<div>For a number of years now, especially after the 6th CPC, the problems faced by LDCs and UDCs have started gaining prominence. The unity and sense of purpose among them makes them look all set for the kind of victory that Pharmacists had. Common sense of purpose, unity and dedication sure make success possible!</div>
<div></div>
<div>In order to decrease the number of grades, the 6th Pay Commission combined all the different grades between Grade Pay 1300 to Grade Pay 1800 into a single grade – Grade Pay 1800, thereby wiping out the entire Group ‘D’. As a result, everybody became Group ‘C’ employees. Even those who lacked the minimum education levels, illiterates and everybody else were lumped into Group ‘C’. Their Grade Pay was also raised to Rs. 1800. But, at the same time, employees working as LDCs, who have a minimum educational qualification of Class XII and also possess some technical education, were not given any upgrading. Instead, they now had to share their grade with lesser-qualified former Grade ‘D’ employees.</div>

<div>The next huge trouble originated from the MACP. Those who didn’t get any promotion for years are given career upgradations through MACP. LDCs who didn’t get any promotions for more than 10 years were given their next grade pay, from Rs. 1900, their pay rose to Rs. 2000. The increase of mere Rs. 100 turned out to be a huge disappointment to many. Similarly, those with Grade Pay 2400 were hoping for a jump to Grade Pay 4200, but were instead forced to upgrade with only Grade Pay 2800 as per MACP rules. That anger kept seething too, because the different is 1400.</div>

<div>The most important demand of the LDCs and UDCs is to upgrade the current Pay Scale-Grade Pay.</div>
<div></div>
<div>Grades are decided based on the educational qualification of the employees. An LDC possesses a minimum educational qualification of Class XII and also has some technical qualifications. The basic salary of an LDC is just Rs. 1900 + 5830 = Rs. 7730.00. They want it revised to Rs. 2400 + 7510 = Rs. 9910.</div>

<div><span style="color: #ff0000;"><strong>The big question is – will the 7th CPC grant this demand?</strong></span></div>

<div>Sir,</div>
<div>We the undersigned employees belonging to the post of LDC/UDC are working in Farakka Barrage Project, under your kind control as well as under Govt. of India, Ministry of Water Resources beg to lay the following facts for your kind consideration and necessary appropriate action please.</div>
<div></div>
<div></div>
<blockquote>
<div>01. That, most of us have joined in Govt. Service between 01-09-1984 prior to 1990 as LDC category, then our Pay Scale was Rs. 260-400/- as per 3rd CPC later on as per 4th CPC w.e.f. 01-01-1986 the Pay Scale was Rs. 950-1500/- and gradually promotional post was UDC / Head Clerk or Assistant respectively and the Pay Scale of UDC was Rs. 4000-6000/- and the Scale of Head Clerk was Rs. 5000-8000/- (Copy of Fixation of Pay or pre-revised and Revised are enclosed for ready reference).</div>

<div>02. The Financial Up-gradation under ACP Scheme was initially introduce in year 1999 i.e. on 09-08-1999 and as per this Scheme a Govt. servant (LDC in the instant case) with 12 years of regular service in the same post, Financial up-gradation to the next Scale of Pay Rs. 4000-6000/- in the same way the 2nd Up-gradation to the Scale of Pay Rs. 5000-8000/- was admissible after 24 years of regular service. There was no further Up-gradation in the ACP Scheme.</div>

<div>03. Consequent upon the recommendation of the 6th CPC and acceptance of GOI, DOPT was pleased to issue MACP Scheme vide OM NO. dated 19-05-2009 in which it was clearly indicated that the MACP Scheme will take prospective effect from 01-09-2008. It was also clearly mentioned in the OM that this order is issued in supersession of all previous orders i.e. ACP Scheme. In the OM a schedule regarding placement from one PB/GP to other upgraded PB/GP has been indicated in the Section-I, Part – A of the First Schedule of the CCS (Revised Pay) Rules 2008.</div>

<div>04. It is further stated that, under the modified MACP Scheme the above said two financial Up-gradation were converted into three Up-gradation as under :-</div>

<div>From the above it is evident that in the PB-1, 5200-20200 having GP Rs. 2400/- and the same PB-1 having GP Rs. 2800/- bears same and identical scale of pay, therefore placement from GP Rs. 2400/- in Pay Band 1 to GP Rs. 2800/- in same Pay Band-1, can not be termed as promotional/up-gradational benefit.</div>
<div></div>
<div>Thus granting of GP Rs.2800/- in same PB i.e. PB-1 is a cause of utter deprivation upon us from having our legitimate and lawful payments i.e. we instead of getting GP of Rs.4200/- in PB-2 is presently getting GP of Rs. 2800/- in PB-1.</div>
<div></div>
<div>In view of the above fact, it is further stated that who have joined before 01-09-1984 in various categories in the Govt. service they have got benefit second financial Up-gradation as per ACP Scheme, later on said employees are entitled for third Up-gradation as per MACP Scheme. In this connection a copy of Judgment of Hon’ble Principal Bench CAT, NewDelhi is enclosed for ready reference and kind</div>

<div>Therefore, we the petitioners are fervently request you to kindly process the case immediately for solving the utter discrimination caused upon us.</div>

<p>Dear friends,</p>
<p>I am posting a letter addressed to Shri K Suresh Kumar, Under Secretary, CS II Section, DoPT returning the proposal for the upgradation of Grade pay of LDC and UDC on the ground given therein. This letter was not attached with the original documents while returning the case to the Association by the CS II. Shri Bipin Kumar Pandey has obtained this letter through RTI and forwarded to me through e-mail.</p>
<p>In para II it is stated that no anomaly item related to the upgradation of the grade pay of LDC and UDC is pending with the National Anomaly Committee. The matter was discussed with Shri S.K. Vyas, who representing the Confederation in the National Anomaly Committee. Shri Vyas has informed me that 11 additional items including item related to the LDC &amp; UDC, have been admitted for discussion in the National Anomaly Committee. Shri Vyas further said that the assurance of taking up these items in the final meeting of the National Anomaly Committee was given to the Staff Side. But any initiative to conduct the final meeting of the NAC has not been come up from the side of the Government. Thus the statement given by the Deputy Secretary (JCA) is not in match with the statement of Shri Vyas, Member NAC.</p>
<p>It is to be noted that in Para IV the Deputy Secretary suggested the CS II to take up the upgradation work of the Grade pay of LDC &amp; UDC in consultation with the Department of Expenditure which itself speak the genuiness of the issue.</p>

<p>Sub: <strong>Upgradation of Grade Pay of LDC and UDC in the Administrative branch of Government of India Offices.</strong></p>
<p>The undersigned is directed to refer to CS II ID No. 25/2/2013-CS. II (B) dated 13/08/2013 relating to PMO ID No. 4/3/2013-PMP4/67682 dated 15.07.2013 on the subject mentioned above.</p>
<p>It is noted that the General Secretary of All India Association of Administrative Staff (NG) has demanded revision of Grade pay of LDCs and UDCs in the Administrative branch of Government of India. This is not an issue of anomaly and no such item was before the National Anomaly Committee.</p>
<p>In this regard it may be noted that the Sixth Central Pay Commission had recommended a hierarchical structure and revised pay scales for the Central Secretariat in Para 3.1.9 of its report. A similar recommendation in respect of Non-Secretariat Organization had been made in Para 3.1.14 of the report. Sixth CPC has granted parity in hierarchical structures and revised pay scales to posts existing in the Central Secretariat and Non-Secretariat Organizations up to the level of Assistant. Accordingly, Sixth CPC granted identical revised pay structures to LDCs, UDCs and Assistants both in Central Secretariat and Non-Secretariat Organizations.</p>
<p>Accordingly, the demand of the All India Association of Administrative Staff(NG) for the revision of the Grade Pay of LDCs and UDCs in the Administrative branch of the Government of India is required to be considered by the CS II Division (which deals with the LDCs and UDCs of CSCS) in consultation with the Department of Expenditure who are the nodal Ministry in respect of  CCS (Revised Pay) Rules, 2008. JCA Section has no role in this issue.</p>
<p>This reference in original is accordingly returned to CS-II Division for action as appropriate.</p>
