annexure-I to OM dated 22.10.2019 (MACPS guidelines) is admissible on completion of 10 years regular service in the same Grade Pay of Rs. 4600/-, or on completion of 10 years from the date of regular promotion to ASP cadre from Inspector Posts in the identical Grade Pay Rs. 4600/-.</li></ul>



<p>2. The matter was examined in consultation with Department of Personnel &amp; Training (DoP&amp;T) and the extract of clarification conveyed by the Establishment (D), DoP&amp;T vide Comp. Dy. No. 1433722/20/CR are re-produced as under:</p>



<p>“….3. ……an official was appointed as Postal Assistant on 19-12-1994 in corresponding GP Rs. 2400/- and subsequently promoted to Inspector of Posts cadre w.e.f 14-10-2004 (in the scale Rs. 5500-9000/- and w.e.f. 01-01-2006 in upgraded scale PB-2 with GP of Rs 4600/) and again promoted to Asstt. Superintendent of Posts (ASP) cadre w.e.f 30-04-2014 (in the identical pay scale with GP Rs. 4600/- &amp; w.e.f 01-01-2016 in upgraded pay Level-8, corresponding to GP Rs. 4800/-).</p>



<p>4. Attention is invited towards para 1 of Annexure-I to DoPT OM No. 35034/3/2008-Estt.(D) dated 19-05-2009 which provides that “There shall be three financial upgradations under the MACPS, counted from the direct entry grade on completion of 10, 20 and 30 years service respectively. Financial upgradation under the Scheme will be admissible whenever a person has spent 10 years continuously in the same grade-pay.”</p>



<p>5. Para 8 of Annexure-I to <a href="https://centralgovernmentnews.com/latest-dopt-orders-2021/" target="_blank" rel="noreferrer noopener">DoPT</a> OM dated 19-05-2009 further provides that “Promotion earned in the post carrying same grade pay in the promotional hierarchy as per Recruitment Rules shall be counted for the purpose of MACPS.”</p>



<p>6. From the information provided by the Administrative Department, 1t may be observed that the said official was appointed as Postal Assistant on 19-12-1994 in corresponding GP Rs. 2400/- and the official has already earned two promotions on 14-10-2004 and 30-04-2014. However, the date of retirement on superannuation in r/o official is not mentioned in the proposal. Therefore, in terms of above provisions under MACP Scheme, the official would be eligible for grant of 34 financial upgradaton in the immediate next higher level in the hierarchy of the Pay Matrix as given in PART A of Schedule of the CCS (Revised Pay) Rules, 2016 but not before 30-04-2024 (on completion of 10 years of service from 2nd promotion) if otherwise, admissible and the official fulfils the other eligibility conditions.”</p>



<p>3. It is therefore, requested to bring these clarifications/instructions to the notice of all concerned immediately and ensure strict adherence in true spirit.</p>

<ol class="wp-block-list" start="2"><li>The cadre units of CSCS annexed at Annexure-I are once again requested to expedite sending the requisite information within a fortnight. In case of nil information, the same may also be intimated to this Department.</li></ol>

<p>Sub:  <strong>Grant of financial upgradation under MACPS to Station Masters.</strong></p>



<p>Reference from Federation (NFIR and AIRF) and a few Railways have been received for ignoring the promotion/ upgradation from ASM (GP 2800) to SM (GP 4200) for grant of financial upgradation under <a href="https://centralgovernmentnews.com/category/macp/" target="_blank" rel="noreferrer noopener">MACPS</a> to those employees who have further been absorbed in other cadres by way of selection on lateral induction or due to medical de-categorisation. The matter has been examined in consultation with Finance Directorate and it has been decided that the benefit of Board’s letter dated 25.02.2020 (RBE No. 26/2020) would also be extended to such employees who have progressed to other cadres by way of lateral induction/ selection or due to medical de-categorization and would be granted financial upgradation under MACPS by ignoring their promotion /financial upgradation from ASM (GP 2800) to SM (GP 4200) irrespective of their progression in other cadres.</p>

<p>2. The benefit of the financial upgradation in such cases would accrue from 16.02.2018 onwards, even if financial upgradation happens to become due before 16.02.2018 as a consequence of ignoring the promotion from ASM to SM.</p>



<p>3. This issues with the concurrence of Finance Directorate of Ministry of <strong><a href="https://centralgovernmentnews.com/category/railways/" target="_blank" rel="noreferrer noopener">Railways</a></strong>.</p>

<h3 class="wp-block-heading">Sub: Implementation of recommendation of 7th CPC &#8211; Para 11.12.140 &#8211; Grant of Grade of Rs. 5400 (PB2) i.e. Level 9 of Pay Matrix in case of Assistant Accounts Officer of Defence Accounts Department of Ministry of Defence.</h3>



<p>Sanction of the Gol, Ministry of Finance, Department of Expenditure on the above subject conveyed vide its OM No. F.No. 25-2/2017-IC/E.III(ii) dated 06.11.2020 is hereby communicated. The OM has been issued in pursuance of the recommendations of <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong> as contained in para 11.12.140 of the Report and Government Resolution No. G.I, M.F. No. 1-2/2016-IC dated 25th July 2016.</p>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-pay-commission-revised-pay-matrix-table-for-central-government-employees-pay-matrix-level-9/" target="_blank" rel="noreferrer noopener">7th Pay Commission Revised Pay Matrix Table for Central Government Employees &#8211; Pay Matrix Level 9</a></strong></h4>



<p>2. In accordance with the ibid OM, the revised pay scale of the post of Assistant Accounts Officer in <strong><a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">Defence</a></strong> Accounts Department would be in Level 8 of Pay Matrix and Level 9 on completion of 4 years in Grade Pay of Rs. 4800/- (PB-2)/ Level 8. This is a Non-Functional Upgradation (NFU), which is subject to the following terms and conditions:-</p>



<h4 class="wp-block-heading"><a href="https://centralgovernmentnews.com/macp-on-completion-of-10-20-30-years-of-service-or-10-years-of-service-after-previous-promotion-aaos-senior-auditor-adr-clerk-mts/" target="_blank" rel="noreferrer noopener"><strong>MACP on completion of 10/20/30 Years of Service or 10 years of service after previous promotion: AAOs, Senior Auditor, Adr, Clerk, MTS</strong></a></h4>



<ul class="wp-block-list"><li>(i) The grant of NFU will be admissible on completion of 4 years of regular service in the cadre from the date of joining as AAO. The aforesaid Non-Functional Upgradation (NFU) to AAQs is effective from 01.01 2016.</li><li>(ii) The NFU will be subject to vigilance clearance. While issuing orders, it may be ensured that none of circumstances for adoption of sealed cover procedure exists and the official is not undergoing any penalty under CCS (CCA) rules 1965.</li><li>(iii) The orders for grant of Non-Functional Upgradation to AAOs shall be issued by the Appointing Authority.</li><li>(iv) Benefit of Pay Fixation as per Rule 13 of CCS (Revised Pay) Rules 2016 shall be available at the time of grant of Non-Functional Upgradation to AAOs. Option for pay ‘fixation may be exercised within one month of issue of orders for grant of NFU.</li><li>(v) After the grant of NFU to AAOs in Pay Level-9 and their pay fixation under Rule 13 of CCS (RP) Rules 2016, there will be no further pay fixation on promotion to the post Accounts Officer in Pay Level-9.</li><li>vi) NEU will be reckoned for financial upgradation under Modified Assured Career Progression scheme (MACPS). Subsequent financial upgradation under MACPS, if any, is to be reckoned from the date of grant of NFU.</li></ul>

<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/macp-guidance-as-per-recommendations-of-the-7th-cpc/" target="_blank" rel="noreferrer noopener">MACP guidance as per recommendations of the 7th CPC</a></strong></h4>



<p>With reference to the above, it is stated that Para 9 of Annexure to Board’s letter dated 10.06.2009 (RBE No. 101/2009) explicitly mentions that … &#8220;<em><strong>Regular service for the purpose of the <a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACPS</a> shall commence from the date of joining of a post in direct entry grade on a regular basis either on direct recruitment basis or on absorption re-employment basis. Service rendered on ad-hoc contract basis before regular appointment on pre-appointment training shall not be taken into reckoning…</strong></em> &#8220;. As such. ad-hoc service is not to be counted for the purpose of MACPS and, therefore. the concerned employee is entitled for 3rd financial upgradation under MACPS wef 11.10.2012 subject to fulfillment of other terms and condition as contained in Board’: letter dated 10-06-09 (RBE No. 101/2009).</p>

<h4 class="wp-block-heading">1. <strong>Doubt</strong>: <strong>What is modified Career Progression Scheme (MACPS) ?</strong></h4>



<p><strong>CLARIFICATION</strong>: The MACP Scheme for Central Civilian Government Employees is in supersession of earlier ACP Scheme . Under the MACP Scheme three financial Up-gradations are allowed on completion of 10, 20. 30 years of regular service, counted from the direct entry grade. The MACPS envisages merely placement in the immediate next higher grade pay as given in Section I, Part -A of the first schedule of the CCS ( Revised Pay) Rules 2008, in case no ( promotion has been earned by the employee 1 during this period.</p>



<h4 class="wp-block-heading">2. <strong>Doubt</strong>: <strong>From which date the MACPS is effective?</strong></h4>



<p><strong>CLARIFICATION</strong>: The MACPS is effective w.e.f. 01.09.2008 or on completion of 10, 20 &amp; 30 years of continuous regular service, whichever is later. Financial upgradation will also be admissible whenever a person has spent 10 years continuously in the same grade pay. (Para 9 of OM dated 19/5/2009)</p>



<h4 class="wp-block-heading">3. <strong>Doubt</strong>: <strong>Who are entitled for financial upgradation under the MACPS?</strong></h4>



<p><strong>CLARIFICATION</strong>: The MACPS is applicable to all Central Government Civilian Employees</p>

<h4 class="wp-block-heading">4. <strong>Doubt</strong>: <strong>What norms are required to be fulfilled while granting the benefits under MACPs</strong></h4>



<p><strong>CLARIFICATION</strong>: The financial upgradation would be on non- 1 functional basis subject to fitness in the hierarchy of pay band and grade pay within PB- 1. Thereafter, only the benchmark of ‘Good’ would be applicable till the grade pay of Rs.6600 In PB-3. The benchmark will be ‘Vety Good’ for Financial upgradation to the grade pay of Rs.7600 and above. However, where the Financial upgradation under the MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in para 17 of the Scheme, the benchmark for promotion shall apply to MACP also. <h4 class="wp-block-heading">5. <strong>Doubt</strong>: <strong>Whether Pay Band would be changed at the time of grant of financial upgradation under MACPS</strong></h4>



<p><strong>CLARIFICATION</strong>: Yes. OM.N0.35034/3/2008-Estt.(D) dated 09/09/2010</p>



<h4 class="wp-block-heading">6. <strong>Doubt</strong>: <strong>Whether the promotions in same grade would be counted for the purpose of MACPS?</strong></h4>



<p><strong>CLARIFICATION</strong>: The financial up-gradation under the MACPS is in the immediate next higher grade pay in the hierarchy of recommended revised pay bands and grade pay as given in CCS (Revised Pay) Rules, 2008. However if the promotional hierarchy as per recruitment rules is such that promotions are earned in the same grade pay , then the same shall be counted for the purpose of MACPS.</p>



<h4 class="wp-block-heading">7. <strong>Doubt</strong>: <strong>How will the benefits of ACP be granted if due between 01.01.2006 and 31.08.2008</strong></h4>



<p><strong>CLARIFICATION</strong>: The revised pay structure has been changed w.e.f. 01.01.2006 and the benefits of ACPS have been allowed till 31.08.2008. Hence, the benefits of revised pay structure would be allowed for the purpose of ACPS. (OM No.35034/3/2008-Estt.dated 9.9.2010).</p>



<h4 class="wp-block-heading">8. <strong>Doubt</strong>: <strong>Whether adhoc appointment would be counted towards qualifying service for MACPS</strong></h4>



<p><strong>CLARIFICATION</strong>: No. Only continuous regular service is counted owards qualifying service for the purpose of MACPS. The regular service shall commence ‘rom the date of joining of a post in direct entry grade on a regular basis. ( Para 9 of the MACPS)</p>



<h4 class="wp-block-heading">9. <strong>Doubt</strong>: <strong>Whether State Government service shall be reckoned for the purpose of MACPS</strong></h4>



<p><strong>CLARIFICATION</strong>: No. Only regular service rendered in the Central Government’s Department/ Office is to be counted for the purpose of MACPS, as the Scheme is applicable to the Central Government Civilian Employees only. ( MACPS , Para 10)</p>



<h4 class="wp-block-heading">10. <strong>Doubt</strong>: <strong>What are the periods included in the regular service?</strong></h4>



<p><strong>CLARIFICATION</strong>: All period spent on deputation/foreign service, study leave and all other kind of leave, duly sanctioned by the competent authority shall be included in the regular service. ( Para 11. MACPS)</p>

<h4 class="wp-block-heading">11. <strong>Doubt</strong>: <strong>How is the MACPS to be extended to the employees of Autonomous and Statutory Bodies.</strong></h4>



<p><strong>CLARIFICATION</strong>: Procedure prescribed in OM No.35034/3/2010- Estt(D), Dated 03/08/2010 would be followed by the administrative Ministries/Departments concerned for extension of the MACPS to the employees of Autonomous and Statutory Bodies under their control.</p>



<h4 class="wp-block-heading">12. <strong>Doubt</strong>: <strong>Whether the cases of grant of financial upgradation allowed under the ACPS between 01.09.2008 and 19.05.2009, the date of issue of the Scheme are be reviewed?</strong></h4>



<p>Yes. Since the benefits of ACPS have been continued w.e.f. 01.09.2008, the cases settled between 01.09.2008 and 19.05.2009, in terms of previous ACP Scheme shall be reviewed.</p>



<h4 class="wp-block-heading">13. <strong>Doubt</strong>: <strong>Whether the past continuous regular service in another Govt. Deptt. in a post carrying same grade pay prior to regular appointment in a new Deptt. without a break shall be counted towards qualifying regular  service for the purpose of MACPS.</strong></h4>

<h4 class="wp-block-heading">14. <strong>Doubt</strong>: <strong>Upto what grade pay the benefits under the MACPS is allowed?</strong></h4>



<p>The benefits of MACPS are being up-to HAG  / scale of Rs.67000-790001. (DOPT’s O.M.No.350341312008-Estt.(D) dated 24.12.2010)</p>



<h4 class="wp-block-heading">15. <strong>Doubt</strong>: <strong>How the cases of pre- revised pay scales (Rs.5000-8000 &amp; Rs.5500-9000 and Rs.6500-10500 8 Rs.7450-11500) merged w.e.f. 01.01.2006 are to be decided under MACPS?</strong></h4>



<p>The cases would be regulated in accordance with para 5 of Annexure-l of MACPS. The Ministries/Departments are expected to re. organise cadres and frame common RRs for the post in merged scales.</p>



<h4 class="wp-block-heading">16. <strong>Doubt</strong>: <strong>Whether ‘Non-functional Scale’ of Rs.8000-13500 (revised to grade pay 01 Rs.5400 in PB-3) would be viewed as one financial upgradation for the purpose of MACPS.</strong></h4>



<p>Yes, in terms of para 8.1 of Annexure-l of MACPS dated 19.05.2009.</p>



<h4 class="wp-block-heading">17. <strong>Doubt</strong>: <strong>Whether ‘time bound promotion’ scheme including ‘in-situ promotion’ scheme can run concurrently with MACPS.</strong></h4>

<h4 class="wp-block-heading">18. <strong>Doubt</strong>: <strong>Whether Staff Car Drivel Scheme can run concurrently with MACPS</strong></h4>



<p>DOPT vide O.M. 35011/03/2008-Estt.(D),3010712010 has extended the benefits o MACPS to Staff Car Drivers as a fall bacl option.</p>



<h4 class="wp-block-heading">19. <strong>Doubt</strong>: <strong>Whether the placement of erstwhile Gr. C employees as Staff Gal Driver, ordinary grade would count as a promotion?</strong></h4>



<p>No. The model RRs for Staff Car Drivers providc deputation/ absorption as a method of appointment for erstwhile Gr. D employees . Thc placement as staff Car Driver is not in the hierarchy hence the same would not be counted as promotion under MACPS. The regular service for the MACPS would be from the date of appointment as Staff Car Driver.</p>



<h4 class="wp-block-heading">20. <strong>Doubt</strong>: <strong>Whether designation, classification or higher status would change on account of financial upgradation under MACPS</strong></h4>



<p>There shall be no change in designation, classification or higher status on grant of financial upgradation under MACPS, as the upgradation under the scheme is purely personal and merely placement in the next higher grade pay.</p>

<h4 class="wp-block-heading">21. <strong>Doubt</strong>: <strong>If a financial upgradation under the MACPS is deferred due to the reason of the employees being ‘unfit’ or due to departmental proceedings, etc, whether this would have consequential effect on the subsequent financial upgradation.</strong></h4>



<p>Yes, this would have consequential effect on the iubsequent financial upgradation, which would also get deferred to the extent of delay in grant of financial upgradation. ( MACPS, Para 15)</p>



<h4 class="wp-block-heading">22. <strong>Doubt</strong>: <strong>Whether the stepping up of pay would be admissible if a junior is getting more pay than the senior on account of grant of financial upgradation under MACPS.</strong></h4>



<p>No stepping up of pay in the band or grade pay would be admissible with regard to junior getting more pay than the senior on account of pay fixation under MACPS. (Para ’10 of OM dated 19/5/2009)</p>



<h4 class="wp-block-heading">23. <strong>Doubt</strong>: <strong>Whether the regular service rendered by an employee if declared surplus in hislher organisation and appointed in the same grade pay or lower grade pay shall be counted towards the regular service in a new organization for the purpose of MACPS.</strong></h4>



<p>Yes. (refer para 23 of Annexure-l of MACPS).</p>



<h4 class="wp-block-heading">24. <strong>Doubt</strong>: <strong>In case of transfer including unilateral transfer own request, whether regular service rendered in previous organisation/office shall be counted alongwith the regular service in the new organization for the purpose of MACPS.</strong></h4>

<h4 class="wp-block-heading">25. <strong>Doubt</strong>: <strong>If a regulation has been been offered but was eefused by the employees before becoming entitled to a financial upgradation under the MACPS, whether financial upgradation shall be allowed to such a government servant.</strong></h4>



<p>If a regular promotion has been offered but was refused by the Government employee before becoming entitled to a financial upgradation, no financial upgradation shall be allowed and as such an employee has not been stagnated due to lack of opportunities. If, however, financial upgradation has been allowed due to stagnation and the employees subsequently refuse the promotion, it shall not be a ground to withdraw the financial upgradation. He shall, however, not be eligible to be considered for further financial upgradation till he agrees to be considered for promotion again and the next financial upgradation shall also be deferred to the extent of period of debarment due to the refusal. ( Para 25 of MACPS)</p>
