<p>The undersigned is directed to refer to MOD OMs of even number dated 22.03.2018 and 26.02.2019 on the issue of availability of option for fixation of pay on promotion from the date of next increment (DNI) in the lower post and method of pay fixation from DNI, if opted for, in context of Army Pay Rules 2017. Air Force pay Rules 2017 and Navy Pay Regulations 2017 and to say that the aforesaid OMs dated 22.03.2018 and 26.02.2019 will be applicable in the cases of pay fixation on grant of MACP also in respect of ICOs/ORs and equivalent.</p>

Sub: <strong>Grant of financial upgradation under MACPS to the staff who are in same Grade Pay for more than 20 years</strong>-reg.</p>
<p>Ref: (i) NFIR’s PNM Item No.l/2011.<br />
(ii) Action Taken Statement provided to NFIR during its PNM meeting held with the Railway Board 10/11-05-2018</p>
<p>The subject was discussed in a separate meeting held between the NFIR and Railway Board on l6/10/2017. During discussions, the Official Side conveyed that reply from DoP&amp;T has been received and shared with the Federation. The Official Side further stated that the DoP&amp;T has not agreed to the proposal. Responding to the version of Official Side, NFIR insisted that such of the staff who have completed more than two decades from the date of first promotion and stagnated, should be granted 3rd financial upgradation straightaway under MACPS and requested the Railway Board to make another reference to DoP&amp;T for which suitable examples will be made available by the Federation for referring the matter again to DoP&amp;T.</p>
<p>In this connection, Federation furnishes below a few cases of employees as to enable the Railway Board to apprise to the DoP&amp;T, the cases of no promotion for over two decades.</p>
<p><strong>RWF, Yelahanka:</strong></p>
<p>l. Shri M.N. Indrashekar, appointed as Jr. CMA on 26/07/1983 – regularized on 26/07/1984 in GP 4200/-. He was promoted to GP 4600 on 20th May, 1986 (1st promotion) – granted financial upgradation with GP 4800/- on 01/09/2008 instead allowing 3rd financial upgradation with GP 5400 (PB-2) in view of no promotion for over 2 decades.</p>
<p>2. Shri K.S. Dutta Shivrama, appointed as CMA on l8/11/1985 in GP 4200/-, promoted to GP 4600/- on l8-11-1986 – granted financial upgradation in GP 4800/- on 01/09/2008 instead allowing GP 5400, having stagnated for over 2 decades.</p>
<p>3. Shri R.P. Suresh Kumar appointed as CMA on 19/12/1985 in GP 4200, promoted to GP 4600/- on 28-02-1989 granted financial upgradation in GP 4800/- on 0l/09/2008.</p>
<p><strong>South Central Railway:</strong></p>
<p>4. Shri Kamal Kumar Kuley, appointed a CMA in GP 4200/- on 18/12/1983, and got promoted to GP 4600/- on 0l/01/1984, granted financial upgradation in GP 4800/- on 01/09/2008 instead granting GP 5400 due to stagnation for over 2 decades from the date of first promotion.</p>
<p>5. Shri Amulya Kumar Dhali, appointed as CMA on 31/12/1982 in GP 4200/-, promoted to GP 4600/- on 01/01/1984 and got MACP in GP 4800/- on 0l/09/2008 instead GP 5400, for having stagnated for more than 20 years from the date of promotion.</p>
<p>Federation believes that above illustrations are sufficient to justify the demand for grant of MACP benefit to the staff in GP 5400/- as the staff suffered without promotion for over two decades and also to all similarly situated staff who have been in the same Grade Pay for more than two decades. A copy of the reference made to the DoP&amp;T may be made available to the Federation for takine further action.</p>

<p>One of the conditions for grant of Modified Assured Career Progression (MACP) scheme is that the earlier Assured Career Progression (ACP) scheme should have been implemented / adopted by the autonomous / statutory body. Since Kendriya Vidyalaya Sangathan (KVS) had themselves chosen not to opt the earlier ACP scheme for their teaching staff, the question of grant of MACP to teaching staff does not arise.</p>
<p>&nbsp;</p>
<p>Senior Scale will be granted to the teaching staff of KVS after completion of 12 years service in the respective cadre and Selection Scale will be granted after completion of 12 years service in the senior scale. However, the number of posts in the selection scale for the teaching staff will be restricted to 20% of the number of posts in the senior scale of the respective cadre.</p>
<p>The Senior Scale and Selection Scale will be given after screening regarding their satisfactory performance by an appropriate Departmental Promotion Committee.</p>
<p>Selection scale will be granted to Primary School Teachers (PRTs) and Trained Graduate Teachers (TGTs) subject to their attainment of higher qualification laid down for TGTs and Post Graduate Teachers (PGTs) respectively. However, this condition has been waived off for the miscellaneous categories of teachers of KVS.</p>
<p>&nbsp;</p>
<p>KVS has informed that all the teachers are getting their Senior Scale in time, though some teachers may not eventually get the Selection Scale due to non-fulfilment of the prescribed criteria for the same or their retirements preceding the date of eligibility.</p>

<p>KVS has informed that representations had been received from recognized staff associations for waiving off the condition of 20% for grant of Selection Scale to teachers and these representations have been considered and disposed off from time to time. No fresh proposal is under examination in this regard.</p>

I am directed to refer to Maharashtra Circle&#8217;s letter no. STA/MACPs/Bench Mark/2017 dated &amp; 12.2.2017 on the subject cited above and to say that &#8216;Promotion&#8217; and &#8216;Modified Assured Career Progression Scheme&#8217; (MACP) are two different matters. The first involves higher duties &amp; responsibilities while latter don&#8217;t.</p>
<p>&nbsp;</p>
<p>2.For MACP, DOP&amp;T has issued instruction vide OM No. 35034/3/2015-Estt(D) dated 28.09.2016, accordingly to which the prescribed benchmark would be &#8216;Very Good&#8217; for all posts and it will come into effect from 25.07.2016. The communication DOP&amp;T has already been circulated by Estt. Division of the Directorate vide letter no. 7-8/2016-PCC dated 5.10.2016 (Copy enclosed)</p>
<p>&nbsp;</p>
<p>3.For promotion, Personnel Division vide letter no. 20-24/2016-SPB-II dated 13.02.2017 has clarified to follow instructions contained DOPT&#8217;s OM No. 35034/7/97-Estt(D) dated 8.02.2002 until further clarification is issued by DOPT or Department of Posts.</p>

<p>In continuation of Department of Personnel Training’s earlier O.M. of even no. dated 20.01.2016 and dated 01.03.2016 on the above mentioned subject, the undersigned is directed to forward a copy of the decision dated 28.04.2016 of Hon’ble CAT, Calcutta Bench in OA No. 351/00195/2014 filed by Shri S.H.K. Murti &amp; Others Vs. UOI &amp;Ors whereby the demand of the applicant for MACP in promotional hierarchy has been dismissed, for necessary action and compliance. The Hon’ble Tribunal in the aforesaid decision dated 28.04.2016 has held that the MACP benefit would be given in the hierarchy of next higher Grade Pay and not in Grade Pay of promotional hierarchy which will be payable on actual promotion.</p>

<p><strong>Further to above, Federation furnishes below yet another category viz., Shorff cadre (Cash &amp; Pay Department – Receipt side) in which case the ACP Scheme was more advantageous than the MACP Scheme introduced by the Railway Board vide Board’s letter No.PC-V/2009/ACP/2 dated 10-06-2009, w.e.f. 01-09-2008.</strong></p>
<p><strong> </strong></p>

<p><strong></strong><strong>Note: * The above comparison clearly establishes the fact that under ACP Scheme the staff got financial up-gradation in Pay Scale Rs.5000-8000/GP 4200/- on completion of 24 years of service whereas under MACP Scheme, the staff gets GP 2800/- (replacement Grade Pay) on completion of three decades and they cannot dream of reaching GP 4200 (PB-2) under MACPS.</strong></p>
<p><strong></strong><strong> </strong> </p>
<p><strong>NFIR, therefore, requests the Railway Board to include the above category of staff in the reference agreed to be made to the DoP&amp;T for seeking guidelines.</strong></p>

With due regards, your attention is invited to the points raised in the JCM meetings by the Staff Side Members of this federation on the subject matter.</p>

<p>You have already clarified that erstwhile ACP Scheme was applicable upto 31.08.2008 and the promotions / upgradations granted prior to 01.01.2006 in the merged grade pay had been ignored for grant of ACP in the promotional hierarchy upto 31.08.2008 and this clarification had already been implemented in favour of supervisory cadre (Chargeman &amp; JWM) of Ord Fys.</p>
<p>&nbsp;</p>
<p>On the above analogy, Blue Printer &amp; Record Supplier being a feeder grade for Tracer (upto 20.04.2006) which is a feeder grade for Draughtsman / Chargeman may be granted the 02 financial upgradations under the ACP Scheme by ignoring his movement upto Blue Printer &amp; Record Supplier.</p>

<p>Further, your attention is invited to the order of CAT (Principal Bench) in OA No. 634/2013 (Smt Madhu Malti Tyagi &amp; ors Versus Union of India &amp; others) decided on  22.10.2013 wherein similar case had been dealt with and the relief was granted in favour of petitioners. Respondent No. 3 (General Manager, Ordnance Factory Muradnagar) had published the necessary Factory Order for pay fixation (copy enclosed) in this regard.</p>

<p><strong>In such circumstances, you are requested to take necessary action so that similarly placed all the non-petitioner Record Supplier / Blue Printers may be granted 01st ACP in GP 2400/- and 02nd ACP in GP 4200/- on completion of 12 yrs &amp; 24 yrs regular service between 01.01.2006 to 31.08.2008 &amp; 03rd MACP in GP 4600/- on or after 01.09.2008 on completion of 30 yrs regular service.</strong></p>

<p style="text-align: center;">MACP on promotional grade</p>
<p>The employees including Group ‘C’ (which includes erstwhile Group ‘D’) are granted three financial upgradations under Modified Assured Career Progression (MACP) Scheme in the next immediate Grade Pay hierarchy as per CCS(Revised Pay) Rules, 2008 on completion of 10, 20 and 30 years of regular service.</p>
<p>There have been instances where Tribunals and High Courts have directed to grant benefits under Modified Assured Career Progression (MACP) Scheme in the promotional hierarchy. However, in such cases, the order of Court is specific to the applicant only.</p>
<p>This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Kamlesh Paswan in the Lok Sabha today.</p>
