<p>Will the Minister of Education be pleased to state:-</p>



<p>(a) whether the Government noticed that Jawahar Navodaya Vidyalayas employees/ Staffs who have joined on or before 1 January 2004 are not entitled to get a CCS pension (1972) as per rules; and</p>



<p>(b) if so, the reasons therefor?</p>



<p><strong>ANSWER</strong><br /><strong>MINISTER OF STATE IN THE MINISTRY OF EDUCATION</strong><br /><strong>(SMT. ANNPURNA DEVI)</strong></p>



<p>(a) &amp; (b) : Department of Pension and Pensioners’ Welfare issued an Office Memorandum dated 01.05.1987 whereby all Contributory Provident Fund (CPF) beneficiaries, who were in service as on 01.01.1986 would be deemed to have come over to the Pension Scheme, unless specifically opted to remain under the CPF Scheme. The employees of NVS had been given the benefits of CPF Scheme w.e.f. 01.04.1988. The matter to extend the benefit of CCS (Pension) Rules, 1972 to NVS employees who joined prior to 01.01.2004 has been considered by the Ministry from time to time in consultation with Ministry of Finance and Department of Pension and Pensioners’ Welfare. However, it has not been agreed to, as it would be against the policy regime of the Government of India in terms of Department of Expenditure’s directives dated 16.03.2000. The New Pension Scheme (now National Pension System) (NPS), which was introduced for the Central Government employees w.e.f. 01.01.2004, was made applicable to the regular employees of NVS w.e.f. 01.04.2009. Those employees who had joined NVS on regular basis before 01.04.2009 were given an option to continue with the existing CPF Scheme or to join the NPS. Those employees of NVS who have opted for and are covered under the NPS, are entitled to the benefits envisaged under this Scheme. The staff of NVS are entitled to benefits of either the CPF Scheme or the NPS Scheme having regard to the option exercised by them.</p>

<p>QUESTION<br />†2221. SHRI GANESH SINGH:<br />Will the Minister of CORPORATE AFFAIRS be pleased to state:</p>



<p>(a) the details of the total appointments made during the period from 08.09.1993 to 31.12.2020 in the Public Sector Undertakings (PSU), banks and insurance companies/financial institutions with 51 per cent Government stake along with the details of backlog posts PSU-wise, bank-wise, insurance company-wise, financial institution-wise, post-wise and category-wise ;</p>



<p>(b) whether reservation rules are applicable to all the various PSUs/financial institutions in which Government stake is 51 per cent or more;</p>



<p>(c) if so, the details thereof;</p>



<p>(d) whether reservation rules apply to PSUs/financial institutions having 50 per cent Government stake;</p>



<p>(e) if not, the details of the order issued by the Government in this regard;</p>



<p>(f) whether 27 per cent reservation policy for OBC has not been implemented in many PSUs/Banks/insurance companies/financial institutions etc till date inspite of having 51 per cent or more than 51 per cent Government stake; and</p>



<p>(g) if so, the corrective steps taken by the Government in this regard?</p>

<p>THE MINISTER OF STATE FOR FINANCE AND CORPORATE AFFAIRS (SHRI ANURAG SINGH THAKUR)</p>



<p>(a) to (g): The Ministry of Corporate Affairs administers Companies Act, 2013 (the Act), Limited Liability Partnership Act, 2008, Insolvency &amp; Bankruptcy Code, 2016.</p>



<p>However, the Ministry of Heavy Industries and Public Enterprises, Department of Public Enterprises and Public Enterprises Selection Board (PESB), Department of Personnel and Training (DoPT) have informed as under:</p>



<p>I. Ministry of Heavy Industries and Public Enterprises, Department of Public Enterprises has informed that Public Sector Undertakings (PSUs) is a wider definition and includes all central organizations including banks, insurance companies, Central Public Sector Enterprises (CPSEs), and other autonomous organizations of Central Government. Department of Public Enterprises (DPE) is a nodal coordinating Department for CPSEs only excluding banks and other financial institutions &amp; autonomous organizations. CPSEs, banks, and other financial institutions function under the administrative control of their respective Ministry/ Department. DPE collects limited information in respect of CPSEs only. The information available in respect of CPSEs is as follows:</p>



<p>As on 31-03-2020, the 366 CPSEs has employed 14.18 lakhs persons. The category wise detail is as follows:</p>

<p>II. Public Enterprises Selection Board (PESB), Department of Personnel and Training has informed that PESB is responsible for making selection/ recommendation of candidates for Board level posts in CPSEs. Subsequent, appointments of the recommended candidates are made by the Ministry/Department concerned under the procedure laid down.</p>



<p>As per the extant policy of the Government, there is no reservation applicable to Board level posts in CPSEs. Accordingly, the PESB, while inviting applications for filling up Board level vacancies, does not seek information related to the category of the candidate to which he or she belongs.</p>

employee who is an allottee of General Pool Residential Accommodation 
(GPRA), can retain Government Accommodation for six months on payment of
 normal license fee. </p>

<p>(b)whether the Government is accepting the recommendations made in the report submitted by Bhagat Singh Koshyari Committee in this regard and if so, the details thereof;</p>



<p>(c)whether the Government has taken or proposes to take any steps to provide atleast 7500/- rupees basic pension and dearness allowance thereon to the EPS pensioners of the year 1995 besides providing free of cost health facilities to the pensioners and their families;</p>



<p>(d)whether the Government has also received representatives from the EPS pensioners of the year 1995 regarding their collective demand;</p>

<p>(a): Amendment of the Employees’ Pension Scheme is a continuous process and is done as and when necessitated in consultation with stakeholders.</p>



<p>(b): Due to financial constraints in increase in Government share under Employees’ Pension Scheme (EPS), 1995 and to maintain sustainability of the Employees’ Pension Fund, the recommendations of the Koshiyari Committee have not been accepted. However, the Government has started providing a minimum pension of Rs. 1000/- per month to the pensioners under EPS, 1995 from 01.09.2014.</p>



<p>(c): A pilot scheme to extend medical benefits to Employees’ Pension Scheme (EPS) 1995 pensioners drawing minimum pension upto Rs. 1000/- per month under EPS, 1995 and residing in Delhi has been drafted. The Scheme would be optional to those pensioners who give their willingness for deduction of Rs.100/- per month from and out of their pension disbursed on monthly basis.</p>



<p>(d) to (f): Representations are received from individual EPS, 1995 pensioners as well as pensioners associations raising various demands like:</p>



<p>(i) To increase the minimum pension to Rs. 2000/ Rs. 3000/Rs. 7500 per month.<br />
(ii) To link the monthly pension with cost of living index.<br />
(iii) Restoration of commuted value of pension.<br />
(iv) Re-introduction of the provision of commutation of pension.<br />
(v) Restoration of the provision of Return of Capital.<br />
(vi) Reduction in the period for calculation of monthly average pensionable salary from 60 months to 12 months.<br />
(vii) Payment of pension on Higher Wages to employees of exempted establishments.</p>



<p>Various representations received were placed before the High Empowered Monitoring Committee constituted by the Government of India for complete evaluation and review of EPS 1995. The committee has submitted its report on 21.12.2018 to the Government.</p>

<p>Will the Minister of HEALTH AND FAMILY WELFARE be pleased to state:-</p>
<p>(a) whether his Ministry has finalised draft rules regarding minimum standards for clinical laboratories, framed under Clinical Establishments Act, 2010, if so, the details thereof;</p>
<p>(b) whether his Ministry is aware that presently most of the work of clinical and research laboratories of even prestigious department i.e. ICMR and Central Government Hospitals is performed and supervised by professionally qualified and technically competent BSc, MSc, PhD medical laboratory professional in lab sciences who are not MBBS/MD, if so, the details thereof;</p>
<p>(c) whether the cadre review of medical laboratory staff approved earlier has not been implemented in complete manner so far and most of issues like pay fixation, DPC, MACP, revision of recruitment rules, filling of vacant promotional posts are still pending, if so, the details thereof and the reasons therefor;</p>
<p>(d) whether his Ministry has not issued any order till date regarding grant of Patient Care Allowance/Hospital Patient Care Allowance (PCA/HPCA) to health employees as per the accepted recommendations of Seventh Central Pay Commission and if so, the details thereof and the reasons therefor; and</p>
<p>(e) whether his Ministry has also approved the short term certificate courses/ programmes which are neither formal degree nor diploma in allied health sciences and run under the aegis of Ministry of Skill Development and are very contrary to the core curricula designed by his Ministry in terms of course content and duration of courses etc., if so, the reaction of the Government thereto?</p>
<p><span style="text-decoration: underline;"><strong>ANSWER</strong></span></p>
<p>THE MINISTER OF STATE IN THE MINISTRY OF HEALTH AND FAMILY WELFARE (SMT. ANUPRIYA PATEL)</p>
<p>(a): Yes. The draft notification to amend the Clinical Establishments (Central Government) Rules, 2012 regarding minimum standards of medical diagnostic laboratories is available on the website of Clinical Establishment Act &lt;clinicalestablishments.gov.in&gt;.</p>
<p>(b): As per the information received from ICMR most of the work of clinical and research laboratories is performed and supervised by professionally qualified and technically competent technical staff and Scientists having B.Sc, M.Sc, Ph.D and MBBS, MD qualification.</p>
<p>As far as Central Government hospitals in Delhi viz. Safdarjung Hospital and Lady Hardinge Medical College &amp; Associated Hospitals are concerned, all the diagnostic work is performed and supervised by professionally qualified and technically competent MBBD/MD professionals.</p>
<p>(c): The cadre of the Medical Laboratory Staff of Central Government Hospitals in Delhi namely Safdarjung, Dr. RML and Lady Hardinge Medical College &amp; Associated Hospitals has already been restructured and implemented by giving benefits of 7th Central Pay Commission.</p>
<p>(d): The order containing condition for payment of HPCA/PCA after implementation of Seventh Central Pay Commission has not been issued so far. The matter is under consideration in this Ministry in consultation with Ministry of Finance.</p>
<p>(e): This Ministry has developed a course curricula for short term skill training. The National Skill Qualification Framework (NSQF) level of the skill development curricula is kept lower than the level of Diploma and Degree in core allied health courses developed by this Ministry. A skilled worker will only reach the higher levels after acquiring adequate qualification (either Diploma or Degree) through an accredited institute/university. There are no contradictions in the short term courses as compared to the core curricula developed by the Ministry.</p>

<p>(a) whether the reports of successive Pay Commissions have been increasing the burden on Government finances/ exchequer in partially accepting their recommendations for increase in wages and if so, the details thereof;</p>
<p>(b) whether the last Pay Commission has suggested productivity linked pay hike to the deserving employees to eliminate below average or mediocre performance and if so, the details thereof;</p>
<p>(c) whether such periodic hikes in wages resulting from Pay Commission recommendations trigger similar demands from the State Government/public utility employees, imposing burden on already strained State finances and if so, the details thereof; and</p>
<p>(d) whether the Government is considering an alternative for increasing the salaries and allowances of Central Government employees and pensioners in future instead of forming Pay Commission and if so, the details thereof?</p>

<p>A Statement is laid on the Table of the House</p>
<p>Statement Annexed with the Lok Sabha Starred Question No. 568 dated 06.04.2018 raised by Shri Jose K. Mani regarding Pay Commission Reports</p>
<p>(a) The financial impact of the recommendations of the Central Pay Commission, as accepted by the Government, is normally more pronounced in the initial year and gradually it tapers off as the growth in the economy picks up and fiscal space is widened. While implementing the recommendations of the last Central Pay Commission, i.e., the Seventh Central Pay Commission, the Government staggered its implementation in two financial years. While the recommendations on pay and pension were implemented with effect from 01.01.2016, the recommendations in respect of allowances have been implemented with effect from 01.07.2017 after an examination by a Committee. This has moderated the financial impact of the recommendations. Moreover, unlike the previous 6th Pay Commission, which entailed substantial impact on account of arrears, the impact in the year 2016-17 on account of element of arrears of revised pay and pension on the present occasion of the 7th Central Pay Commission pertained to only 2 months of the previous financial year of 2015-16.</p>
<p>(b) The Seventh Central Pay Commission in Para 5.1.46 of its Report proposed withholding of annual increment in the case of those employees who are not able to meet the benchmark either for Modified Assured Career Progression (MACP) or regular promotion within the first 20 years of their service.</p>
<p>(c) The service conditions of employees of State Governments fall within the exclusive domain of the respective State Governments who are federally independent of the Central Government. Therefore, the concerned State Governments have to independently take a view in the matter.</p>
<p>(d) No such proposal is under consideration of the Government.</p>

<p>(d): No separate category is maintained regarding co-terminus employees and therefore, this information cannot be provided.</p>

<p>Will the Minister of PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-</p>
<p style="text-align: center;">(a) whether the Government proposes to give reservation in Government jobs to the people belonging to the Economically Backward Classes; and</p>
<p style="text-align: center;">(b) if so, the details thereof and if not, the reasons therefor?</p>
<p><strong>ANSWER</strong></p>
<p>Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office. (DR. JITENDRA SINGH)</p>
<p>(a) &amp; (b): At present, there is no proposal to give reservation to the people belonging to Economically Backward Classes in Central Government jobs. The Hon’ble Supreme Court in the case of Indra Sawhney has, inter-alia, held, that economical backwardness cannot be the sole criterion for providing reservation.</p>
<p>Further, the Commission for Economically Backward Classes (CEBC) which submitted its Report to the Government on 22nd July, 2010 did not recommend the reservation for Economically Backward Classes.</p>
