<p>We are the first to introduce a calculator for converting the basic salary from 6th CPC to 7th CPC. The 7th pay commission recommendations had been accepted by the Government of India in the middle of 2016 and implemented the same with effect from 1.1.2016 with minor modifications.</p>

<p>7th pay commission has directed two types of proposals to fix the pension for the pensioners who retired before January 2016. The determination of basic pension as per 7th pay commission after 1st January 2016 initially got confused. </p>



<p>Transport allowance is given to all employees working in Central Govt services for the expenditure on travel from residence to office and back. Employees are using various modes of travel to come to the workplace and return.</p>

<p>There is no problem to calculate pension and other retirement benefits for 7th CPC pensioners i.e., retired after (1.1.2016) implementation of 7th CPC. Pensioners retired in the 6th CPC regime are also easy to calculate basic pension and family pension.</p>



<h3 class="wp-block-heading">7th CPC Voluntary Retirement Scheme</h3>



<p>A Central Government employee could apply for voluntary retirement after completion of 30 years of service. He may be allowed to retire from his service under Rule No. 48 of CCS (Pension) Rules 1972. </p>

Ministry, who holding the post of MCM in the Pre-revised pay scale of 
Rs.4500-7000 as on 31.12.2005.</strong></p>



<p>&nbsp; The above demand 
was discussed as Item No.19 of the Standing Committee meeting of the 
National Council (JCM) held on 07.03.2019. The extract from the minutes 
of the above meeting is given below for your kind reference.</p>



<p>&nbsp; ‘Chairman desired that Addl,Secretary, DOP&amp;T may hold a meeting with the officials of MoD to Settle the matter.’</p>



<p>It
 is understood that as per the decision of the Chairman a meeting was 
held in DoP&amp;T with the Officials of MoD. However till date the issue
 is not resolved and the affected employees are retiring without getting
 their due MACP benefits. Considering the delay which is taking place in
 settling this genuine demand it is requested that necessary 
instructions for granting <strong>MACP</strong> to the above mentioned affected 
employees of MoD may please be issued at the earliest. A copy of your 
instruction may please be endorsed to this Office.</p>

<p>This is in reference to DoP&amp;T OM F. No. 35034/3/2015-Estt.(D) dated 27/28.09.2016 regarding enhancement of Benchmark for financial up‑gradation under MACP Scheme as per recommendations of the 7th CPC accepted by the Government.</p>
<p>Of late, field units have been seeking clarification regarding the applicability of benchmark ‘Very Good’ for considering financial up-gradation under MACP Scheme. The matter has been examined at FHQ and the following clarifications are issued for compliance by all concerned:-</p>
<p>(i) For grant of financial up-gradation under the MACPS, the prescribed benchmark would he ‘Very Good’ for all the posts w.e.f. 25.07.2016.</p>
<p>(ii) APAR grading ‘Good’ for the period prior to 25.07.2016 i.e. the date from which the new Benchmark made applicable, may be treated as ‘Very Good’ while considering such cases by the Screening Committee/BOO.</p>
<p>(iii) There should be at least three ‘Very Good’ grading and other two not below ‘Good’ grading out of last five ACRs/APARs considering point (i) &amp; (ii) in view for arriving at the prescribed Benchmark ‘Very Good’. Some illustrations are given in the enclosed Annexure-A for guidance.</p>

<p style="text-align: center;"><span style="text-decoration: underline;"><strong>ORDER</strong></span></p>
<p>(a) The impugned judgment and order dated 16th April, 2013 made by the CAT is hereby set aside.</p>
<p>(b) The petitioner is held entitled to receive the benefit of MACP with effect from 1st January, 2006 together with all consequential benefits.</p>
<p>(c) The respondents are directed to work out the benefits of MACP with effect from 1st January, 2006 together with consequential benefits and to pay the same to the petitioner as expeditiously as possible and in any case within a period of three months from today.</p>
<p>(d) If, such benefits/consequential benefits are not paid to the petitioner within three months from today, then the respondents will liable to pay interest thereon @ 6% p.a. from the date such payments became due and payable, till the date of actual payment.</p>
<p>(e) Rule is made absolute in the aforesaid terms. There shall however be no order as to costs.</p>

<p>3. The 6th Central Pay Commission has merged the post of Section Officer with Assistant Accounts Officer from 01-01-2006. The 6th Pay Commission has recommended the Pay Band 2 in the Pay Scale of Rs. 9300-34800 Plus Grade Pay of Rs. 4200/- to the Senior Accountant. The Asst. Accounts Officer were also given the Pay Band No. 2 but they were given the Grade Pay of Rs. 4800/-.</p>
<p>4. The Government of India, Ministry of Personnel, Public Grievances and Pensions under O.M. No. 35034/3/2008-Estt (D) dated 19-05-2009 has introduced the Scheme of Modified Career Progression Scheme (for brevity M.A.C.P.) which is the modified version of earlier A.C.P. Scheme. As per the Scheme the Government Servants will be granted 3 financial upgradations after completion of 10, 20 and 30 years of service if they have not received any regular Promotion. The condition No. 2 read with 6.2 of the Annexure 1 of the OM. laid down that:</p>
<p>&#8220;….financial upgradations under the Scheme should be done strictly in accordance with the hierarchy of grade pays in pay bands as notified vide CCS (Revised Pay) Rules, 2008&#8221;</p>
<p>According to the information available to this Association, the Senior Accountants are being granted Grade Pay of Rs. 4600 /-(level 7 of pay matrix) on grant of benefits under M.A.C.P.</p>
<p>In this connection, your kind attention is invited to the following orders/Judgments of the various Tribunals/ High Courts/Supreme Court wherein the Tribunals/ High Courts have held that the Grade Pay of hierarchical Promotion Post has to be given on grant of financial benefits under M.A.C.P.</p>
<p>1. Central Administrative Tribunal (C.A.T.) Ernakulam Order dated 27-09-2011 in T.P.Leena Vs. Union of India.</p>
<p>The Tribunal has granted the Grade Pay of Rs. 4800/- on grant of 1st Financial Benefit under M.A.C.P. from Rs. 4200/-</p>
<p>2. The High Court of Ernakulam has by Judgment dated 21-06-2012 in the case of Union of India Vs. T.P.Leena has upheld the Order of CAT. and Hon’ble Supreme Court has dismissed the S.L.P. by Judgment dated 15-10-2012 holding that there is no reason to interfere with Impugned Order.</p>

<p>3. CAT New-Delhi by Order dated 26-11-2012 in Sanjay Kumar &amp; others Vs. Ministry of Defence &amp; others has granted the Grade Pay of Promotion Post (Copy enclosed).</p>
<p>Sir, it would not be out of place to submit that the Controller of Accounts C.B.D.T. Mumbai in compliance of C.A.T. Mumbai order has by order No. ZAO/MACP/ADMN/12015-16 dated 01-02-2016 has granted Grade Pay of Rs. 4800[- (level 8 of Pay Matrix] to 13 Senior Accountants on grant of benefits of 2“d M.A.C.P. The copy of the Order is enclosed as Annexure ‘B’ for your perusal.</p>
<p>It is further submitted that the Principal Chief Controller of Accounts. Zonal Accounts Office, CBDT, Mumbai has, while quoting Principal Chief Controller of Accounts C.B.D.T. New- Delhi letter No. -PCCA/CBDT/Estt/Rep/2018-381-382 dated 01-08-2018 has granted benefits of 3rd M.A.C.P. to 16 Senior Accountants under order No. ZAO/CBDT/MUM/ADMN/MACPS/2018-191 742 dated 04-09-2018 [Copy enclosed]. The perusal of the order would exhibit that all the Senior Accountants were in receipt of Grade Pay of Rs. 4800/- (level 8 ef Pay Matrix] on grant of benefits of 2nd M.A.C.P. and they have been granted Grade Pay of Rs. 5400/-[level 9 of Pay Matrix) which is the Grade Pay of hierarchical Post of Asstt. Accounts Officer.</p>
<p>In View of submission made in the letter, it is clear that the members of our Association are meted out with discrimination as far as grant of Grade Pay of Rs. 4800/-[level 8 of Pay Matrix) on grant of benefits of M.A.C.P. to Senior Accountants are concerned. They are given the Grade Pay of Rs. 4600/- [level 7 of Pay Matrix). This amounts to discrimination and violative of Article 14 and 16 of the Constitution of India. It is therefore requested that the Grade Pay of Rs. 4800/-(level 8 of Pay Matrix) may please be granted to all the Senior Accountants who have been granted benefits of M.A.C.P. A comprehensive review may please be taken and set right the grave injustice caused to our members.</p>
<p>In this context the observation of Principal Bench New Delhi in the case of All India Defence Civilian Clerks Association of ADC and Records Office and another Vs. The Secretary, Ministry of Defence and others in order dated 01-02-2012 (Copy enclosed) assumes importance.</p>
<p>We do not understand the logic of the Ministry of Defence, D.0.P &amp; T. Ministry of Finance or even the Ministry of Law as to how the aforesaid directions as upheld by Hon&#8217;ble High Court of Delhi and the Apex Court cannot be made applicable to the Applicants who are admittedly similarly placed. In our considered opinion the Respondents/Departments should desist from rejecting the genuine request of the employees and force them to knock the door of Courts unnecessarily without any justifiable grounds.</p>
<p>In view of above observation of Hon&#8217;ble Principal Bench 1 request you to consider our request positively and arrange to do justice by removing the discrimination between the two set of similarly situated employees.</p>

<p>Sub: <strong>Grant of Grade Pay Rs.6600/PB-3 to Nursing personnel i.e. staff Nurses/Nursing Sister/Matron/Chief Matron under 3rd MACP.</strong></p>
<p>The staff side (NFIR and AIRF) had demanded for grant of 3rd financial upgradation in the Grade Pay of Rs.6600/PB-3 to Nursing personnel under MACPS on the basis of OM dated 09-09-2016 issued by Ministry of Health and Family Welfare. The matter was examined in consultation with the Deptt. of personnel and Training and it has now been decided as under.</p>
<blockquote><p>a) Those Staff Nurse/Nursing Sister/Matron/Chief Matron who have been awarded 1st and 2nd financial upgradation under ACP Scheme in the hierarchy pay scale of Rs.5500-9000 and Rs.6500-10500 upto 31-08-2008 may be granted a replacement Grade Pay of Rs.4800/-PB-2 and Rs.5400/PB-3. Therefore, the 3rd financial upgradation under MACP Scheme, if granted to these categories of officials, may be revised to Rs.6600/PB-3 from Rs.5400 in PB-3.</p>
<p>b) Those Staff Nurse/Nursing Sister/Chief Matron who have been granted 1st ACP in the pre-revised pay scale of Rs.5500-9000 upto 31-08-2008 may be placed in the replacement Grade Pay of Rs.4800/PB-2. They will be entitled for grant of 2nd and 3rd financial upgradation under MACP Scheme in the Grade Pay of Rs.5400/PB-2 and Rs.5400/PB-3 only.</p>
<p>c) All the remaining Staff Nurse/Nursing Sister/Matron/Chief Matron who are to be granted 1st, 2nd and 3rd financial upgradation under MACP Scheme may be granted next higher Grade Pay.</p></blockquote>
<p>2. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</p>

<p>Reference is invited to this office OM No. A-26011/20/MACPS/2017/MF.CGA(A)/NGE/39 dated 13th April, 2018 and its subsequent reminder of even no. 110 dated 31.05.2018 vide which Ministries/Departments were requested to forward the cases of such AAOs/PS who are eligible for grant of financial upgradation upto 31.03.2019, in the enclosed proforma along with Service Book, complete CR Dossier upto 2016-17 and latest vigilance clearance certificate respectively by 15.05.2018 &amp; 31.05.2018.</p>
<p>In this regard, it is stated that the requisite information is yet to be received from the Ministries/Departments mentioned below.</p>
<p>In view of above, it is requested that the matter may please be expedited and the cases of eligible AAOs/PS may be forwarded in the enclosed proforma alongwith Service Book, complete CR Dossier upto 2016-17 and latest vigilance clearance certificate by 11.06.2018 positively. In case of NIL information the same may also be furnished.</p>

<p>The Government of India has accepted the recommendation of the Seventh Pay Commission with regard to Modified Assured Career Progression (MACP) scheme and withholding of annual increments as under:-</p>
<blockquote class="tr_bq"><p>(i) Benchmarking for performance appraisal for promotion and financial upgradation under MACPS to be enhanced from ‘Good’ to ‘Very Good’.</p>
<p>(ii) Withholding of annual increments in the case of those employees, who are not able to meet the benchmark either for MACP or a regular Promotion within the first 20 years of service.</p></blockquote>
<p>This was stated by the Union Minister of State (Independent Charge) Development of North-Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr. Jitendra Singh in a written reply to a question by Shri Rajeev Shukla in the Rajya Sabha today .</p>

										<content:encoded><![CDATA[<p><strong>Status of MACP in the 7th pay commission</strong></p>
<p>Newspapers continuously update us with news about the recommendation of the 7th Pay Commission which holds the highest expectation levels at present. From such sources, we come to know that the recommendations of the 7th Pay Commission are going to be submitted on 31st of October and they may come to force from 1/4/2016.</p>
<p>Pay structure is very important and equally important is the promotion policy.<br />
Assured Career Progression (ACP) which was introduced in the 5th Pay Commission, provided some comfort for the employees who suffered from lack of promotions for long years. Before this, promotion was just an illusion. Labour Unions and Federations of the Central government employees got these benefits for us after much struggle.</p>
<p>In the recommendations of the 6th Pay Commission, which came after this, ACP was changed to MACP (Modified Assured Career Progression) and it provided an opportunity for employees who were not promoted for the last ten years to enter the next Grade Pay.</p>
<p>In this, the benefit was very small as 1800, 1900, 2000, 2400, 2800, 4200, 4600, 4800 (excluding 2800-4200). Many issues in this method of Grade Pay still lie unresolved before the National Anomaly Committee.</p>
<p>Hence, lakhs of Central Government employees expect a favourable change in MACP at least through 7th Pay Commission. During his or her service period, an employee must have at least five promotions. This has been an important plea of the Central Trade Unions.</p>
<p>The benefit of the first MACP has to be given after 8 years of continuous service and the benefit of the successive MACP has to be given after 7,6,5 and 4 years of continuous service.</p>
<p>If the benefits of MACP were such, certainly all the central government employees will be highly encouraged and will work hard to make all the Central Government plans and activities a great success.</p>
<p>This will definitely increase the productivity of the Central Government and the associated industries. Due to this, the relationship between the government and the employees will become more harmonious and there will be a peaceful working environment.</p>
