Sub: Booking of Air tickets under LTC Scheme prior to 21 days – Reg.

Leave Travel Concession (LTC) scheme is a concessional travel facility for the Government employees to visit their Hometown or to visit any place in India during a block of four years. In terms of provisions of the Scheme, the Government employees have the option either to avail Hometown LTC twice in a block of two years each or to visit home town once in a period of two years and to visit any place in India in another block of two years. The current block of four years is 2022-25 with two years block of 2022-2023 and 2024-2025.

Instructions from DOPT regarding booking of Air tickets were issued in vide OM No. 31011/12/2022-Estt(A-IV), dt. 29.08.2022(the copy of the circular is enclosed) in which following were emphasized:

In all cases of air travel in respect of LTC, air tickets shall be purchased from the three Authorised Travel Agents(ATAs) namely:

1. M/s Balmer Lawrie & Company Limited (BLCL)
2. M/s Ashok Travels & Tours (ATT)
3. Indian Railways Catering and Tourism Corporation Ltd (IRCTC)

• Government employees are to choose flight having the Best Available Fare on their entitled travel class which is the Cheapest Fare available, preferably for non-stop flight in a given slot, at the time of booking. They are to retain the print- out of the concerned webpage of the ATAs having flight and fare details for the purpose of the settlement of the LTC claim.
• Employees are encouraged to book air tickets at least 21 days prior to the intended date of travel on LTC, to avail the most competitive fares and minimise burden to the exchequer.

It is observed that in many cases the instructions regarding booking of air tickets well in advance were not being followed. Hence, it is hereby instructed to furnish valid reasons / justifications for such non-compliance. It is also noted that the officials are submitting LTC intimations / applications at a very short period before the date of Outward Journey. As minimum time is required to process the applications it is advised to submit the LIC Advance and EL Encashment on LTC application at least 10 days prior to the date of onward journey.

Sir/Madam,

Correspondences were being received from the field offices regarding CCS (LTC) Rules 1988 – wherein various queries were raised while regulating LTC claims pursuant to instructions issued vide Ministry of Finance, Department of Expenditure’s O.M. dated 31.12.2021, 16.06.2022 & Ministry of Personnel, Public Grievances & Pensions, Department of Personnel & Training’s OM dated 29.08.2022.

2. The matter was referred to DoPT/MoF and accordingly response has now been received from DoPT as well as from MoF.

3. The consolidated clarifications received on the queries raised, from DoPT/MoF are as under:-

4. Accordingly, it is stated that LTC cases may be regulated as per above clarifications received from the Ministry.

5. The cases already settled pursuant to MoF, OM dated 31.12.2021/ 16.06.2022 & DoPT’s OM dated 29.08.2022, while still a lack of clarity in the matter, may also be re-examined/ re-regulated in the light of the above.

6. It may be noted that copies of office orders etc, in this regard need not be sent to Headquarters.

Subject: Central Civil Services (Leave Travel Concession) Rules, 1988 – Relaxation to travel by air to visit North East Region, Jammu & Kashmir, Ladakh and Andaman & Nicobar – extension beyond 25.09.2024 -regarding.

The undersigned is directed to refer to this Department’s OM No. 31011/15/2022 -Estt.A-IV dated 11.10.2022 regarding relaxation to travel by air to visit North East Region, Jammu & Kashmir, Ladakh and Andaman & Nicobar, and to say that in relaxation to CCS (LTC) Rules, 1988, the scheme allowing Government servants to travel by air to North East Region (NER), Union Territory of Jammu and Kashmir (J&K), Union Territory of Ladakh and Union Territory of Andaman & Nicobar Islands (A&N) is extended for a further period of two years, w.e.f. 26th September, 2024 till 25th September, 2026.

2. The above Special Dispensation Concession is subject to the following terms & conditions: –

i. All eligible Government servants may avail LTC to visit any place in NER/ A&N/ J&K/ Ladakh against the conversion of their one Home Town LTC in a four years’ block period.

ii, Government servants, whose Home Town and Headquarters / place of posting are same, they are not allowed the conversion of any Home Town LTC as they are not eligible for the Home Town LTC facility.

iii. The Government servant whose Home Town is situated in NER/A&N/J&K/Ladakh will also be allowed conversion of Home Town LTC for availing this Scheme to visit any place in any one of the three regions out of the above mentioned four regions except the region wherein his/her Hometown is situated.

iv. Fresh Recruits are also allowed conversion of one of the three Home Town LTCs in a block of four years, applicable to them to visit NER/A&N/J&K/Ladakh. In addition, they are allowed one additional conversion of Home Town LTC to visit UT of J&K/UT of Ladakh in a block of four years.

v. Government servants entitled to travel by air may avail this concession from their Headquarters in their entitled class of air by any airlines subject to the terms and conditions as enumerated in DoPT’s OM. No. 31011/12/2022- Estt.A-IV dated 29.08.2022 read with DoPT’s OM No. 31011/11/2023 – Pers. Policy A-IV dated 20.10.2023 (copies enclosed).

vi. Government servants not entitled to travel by air are allowed to travel by air in Economy class by any airlines subject to the terms and conditions as enumerated in DoPT’s OM dated 29.08.2022 read with DoPT’s OM No. 31011/11/2023 – Pers. Policy A-IV dated 20.10.2023 in the following sectors:- :

1. Between Kolkata/Guwahati and any place in NER.
2. Between Kolkata /Chennai/Visakhapatnam and Port Blair.
3. Between Delhi/Amritsar and any place in J&K/Ladakh.

Journey for these non-entitled employees from their Headquarters upto Kolkata/ Guwahati/ Chennai/ Visakhapatnam / Delhi/ Amritsar shall be undertaken as per their entitlement.

vii. Air travel by Government employees to NER, J&K, Ladakh and A&N as mentioned in para (v) and (vi) above is allowed whether they avail the concession against Anywhere in India LTC or in lieu of the Home Town LTC, as permitted.

viii. Government servants not entitled to travel by air are also allowed to travel by air in Economy class by any airlines to any place in NER/ A&N/ J&K/ Ladakh from their Headquarters directly, however, the reimbursement will be subject to the conditions as enumerated in DoPT’s OM No. 31011/12/ 2022-Estt.A-IV dated 29.08.2022.

ix. The instructions regarding booking of air tickets through authorized travel agents, best available fares, slots, booking time, advances, reimbursement, etc., as mentioned in DoPT’s OM No. 31011/12/2022- Estt.A-IV dated 29.08.2022 read with DoPT’s OM No. 31011/11/2023 – Pers. Policy A-IV dated 20.10.2023 will also be applicable for this Special Dispensation Scheme.

3. All the Ministries/ Departments are advised to bring it to the notice of all their employees that any misuse of LTC will be viewed seriously and the employees will be liable for appropriate action under the rules. In order to keep a check on any kind of misuse of LTC, Ministries/ Departments are advised to randomly get some of the air tickets submitted by the officials verified from the airlines concerned with regard to the actual cost of air travel vis-a-vis the cost indicated on the air tickets submitted by the officials.

4. In their application to the persons belonging to Indian Audit and Accounts Department, these orders are issued as mandated under Article 148(5) of the Constitution and after consultation with the Comptroller & Auditor General of India.

Please refer to main office circular no. AN/ Pay/ T/ 351/ TA/ DA/ LTC dated: 13.06.2022 and circular of even number dated: 25.08.2023 (copy enclosed), wherein this office has advised DAD Officials to book their Air tickets/Train tickets on Tour/ LTC purpose through D.T.S. (Defence Travel System, E- ticketing project) platform.

2. Off late, it is observed that booking of Air ticket/ Train tickets on Tour/LTC purpose by DAD officials through D.T.S. is very low in percentage with respect of overall claim passed in Tour/LTC, which has been viewed very seriously by competent authority. Further competent authority has also directed all DAD officials to book their ticket on above purpose through D.T.S. platform.

3. In this regard all officers-in-charge are requested once again to provide the data in respect of officers/staff of their office. who have not yet enrolled on D.T.S. till date as per prescribed format (copy enclosed).

4. Further, all the officers and staff are advised to utilize Defence Travel System (D.T.S) of the department for booking of their ticket for their authorized and approved tours.

It has been decided with the approval of Board (Member Finance) to delegate the powers for sanction of air travel for Station Development Directorate of Board’s office as under:

1. For the Financial Year 2023-24, an allotment of Rs. 5 Lakhs towards air travel of officials (DDs/ JDs/ Directors/EDs) of Station Development Directorate i.e. including ED/ SD-I and ED/SD-II is to be earmarked.

2. The tour programme should be approved by PED/GS which will not require Finance concurrence.

3. At the time of approval, lowest airfare should be taken.

4. Station Development Directorate should keep accountal of the ceiling limit and it should not be breached.

Subject: Refund of Penal Interest on LTC Claims.

Sir,

I am writing to request your attention to the matter of the penal interest charged to Group ‘B’ & ‘C’ Defence Civilian employees who had availed LTC to NER, J&K, A&N Islands by air after purchasing tickets from private/ unauthorized travel agents. As you may recall, vide letter No. BPMS / DoP&T/ LTC / 50 (7/2/R), Dated 10.11.2014 this federation requested the DoP&T as well as MOD to consider the issues related to LTC and in turn the Ministry of Defence had sent a proposal to the Department of Personnel and Training (DoPT) on 09.02.2017 seeking a one-time relaxation in this regard.

The DoPT had sympathetically considered the matter and had communicated via I.D. Note No. 43020/2/2016 -Estt.(A-IV), dated 19.02.2020, that such relaxation would be granted with the concurrence of the Financial Advisor of the concerned Ministry/ Department, subject to certain conditions. However, before the relaxation could be granted, the audit authorities had already recovered the advance/ claimed amount along with the charging of penal interest.

Now that the cases have been considered and the claims have been settled by granting one-time relaxation, it is only fair that the penal interest charged to the affected employees be refunded. We request you to kindly initiate the necessary steps to refund the penal interest to those employees whose claims have been allowed by granting one-time relaxation. We hope that you will take swift action in this matter and ensure that justice is done to the affected employees.

Reference: This office letter of even No dated 05/09/2022.

1. In terms of F.No. 31011/12/20 GOI Ministry of Personnel, Public Grievances & Pensions DOPT letter dated : 29.08.2022 and OM No- 19024/03/2021-E.IV dated 16.06.2022 in all cases of air travel in r/o LTC/TA DA air tickets shall be purchased from the three Authorized Travel Agents (ATAs) only and the printout of the concerned webpage of authorized travel agent is required when any government employee entitled to air travel may apply for advance with the printout of the concerned webpage of 3 ATAs having suitable Might and fare details for the purpose of the settlement of the claims.

2. Of late, it has been observed that most of the TA/DA on temporary duty as well as permanent posting and LTC bills (both advance and final) are being submitted in this section without the printout of the webpage of authorized travel agent (3 ATAs) where in suitable fight and fare details under the three hours time slot are available to determine the cheapest fare and Hight to process the claim.

3. Therefore. all concerned are requested to ensure strict compliance to the above instructions.

Subject: Central Civil Services (Leave Travel Concession) Rules, 1988 – Fulfilment of procedural requirements

The undersigned is directed to refer to the above mentioned subject and to state that Government employees are allowed to encash 10 days earned leave at the time of availing of LTC to the extent of 60 days during the entire service. However, certain queries have been raised about whether to allow reimbursement of leave encashment or not in cases where the Government employees undertake journeys on private vehicles in areas connected by public transport or the Government servant himself decides to forgo his claim resulting in ‘Nil’ claim on journeys performed.

2. The matter has been considered and decided that since the leave encashment is limited upto 60 days in the entire service, the denial of encashment of leave would not be appropriate in such cases where the Government employee decides to forgo his claim of reimbursement for travel undertaken on private/ hired vehicle or his claim is ‘Nil’, provided that:

• (i) A Government employee intimates to the Department his intention to avail of LTC in advance and gets the leave sanctioned as per the prescribed procedure before the journey is undertaken;
• (ii) The Government employee has submitted a request for leave encashment before the commencement of the journey;
• (iii) The Government employee gives a self-declaration that he has actually travelled to the declared place of visit and is not claiming the fare reimbursement for the entire LTC journey.

3. It is further clarified that in the following cases, the Government employees are not required to forgo the fare-reimbursement for LTC Journey as per prevailing instructions:

• (i) The Journey on LTC is made by taxi, auto-rickshaw etc, only between places not connected by rail and these modes operate on a regular basis from point to point with the specific approval of the State Governments/transport authorities concerned and are authorized to ply ;
• (ii) Where a Government servant travels on LTC upto the nearest airport/railway station/ bus terminal by authorized mode of transport and undertakes the rest of the journey to a declared place of visit by private transport/ own arrangement (such as personal vehicle or private taxi, etc.), limited upto 200 KMs to and fro ;
• (iii) When the Head of Department allows the use of own/hired taxi for an LTC journey on account of the disability of the Government servant or dependent family member as per the extant instructions.

4. It is also reiterated that, within the same block, when the LTC is being availed of by the Government servant and his family members separately, encashment of leave would be restricted to one occasion only.

Subject: Extension of the LTC block year 2018-21 (extended) for a period of three months – reg.

The undersigned is directed to refer to the above mentioned subject and to state that as per rule 10 of the CCS(LTC) Rules, 1988, a Government servant who is unable to avail of the LTC within a particular block of two years or four years may avail of the same within the first year of the next block of two years or four years. Accordingly, the block year 2018-21 was deemed extended upto 31st December, 2022 by virtue of rule 10 of the CCS(LTC) Rules, 1988.

2. In relaxation of Rule 10 of the CCS(LTC) Rules, 1988, exercising the powers conferred under Rule 18 – ‘Power to relax’, of the CCS(LTC) Rules, 1988, it has now been decided with the approval of competent authority to extend the LTC Block year 2018-2021 (extended) for a period of three months i.e. upto 31st March, 2023.
